Chairijah 12 August 2003 ABSTRACT Marine development, particularly that of the shipping industry, constitutes an integral and essential element of Indonesia's on-going national progress in not only meeting the needs of the domestic movement of passengers and trade, but also in supporting export and import activities. Sea transportation is still the cheapest, most effective and efficient type of transportation, particularly for the more isolated areas of Indonesia. Despite these benefits sea transportation is potentially risky. For this reason the development and management of shipping must be integrated with other areas of the economy by means of clear and sustainable planning. Obstacles to the rapid development and modernisation include the scarcity of qualified persons, insufficient facilities and infrastructure, hmited budgets, too few marine institutions, and a lack of strong interest in gaining expertise in the marine sector generally. However, significant strides have been made in Indonesia since the 1990s through Government's Long Term Development Plan (PJP). This thesis examines the regulatory framework governing shipping in Indonesia. The areas of focus are the development and implementation of the regulation of shipping and water transportation, including shipowners" responsibility, port management, search and rescue, and court jurisdiction. The thesis argues that the development of the shipping industry really needs to be supported by a proper legal framework, which is inadequate at the moment. 11 ACKNOXVLEDGEMENTS The completion of this thesis would not have been possible without the generous support of the author's supervisor, colleagues, family, and many friends. It is believed to be done for certain purposes. One of the intentions is that it is as an evidence of sacrifice of the circumcised person to get close to God. In the last decades, the demand for ignoring this practice on female by various circles often springs. Reason being is that the practice is accused of inflicting female herself. Moreover, it is regarded as a practice that destroys the rights of female reproduction and that of female sexual enjoyment and satisfaction. Commonly, female circumcision is done by cutting clitoris and throwing the minor and major labia. This practice of circumcision continues based on the myths that spread so commonly among people. This article aims to conduct a research on female circumcision in the perspective of Islamic law. According to Islamic doctrine, female circumcision is legal by Islamic law. By adopting the methodology of syar‘a man qablana (the law before us) and theory of maqasid al-syari‘ah (the purposes of Islamic law) and some other legitimate Quranic verses, circumcision becomes an important practice. Again, the famous female circumcision practice is evidently not parallel with the way recommended by Islam.     1 BAB I PENDAHULUAN A. Latar Belakang Masalah Indonesia sebagai Negara kepulauan terbesar di dunia karena jumlah kepulauanya sekitar tiga belas ribu kepulauan dan jumlah penduduk hampir mencapai dua ratus juta jiwa. Bahkan Indonesia dikenal juga sebagai masyarakat yang terligius dan beradab karena masyarakatnya bertuhan. Dalam kaitan ini, Joahim Wach menegaskan bahwa tidak ada agama tanpa Tuhan karena agama adalah perbuatan manusia yang paling mulia dalam kaitannya dengan Tuhan Yang Maha Pencipta. Kepadanya manusia memberikan kepercayaan dan keterkaitan yang sesungguhnya.1 Hal ini, sesuai dengan keyakinan agama yang dianut oleh masyarakat Indonesia, bahkan diperkuat dengan falsafah bangsa Indonesia yang termuat dalam Pancasila yang pertama adalah Ketuhanan Yang Maha Esa. Agama yang ada di Indonesia adalah bertuhan karena tidak bertuhan berarti bertentangan dengan Pancasila, bahkan tidak diakui sebagai agama. Maka keberadaan Tuhan adalah masalah pokok dalam setiap agama karena agama tanpa kepercayaan kepada Tuhan tidak disebut agama.2 Oleh karena itu, Edward B.     BAB II BIOGRAFI MUHAMMAD QURAISH SHIHAB A. Latar Belakang Muhammad Quraish Shihab 1. Latar Belakang Keluarga Muhammad Quraish Shihab adalah anak ke lima dari 12 bersaudara, dilahirkan di Lotassato, Kabupaten Sidenreng Rappang (Sidrap), Sulawesi Selatan, pada tanggal 16 februari 1944, yang bertepatan dengan 22 bulan syafar 1363 H.1 Ia adalah putra ke lima dari dua belas bersaudara, putra dari Abdurrahman Shihab. Yakni seorang ulama tafsir yang semasa hidupnya merupakan cendekiawan terkemuka di Ujung Pandang; Ia adalah seorang pendiri Universitas Muslim Indonesia (UMI) di Ujung Pandang dan juga staf pengajar, dengan jabatan guru besar pada Institut Agama Islam Negri (IAIN) Alauddin Ujung Pandang, dan sebutan Shihab adalah nama keluarga.2 Abdurrahman Shihab lahir di Makassar pada tahun 1915 , ia adalah putra dari Habib Ali bin Abdurrahman Shihab, seorang juru 1 Anshori, Penafsiran ayat-ayat jender menurut Muhammad Quraish Shihab, (Jakarta : Visindo Media Pustaka,2008 ) H. 31 2 Alwi Shihab, Islam Insklusif : Menuju Sikap Terbuka dalam Beragama, (Bandung : Mizan, 1999), H. 6 23 24 dakwah dan tokoh pendidikan kelahiran Hadramaut kota Yaman yang kemudian hijrah ke Batavia-kini Jakarta3. Muhammad Quraish Shihab sendiri mengaku bahwa dorongan untuk memperdalam study Al-Qur‟an terutama tafsir itu adalah datang dari ayahnya. Ayahnya senantiasa menjadi motivator bagi Muhammad Quraish Shihab.4 Mengenang ayahnya Quraish Shihab menuturkan “beliau adalah pencinta ilmu. Walau sibuk berdagang, beliau selalu menyempatkan diri untuk berdakwah dan mengajar. Bahkan beliau juga mengajar di masjid. Sebagaimana hartanya benar-benar dipergunakan untuk kepentingan ilmu. Beliau menyumbangkan buku-buku bacaan dan membiayai lembaga-lembaga pendidikan Islam di wilayah Sulawesi.5 Rappang adalah kampung halaman ibunda Quraish (Asma) yang biasa di sapa Puang Asma atau dalam dialek lokalnya Puc Cemma ; Puang adalah sapaan untuk keluarga bangsawan, dan nenek Asma adalah Puattulada yakni adik kandung Sultan Rappang.

