The European Court of Justice case of Breyer Mr. Alan S. Reid Sheffield Hallam University Abstract This case note analyses the impact and significance of the European Court of Justice decision in Breyer. The European Court of Justice has expanded the definition of personal data to include dynamic IP addresses. The judgment improves the privacy situation of internet users across the European Union. The facts of Breyer1 Patrick Breyer is a German politician and activist who belongs to the Pirate Party. The Pirate Party was originally set up in Sweden in 2006, as a single issue political party, committed to the modernisation of copyright law in Sweden, following the crackdown on The Pirate Bay peer-to-peer network. After limited success in Sweden, sister parties sprung up across Europe, in order to capitalise on the notoriety of The Pirate Bay. In order to broaden their appeal, the European Pirate Parties set out common themes of campaigning interest, in particular, on issues surrounding the internet, such as open access to information, freedom of expression and privacy. As a technophile and politician committed to internet freedoms, Patrick Breyer vociferously objected to various Federal German government websites retaining details of his dynamic Internet Protocol (IP) address after he had completed browsing. Internet Protocol (IP) addresses are the essential backbone of the internet. Internet protocols are the method by which interconnected computers and devices communicate, share and transfer data between themselves. An IP address consists of either four pairs of numbers (version 4)2 separated by three colons or eight pairs of numbers separated by six colons (version 6).3 The US organisation ICANN4, the Internet Corporation for Assigned Names and Numbering, is tasked with overseeing the interconnectivity and compatibility required for the continued successful operation of the internet infrastructure. -

[email protected] Abstract This paper examines recent policies and politics of services, in particular child care services in European welfare states. It is argued that social (care) services are becoming an increasingly political issue in postindustrial societies and are at the very center of welfare-state restructuring. Some countries have recently developed new policy pro grams for child care-but there are important differences among these programs. To understand these differences as well as some common features, the paper argues that it is necessary to examine the institutional organization of child care and short-term political factors as well as the rationales articulated in political debates to support or im pede various policies. The paper concludes that a comprehensive system of child care provisions is still far off in most countries, despite a rhetoric of choice and postindustrial care and labor-market patterns. ·This working paper was written while I was a viseing scholar at the Center for European Studies, Harvard University. Almost all West European welfare states have been confronted by mounting new phenomena since the late 1970s, such as the withering away of the policy-informing idea of "full employ ment for all," growing female labor-market participation, demographic change (aging, fertili ty), increasing social differentiation (living-arrangements, migration), and the growing influ ence of European integration on domestic policy-to mention just some problems. -

Politics as Unusual: The Pirate Party and New Politics in OECD Countries Matt Hastings Political Science Jennifer Fitzgerald: Thesis Advisor Committee Members: Andy Baker: Political Science Jennifer Fitzgerald: Political Science David Spires: History University of Colorado, Boulder April 4, 2011 Politics as Unusual: Matt Hastings 1 Abstract: Standard bearer left and right parties, the customary powers for over a century, are under siege from new political movements that range from green and animal rights parties to a resurgent radical right. One piece of this new politics movement is a party that began in Sweden. Focusing on intellectual property rights and technology, specifically the internet, the Pirate Party of Sweden achieved representation in the European Parliament in June of 2009. This success has lead to the emergence of other Pirate Parties across Europe and even Canada. This paper seeks to answer what domestic factors would result in individuals forming and voting for Pirate Parties, a small piece of this new politics movement. Analysis is done using logistic regressions of variables corresponding to four schools of thought. After the data is analyzed, the evidence points to the Pirate Party being the result of electoral structural (the effective number of parties) and the culmination of values change in the 34 OECD countries. The Single-Issue Party Thesis and the Sweden Democrats1 Gissur Erlingsson, Kåre Vernby and Richard Öhrvall Abstract When commenting on the European radical right, the term ‘single-issue party’ is frequently bandied about. We survey the various conceptualizations of the term and then apply them to the Sweden Democrats (SD), a party with roots in extremist subcultures that gained parliamentary representation in the 2010 elections. In the empirical analysis, we draw primarily on a unique survey of all parliamentary candidates to study: (1) the SD candidates’ positions on a large number of diverse issues, (2) what issues they prioritize, and (3) the degree of ideological cohesion among their candidates. Secondarily, certain voter characteristics associated with the single-issue party concept are surveyed. Here, we use a large-scale exit poll to study: (1) SD voters’ demographic characteristics and (2) what issues they prioritize. Throughout, the other main Swedish parties serve as points of comparison. Against what is commonly claimed, we find that the single-issue party label fits the SD poorly.
