BE IT ENACTED by the General Assembly of in Parliament assembled, and by the authority of the same, as 20 follows :- 1. This Act may be cited as the Wellington City Empowering and Short Title. Amendment Act, 1929.

Definitions. 2. In this Act, if not inconsistent with the context,- " City " means the City of Wellington: " Corporation " means the Corporation of the Mayor, Councillors, and Citizens of the City of Wellington: " Council " means the . 5 Council may 3. The portion of Evans Bay Road described in the First Schedule portion of Evans Bay Road and vest hereto is hereby closed and vested in the Hataitai Land Company, same in the Hataitai Limited, in pursuance of an agreement made between the said company Land Co.,Ltd. and the Corporation for the exchange of this land for certain other 35 adjacent land already transferred to the Corporation for the purpose of widening Evans Bay Road. Declaring certain 7. (1) The portion of Palliser Road lying between Shannon Street ways to be public streets. and the Town Belt now used by the public as a highway is hereby declared to be street, and vested in the Corporation accordingly. 40 (2) The land described in the Second Schedule hereto, being the way leading from Tennis-court Road to the Railway-station is hereby declared to be street, and vested in the Corporation accordingly. (3) The Council may make such charges as it thinks fit for the use of such land and for admission thereto. (4) (i) The Council may, with the consent of the said Minister, make such by-laws as it in its absolute discretion thinks fit for the 5 administration of the said land or the safety of the public. (ii) All such by-laws shall be made under the provisions of the Municipal Corporations Act, 1920, and all the provisions of that Act relating to by-laws shall apply to such by-laws. (5) (i) All land appropriated under the provisions of subsection one 10 hereof shall vest in the Mayor, Councillors, and Citizens of the City of Wellington for the purposes mentioned in subsection one of this section. (ii) A certificate under the hand of the Minister of Defence that any part of the said land has been so appropriated, accompanied by a plan signed by the said Minister showing the area of land affected, shall 15 be sufficient authority to the District Land Registrar at Wellington for the issue of a certificate of title to the Corporation for such land subject to the said trusts. (6) The said Council may borrow by way of special loan, by special order, and without taking the steps described in sections nine to thirteen 20 of the Local Bodies' Loans Act, 1926, for the purposes of this section such sum or sums, not exceeding in the aggregate teventy thousand pounds, as the said Council thinks fit. 10. (2) The Council may lease the land described in the Fourth Schedule 50 hereto under the provisions of the Municipal Corporations Act, 1920, but the said land shall not after the passing of this Act be alienable by the City Council in any other manner. 4 Wellington City Empoevenng and A mendment Bill.

Power to transfer 14. The Corporation is hereby authorized to transfer to the portion of Keringa Wellington Fire Board, pursuant to the provisions of the Fire Brigades Street and portion of Town Belt to Act, 1926, as part of the Constable Street Fire-station, not only the Fire Board. land comprised in certificate of title, volume 361, folio 254 (being the land vested in the said Corporation for fire-brigade purposes), but also 5 the portion of Keringa Street and the portion of the Town Belt described in the Fifth Schedule hereto, and the said land and buildings shall be valued accordingly.

FIRST SCHEDULE.

ALL that piece of land situate in Block VII, Port Nicholson Survey District, in the City of Wellington, being part of Evans Bay Road in the said city, containing 3·96 perches ; as the same is more particularly delineated on the plan thereof deposited with this Bill, and therein coloured red.

SECOND SCHEDULE.

ALL those pieces of land, being part of Section 3, Block XI, Belmont Survey District, and part of closed road sit)uate in the City of Wellington, containing 22·64 perches ; as the same are more particularly delineated on the plan thereof deposited with this Bill, and therein coloured respectively red and yellow.

THIRD SCHEDULE.

ALL those pieces of land situate in Block XI, Port Nicholson Survey District, in the City of Wellington, containing 63 acres 1 rood 37·4 perches, being parts of Lots 2,3, and 4, D.P. 1808, and part of proposed road shown on D.P. 1808, and also Lot 2 and part of Lot 1 on D.P, 2481, part of Lot 4, D.P. 2456, and also part of sewer reserve in the said Block XI, vested in the Corporation ; as all the said pieces of land are shown on the plan thereof deposited with this Bill, and therein edged red.

FOURTH SCHEDULE.

ALL those pieces of land situate in the City of Wellington, containing by admeasurement 26·59 perches, being Lots 1, 2, and 3 on D.P. 1528, being parts of Sections 1 and 2, Sir George Grey's Reclamation, as the same are more particularly delineated on the plan thereof deposited with this Bill, and therein coloured red.

FIFTH SCHEDULE.

1. ALL that piece of land situate in Block VII, Port Nicholson Survey District, part of the Town Belt, City of Wellington, containing 3·23 perches ; as the same is more particularly delineated on the plan thereof deposited with this Bill, and therein coloured red. 2. All that piece of land situate in the City of Wellington, being part of Keringa Street, in the City of Wellington, containing 1 ·98 perches ; as the same is more particularly delineated on the plan thereof deposited with this Bill, and therein coloured green.
