Peut-on parler d’outils de promotion de la part des artistes ou des producteurs ? Le téléchargement légal et gratuit a-t-il un impact sur les ventes d’œuvres physique ou numérique ? Cela traduit-il une volonté promotionnelle de la part des artistes de poursuivre une pratique de téléchargement déjà largement implantée chez les usagers du Web au moyen du téléchargement illégal ? En quoi cela souligne-t-il une nouveauté, puisque ce phénomène préexiste dans le domaine de la presse ou du disque à l’époque où des supports physiques étaient distribués gratuitement en guise de promotion ? Ces questions soulèvent un paradoxe important d’un point de vue économique et culturel. Prenant une place non négligeable dans nos sociétés, la gratuité des œuvres culturelles dissimule plusieurs modèles économiques complexes. La question de la gratuité amène à repenser la culture et son financement, prenant comme tremplin la numérisation des œuvres et l’apparition d’Internet. Les artistes musicaux évoluent aujourd’hui dans un univers n’ayant jamais été aussi changeant : la diversité de œuvres sur Internet et leur accessibilité redéfinissent une partie importante de l’industrie de la musique. La gratuité de l’écoute de la musique par les outils Web mis à disposition du public a fortement amené les producteurs et artistes à repenser leurs stratégies de communication et de marketing. Il s’agira dans ces pages de capturer une image la plus fidèle possible de l’état dans lequel se trouve l’industrie de la musique aujourd’hui, afin d’en réaliser un rappel historique mais aussi de comprendre les interactions qui existent entre les anciens et les nouveaux acteurs de cette industrie. Plusieurs plateformes Web liées à la musique apparaissent, proposant de nouveaux services apparentés à la gratuité d’accès aux œuvres, et laissant apparaître une nouvelle forme de consommation des œuvres musicales propre à un système complexe car marquant une rupture avec l’industrie musicale établie bien avant l’apparition de la Toile. Le Web n’ayant pas toujours réussi à se plier aux règlementations imposées par la législation relatives aux droits d’auteurs, une zone de non droit commercial s’est installée, forçant les acteurs de 4 ce système économique à faire évoluer de leur propre chef les modes de mises en accès aux œuvres proposées. La gratuité devient alors une alternative au payant, voir une norme, depuis que les pratiques d’écoutes et d’accaparement des œuvres par les internautes se sont généralisées. Le streaming, ainsi que le téléchargement d’œuvres, légal et gratuit, forment désormais à eux seuls une part extrêmement conséquente de l’industrie de la musique, bien que ces outils se soient développés en marge du système traditionnel du marché de la musique. Toutes les notions de ventes des œuvres sont remises en questions techniquement et culturellement parlant. Beaucoup de questions se posent à l’heure où l’industrie musicale se trouve être confrontée à des logiques technologiques la dépassant en terme juridique, promotionnel mais surtout de pratiques développées à l’insu de ces industries par les internautes et les sites Internet. Ces questions prennent place dans un cadre où Internet est en phase de proposer des techniques permettant de remplacer (en théorie) les outils traditionnellement utilisés par les industries culturelles telles que ces dernières se représentent et se revendiquent. Car élevé au rang d’ennemi ultime par certains, entrevu comme une entité salvatrice par d’autres, Internet propose à bien des égards des outils entrant dans une nouvelle forme de logique culturelle mais, qui, de ce fait, peut (se) permettre de détourner les usages faits de la production, de la diffusion et de l’écoute de la musique. De manière non conventionnelle, des outils liés à Internet vont proposer à leurs utilisateurs de remplacer (bien que cela reste aujourd’hui quasiment utopique) la plupart des maillons de la chaîne des industries culturelles traditionnelles. Du financement des artistes à la conception d’œuvres en passant par la distribution, le Web a mis au point, dans un souci de rentabilité et de pluralité culturelle (les deux aspects étant imbriqués), des outils permettant le développement de pratiques non conventionnelles aux industries culturelles. L’intérêt de ce sujet réside dans les nouveaux usages développés par le Web relatif à la promotion d’artistes sur des plateformes dont le contrôle ne revient qu’à ceux qui les ont mises en place, et non plus aux entités classiques régulant l’économie et le marché de la musique. L’intérêt est donc multiple puisque le principe de ce travail va être de démontrer l’influence que détient le Web sur l’industrie de la musique, grâce aux développeurs de sites ayant la possibilité de structurer des outils capables d’attirer un 5 grand nombre d’utilisateur et donc de se faire accorder une attention particulière de la part des majors, par exemple. L’industrie musicale et les techniques de communication y étant jointes se transformeraient donc peu à peu en fonction des outils mis à leur disposition sur le Web, légitimée par les
