Glossary

Affected Household: All members of a project affected household residing together and operating as a single economic unit, who are adversely affected by the Project or any of its components; may consist of a single nuclear family or an extended family group.

Compensation: Money or payment in kind to which the affected masses are entitled in order to replace the lost asset, resource or income.

Displaced Persons: In the context of involuntary resettlement, displaced persons are those who are physically displaced (relocation, loss of residential land, or loss of shelter) and/or economically displaced (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas.

Entitlement: Range of measures comprising compensation, income restoration, transfer assistance, income substitution, and relocation which are due to displaced persons (DPs), depending on the nature of their losses, to restore their economic and social base.

Involuntary resettlement: Development project results in unavoidable resettlement losses that DPs have no option but to rebuild their lives, incomes and asset bases elsewhere.

Land Acquisition: The process whereby a person is compelled by a government agency to alienate all or part of the land a person owns or possesses to the ownership and possession of the government agency for public purpose in return for compensation.

Relocation: The physical resettlement of a DP from her/his pre-project place of residence.

Replacement Cost: Compensation for acquired land, structures and other assets, including (i) fair market value, (ii) transaction costs, (iii) interest accrued, (iv) transitional and restoration costs, and (v) other applicable payments, if any

Resettlement plan: A time-bound action plan with budget setting out resettlement strategy, objectives, entitlement, actions, responsibilities, monitoring and evaluation

Vulnerable groups: Distinct groups of people who might suffer disproportionately from resettlement effects

I. INTRODUCTION

A. Project Background and Description

1. The Peshawar Sustainable Bus Rapid Transit Corridor Project (PSBRTC) under construction with the financial assistance from the Asian Development Bank will contribute to the development of a sustainable urban transport system in Peshawar. The project will improve public transport in Peshawar, directly benefiting a population of at least 0.5 million. The project will consist of two interlinked outputs: (i) full restructuring of a 26-kilometer BRT corridor, including BRT dedicated lanes, 31 stations, 2 depots, mixed traffic lanes, bicycle lanes, parking, sidewalks, green areas, energy-efficient streetlights and proper drainage to climate-proof the BRT infrastructure; and (ii) effective project management and sustainable BRT operations through institutional and organizational developments. The Location Map of the Project is given as Figure 1.

2. The project will provide an integrated bus rapid transit (BRT) corridor, focusing on accessibility, passenger time savings and alleviating congestion for car users, and reducing vehicle operating cost and carbon emissions, which will in turn help make Peshawar safer, more livable, and foster gender equity.

B. Internal Monitoring Report Objectives and Scope

1. Internal Monitoring Report Objective and Purpose

3. The overall objective of this Internal Monitoring Report (IMR) is to determine whether resettlement goals are being achieved and more importantly whether livelihoods and living standards are restored and enhanced to mitigate the project risks and negative impacts. The specific objectives for internal monitoring are to determine: Whether the implementation of land

acquisition and resettlement of project is in compliance with the approved Land Acquisition Resettlement Plans, and the others safeguard documents; (ii) The availability of resources and the efficient, effective use of these resources to implement land acquisition and resettlement activities; (iii) That resettlement institutions are well-functioning during the course of project implementation; (iv) Resettlement activities are undertaken in accordance with the implementation schedule described in the LARP/RPs and the others safeguard documents; (v) To identify problems, if any, remedial actions and to consolidate lessons learned from practical experiences.

4. The purpose of this IMR is to present an up to date status of monitoring of the progress of LARP/RPs covering social safeguards aspects of project; the allocation of replacement of assets if required and will track indicators such as the number of families affected, assistance extended, infrastructure facilities provided, financial aspects and compensation payment disbursed to APs. The report reflects current situation with land acquisition and related issues, as well as opinions of APs, whose interests and rights have been affected in this process. Moreover, the report summarizes and describes the current status of the permanent land acquisition process including completed issues, payment status, outstanding issues and feedback from the APs

2. Scope of Internal Monitoring of LARP Implementation Status

5. This internal monitoring report outlines monitoring implementation of social safeguard activities covers the period from 1st November 2017 to 31 May 2018. It covers resettlement and social safeguard monitoring to comply with the ADB policy to ‘enhance stakeholders’ trust ‘in and ability to engage with ADB, and thereby increase the development impact of the BRT Project in which disclosure of safeguard monitoring is a prominent aspect.

