SUMMARY: The City has received a letter from Studley, the real estate brokerage firm representing the property owner at 5962 La Palma Avenue, requesting that the City consider the development of a JP Morgan Chase Bank on their property. The letter is provided as Attachment 1 to this report. The site is located at the southwest corner of Valley View Street and La Palma Avenue and has been vacant for over 10 years. Late last year, the subject parcel was rezoned from Neighborhood Commercial (NC) to Planned Neighborhood Development (PND) land use designation, which prohibits financial institutions and banks. The Broker has stated that they have exhausted attempts to find end users for his client’s property that are consistent with the goals of the new PND Zone and that meet the needs of his client. They have a ground lease offer from Chase to develop a free-standing bank. The financial institution use alone does not meet the requirements in the PND Zoning District to develop the commercial corner with retail uses that are lacking in the community.

This Operations Standards Manual or OSM is written for the employees of ABC Restaurant Company, primarily for those employees involved in the day to day operations of our restaurants. It is also written for the franchisees of ABC Restaurant Company, the “franchisees of record,” who own and operate ABC Restaurants under a franchise agreement, and their re- spective employees. This document is designed to serve multiple purposes. It is a source of information, a reference, a guide and training “tool,” in the effective and successful operation of an ABC Restaurant Company restaurant. This Manual contains vital information as it relates to the standards, procedures, processes, product, business methods and some key areas of operational support needed for the daily operation ABC restaurants to ensure we meet or exceed the expectations of our customers. This OSM is predominantly focused on restaurant operations and the support functions to restaurant operations in Market- ing and Human Resources. There is also a section on Key Considerations for New Franchisees. This OSM is written by the team members of ABC Restaurant Company who work in the Operations Service and Support func- tion of the company.

Total Initial Investment: The total investment necessary to open a single YOSHINOYA restaurant (not yet in operation) will range from $507,600 - $841,300. This includes $195,600 - $274,300 you pay the franchisor or its affiliates as Initial Fees. The total investment necessary to purchase an existing YOSHINOYA restaurant will range from $272,316 - $1,887,867. This includes $165,600 - $1,674,300 you pay the franchisor or its affiliates as Initial Fees. For area development rights, which let you open an agreed number of YOSHINOYA restaurants in a protected area, provided you meet development deadlines, you pay us a Territorial Rights Fee. It is the product of $13,750 (50% of the $27,500 Initial Franchise Fee) times the number of YOSHINOYA restaurants in your development commitment.
