INTRODUCTION BY SENATOR JOHN F. KERRY, CHAIRMAN (111TH CONGRESS), U.S. SENATE COMMITTEE ON FOREIGN RELATIONS 1 The 111th Congress was an active and productive period for the Committee on Foreign Relations. The committee and its sub- committees held hearings on critical foreign policy priorities, such as Iraq, Afghanistan and Pakistan, legislation, treaties, and nomi- nations, briefings from members of the Executive Branch and non- governmental experts, and meetings with heads of state and senior officials of foreign governments. The committee’s work included de- velopment of significant legislation, and Senate approval of seven treaties and 207 nominations. Legislation The committee’s legislative efforts addressed the range of diverse and complex issues falling under its jurisdiction, including national security and counterterrorism, energy and the environment, human rights, trafficking in persons, global women’s issues, foreign aid re- form, international development, global poverty relief, and various regional and country-specific matters. For example, the committee undertook efforts to modernize the State Department and civilian capacity in support of national secu- rity priorities. The committee reported favorably S. 2971, the For- eign Relations Act for Fiscal Years 2010 and 2011, which author- izes funding, programs and policies for the State Department and related agencies, including important increases to our diplomatic corps, provides vital funds and resources to international organiza- tions, addresses critical pay equity issues for Foreign Service offi- cers, and enhances U.S. public diplomacy and consular efforts.

For example, Chairman Kerry and Ranking Member Lugar introduced, and the committee favorably reported, S. 1524, the Foreign Assistance Re- vitalization and Accountability Act of 2009, which authorizes a pol- icy framework for rebuilding strategic and policy capacity, increas- ing accountability and transparency, and modernizing human re- sources at U.S. foreign assistance agencies. The committee also considered and favorably reported S. 705, the Overseas Private In- vestment Corporation Reauthorization Act of 2009, which reauthor- izes OPIC and strengthens the agency’s development mandate to ensure its activities are consistent with U.S. foreign policy objec- tives; S. 954, the World Bank International Development Associa- tion Replenishment Act of 2009, which authorizes 3-year contribu- tion of $3.7 billion for the fifteenth replenishment of the World Bank’s International Development Association, which funds pro- grams and activities for the poorest countries in the world; and S. 955, the African Development Fund Replenishment Act of 2009, which authorizes 3-year contribution of $486 million for the elev- enth replenishment of the African Development Fund, which funds programs and activities for low-income African countries. With respect to energy and the environment, the committee con- sidered and favorably reported S. 345, the Tropical Forest and Coral Conservation Act of 2009, which reauthorizes legislation to protect tropical forests and coral reefs by forgiving debts owed the U.S. by developing countries in exchange for the forest and coral reef preservation. In addition, recognizing that global climate change and energy security are two of the greatest challenges fac- ing the United States today, the committee began its work in the 111th Congress with a hearing entitled ‘‘Addressing Global Climate Change: The Road to Copenhagen’’ with Vice President Al Gore as the committee’s first witness. In addition to this hearing, the com- mittee held hearings on similar topics, including China as an emerging economy and large greenhouse gas emissions emitter; how a green stimulus complements a global economic stimulus; the national security challenges posed by climate change; and the role for U.S. leadership in international negotiations. The Chairman also participated at the 15th Conference of the Parties to the United Nations Framework Convention on Climate Change in Co- penhagen, Denmark and introduced legislation to support this glob- al agreement, the International Climate Change Investment Act of 2009 (S.2835). The committee continued to focus on human rights, trafficking in persons, and global women’s issues. For example, on December 14, 2010, the committee favorably reported the International Violence Against Women Act (S. 2982), which directs the Secretary of State to develop a comprehensive, five-year international strategy to pre- vent and respond to violence against women and girls, mandates the appointment of high level individuals in both the State Depart- ment and U.S. Agency for International Development to be respon- sible for the issue, and provides a strong programmatic component to respond to violence against women in humanitarian relief, peacekeeping, conflict, and post-conflict settings. In addition, on May 13, 2009, the committee favorably reported a concurrent reso- lution (S. Con. Res. 19) urging the Government of Afghanistan to