6. As per the loan agreement (para 12a Schedule 5), draft/updated LARPs/RPs internal monitoring is to be done on a semi-annual basis. The report covers most of the key indicators provided in the monitoring chapter of the approved LARP, (including brief explanation in case of deviation from the original plan) as follows:

i. Review effectiveness of land acquisition and resettlement planning process, i.e., adequacy of enumeration of project land acquisition and resettlement impacts, timeframe, budgetary provision, institutional arrangements, GRM, mitigation of unforeseen resettlement impacts etc.). ii. Consultations organized and dissemination campaign carried out with regard to LARP and DPs are aware of, i.e., entitlement packages, payment procedures, grievance redress mechanism, etc. iii. Verification whether land and assets situated to the land, resettlement and rehabilitation assistance payments made only to entitle APs recorded before cut-off date. iv. A grievance redress committee is established during the stage of detailed engineering design to ensure fairness and transparency during the LARP implementation process. v. Finances for compensation, resettlement and rehabilitation assistance provided on time.

vi. One-month advance notices to vendors and 6 months advance notices to lessees of underpasses and 3 months advance notices to owners and shopkeepers of Chughal Pura and two-month advance notices to mosques committees to be given before shifting/relocation. vii. Timely disbursement of compensation, resettlement and rehabilitation assistance amount to DPs as per schedule in an efficient and transparent manner and is in conformity with the provisions in the Entitlement Matrix. viii. Relocation of affected vendors by permitting them to shift their businesses to alternative business sites. ix. Provision of skilled, semi-skilled and skilled labor opportunities and employment to affected households (AHs) with numbers including number of persons whose skills are upgraded. x. Verify recording and addressing the concerns/grievances of DPs are dealt on timely basis during and after land acquisition and resettlement process and consistent with the LAR. xi. Major issues of conflict between DPs and contractors are addressed efficiently during implementation of resettlement activities. xii. Effective monitoring of LRP and issues identified for immediate actions will be referred to the PM-PMU and Project Director of TMTD, and NGO for modifications in the LRP based on the progress and lessons learned in the course of LRP implementation and additional funds to cover additional activities. xiii. Effective implementation of Gender Action Plan, collection of gender disaggregated data and gender specific consultations with women. xiv. Degree of satisfaction of DPs and AHs with support received for restoration of their income and livelihood. xv. Any changes in social and economic parameters related to living standards of AHs. xvi. Efficient restoration of public utilities and/or other affected services/infrastructure. xvii. Lease agreements signed for the temporary use of land, full restoration of land after completion of construction.

7. The project is categorized as category A for social safeguards issues. This report presents project background and its components, project’s progress in terms of consultations with APs, compensation of Rehabilitation & resettlement assistance and grievance management. This internal monitoring report, prepared by PDA provides an updated status of LARP implementation and payments made to the APs covering the following:

i) No. of affected persons (APs); ii) Status of land acquisition; iii) Loss of structures and status of payments and income restoration; iv) Affected fruit and timber/ wood trees and status of their payments; v) Affected crops and payments; vi) No. of APs paid, unpaid and being paid; vii) Payment of allowances including rehabilitation, livelihood restoration and vulnerability allowances;

viii) Linear map of the BRT alignment and visualization of impacts and compensation Payment ix) Consultation meeting with stakeholders x) Complaints/redress management; xi) Gender action plan implementation xii) Conclusions and recommendations.

II. METHODOLOGY AND APPROACH

A. Approach Followed

8. The methodology and approach has been adopted for the preparation this internal monitoring report included the following: formal and informal consultative process are being carried out for the project including, but not limited to Focus Group Discussions (FGDs), public meetings, community discussions, and in-depth and key informant interviews in addition to the censuses and socio-economic surveys. The following procedures have been adopted during monitoring of resettlement plan implementation:  Reviewing the functioning of the institutional mechanism and resettlement implementation proposed in the LRP/RPs;  Analyzing LARP, procedures of entitlement, compensation payments processes, and agreed ADB’s Social safeguard & Resettlement Policy;  Verifying the records of data/information on compensation payment to APs against their entitlement by types of compensation for each individual APs provided in LARP/RP documents;  Conducting consultation/meetings with different stakeholders of the project including project affected & project beneficiaries and contractors staffs/workers employed for BRT construction works;  Interacting with APs through consultations and interviews to assess their level of satisfaction with resettlement and rehabilitation assistance disbursement process and grievance redress mechanism.

