Consolidation Order 2010

South Lanarkshire Council in exercise of the powers conferred upon them by Section 19 of The Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999, Sections 32 and 35 of the Road Traffic Regulation Act, 1984, as amended, (“the Act”) and Part IV of Schedule 9 to the Act and of all other enabling, hereby make the following order:-

Citation and Commencement

1. This Order may be cited as “The South Lanarkshire Council (Use of Off-Street Parking Places) Consolidation Order 2010” and shall come into operation on the, Twenty First day of June, Two Thousand and Ten.

Interpretation

2 (i) In this Order, except where the context otherwise requires, the following expressions shall have the meanings hereby respectively assigned to them:-

“Council” means South Lanarkshire Council;

“motor car” means a mechanically propelled vehicle constructed or adapted to carry not more than seven passengers exclusive of the driver, or any other vehicle, the weight of which, unladen, does not exceed one ton and a half;

“parking permit” means a parking permit issued by the Council to a person who ordinarily resides in a dwelling house located within a Controlled Parking Zone;

“Controlled Parking Zone” means those areas within which parking bays are situated and whose use is controlled by an Order;

"motor cycle" has the same meaning as is given to the expression in Regulation (3)(2) of the Road Vehicles (Construction and Use) Regulations 1986;

“parking attendant” means a person authorised by or on behalf of, the Council to supervise any parking place;

“parking bay” means a space in a parking place which is provided for the leaving of a vehicle;

“ticket parking meter” means an apparatus of a type approved by the Secretary of State, where applicable, for the purposes of those parking places described in the Schedules to this Order, operated by the method described in Article 8(i)(c) and (d) below, being apparatus designed to indicate the time and date and where appropriate to issue tickets indicating the payment of a charge, the period in respect of which it has been paid, the day and time at which the charge was paid and having a mark which enables the issuing parking ticket meter to be identified;

“parking places” means an area designated as a parking place by this Order;

“season ticket” means a season ticket issued by the Council under the provisions of Article 25 of this Order;

“day” means a period of twenty four hours commencing at 00.00 hours and ending at 24.00 hours and any reference to hours shall be construed as referring to consecutive hours within a day.

“disabled person's badge" has the same meaning as in the Disabled Persons (Badges for Motor Vehicles) (Scotland) Regulations 2002;

"disabled person's vehicle" has the same meaning as in The Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (Scotland) Regulations 2002;

(ii) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment.

Designation of parking places

3. Each area which is described in Schedules 1 to 7 to this Order shall be a parking place for the purposes of this Order.

Layout and marking of parking places and parking bays

4. The limits of each parking place and the limits of every parking bay in that parking places shall be indicated in such a manner as the Council may determine by lines, studs or other indications.

Vehicles which can use parking places

5. Each parking place may be used, subject to the provisions of this Order, for the leaving of motor cars or motor cycles only.

Ticket parking meters to be installed at parking places

6. There shall be a ticket parking meter or meters in the vicinity of every parking place operated by the method described in Article 8(i) (c) and (d) below.

Amount of parking charges at parking places

7. The charges for a vehicle left in a parking place shall be in accordance with the rates specified in Schedule 1 to 7 to this Order, the said rates having regard both to the location of the parking place and the period for which the vehicle is parked. Such charge shall hereinafter be referred to as the “initial charge”. No such charge shall be payable if a valid season ticket is displayed on that vehicle in accordance with the provisions of Article 25 of this Order. Charges apply all day unless specified in the Schedule.

Method of payment of initial charge and requirements as to display of a ticket

8. (i) Methods of Payment

Any of the following methods of payment may be used in the parking places specified in Schedules 1 to 7 to this Order:-

(a) Payment to a parking attendant within or in the vicinity of the parking place, in return for a ticket specifying the charge payable of a sum to the value determined in accordance with the rates specified.

(b) Payment at the time of departure from the parking place, to a parking attendant such charge being determined, having regard to the date and time specified on a ticket issued from a ticket parking meter situated at the entrance to the parking place on arrival of the vehicle, in accordance with the rates specified.

The South Lanarkshire Council (Use of Off-street Parking Places) Consolidation Order 2010 Page 4 of 97 (c) Payment at the time of departure from the parking place by the insertion in a ticket parking meter at the parking place of coins of a denomination detailed on the ticket parking meter, the charge payable being in accordance with the rates specified.

(d) Payment on arrival by insertion in a ticket parking meter at the parking place of coins of a denomination detailed on the ticket parking meter, the charge payable being in accordance with the rates specified.

If, at the time when a vehicle is left in a parking place, operated by any of the methods detailed in (i) (b), (c), or (d) of this Article, there are on the ticket parking meters or other apparatus relating to that parking place, notices placed by any person duly authorised by the Council, indicating the meters or apparatus are out of order, an authorised person may manually issue tickets from the ticket parking meter or manually operate the said apparatus in such a manner as to comply with the charges for the parking place as provided in Schedules 1 to 7 to this Order.