On October 26, 2010, the committee favorably reported the Inter- national Protecting Girls by Preventing Child Marriage Act (S. 987), which authorizes assistance to prevent the incidence of child marriage in developing countries and directs the President to es- tablish a multi-year strategy to prevent child marriage and pro- mote the empowerment of girls at risk of child marriage. Further, the committee favorably reported the Child Protection Compact Act (S. 3184), which authorizes the Secretary of State, acting through the Office to Monitor and Combat Trafficking in Persons of the De- partment of State, to enter into agreements, or Compacts, with se- lected eligible countries on strategies to end the trafficking, exploi- tation, and enslavement of children; the Foreign Prison Conditions Improvement Act (S. 3798), which sets forth minimum standards for the elimination of inhumane conditions in foreign prisons and other detention facilities, authorizes assistance for the purposes of helping to eliminate such conditions, and mandates an annual re- port describing the conditions in prisons and other detention facili- ties in countries receiving United States assistance; and the Tor- ture Victims Relief Reauthorization Act (S. 2839), which amends the Torture Victims Relief Act of 1998 to authorize federal funding for domestic and foreign specialized treatment centers for torture survivors. Finally, on December 21, 2010, the committee favorably reported a concurrent resolution recognizing the U.S. national in- terest in preventing and mitigating acts of genocide and other mass atrocities against civilians (S. Con. Res. 71). The committee also developed and passed legislation to strength- en U.S. public diplomacy and promote freedom of the press in for- eign countries. For example, on December 18, 2009, the committee favorably reported the Daniel Pearl Freedom of the Press Act (S. 1739), which amends the Foreign Assistance Act of 1961 to include in the Annual Country Reports on Human Rights Practices infor- mation about freedom of the press in foreign countries. The com- mittee discharged the House complement bill (H.R. 3714) by unani- mous consent, which was signed into law on May 17, 2010 (P.L. 111-166). On June 29, 2010, the committee favorably reported the Peace Corps Improvement and Expansion Act (S. 1382), which re- quires the Director of the Peace Corps to develop a strategic plan based on an assessment of how best to strengthen Peace Corps management capabilities and program effectiveness, expand oppor- tunities for Peace Corps volunteers, and increase the size of the Peace Corps. The committee also favorably reported a bill to pro- vide additional and permanent funding for Radio Free Asia (S. 3104), which became law on July 13, 2010 (P.L. 111-202); a resolu- tion expressing the sense of the Senate regarding the importance of public diplomacy (S. Res. 49), which calls on the Secretary of State to reexamine the public diplomacy platform strategy of the United States with a goal of reestablishing publicly accessible American Centers; and a resolution recognizing the 60th Anniver- sary of the Fulbright Program in Thailand and encouraging the President to expand interaction with the Kingdom of Thailand to foster cooperation in the areas of education and cultural exchange throughout all of Thailand (S. Res. 469).

For example, with respect to South Central Asia, the committee developed a landmark piece of legislation enti- tled the Enhanced Partnership with Pakistan Act of 2009, cospon- sored by Senators Kerry and Lugar, which was passed by the full Congress in September 2009 as S. 1707 (the ‘‘Kerry-Lugar-Berman Act’’) and enacted into law on October 15, 2009 (P.L. 111-73). This Act aimed to transform the relationship between the United States and Pakistan from a short-term focus based largely on military aid to long-term cooperation grounded in a broader and deeper stra- tegic outreach to the Pakistani people. The level of authorized eco- nomic assistance was tripled to $1.5 billion per year for five years, for a total authorization of $7.5 billion. This assistance is intended to help the Pakistani people engage in development projects such as building roads, clinics, and schools, and rebuilding the infra- structure destroyed by natural disasters such as the devastating floods of 2010. The Act built upon S. 3263, which was reported fa- vorably by the committee during the 110th Congress. The committee also favorably reported the Pakistani-American Enterprise Fund Act (S. 3665) on November 19, 2010. This bill seeks to strengthen the private sector in Pakistan by leveraging ex- isting funds approved under the Enhanced Partnership with Paki- stan Act to provide direct financial capital and technical assistance to commercially viable small and medium-sized businesses in Paki- stan. The Act authorizes the President of the United States to ap- point a Board of Directors, comprised of four private citizens of the United States and three private citizens of Pakistan, to oversee the Fund. In an effort to create a two-way professional exchange pro- gram between the United States and Muslim-majority countries to promote career development and cross-cultural understanding for young to mid-career professionals, on December 22, 2010 the com- mittee reported favorably the International Professional Exchange Act (S. 3688), which authorizes the Secretary of State to establish a three-year pilot program to help build professional capacity with- in local communities through a reciprocal exchange of fellows, in- cluding representatives from the public sector, such as teachers, urban planners, public health workers, and public administrators, and civil society. With regard to the Middle East, the committee considered resolu- tions concerning political and human rights developments, includ- ing in Egypt, Libya, Yemen, Iran and Iraq. For example, the com- mittee discharged a resolution expressing the sense of the Senate on religious minorities in Iraq (S. Res. 322), which, inter alia, calls on the U.S. Government and the United Nations Assistance Mis- sion for Iraq to urge the Government of Iraq to enhance security at places of worship in Iraq and implement provisions of the Con- stitution of Iraq that protect rights to freedom of thought and reli- gion; S. Res. 71, a resolution condemning the Government of Iran for its state-sponsored persecution of the Baha’i minority in Iran and its continued violation of the International Covenants on Human Rights; and S. Res 253, expressing the sense of the Senate that the Government of Libya should apologize for the welcome home ceremony held to celebrate the release of a convicted Lockerbie bomber.