9. In line with the above procedures, following activities were carried out for internal monitoring and progress reporting.

1. Review of Project Documents

10. The review of the documents was carried out during the reporting period. The main documents reviewed and finalized included the land acquisition and resettlement plans of various reaches and other safeguard related documents such as Due Diligence Report (DDR), addendum and design plans which enabled the PIU to follow an appropriate line of action for the implementation of LARP/RPs to accomplish the objectives of the assignment.

11. From design to implementation the project is being implemented on fast track. Due to changes in project design, the LARPs/RPs were required to be continuously, being revised and updated. As anticipated, the preparation of addendums and DDRs will continue till the completion of this BRT project.

2. Data Collection and Analysis

12. The preparation of Due Diligence Report (DDRs), addendum of most of the LARP/RP related documents have been prepared through consultations with APs, conducting surveys and collection of regular data and analysis. Both the social and resettlement units at PIU, PDA and Project Management Construction Supervision Consultants (PMCSC) were involved in data collection and analysis in the impact assessment and verification.

3. Consultation with Key Stakeholders

13. Several consultation meetings were held with the stakeholders during the progress reporting period summarized below.

 A number of regular meetings held with Deputy Commissioner/District Revenue Office Tehsildar/Patwari confirming funds transferred, document sharing, request for sections notification under LAA and land demarcation in Sardar Garhi required for BRT.  Meetings held with Directors/Deputy Directors PDA of Reach 1, 2 and 3 for APs right sensitization, on the spot complaint resolution and sensitive grievance redress.  Meeting with PMCSC for data cleaning, verification of missed APs and current unit rate estimation and help for AP identification and determining eligibility for compensation payment.  Regular meetings with KPUMA, TMDT and TransPeshawar to discuss allocating BRT Commercial spaces to APs and gender related issues.  Conducted numerous meetings with representatives of APs of Sardar Garhi, Zia market, Hashtnagri underpass, vendors of Reach 1, 2 and 3.  Meetings held with APs for disclosure of full information to women and vulnerable APs to make them aware of their entitlements and obligations, compensation and allowances, complaints and grievance redress procedures.  Regular meetings with APs to guide them in account opening and assisting them to obtain their CNICs.  Meetings and consultations undertaken with key stakeholder were regularly documented and action points were followed up.

 Meeting with DPCs to make them to understand the grievance redress mechanism established at PIU.  Meetings with ADB mission for sharing project progress and updates.

III. INSTITUTIONALISAION OF LARP/RP IMPLEMENTATION PROCESS

A. Institutional Roles and Responsibilities

14. The Project’s executing agency (EA) is Khyber Pakhtunkhwa Urban Mobility Authority (KPUMA). Transport and Mass Transit Department (TMTD) provides administrative and secretariat support to KPUMA through the PMU at TMTD and with support of the Project Management, Coordination and Capacity Building (PMCCB) consultants. KPUMA is responsible for overall coordination of the project and ensure availability and timely release of counterpart funds. The project Implementing Agencies are (IAs) Peshawar Development Authority and TransPeshawar.

15. Peshawar Development Authority (PDA) is the Implementing Agency of LARP/RPs. PDA is responsible for day-to-day implementation/operations of LARP/RPs and has established adequate and appropriate systems for LARP/RPs implementation including institutional arrangements, internal monitoring and reporting. PDA has also been managing functions of consultants, contractors and other relevant parties regarding social safeguards management. The Design and Supervision Consultants are carrying out the supervision of the project, including social and environmental management and supervision and monitoring of LARP/RPs and EMP implementation.

16. EA is supported by Project Implementation Unit (PIU) housed within PDA assisted by the Social Team for Resettlement Plan Implementation (STRPI). The PDA is using the services of the STRPI with assistance from the Project Management Construction Supervision Consultants (PMCSC) for implementation of the LAR related activities including implementation of R&R assistance to APs and in liaison with Deputy Commissioner, Peshawar for land acquisition and subsequent compensation payment to APs.

17. The Land Acquisition and Resettlement Plan Implementation Committee was established and notified by PDA to ensure that safeguard management including land acquisition is in compliance with ADB, SPS 2009 requirements as well as to resolve field related issues see Annex 1.