In Indonesia, normatively, the practices of religious harmony and freedom are referred to both Islamic religion and Pancasila values. The two normative references are positioned in line. Thus, even for the people, Pancasila has a spirit of Islam, because the framers of Pancasila (and Konstitution UUD 1945) are Moslem like Muhammad Yamin and Sukarno. Consciously or not, the Islamic teaching viewed by those framers of Pancasila absorbed into the values of Pancasila. Therefore, it is fair enough that Pancasila and Islam have harmony and conformity, including the concepts of religious harmony and freedom. Wacana kerukunan dan kebebasan beragama masih menjadi kajian aktual dan banyak dikaji melalui berbagai pendekatan, diantaranya dalam perspektif sejarah, sosiologi, dan budaya. Di Indonesia, secara normatif, praktik kerukunan dan kebebasan beragama mengacu pada nilai agama Islam dan Pancasila sekaligus. Kedua acuan normative tersebut diposisikan sejalan. Bahkan bagi sebagian kalangan Pancasila memiliki ruh ajaran Islam, karena para perumus Pancasila (dan UUD 1945) adalah umat Islam, seperti Muhammad Yamin dan Soekarno. Disadari atau tidak, ajaran Islam yang dipersepsi para perumus Pancasila tersebut meresap kedalam Pancasila. Oleh karena itu, wajar apabila antara Pancasila dan Islam memiliki keselarasan dan kesesuaian, termasuk dalam hal konsep kerukunan dan kebebasan beragama.

Riwayat Hidup Prof. Dr. Muhammad Quraish Shihab, M.A Lahir di Lottasalo kabupaten Sidenreng Rappang (Sidrap), Sulawesi Selatan, pada hari rabu 16 Februari 1944. Ia berasal dari keturunan arab yang terpelajar. Ayahnya Prof. Abdurrahman Shihab, menerapkan pendidikan dan disiplin yang keras.1 Rappang adalah kampung halaman ibunda Quraish, Asma, yang biasa disapa Puang Asma atau dalam dialek lokalnya Puc Cemma’. Puang adalah sapaan untuk anggota keluarga bangsawan. Dikarenakan nenek Asma, Puattulada, adalah adik kandung Sultan Rappang. Kesultanan Rappang yang bertetangga dengan Kesultanan Sidenreng kemudian melebur jadi bagian 1 Mauluddin Anwar, dkk, Cahaya, Cinta dan Canda (Tangerang : Lentera Hati, 2015), XXII. 20 21 Indonesia, setelah pemerintah Belanda mengakui kedaulatan RI pada 27 Desember 1949.2 Sebagai putra dari seorang guru besar, Quraish Sihab mendapatkan motivasi awal dan benih kecintaan terhadap bidang studi tafsir dari ayahnya yang sering mengajak anak-anaknya duduk bersama. Pada saat-saat seperti inilah sang ayah menyampaikan nasihatnya yang kebanyakan berupa ayat-ayat Al- Qur’an. Quraish kecil telah menjalani pergumulan dan kecintaan terhadap Al-Qur’an sejak umur 6-7 tahun. Ia harus mengikuti pengajian Al-Qur’an yang diadakan oleh ayahnya sendiri. Selain menyuruh membaca Al-Qur’an, ayahnya juga menguraikan secara sepintas kisah-kisah dalam Al-Qur’an. Disinilah, benih- benih kecintaannya kepada Al-Qur’an mulai tumbuh. Tonggak kecintaan Quraish pada ilmu Al-Qur;an tertancap berkat gemblengan Aba Abdurrahman Shihab. It sketches a variety of Indonesia's Arabs—sadah and non-sadah alike— and their contributions to the shape of Indonesian Islam, Islamic cultures and Muslim politics. It also traces the roots of—and depicts the historical dynamics and changes—social relations and interactions between Arabs and local populations. The relations between Arabs and non-Arabs in the country have always been marked with conflict and tensions on the one hand, and peace and cooperation on the other. Some Muslims in the country "have admired" and built a strong relationship with the Arabs and "Indo-Arabs" while others have denounced them as the destroyers of Indonesia's local traditions, civic pluralism, social stability and interreligious tolerance. This article tries to portray this paradox, discuss factors contributing to the damaging image of Arabs in contemporary Indonesia, and explain the rationales behind it.