Res. 400, a reso- lution urging the implementation of a comprehensive strategy to address instability in Yemen, and discharged S. J. Res. 18, a joint resolution relating to the approval of the proposed agreement for nuclear cooperation between the United States and the United Arab Emirates. With respect to Latin America and the Caribbean, the committee considered and reported favorably S. 3087, a bill to support revital- ization and reform of the Organization of American States; S. 2961, a bill to provide debt relief to Haiti; and S. Res. 90, a resolution expressing the sense of the Senate regarding the Fifth Summit of the Americas, held in Port of Spain, Trinidad and Tobago, April 17, 18, and 19, 2009. Concerning Africa, the committee remained very involved in Sudan, which held a pivotal referendum on independence for the South in January 2011. Chairman Kerry traveled to the region 4 times, and the committee held two hearings and a roundtable dis- cussion to examine developments between Northern and Southern Sudan and in Darfur as well as two hearings at the sub-committee level. The committee reported out S. Res. 404, which expressed support for full implementation of the Comprehensive Peace Agree- ment and other efforts to promote security and stability in Sudan. The committee also reported favorably S. 1067, the Lord’s Resist- ance Army Disarmament and Northern Uganda Recovery Act of 2009, which became law on May 24, 2010 (P.L. 111-172). The Lord’s Resistance Army (LRA) has terrorized Northern Uganda and more recently neighboring countries for years, causing massive dis- placement and human suffering, and, since 2001, the Secretary of State has included the LRA on the ‘‘Terrorist Exclusion List.’’ The Act seeks to support stabilization and lasting peace in northern Uganda and areas affected by the LRA through development of a regional strategy to support multilateral efforts to protect civilians, eliminate the threat posed by the group, and authorize funds for humanitarian relief and reconstruction, reconciliation, and transi- tional justice. The committee also considered a host of matters re- lating to ongoing events in Africa. For example, the committee sought to strengthen prospects for democratic reform in Zimbabwe by hosting a coffee with Prime Minister Morgan Tsvangirai, issuing a committee print on developments in that country, and reporting out S. 3297, the Zimbabwe Transition to Democracy and Economic Recovery Act of 2010. Finally, regarding Europe, the committee recognized the contin- ued value of U.S. leadership in the consolidation of peace and sta- bility in the Balkans with various legislative initiatives. For exam- ple, in S. Res 182 the committee expressed its concern for the vio- lent turn the Albanian election had taken and urged the new NATO member to maintain the highest standards in its electoral administration. In S. Res. 483, the committee encouraged the EU to welcome Serbia’s application for membership and welcomed Bel- grade’s determination to embrace a future as part of European in- stitutions. In P. L. 111-177, the committee acted successfully to close loopholes and afford protection to U.S. officials serving in the Office of the High Representative in Bosnia and the International Civilian Office in Kosovo from predatory lawsuits for actions under- taken during their service.