18. A Resettlement Assistance Disbursement Committee was established and notified to assist PDA, the implementing agency in fulfilling its obligations relating to transparent and timely payment of resettlement and rehabilitation assistance to APs of the project according to the entitlements of each category of APs as per approved LARP/RPs documents, Annex 2.

19. To ensure effective implementation of Grievance Redress Mechanism, a Grievance Redress Committee (GRC) was established and notified to review and investigate all grievances lodged by APs and effectively address and resolve them in a timely manner. The Social Development and Resettlement Specialist has been serving as a member/secretary of the GRC, Annex 3 and GRC Meeting Notification as Annex 4.

20. The Reach-wise focal persons were nominated and notified to lead to the “First Tier of the Grievance Redress Mechanism” for timely and effective resolution of grievances to ensure the successful implementation of the Project. The STRPI has been facilitating the focal person of each Reach in investigating and providing guidance in grievance redress matters and record keeping, Annex 5.

21. DPs Committees (Shura) already established was activated and revitalized to represent and safeguard interest of APs. The Shura is also playing the role of a bridge between PIU and APs and helping in grievance resolution. Male & Female DPCs at Sardar Garhi were established and are functioning.

22. A Gender Focal Group comprised of KPUMA, TransPeshawar, STRPI, PMCSC and Social Welfare Department was established to implement Gender Action Plan. The focal group convenes meetings on monthly basis to review the Gender Action Plan.

23. As for the BRT project, the PIU has already engaged the services of an External Resettlement Monitor (ERM) to undertake semi-annual external monitoring of RPs/ LARP implementation.

IV. PROGRESS ON LARP/RP IMPLEMENTATION

A. LARP/RP Review, Endorsement and Implementation

24. The Land Acquisition and Resettlement Plan (LARP/RPs) are prepared for Civil Works Construction of all three Reaches were approved by KPUMA and ADB and uploaded on PDA and ADB websites. The addendum of Reach 1 is under preparation by the PMCSC due to additional impacts following the design changes. Table 1 summarizes the status of LARP/RP and DDR related documents preparation and their subsequent approval process.

25. Temporary Land Acquisition required for the construction purposes, e.g., for construction of bus stations and other allied structures as well as warehouses for storing construction materials & equipment have to be managed through the civil construction contracts with compensation to be paid at current commercial rates for the period that temporary acquisition of the land is required. This issue has been brought to the notice of PMCSC and contractors and being monitored under the project.

B. Resettlement Principles and Compensation Disbursement

1. Resettlement Principles of the Project

26. The Resettlement planning during the project preparation is based on Government of KPK regulations and incorporating the ADB SPS 2009. As per the project R&R policy, all affected households are entitled to a combination of compensation measures and resettlement assistance, depending on the nature of their ownership rights over the affected assets and the scope of the impact, including the social and economic vulnerability of the affected persons. In general terms, the APs in the project are entitled to the following types of compensation and assistance: i. compensation for loss of land, trees, etc. at replacement value; ii. compensation for residential/commercial structures at replacement value; iii. assistance for loss of business/wage income; iv. assistance for shifting;

v. rebuilding and/or restoration of community resources/facilities; and vi. special additional assistance for vulnerable households

2. Preparation of Micro Plans for Compensation Disbursement of Affected Assets

27. For compensation payment, as per the entitlements of APs provided in the LARP/RP of each Reach were studied and analyzed. The Micro Plans have been prepared for all the affected non-titleholders and for the titleholders as per the provisions of the LAA 1894 are being followed in disbursement of land compensation to the affected land owners. The competent authorities for Land Acquisition (LAC) and PDA have prepared the micro plans for providing compensation for those who lose their lands and assets as per the provisions.

3. Preparation of Claim Forms and Payment Vouchers 28. APs claim forms and payment vouchers were prepared in line with micro plans for each AP and verified by PIU, PMCSC and Finance Department with details category of women and vulnerable DPs, asset lost, compensation and all types of resettlement and rehabilitation assistance. LAC and Director Finance were orientated on claim forms and payment vouchers. All compensation payments conducted in transparent manner. ADB Consultants monitored the initial compensation payments process.

