IN THE MATTER OF STEVENS Resolution No. 13-2020 COUNTY PARCEL #8007826, Tax # 1 IN SECTION 8, TWP. 29 N., R. 42, INTENT TO OFFER TAX TITLE EWM PROPERTY FOR SALE PURSUANT TO RCW 36.35. lS0(l)(b) and (c)
WHEREAS, Steven s County property ID #8007826, Tax # 1 in Section 8, Township 29 North, Range 42, EWM ("Property") was originally created by a grant "not over 12 & a half feet wide, starting from the Southwest corner of the Northwest "forty" of the Southwest quarter of Section 8, Township 29 North, Range 42, E.W.M." by Warranty Deed from Albert Furze & E. Janie Furze, his wife, to P.C. Johnson, recorded May 3, 1921 under Instrument No. 65151 (Exhibit A); and a grant "not over 12 & a half feet wide, starting from the Northwest corner of the Southwest Quarter of the Southwest Quarter of Section 8, Township 39, Range 42, E.W.M., running East eighty rods" by Warranty Deed from Richard Morcom & Clara Morcom, his wife, to P .C. Johnson, recorded May 3, 1921 under Instrument No. 65152 (Exhibit B); and
WHEREAS, title to the North 12 ½ feet of the 25 foot strip was merged in P.C. Johnson by Warranty Deed recorded June 29, 1928 in Book 83 of Deeds, Page 172, when he was granted the NW ¼ of the SW ¼ of Section 8 (Exhibit C); and
WHEREAS, title to the South 12 ½ feet of the 25 foot strip was merged in P.C. Johnson by Warranty Deed recorded July 24, 1929 in Book 85 of Deeds, Page 74, when he was granted the SW¼ of the SW¼ of Section 8 (Exhibit D); and
WHEREAS, P.C. Johnson and Selma Johnson, his wife, granted the entire SW ¼ of Section 8 to P.H. Peterson, husband of Bertha L. Peterson, by Warranty Deed recorded July 13, 1929 in Book 84 of Deeds, Page 558 (Exhibit E); and
WHEREAS, the 25' parcel was severed from the W ½ of the SW ¼ by in 1936 by Treasurer's Deed recorded in Book 97 of Deeds, Page 255 (Exhibit F); and
WHEREEAS, Stevens County acquired title to the remainder of the W ½ of the SW¼ in 1938 by Treasurer's Deed recorded in Book 104 of Deeds, Page 1 through 14 (Exhibit G), once again merging title to the parcels; and
WHEREAS, in 1948 Stevens County sold to Oliver A. Peterson the W ½ of the SW¼ of Section 8, EXCEPT the 25 foot parcel, by Treasurer's Deed recorded March 8, 1948 in Book 118, Page 479 (Exhibit H). Said Deed created the orphaned 25 foot parcel. This was clearly in error and the 25 foot parcel should have been included; and
WHEREAS, upon review of the Property's characteristics the county determined that it is not practical to build on the Property due to its physical characteristics and legal restrictions on construction activities on the Property (RCW 36.35.150); and WHEREAS, the county has consulted counsel through the prosecutor's office; and
WHEREAS, pursuant to RCW 36.35.150(l)(b) and (c) the Board of County Commissioners has the authority to dispose of tax foreclosed property by private negotiation, without a call for bids when the county legislative authority determines that it is not practical to build on the property due to the physical characteristics of the property; and when the property has an assessed value of less than five hundred dollars and the property is sold to an adjoining landowner; AND
WHEREAS, the county believe a direct sale to the land possessor as purchaser and settling all rights and claims including all back taxes would be in the best interest of the county,
NOW, THEREFORE, IT IS HEREBY RESOLVED that Stevens County sell the North ½ of said 25 foot strip (N ½ Tax #1) to Forested Habitats, LLC, and the South ½ of said 25 foot strip (S ½ Tax #1) to Kenneth R. Hall and Diana L. Hall, husband and wife, by a direct sale to these land owners for a total amount of $500. In the sale documents there shall be language resolving all rights and claims that may exist against the County.
BE IT FURTHER RESOLVED that Buyer shall within 90 days of purchasing the property complete a boundary line adjustment or consolidation combining all of this parcel into the neighboring property/ properties thereby eliminating this parcel. The boundary line adjustment or consolidation shall be recorded prior to the recording of the deed that transfers the property.

Specifically, the property is 25 feet in width. The property is zoned Rural-5 and Stevens County Code Title 3; Section 3.04.010 requires a structural setback of 10 feet from side property lines.