Nine treaties were favorably reported by the committee during the 111th Congress, and the Senate provided to ratification to all but two. Among the treaties approved by the Senate were international agreements concerning nuclear nonproliferation, defense trade cooperation, avoidance of double- taxation, and international recovery of child support and family maintenance. These included the Treaty with Russia on Measures for Further Reduction and Limitation of Strategic Offensive Arms (‘‘New START’’); the Treaty with the United Kingdom Concerning Defense Trade Cooperation; the Treaty with Australia concerning Defense Trade Cooperation; protocols amending tax conventions with France and New Zealand, a Tax Convention with Malta, and the Hague Convention on International Recovery of Child Support and Family Maintenance. The committee devoted extensive attention and effort to consider- ation of the New START Treaty. The treaty, which has a term of ten years that may be extended by mutual consent for one five-year period, will limit each country to 1,550 deployed strategic war- heads, 700 deployed delivery vehicles, and 800 deployed and non- deployed launchers of intercontinental ballistic missiles (ICBMs), launchers of submarine-launched ballistic missiles (SLBMs), and heavy bombers. The treaty also extends and modifies a previous verification regime that includes on-site inspections, notifications, a comprehensive and continuing exchange of data regarding strategic offensive arms, and provisions for the use of national technical means of verification. Committee action on the treaty began during its negotiation, with more than five closed briefings on the progress of negotiations from relevant executive branch officials. Between April 29 and July 15, 2010, the committee conducted another 12 unclassified and classified hearings on the treaty. The committee met in September 2010 to consider the treaty, at which time it voted to recommend favorably to the full Senate the treaty and an accompanying resolution of advice and consent to ratification of the treaty. The committee’s Chairman and Ranking Member managed the Senate’s consideration of the treaty in December 2010, at which time the Senate, by a vote of 71 to 26, provided its advice and con- sent to ratification subject to 14 conditions, 3 understandings, and 12 declarations. The committee also devoted significant attention to Defense Trade Cooperation treaty matters. In addition to considering the Defense Trade cooperation treaties with the United Kingdom and Australia, the committee also considered and reported favorably an amended version of the Defense Trade Cooperation Treaties Imple- mentation Act of 2010., S. 3581, which provided a statutory basis for the President to implement the treaties with the United King- dom and Australia, including ensuring that violations of the trea- ties, their implementing arrangements, or of regulations issued pursuant to them would be subject to the criminal and civil sanc- tions enumerated for certain offenses under the Arms Export Con- trol Act. Provisions of the Act were later incorporated into the Se- curity Cooperation Act of 2010, which was enacted into law on Oc- tober 8 (P.L. 111-266).

The treaty was reported out of committee with one understanding and one

Similarly, the committee examined the Treaty with Rwanda Con- cerning the Encouragement and Reciprocal Protection of Invest- ment, Treaty Doc. 110-23, during the November 10, 2009, hearing. This treaty was reported out of committee with one declaration on December 22, 2010, and placed on the Executive Calendar. The Senate took no action, and the treaty was automatically rereferred under paragraph 2 of Rule XXX of the Standing Rules of the Sen- ate.

2. AMBASSADORS During the 111th Congress, 125 nominations for country Ambas- sadors were referred to the committee. Of these, 113 were con- firmed by the Senate, and 12 were returned to the President. The committee received 4 nominations for Ambassador at Large, 2 nominations for rank of Ambassador at Large, and 28 nominations for rank of Ambassador. One of these nominations was withdrawn, 4 were returned, and 29 were confirmed by the Senate. The com- mittee also received and the Senate confirmed 3 nominations for the personal rank of Career Ambassador.

3. OTHERS The committee received 7 nominations for officials for the United States Agency for International Development, 2 for the Peace Corps, 2 for the Overseas Private Investment Corporation, one for the Trade and Development Agency, one for the Millennium Chal- lenge Corporation, one for the International Broadcasting Bureau of the Broadcasting Board of Governors, and 8 nominations to var- ious international banks (one of which was for the rank of Ambas- sador). The Senate confirmed 21 of these nominations. Nominations for membership on boards and commissions were received as follows: African Development Foundation (3); Broad- casting Board of Governors (9); International Joint Commission, United States and Canada (1); Millennium Challenge Corporation (2); Overseas Private Investment Corporation (8); and the World Health Organization (1). Seventeen of these were confirmed by the Senate.

4. INTERNATIONAL CONFERENCES Fifteen nominations were submitted to serve as United States representatives and alternates to the United Nations General As- sembly. Thirteen representatives and alternates were confirmed by the Senate. E. ACTIVITIES During the 111th Congress, the full committee and its sub- committees held a total of 197 sessions. These included hearings on legislation, treaties and nominations, as well as briefings, discus- sions, and consultations with officials of the executive branch and non-government witnesses on foreign policy matters. Members and staff made individual trips abroad and participated in conferences, further exercising the legislative oversight responsibilities of the committee. On 56 occasions committee members received heads of state and senior officials of foreign governments to discuss matters of mutual interest.