C. Project Impacts and Compensation Disbursement

1. Reach 1

29. The Project will impact 418 APs due to economical and physical displacement. Table 2 summarizes the type of impacts and compensation payment status to each category of the affected asset.

30. The list of APs has been vetted and finalized by the LAC as per the details available in the revenue records and LARP. The compensation for the titleholders in the impact survey were estimated as per the provisions of Land Acquisition Act 1894. Most of the individual titleholders received their compensations. There are few titleholders who are yet to receive their compensation due to the incomplete documentation and pending mutation cases.

31. A total of 174.4 kanals land was required for the construction of BRT at Sardar Garhi, which has been fully acquired. A total amount of land compensation was calculated Rs. 1,095.181 million was to be paid to 73 APs. Out of which, Rs. 1,094.675 million have been paid to 67 DPs. The remaining 6 APs has to be paid an amount of Rs. 4.527 million. The payment has been delayed due to expired ID cards and mutation cases. The details and reasons for non-payment of the remaining APs are still awaited due to the transfer of the Patwari. Further details about land compensation to the APs are provided in Table 3. The rates of the crops and trees have been assessed by officials of agriculture and forest department keeping in view the of the current market rates. The rates provide to APs were based on the damages incurred due to the BRT construction works.

1.1.1 Payment of Residual land

32. Residual land issues were discussed with APs and PDA, Project Director. Currently, two cases are under discussion. The first case is related to the acquisition of 12.5 Marla piece of land at Sardar Garhi owned by two brothers (Rashid and Naveed) and second case is about 20 Marla land strip owned by Zahidullah at Chamkani. In view of the future speculative value of the land, in both cases APs are undecisive, probably they will keep the residual land if they become satisfied with the proper access is provided to them. A definitive answer is still awaited from both APs and PDA. The issue will be resolved, documented and reported in the next semi-annual IMR.

1.1.2 Payment of Affected Crops

33. Compensation for crops will be paid to a total number of 12 APs. The compensation amount calculated as Rs. 0.777 million. To date only seven APs were paid Rs. 0.389 and the remaining APs were not paid due to transfer of the PDA, LAC.

1.1.3 Payment of Affected Trees

34. In case of fruit and wood trees, a total of 26 AP had to be paid an amount of Rs.4.744 million. During the reporting period, 21 AP have been paid an amount of Rs. 2.710 million. The remaining 5 APs are yet to be paid an amount of Rs. 2.034 million.

1.2 Payment of Affected Building Structures

35. Census survey results show that total amount of compensation for loss of residential/ commercial structures was Rs. 36.581 million has to be paid to 76 APs including one female owner of a commercial structure. Both residential and commercial structures will be impacted due the BRT construction. The summary of impacted structures and compensation payment to APs has been given in Table 4.

1.3 Payment for Resettlement and Rehabilitation Assistance

36. The Resettlement and Rehabilitation (R&R) Assistance involve two types of allowances covering lump sum and monthly payments for income loss. For allowances (rehabilitation/ livelihood restoration) payments, 334 APs including four female APs had to be paid an amount of Rs. 44.04 million. Out of total, 164 APs have been paid an amount of Rs. 25.46 million on account of allowances/ livelihood restoration including income loss, relocation, shifting allowance and vulnerability allowance. The remaining 170 APs has to paid Rs. 18.58 million. The summary of the assistance provided for the affected persons are given in Table 5.

4. Action Plan for the Compensation Payment to Unpaid APs of Reach 1

43. The compensation payment to the remaining APs is undergoing. It was discussed with the Project Director that the Lump sum payment to all APs will be completed at the end of September 2108. However, the monthly payments to APs are conditional to the completion of the rehabilitation and construction work and handing over shops back to the APs. The decision on

the mode of payment to the unique APs such as Afghan nationals, blocked NIC holders and underage APs are still awaited. Table 11 provides an Action Plan for the payment disbursement to the remaining unpaid APs.

IV. CONSULTATION, PARTICIPATION AND INFORMATION DISCLOSURE

A. Stakeholder Consultation and Participation

44. Consultation meetings, group discussions and in-depth interviews were conducted with APs in each reach (including representatives of poor households, households which are required to resettle and households losing their business or agricultural land) and provided timely, relevant, understandable, and accessible information, in a culturally appropriate manner, free of coercion and intimidation. Stakeholder engagement logs, and meeting minutes were prepared and were made available to APs and other relevant stakeholders when required.