(ii) Method of Display

Where method (d) is used, the ticket shall be displayed on the vehicle facing forwards on the nearside of the glass of the windscreen, behind the glass.

The parking ticket shall be so displayed on the vehicle that the time shown on the front is clearly visible to a person standing beside the vehicle.

Amount of penalty charge at parking places

9. (i) If a vehicle is left in any of the parking places described in Schedules 1 to 7 to this Order for longer than the period authorised in terms of that Schedule, in respect of the value of the ticket purchased, if applicable, an additional amount of sixty pounds (hereinafter referred to as the “penalty charge”) shall be payable.

(ii) (a) If a vehicle (not being a vehicle exempt from payment of the initial charge by virtue of Article 16 hereof) is left in a parking place without the initial charge having been paid, a penalty charge shall become payable.

(b) If a vehicle if left in a parking place detailed in column 1 of Schedule 7 to this Order and does not comply with the restriction detailed in column 2, opposite the said column 1, relative to parking permits, season tickets, minimum or maximum length of stay, as appropriate, a penalty charge shall become payable.

The South Lanarkshire Council (Use of Off-street Parking Places) Consolidation Order 2010 Page 5 of 97 (iii) In the case of a vehicle, in respect of which a penalty charge has been incurred, it shall be the duty of the parking attendant to fix a penalty charge notice to the vehicle; or give such a notice to the person appearing to him to be in charge of the vehicle as specified in the Road Traffic Act 1991, Section 66.

Prohibition of meter feeding and transfer of tickets.

10. Where the method of payment detailed in Article 8(i)(d), of this Order, is used:-

(a) A ticket shall be valid for a single stay only and no other ticket issued by a parking ticket meter shall be displayed on a vehicle thereafter i.e. meter feeding is prohibited.

(b) A ticket can only be used on one vehicle and cannot be transferred to another, whether that vehicle remains in or leaves the parking place.

Any vehicle, displaying a ticket contrary to the conditions described in (a) or (b) above, shall be subject to the payment of a penalty charge.

Maximum length of stay

11. If a vehicle is left in any of the parking places described in Schedules 1 to 7 to this Order for longer than the period authorised in terms of any item contained within that Schedule, a penalty charge shall be incurred. Nothing in this article shall apply to any disabled person’s vehicle which displays a valid disabled person’s badge.

Period for which vehicle may be left after penalty charge incurred

12. (i) The period for which a vehicle shall be left in a parking place after a penalty charge has been incurred, shall not exceed twenty four hours.

(ii) If a vehicle is left in a parking place for more than twenty four hours after a penalty charge has been incurred, a further penalty charge shall be incurred for that parking place.

Restriction on the removal of notices

13. Where a penalty charge notice has been attached to a vehicle in accordance with the provisions of Article 9(iii) of this Order, no person, not being the driver of the vehicle or a person duly authorised by the Council, shall remove the notice from the vehicle unless authorised to do so by the driver.

Indications by parking meter tickets

14. (i) Payment of the initial charge for a vehicle left in a parking place shall be indicated by the issue, from a ticket parking meter in the parking place in which the vehicle was left, of a numbered ticket having a mark which enables the issuing ticket parking meter to be identified, indicating what charge has been paid and the day and time of payment, and by the display of the ticket on the vehicle in a manner specified in Article 8(ii) of this Order;

(ii) The expiry of the period for which the initial charge has been paid shall be indicated when the time shown on the clock on the said ticket parking meter is later, having regard to the time shown on the ticket, than the expiry of the period authorised for parking in terms of the initial charge incurred, in respect of the ticket, as provided for in Schedules 5 and 6 to this Order.

Indication by ticket parking meters and tickets as evidence.

15. (i) If at any time, while a vehicle is left in a parking place, no parking ticket is displayed on that vehicle in accordance with the provisions of paragraph (ii) of Article 8, it shall be presumed, unless the contrary is proved, that the initial charge has not been duly paid;

(ii) If, at any time, while the vehicle is left in a parking place, the clock on the ticket parking meter relating to the parking place in which the vehicle is left and the parking ticket indicates that the period for which the initial charge has been paid has expired in the circumstances referred to in paragraph (ii) of the preceding Article, it shall be presumed, unless the contrary is proved, that the initial charge has been duly paid and that the period for which payment was made by the initial charge has already expired.

Exemptions from charges

16. (i) Any disabled person’s vehicle left in a parking place, which displays a disabled person’s badge issued by a local authority, in exercise of its powers under Section 21 (1) of the Chronically Sick and Disabled Persons Act 1970 shall be exempt from any such charge for those car parks detailed in Schedules 2, 4, 5 and 6;

(ii) Without prejudice to the generality of paragraph (i) of this Article, a vehicle to which paragraph (i) applies shall stand in the parking place in accordance with the provisions of Article 18 of this Order.

