I understand your deep concerns in relation to this issue. However, it is important that the background to this application is taken into account. In this respect, it is especially important to note that the Commission is under the obligation to assess all filed applications for protection of traditional terms as regards their admissibility and validity within the meaning of the applicable Union legislation. As regards Croatia’s application for the protection of the traditional term 'Prošek', the Commission has assessed its compliance with the admissibility and validity requirements and will now proceed with its publication in the Official Journal of the European Union. All interested parties will have two months from the date of publication to submit a substantiated objection. The Commission will then analyse any objection received and will take a final decision considering all elements at its disposal. As far as whole or partial homonymy with an already protected geographical indication might be raised as an objection ground, it should be noted that homonymy alone is not a sufficient factor for the rejection of an application. As you point out, geographical indications are protected to a high standard in the EU, including against evocation and misuse. The protection system specifically takes account of the rights of all parties, including those who use varietal names, prior good-faith trade marks and, in this case, proposed traditional terms, that can conflict with GIs. The rules ensure fairness and equity among all parties and stress the need to avoid labelling that misleads consumers. The content of the agreement is currently classified, owing to the commercially sensitive information within it. However, this protection of AstraZeneca’s legitimate interests should also be balanced by the need for transparency in relation to citizens and their representatives. It is unusual for even MEPs not to have access to the vital information set out in the trade agreement signed by the Commission, especially considering that on 22 September 2020 the ENVI and ITRE committees had invited the pharmaceutical companies involved in the search for a vaccine to attend a hearing, but AstraZeneca had declined the invitation. In the light of the above, can the Commission answer the following questions: 1. Does it not consider it appropriate to share the content of the agreement with Parliament, while taking due precautions? 2. In its view, could such a situation not set a significant precedent when it comes to balancing the interests of the commercial protection of a company with the need for transparency and citizens’ right to health? More particularly, in 2015 and 2019, the Commission outlaid EUR 73 3751 and EUR 87 436 respectively2 to the Institute under the Horizon 2020 Programme for promoting research funding. It would appear that the Institute is also receiving an additional EUR 88 433,753 for a virus epidemic monitoring project launched on 1 January 2020. Under the Horizon 2020 Programme, the Commission monitors project participants for up to two years after they receive funding4. This is designed to avert risk and prevent fraud. In order to avoid problems of social, as well as financial, unrest, and to revive consumption and investment, leading figures and political forces have argued that indirect taxation could be frozen for a certain period of time and that this could be done also by introducing the so-called zero VAT rate. This approach seems to be in line with the recent speech by President von der Leyen on the suspension of the Stability Pact and state aid rules, later summarised by the press with the motto ‘whatever it takes’. In its press release of 13 March, the Commission subsequently explained the President's thinking in more detail and confirmed the concept of ‘suspension’, without, however, openly declaring its non-opposition to a possible national cancellation or reduction of VAT.
