Natural Law and the Scottish Enlightenment Natural law ideas are a well known feature of both ancient and medieval thought, and it has always been a popular scholarly pastime to debate where the 'modern' school of natural law begins — a particular favourite being the question whether Hugo Grotius was the last of the scholastics or the first of the moderns. Much of this debate is fruitless, but it has nevertheless made clear that there is a range of issues over which Grotius' standpoints can be seen to set the course for the future, even though it may be possible to find more or less clear scholastic antecedents for some of them.1 And even if Grotius had been entirely unoriginal, it would still be to him that the historian of ideas would have to turn in order to understand modern natural law theory. -

I took the comment as a marker of the sensus communis common to many critics of law and state.2 It is not just emoting. -

chapter 6 The International Political Thought of Johann Jacob Schmauss and Johann Gottlieb Heineccius: Natural Law, Interest, History and the Balance of Power Peter Schröder 1 Introduction Hugo Grotius had been fairly optimistic that his natural law doctrine would be able to regulate the antagonistic relations between sovereign states. By looking at the arguments of Johann Jacob Schmauss (1690– 1757) and Johann Gottlieb Heineccius (1681– 1741), this chapter scrutinizes the limits of natural law regard- ing interstate relations. They used classical political or juridical concepts of international political thought – such as interest, balance of power, natural law and history – in their political and philosophical writings. Schmauss and Heineccius were both taught by Christian Thomasius1 and were part of the circle of Thomasius’s disciples at the newly founded University of Halle who shaped and continued the early Enlightenment and natural law project. But they pursued their writings and teaching in different directions. Schmauss belonged to the great eighteenth- century jurists. And yet he is almost entirely forgotten, despite the fact that some specialists have empha- sized his importance.2 Schmauss provides one of the crucial links between the University of Halle and the natural law tradition which is so closely associated with Thomasius, and the up and coming University of Göttingen, where he 1 In contrast to Schmauss and Heineccius, Thomasius has been well researched. Gunnerus outlined a reform of the University of Copenhagen. The reform plan was commissioned by J.F. Struensee who at the time was the ruler of Denmark and Norway and was part of a wide reform movement aiming at a thorough modernization of the Danish states. The article summarizes parts of the university reform project and discusses them in the context of Enlightenment philosophical thinking on the nature of scientific knowledge. One by- product of the university reform proposal was a projected university in Norway. The reform proposals came to a standstill when Struensee was overthrown in 1772. Key words: J.E. Introduction In the summer of 1771 Bishop Johan Ernst Gunnerus in Trondhjem received an order from the King summoning him to Copenhagen as Aspects of Johan Ernst Gunnerus' life and work. DKNVS Skrifter 2, 2011 soon as the duties of his diocese would allow him. The letter, signed by the King’s cabinet secretary, Johann Friedrich Struensee, announced that further instructions would be given him upon his arrival in the capital.1 Gunnerus arrived in Denmark in September and was received by Struensee, who was no longer a cabinet secretary. -

Chapter 4 Banning the Best World, God’s (Supposed) Freedom, and the Principle of Sufficient Reason: Christian August Crusius’s Criticism of Optimism (1745) Christian August Crusius is an unfamiliar name in conventional accounts of the history of modern philosophy. Yet he was a leading character of the early German Aufklärung, both because of his role as a relevant influence on Kant’s pre-critical thought, and due to the fact that he was one of the most fervent op- ponents of Leibnizian and Wolffian rationalist metaphysics in the eighteenth century. Crusius was born in 1715 near Halle and Leipzig in eastern Germany as the son of a Lutheran pastor. He studied philosophy and theology in the University of Leipzig, became professor of Philosophy at that University in 1750 and five years later professor of Theology. He died in Leipzig in 1775. His main philo- sophical works are the Dissertatio philosophica de usu et limitibus principii ra- tionis determinantis, vulgo sufficientis (Philosophical Dissertation Concerning the Use and Limits of the Principle of Determinant or Sufficient Reason) (1743), a critical examination of the Principle of Sufficient Reason; the Anweisung, vernünftig zu leben (Guide to Rational Living) (1744), his system of ethics; the Entwurf der nothwendigen Vernunftwahrheiten, wiefern sie den zufälligen ent- gegengesetzt werden (Outline of the Necessary Truths of Reason, as Opposed to Contingent Truths) (1745), his main treatise on metaphysics;1 the Weg zur Gewissheit und Zuverlässigkeit der menschlichen Erkenntniss (Path to the Certainty and Reliability of Human Knowledge) (1747), a system of logic; and the Anleitung, über natürliche Begebenheiten ordentlich und vorsichtig nachzuden- ken (Instruction on How to Reflect Correctly and Cautiously on Natural Events) (1749), his physics.2 1 An English translation of parts of this work can be found in Watkins 2009. -