The South Lanarkshire Council (Use of Off-street Parking Places) Consolidation Order 2010 Page 7 of 97 (iii) No charge shall be payable in respect of the leaving of a motor-cycle or pedal cycle in any part of a parking place at which the Council have placed a sign or signs indicating that part of the parking place is for the use of the said cycles.

Penalty for parking in a disabled space

17. If a vehicle, other than a vehicle which displays a valid disabled person’s badge issued by a local authority in exercise of it’s powers under Section 21 (1) of the Chronically Sick and Disabled Persons Act 1970,

(a) is left in a parking bay, within any of the parking places detailed in Schedules 1, 3, 5, 6, and 7 of this Order and signed in accordance with diagram 661A of The Traffic Signs Regulations and General Directions 2002; or

(b) is left in any parking place detailed in Schedules 2 and 4 of this Order, shall be subject to a penalty charge.

Manner of standing in parking places

18. Every vehicle left in a parking place shall so stand such that every part of the vehicle is within the limits of a parking bay; provided that, in the case of any parking place where the length of any vehicle precludes it from standing wholly within the limits of a parking bay, that vehicle shall so stand in the parking bay that as much of the vehicle as possible is within the limits of the parking bay and does not constitute a danger or obstruction to other users of the parking place. Any vehicle parking in contravention of the condition described in this Article shall be subject to a penalty charge.

Alteration of position of vehicle in parking places

19. Where any vehicle is standing in a parking place in contravention of the provisions of the last preceding Article, a parking attendant or other person authorised by the Council may alter or cause to be altered the position of the vehicle in order that its position shall comply with those provisions.

Removal of vehicles from parking places

20. Where a parking attendant or other person authorised by the Council is of the opinion that any of the provisions contained in Articles 5, 8(i), 12 or 22(iii) have been contravened or not complied with in respect of a vehicle left in a parking place, they may remove or cause to be removed the vehicle from the parking place, and where it is so removed shall provide for the safe custody of the vehicle.

21. A parking attendant or other person authorised by the Council may, in the case of an emergency, move or cause to be moved to any place he thinks fit, vehicles left in a parking place.

Power to suspend parking places

22. (i) Any person duly authorised by the Council may suspend the use of a parking place or any part thereof whenever he considers such suspension reasonably necessary;

(ii) On any suspension of a parking bay in a parking place in accordance with the provisions of the preceding paragraph, any person duly authorised by the Council, may use suitable means to indicate that the use of the parking bay or parking place is suspended.

(iii) No person shall cause or permit any vehicle to wait in any part of a parking place which has been suspended in accordance with the provisions of this Article, except with the permission of a person authorised by the Council.

Restrictions of use of parking places

23. (i) No person shall use a parking place in connection with the sale of any article to any person in or near the parking place or in connection with the selling or offering for sale of his skills in handicraft of his services in any other capacity other than with the written consent of the Council; without prejudice to any planning or health regulations which may require to be met.

(ii) No person shall wash, clean or overhaul any vehicle or execute any mechanical or other alterations or repairs to the vehicle while it is in a parking place, except such repairs as may be essential for the purpose of enabling the vehicle to be towed or driven away from the parking place.

Power to dispose of abandoned vehicles

24. (i) The Council may, in respect of a vehicle which has been removed from a parking place in pursuance of Article 20 of this Order, if it appears to them to have been abandoned, sell or otherwise dispose of the vehicle after having made reasonable enquiry to ascertain the name and address of the owner of the vehicle.

The South Lanarkshire Council (Use of Off-street Parking Places) Consolidation Order 2010 Page 9 of 97 (ii) The Council shall be deemed not to have made reasonable enquiry to ascertain the name and address of the owner of any vehicle to which this Article applies unless they have taken, in relation to that vehicle, such steps as or may be prescribed by Section 11 to 19 inclusive of the Removal and Disposal of Vehicle Regulations 1968 or any amending Regulations (except that for any reference in the Regulations or any sub-section of Section 21 or 22 of the Civic Amenities Act 1967).

Season Tickets

25. (i) The Council may with regards to parking places described in Schedules 1, 3, 5, 6 and 7 to this Order issue season tickets and the charges of such and the period for which such tickets are applicable shall be as prescribed in Schedule 8 to this Order.

(iii) The driver of any vehicle parked in a parking place described in Schedule 1, 3, 5, 6 and 7 to this order, and to whom a season ticket or permit has been issued, shall attach or display the said season ticket or permit on the near side of the vehicle in such a position as to ensure that the front of the season ticket or permit is clearly visible to any person standing at the front or nearside of the vehicle;

(iv) Such season ticket or permit shall not guarantee the holder the use of a parking bay.

Responsibility of driver

26. The person who was driving the vehicle at the time when it was left in the parking place shall be responsible for complying with the provisions of Article 5, 8, 9(i) and (ii), 10, 11, 14 and 17 of this Order and unless otherwise proved, the owner of the vehicle shall be deemed to be the driver of that vehicle.

Revocation of existing orders

27. The Orders, or parts thereof, specified in Schedule 9 to this Order are hereby revoked.
