Pine Tar and the Infield Fly Rule: An Umpire’s Perspective on the Hart-Dworkin Jurisprudential Debate William D. Blake, Ph.D.1 Assistant Professor Department of Political Science Indiana University, Indianapolis (IUPUI) [email protected] Abstract: What is law? Though on its face this question seems simple, it remains an incredibly controversial one to legal theorists. One prominent jurisprudential debate of late occurred between H.L.A. Hart, a positivist, and Ronald Dworkin, an interpretivist. While positivism, at its core, holds the law is a set of authoritative commands, Dworkin rejects this reflexive approach and instructs judges to incorporate and advance communal norms and morals in their decisions. In baseball, umpires utilize both legal theories, depending on the type of rule they are asked to interpret or enforce. I conclude that, like umpires, most citizens are not dogmatic about either legal theory. 1 I wish to thank Justice George Nicholson of the California Court of Appeal for encouraging my participation at this Symposium. A lucky newspaper photographer snapped a shot, which demonstrated Klem’s mistake. The next day, reporters demanded to know how the batter could be out in light of the incontrovertible photographic evidence. -
Florida Fandom 2011: 35Th Anniversary Issue
Welcome to the first print issue of Florida Fandom since 1996 or a close to print issue. This will be published as a PDF e-zine, I will print at least one print issue for old time sake. I’m writing this in word 2007 and most of the graphic were done on The Print Shop or The Print Shop 3.0. A big jump from the first issue done on an electric typewriter, cut up and pasted on to graft paper that wouldn’t reproduce when printed. Over the years we have used many formats in creating FF. Most of the issues were done on typewriter, although we did try several early issues using a Commodore 64 computer and dot matrix printer. They were not very easy to read and the computer was used mostly for making graphics using The Print Shop for C-64 and The Print Shop Companion for the C-64. After we went to ink jet we did to a couple of issues – using MS Publisher – they even had some scanned pictures in them. In just 15 years computers have changed. With my laser printer I could do the entire print run from home and the scans no longer look like, well scans. But instead of printing it out we can print it as a PDF which can be read with several different e-readers or with your computer using a PDF reader. (It’s more fun with an e-reader as the pages will act more like a zines page.) After I finish writing this page I will be going to Facebook to plead with people to send something to be in this issue. -

His historic rookie season has been fun to watch not only for Yankees fans but baseball fans in general. He's a team leader that puts his teammates first, he performs when the team needs him most, and he's almost single-handedly making Yankees baseball exciting again. Sound familiar? Of course it does. Let's take a trip down memory lane to 1996. The Yankees were 17 years removed from their last World Series win. A very long time for a franchise like the Yankees. They broke their playoff drought in 1995 but still lacked key pieces to put them back on top. They found that key piece in a 22-year-old Derek Jeter. You may have heard of him. 1 / 3 Jeter's rookie season in 1996 was something Yankee fans had been waiting for for years. He hit .314 with ten homers, 104 runs scored, and 78 RBI, helping him receive all 28 first-place votes in the AL Rookie of the Year voting. He batted leadoff throughout the 1996 postseason. I'm sure everyone remembers the infamous "Jeffrey Maier home run" in Game 1 of the ALCS. Jeter would go on to bat .361 throughout the postseason and helped the Yankees defeat the Braves and win their first World Series Title since 1978. Jeter brought the fun back to that Yankees team. -