45. Regular public consultations and meetings have made with the affected households to make them fully understand about the compensation and related procedures of the LAR. Majority AHs were satisfied with the LA process, fair appraisal of the property, timely payment and LAR policy arrangement. Consultation meeting with group of APs continued on weekly basis especially in Sardar Ghari with APs of Zia Market and Firdous and Hashtnagri underpasses affected significantly.

46. A number of preliminary field/ site visits, meetings, discussions with officials of PIU, PMCSC, contractors, consultants as well other key stakeholders were carried out to coordinate, clarify and implement project design and LARP/RP implementation issues.

47. Meetings were held with Deputy Commissioner (DC), Additional Deputy Commissioner (ADC), Tehsildar to expedite the land acquisition process and issuing of the required sections under the Land Acquisition Act, 1894. The team made several visits along with Patwari to demarcate the acquired land in Sardar Ghari and conducted assessment of affected trees and crops to commence compensation payment to APs for affected land and structure. The detailed findings of consultations with APs during the reporting period are provided as Annex 7.

B. Information Disclosure

48. The ADB-approved safeguards documents have been disclosed on PDA website in line with ADB’s SPS 2009 requirements. In view of difficulty for APs to comprehend LARP in English, the LARP Reach 1 was translated in Urdu and disseminated to APs of Firdous and Hashtnagri and Zia Market APs. Executive summary and entitlement matrix of RPs of Reach 2 and 3 were also translated in Urdu and distributed among APs.

V. STATUS OF GRIEVANCES LAUNCHED AND RESOLVED

A. Grievance Redress Mechanism

49. With a view to likeliness of grievances during LARP/RP implementation, provision of constituting a Grievance Redress Committee (GRC) has been made and notified to minimize expected protracted and expensive litigation. The GRC is being coordinated by Social Development and Resettlement Specialist as the Secretary of the committee.

50. The main responsibilities of the GRC at both PIU and DC level is (i) provide support to affected people on problems arising from land/property acquisition; (ii) record AP grievances, and resolve them. The GRC is expected to resolve grievance of the eligible persons within a stipulated timeframe.

51. The three-tier grievance redress mechanism (GRM) was established to ensure systematic disclosure of information, hearing and recording of complaints, proper arrangement for addressing conflicts and appeal procedures regarding eligibility and entitlements as well as the implementation of resettlement activities. Through an outreach program, APs were informed on how the mechanism will work and ensured it is accessibility to vulnerable and women APs. The GRM was translated in Urdu and distributed among APs.

B. Grievance Status 52. To date, 24 complaints were received, out of the total 10 were resolved and 13 are still under process at the PIU level, summarized in Table 12. A close follow-up was carried out with the complainants to address their complaints. In this regard, precautionary measures were adopted through conducting various formal and informal meetings with the aggrieved persons to manage their grievances. In such meetings the BRT alignment design, PDA owned ROW limits, LAR impact assessment including eligibility, entitlement provisions under project resettlement plan were explained. The Grievance Log is provided as Annex 8.

Some of the grievances involved missing names of APs in the impact assessment and misunderstanding regarding the unit rates and eligibility criteria of APs to be entitled for compensation were resolved timely. However, the grievances of critical nature to be resolved are in process are provided in the Table 13. PIU is involved in the preparation of the documents related to grievances, follow up action taken to resolve along with explanatory note on nature, seriousness of grievance to be redressed. VI. GENDER ACTION PLAN IMPLEMENTATION

A. Introduction 54. This Gender Section shares updates and progress made on LARP/RPs implementation of Peshawar Sustainable Bus Rapid Transit Corridor Project (PSBRTCP) using gender lens. The gender mainstreaming initiatives were focused on facilitation of the more susceptible APs particularly women and the potential BRT commuters including women, disabled and the vulnerable.

55. The PSBRTC is classified as Effective Gender Mainstreaming (EGM) Project. Women have been provided increased assistance in all project related activities that target men and women. A Gender Action Plan has been developed involving all stakeholders and is being implemented. Regular consultations were conducted with all stakeholders including APs of the BRT corridor.

C. Progress on GAD Implementation

56. Supported effective implementation of Gender Action Plan (GAP) in coordination and collaboration with TransPeshawar, PDA, TMTD, KPUMA consultants and other stakeholders. During the month first Gender Focal Persons (GFP) GAP meeting was held the office of TransPeshawar including GFPs from PIU PDA, ADB, TransPeshawar, PMCSC, PMCCB and SWWDD.