    1 The Root of Islamic Radicalism Alwi Shihab* It is worth noting that the Muslim world is too large and too diverse to march to the beat of a single drummer. Many people of the West mistakenly assume that the Muslim world is equivalent to the Middle East. The fact that the Muslim world extends from Morocco to Merauke in Indonesia, from Uzbekistan to Cape Town in South Africa. In addition, more Muslims live in China than in Arabian Peninsula, and more Muslims live in Indonesia than those in the entire Arab world combined. Although Indonesia is the home of over 85% Muslims, but it is neither Islamic state, nor secular one. Pancasila, which literally means five principles, is the ideology of the nation and the state. Namely; the belief in the One Supreme God, Humanitarianism, Indonesia national unity, democracy led by the wisdom of deliberations in representative bodies, and social justice for all people. The fact that the term Pancasila is a human invention derived from Sanskrit and not from religious vocabularies, some observers argue that Indonesia is a secular state. Such an observation is, indeed, incorrect. Indonesia is not a secular state in the true meaning of complete separation between state and religion. In other words, Indonesian nation do not separate themselves from religious life and values. Despite a greater presence of Islamic values and symbols in the contemporary Indonesian public and social space, the Indonesian people are far from rigidity of their understanding of Islam. The moderate understanding of Islamic teachings among Indonesians is prevailing. The peaceful manner by which the five major religions, namely Hinduism, Buddhism, Islam, Catholicism, and Protestantism were introduced to Indonesia, has left a long lasting positive influence on the promotion of mutual trust and tolerance among the communities of faith.

More than eighty years ago student and youth of Indonesia gathered and vowed on Indonesia. In spite of eighty years passed and sixty five years after declaration of Independence, people of Indonesia still curious about the Indonesia’s and Indonesian identity. Some people from eastern part of Indonesia still questioning themselves are they Indonesian or not. This nation builds the identity through the history of colonization. The identity comes from the language which is Bahasa. Major religion in some case also comes as identity. Javanese largest population and its culture play the same role. There is also come the modernization and culture from western country. It is also comes with the idea of development. But after so many decades there were so many changes and the identity of Indonesia have to be rebuilt again. Indonesia’s Identity: Past Times The major problem of many developing countries is creating a single identity. Most of developing nations rise from the political scrap of colonization. Many nations come as single country, or in the other side, single nations become many countries. The leftover of colonization then become a political burden of a new government. They created a constitution to assemble them together, but it replaced again and again. They try to rise a majority specification as an identity, but it comes to trouble for the minority. The term ‘native people’ is not really applied for Indonesian, since there are so many Chinese descendants.

Dalam penelitian ini diketengahkan pandangan seorang ahli tafsir al-Qur‟an terkemuka yang diakui secara keilmuan, tokoh tersebut adalah M. Quraish Shihab. Dari latar belakang yang demikian itu, maka dirumuskan dua poin rumusan masalah dalam penelitian ini, yaitu: (1) bagaimana pandangan M. Quraish Shihab tentang gender berdasarkan tinjauan dalam bidang pendidikan, (2) bagaimana relevansinya terhadap tujuan pendidikan di Indonesia saat ini. Penelitian ini ditulis dengan model penelitian kualitatif, dengan cara melakukan penelusuran atas buku-buku yang ditulis oleh M. Quraish Shihab, terutama buku-buku yang berkaitan atau memuat tema gender di dalamnya baik secara khusus atau sebahagiannya. Dengan kata lain, jenis penelitian ini adalah “library research”. Data diolah dengan melakukan klasifikasi data, dengan menyusun data dalam beberapa kategori menurut kriteria yang timbul secara logis dari masalah yang akan dipecahkan.
