  • 2G Spectrum Scam
    2G SPECTRUM SCAM The 2G spectrum scam in India involved the issue of 122 licenses by the ruling Congress-led UPA alliance[1] of the 2G spectrum to 85 companies[1] including many new telecom companies with little or no experience in the telecom sector at a price set in the year 2001.     Vulture Funds and the Fresh Start Accounting Value of Firms Emerging from Bankruptcy Miles Gietzmann University of Bocconi, Italy Helena Isidro ISCTE-IUL Instituto Universitário de Lisboa, Portugal Ivana Raonic Cass Business School, City, University of London, UK Abstract: We study how distress-oriented hedge funds (vulture funds) play an important role in the fresh start valuation of firms emerging from Chapter 11 reorganization.. We find that loan-to-own vultures acquire debt positions of the distressed firm that grant dominant power in the bankruptcy negotiations, and they then use the discretion allowed by fresh start accounting to introduce valuation bias in their favor. We show that the strategic influence over fresh start values can create opportunities to increase vulture investors’ returns at the expense of other claim holders. TRANSNATIONAL LAW PRACTICE Richard L. Abelt T RANSNATIONAL law practice has grown dramatically in recent years, but scholarship has not kept pace. This Article fills the void in three different, yet related, ways. The first section seeks to explain the patterns of transnational law practice that have emerged in recent decades. The second describes the constraints on transnational practice, especially those imposed by national and supranational regulation. I conclude with proposals about how lawyers, professional organizations, and governments should regulate transnational law practice. Since there is no comprehensive account of the growth of transnational law practice, I have appended one, drawn from a wide variety of sources, including Martindale-Hubbell, the International Financial Law Review, and Business Lawyer,' as well as a dozen interviews with lawyers in t Professor, U.C.L.A.     VOLUME 50, OCTOBER 2018 THE NEWSLETTER Update Yourself Stamp Duty not Necessary for Enforcing Foreign Award he Hon’ble Supreme Court of India in its recent judgment in the case of Shriram EPC Limited vs. Rioglass Solar SA decided on 13.09.2018, has T observed that foreign award is enforceable without paying any stamp duty un- der the Indian Stamp Act, 1899 (“Stamp Act”). The dispute at hand arose before the Hon’ble Supreme Court on appeal filed by Shriram EPC Limited (“Appellant”) against the decision of the Division Bench of the Madras High Court. Initially, Rioglass Solar SA (“Respondent”) filed a petition before the Single Bench of the Madras High Court to enforce a foreign award delivered by the International Chambers of Commerce in London against Appellant. The Single Bench of the Madras High Court en- forced the foreign award and the Appellant filed an appeal against this enforcement before the Division Bench of the Madras High Court. One Inside this issue: of the contentions raised by the Appellant before the Division Bench was that stamp duty had not UPDATE YOURSELF been paid by the Respondent on the foreign Maharashtra State Ad- 2 award under the provisions of the Stamp Act. The Division Bench of the Madras High vance Ruling Appellate Court decided the appeal in favour of the Respondent and upheld the enforcement of the foreign award. Consequently, the dispute was brought before the Supreme Court, Karnataka HC Imposed 2 but only to the extent of the question of law that whether stamp duty is payable on a Cost on Deputy VAT foreign award under the provisions of the Stamp Act.
