    June 24, 2015 Trucking Industry Uses Election Spending and Lobbying Expenditures to Weaken Truck Safety Rules Through Backdoor Riders on Transportation Spending Bills Large truck crashes kill 4,000 thousand Americans every year, and injure nearly 100,000 more at an economic cost of $99 billion. With such a devastating toll of needless death and suffering, the United States urgently needs enhanced truck safety measures. But it’s not stronger truck safety that’s on the Congressional agenda. Shamefully, Congress is instead acting to weaken truck safety standards. If the trucking industry succeeds with its investment of $78 million in congressional lobbying and campaign money since 2012 as this report reveals, the public will be paying even more with their lives and their wallets. On June 9, the U.S. House of Representatives passed an appropriations rider that would roll back a series of truck safety rules; similar life-threatening provisions are now under consideration in the U.S. Senate Appropriations Committee, which will consider them at a committee markup Thursday, June 25. These measures are not being passed through the normal process. They are not being considered in the committees of jurisdiction; they are not being passed after or in response to committee investigation and oversight; they are not evidence-driven in any way. Instead, they are moving as policy riders – incorporated as extraneous matters into must-pass Transportation Department spending bills. There is only one way to understand this Congressional action: With their campaign contributions and lobbying expenditures, big freight companies have leveraged their financial power to win legislative objectives to increase their profits.

    2008 TRUCKING PERSPECTIVES What can be written about the challenges facing the U.S. trucking industry that hasn’t already been chewed up and steamrolled over countless times? Rising fuel prices, green equipment mandates, shifting truckload (TL) and less-than-truckload (LTL) demands, mode competition, excessive capacity, and end-user demands have carriers checking their side-view mirrors for lost business, assets, and competitors discarded along the way. For an economy inherently tied to over-the-road commerce, these objects in the mirror are closer than they appear. Numerous failures, including Alvan Motor Freight and Jevic Transportation, have cast a pall over the trucking industry at large. But with time, distance, and perspective, carriers are managing these challenges and turning their attention to what lies ahead, chasing the tail lights of a sputtering economic engine that is showing signs of turning over. Since resuscitating IdleAir from the ashes of a formerly terminated business, we have realized a number of milestones: IdleAir preserved a proprietary remotely managed “virtual motel” network with over 1,000 active rooms and more than 6,000 parking spaces of intact expansion capacity. The durable high voltage infrastructure we rescued had an original cost of more than $150mm and in many cases has significantly exceeded its design life with very few mechanical challenges. Since 2011 we have doubled our footprint of locations to more than 40 truckstops and fleet terminals. This month we opened the Latta, SC Flying J, which is our second solar-PV powered truckstop. We’ve also just completed construction of our first of several planned dedicated IdleAir terminals with Covenant Transport at their Headquarters and national training facility in Chattanooga, TN. MEMORANDUM IN SUPPORT OF THE MOTION OF THE UNITED STATES TO TERMINATE LEGACY ANTITRUST JUDGMENTS The United States respectfully submits this memorandum in support of its motion to terminate two legacy antitrust judgments. The Court entered these judgments in 1951 and 1956, respectively; thus, each of them is more than sixty years old. After examining each judgment- and after soliciting public comments on each proposed termination-the United States has concluded that termination of these judgments is appropriate. Termination will permit the Court to clear its docket, the Department to clear its records, and businesses to clear their books, allowing each to utilize its resources more effectively. I. BACKGROUND From 1890, when the antitrust laws were first enacted, until the late 1970s, the United States frequently sought entry of antitrust judgments whose terms never expired.1 Such perpetual judgments were the norm until 1979, when the Antitrust Division of the United States Department of Justice ("Antitrust Division") adopted the practice of including a term limit of ten years in nearly all of its antitrust judgments. Perpetual judgments entered before the policy change, however, remain in effect indefinitely unless a court terminates them. Although a defendant may move a court to terminate a perpetual judgment, few defendants have done so. There are many possible reasons for this, including that defendants may not have been willing to bear the costs and time resources to seek termination, defendants may have lost track of decades-old judgments, individual defendants may have passed away, or company defendants may have gone out of business.