57. Information disseminated to women APs, and vulnerable APs of Sardar Garhi and the two Underpasses were provided information through regular meetings on project impacts on assets/income; LAR and Gender Policy, entitlements/obligations, disbursement, complaints; GRMs, M&E of LARPs, GAP; information. eviction, timeframe. In brief, during the reporting period, following activities were carried out for effective implementation of the GAP.

 Coordination and communication with all APs and key stakeholders for the effective implementation of GAP.  Organized regular consultation meetings with women APs on LAR, LRP; GAP on the issues related to the impact of project on their livelihoods.  Documented male and female APs concerns and proposed remedial measures to address concerns through consultations.  Assisted women APs in opening up their bank accounts to be able to receive compensation; prepared vouchers/cheques for issuance of compensation.  Informed women APs regarding process of compensation & disbursement procedures to receive compensation.  Prepared Micro Plans for women and vulnerable APs including information category of asset lost and type of assistance compensation and amount of compensation.

 Developed payment schedules and assisted timely payments of compensation for women and vulnerable APs.  Ensured transparent process of compensation disbursement and resettlement assistance for both men and women APs.  Facilitated APs particularly elderly/women in resolving their grievances/complaints; during LARPs and GAP implementation.  Informed DPs particularly women about the status of their complaints until resolution.  Represented PIU PDA in High Level Official meetings including GAP Implementation meetings.  Shared information at Peshawar University on Bike lane and Bike sharing with female university students.  BRT Commercial spaces 15% for women information shared with APs at Zia Market and Dabgari Staging station.  Meetings held with UN Women to liaise and synergize initiatives to support and work together in addressing gender concerns.

VII. CONCLUSIONS AND RECOMMENDATIONS

A. Conclusions

58. As evident from the preceding sections, a considerable progress has been made in the process of the LARP/RPs implementation in terms of payment of land compensation and the disbursement of rehabilitation and resettlement assistance to the APs. Progress were also made in engaging with stakeholders, restoring livelihoods, addressing the needs of vulnerable people, ongoing follow up of grievance resolution and tracking monitoring impacts. However, the cases of unique APs (Afghan Refugees, blocked and expired ID Cards holders and underage APs) are still pending. Overall, the APs were found to be satisfied about the LARP/RPs implementation process.

B. Recommendations

59. The payment to the unique APs should be given priority. A possible solution could be that PDA should disburse the compensation payment using cross cheques through the legally registered Shura for onward payment to unique APs in the presence of PDA Finance Department, STRPI and PMCSC.

60. Frequent design changes and lack of capacity in LAR planning and assessment on the part of PMCSC impeding the progress in the LARP/RPs implementation process. These issues

are needed to be addressed on urgent basis. Hiring of a senior Social Development and Resettlement Specialist by PMCSC will add value and can expedite the implementation process.

61. The compensation payment disbursement has been slow down due to authorization and approval process of cross checks. A dedicated time slot is required on daily basis from the Finance Department for compensation payment to APs.

62. Revenue officials/Patwari failure to demarcate and classify land and slow process of land acquisition process will add APs frustration can lead to the impoverishment of APs and their agitation/protest could cause subsequent delays in project implementation. Both PDA and LAC need to have a realistic understanding of what can be achieved so that stakeholder expectations can be managed.

63. Competing and conflicting interests of powerful APs having a considerable clout on the implementing agency are to be carefully managed otherwise delays are inevitable. Individual expectations of what the project will offer need to be carefully managed by the PDA.

64. The rate of compensation for lost assets must be calculated at full replacement cost, that is, the market value of the assets plus transaction costs. The C&W should be convinced in determining the replacement cost, depreciation of the asset and the value of salvage materials are not taken into account for the assessment of an affected asset

65. LARP budget limitations - GAP activities could not support conducting survey for training requirements for skill up gradation and subsequent possible admission in institutions responsible for training. A Livelihood Restoration Plan (LRP) may help in this regard, has not been provided by PMCSC yet.

66. Following the approval of the First Semi-annual Internal Monitoring Report, the External Resettlement Monitor should will be engaged for validation of the above-mentioned report.
