This undersigned is directed to refer to this Ministry's D.O. letter of even number dated 09.08.2019 (copy enclosed) wherein it was informed that the National Medical Commission Act, 2019 which received the assent of the President on 8" August, 2019, provides for constitution of Medical Advisory Council consisting of representatives of StatedUTs, State Medical Council and others for which ~inis@ome Affairs to nominate representatives of Union Territory in accordance with the provision of section I I of the Act.

2. Govemment of Jammu & Kashmir vide letter No. ME-GAZ-126/2019 dated 9th October, 2019 nominated Dr. Manoj Kumar Dhar, Vice Chancellor, Jammu Health University, in terms of clause (c) of sub-section 2 of Section 11, as the representative of the State in Medical Advisory

3. However, Jammu and Kashmir Reorganization Act, 2019. which will come into effect on I" October, 2019, provides for reconstitution of the state of Jaminu and Kashmir into two union ''R\~T/emitories namely iammu and Kashmir and Ladakh. '/ 4. In view of above, it is requested to reaffirm the nomination of Vice Chancellor to represent Union Territory of Jammu & Kashmir and also to arrange for the nom~nationof representative of Union Territo~yof Ladakh at the earliest to enable this Ministry proceed further.

The ~gtionalMedical Commission Bill, 2019 has been passed by the Parliament and has become an Act after receiving the consent of President of India.

2. A copy of the National Medical Comrnission Act, 2019 is available on the Ministry's website i.e. httvs://mohfw.gov.in. The Act provides for the constitution of a Medical Advisory Council (MAC). The relevant clause 11(1) regarding composition of the MAC in the NMC Act, 2019 reads as under:

"(c) one member to represent each State, who is the Vice-Chancellor of a health University in that State, to be nominated by that State Government;

(d) one member to represent each Union territory, who is the Vice-Chancellor of a health University in that Union territory, to be nominated by the Ministry of Home Affairs in the Government of India;

Provided that if there is no health University in any State or Union ' territory, the vice-Chancellor of a University within that State or Union territory having the largest number of medical colleges affiliated to it shall be nominated by the State Government or by the Ministry of Home Affairs in the Government of India:

Provided further that if there is no University in any llnion territory, the ini is try of Home Affairs shill gominate a member who possesses such medical qualification and experience as may be prescribed."

The qualification and' experience prescribed for members in NMC is that they shall be persons of outstanding ability, proven administrative capacity and integrity, possessing a postgraduate degree in any discipline of medical sciences from any University and having experience, of not less than fifteen years in such field, out of which at least seven years shall be as a leader in the area of medical education, public health, community medicine or health research.

4. Thus, for the Union Territories where, there is no University, the representative may be nominated in accordance with the said criteria in anticipation of specific rules to be framed in this regard so that the constitution of MAC is not delayed and all UTs are also represented. I would therefore request you to kindly arrange to nominate the representatives of the Union territories under section 1 l(l)(d) of the Act and furnish the details to this Ministry for necessary action. 1 would be gratefd if the matter receives personal attention and henominations are sent by 30" August 2019 positively.
