MacKinnont INTRODUCTION After successful agitation, Canadian women secured in Canada's new constitution, the Charter of Rights and Freedoms, sex equality guar- antees with more direct potential to produce actual sex equality than ex- ists in the constitutional language of any other democracy. These equality provisions, which came into effect in April 1985, prohibit dis- crimination on the basis of sex through law' and also expressly guarantee all Charter rights equally to "male and female persons."2 The first deci- sion under the broad equality rights provision, Law Society of British Co- lumbia v. Andrews,3 begins to deliver upon the promise of the Charter's language. It rejects the usual "similarly situated" approach, under which equality means treating likes alike and unlikes unalike, and embraces in- stead an approach the purpose of which is to rectify the systematic disad- vantage of historically subordinated groups. A defect in the 1982 compact which created the Charter was its lack of approval by Quebec. A long-term conflict exists in Canadian society * Copyright @ 1990 by Catharine A. Section 15 provides that: (1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability. (2) Subsection (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability. Id. 2. CAN. CONST. pt. 1, § 28. Section 28 provides that: "Notwithstanding anything in this Charter, the rights and freedoms referred to in it are guaranteed equally to male and female per- sons." Francophones are in the minority except in Quebec; Anglophones domi- nate throughout Canada but are numerically a minority in Quebec. The cultural dignity and particularity of the French is not sufficiently respected by much of Anglo Canada, producing a wariness of the Char- ter as a possible device for imposing Anglo-Canadian values, culture, legal traditions, and language. At the same time, the nonacceptance of the Charter by Quebec leaves for many a legal and political gap, a sense in which the nation is not whole. Eleven men-ten Premiers and the Prime Minister-met in 1987 to attempt to devise terms for confederation acceptable to all. The Meech Lake Accord was the result. It provides for the recognition of Quebec as "a distinct society" within Canada4 and also reiterates the recognition of multicultural and aboriginal rights, thought in jeopardy without reaffirmation.' Women, including some in Quebec, reacted immediately to the lack of recognition of sex equality rights in the Accord. At the same time, any criticism of the Meech Lake Accord has often been taken as, and has often been, anti-French. As the debate has progressed, concerns with the Accord that nonetheless respect the French "distinct society" have been virtually drowned out by often vicious (and sometimes subtle but equally invidious) anti-French sentiment. It has become almost impossible to be heard as anything other than anti-Quebec when expressing reservations about the Accord. 4. The Meech Lake Accord is in the form of amendments to the Constitution Act, 1867 (Brit- ish North America Act, 1867, 30-31 Vict., ch. 3). The Accord includes a new section 2 of the Constitution Act as follows: (1) The Constitution of Canada shall be interpreted in a manner consistent with (a) the recognition that the existence of French-speaking Canadians, centred in Que- bec but also present elsewhere in Canada, and English-speaking Canadians, concentrated outside Quebec but also present in Quebec, constitutes a fundamental characteristic of Canada, and (b) the recognition that Quebec constitutes within Canada a distinct society. (2) The role of the Parliament of Canada and the provincial legislatures to preserve the fundamental characteristic of Canada referred to in paragraph (1)(a) is affirmed. (3) The role of the legislature and Government of Quebec to preserve and promote the distinct identity of Quebec referred to in paragraph (1)(b) is affirmed. (4) Nothing in this section derogates from the powers, rights or privileges of Parlia- ment or the Government of Canada, or of the legislatures or governments of the provinces, including any powers, rights or privileges relating to language. Id. 5. Section 16 of the Meech Lake Accord states: "Nothing in section 2 of the Constitution Act, 1867 affects section 25 or 27 of the Canadian Charter of Rights and Freedoms, section 35 of the Constitution Act, 1982 or class 24 of section 91 of the Constitution Act, 1867." Two refused to ratify and one talked of rescinding, under rules that seem to require unanimity. The opposition of one Manitoba legislator, a Na- tive man, prevented its ratification conclusively. Failure of ratification leaves further negotiation of terms including possible companion resolu- tions, continued limbo, or the partial or complete separation of Quebec as among alternatives being actively discussed.6 The testimony below was given at the request of the Ontario Legis- lature at hearings on the Accord. When the Ontario Legislature ap- proved Meech Lake, women sang songs of protest in the gallery.7 Perhaps these reflections on the place of women in Canadian nation- building will apply in some ways to Eastern Europe, particularly in light of the internal ethnic tensions there. The argument is that national unifi- cation not be accomplished at women's expense. 8 TESTIMONY BEFORE THE LEGISLATIVE ASSEMBLY OF ONTARIO MR. CHAIRMAN: Good afternoon, ladies and gentlemen. We can begin our afternoon session. I would like to call upon our first witness for this afternoon, Professor Catharine MacKinnon, a constitutional law- yer and political scientist. She has taught at Yale, Harvard, Stanford, and most recently at the University of Chicago and Osgoode Hall. I understand that next fall you are going to be teaching constitu- tional law and sexual equality at Osgoode Hall. DR. MACKiNNON: Yes, I will. MR. CHAIRMAN: I am sure this whole topic is going to provide years of teaching material if one just looks at the testimony before our committee. I want to thank you very much for coming here this after- noon. I will let you go ahead with your presentation, following which we will go ahead with questions. DR. As an American constitutional lawyer and a political scientist work- ing internationally in the area of sex equality, I am going to offer for your consideration a comparative perspective on the potential impact of the Meech Lake Accord on women's equality. From my observations of the debate to date on the Accord, I have noticed that when women ask questions about the impact the Accord may have on their legal rights, they are reassured that the issues are not legal, but political. When they then ask questions about the impact of the Accord on their political status, they are reassured that the issues are legal and will be dealt with by the courts.

By its very creation, NAFTA opened up the possibility for scholars of European integration to add a comparative dimension to their research. Starting with the question whether the differences between North America and Europe are so great as to preclude their meaningful comparison (as implied by the expression, “apples and oranges”), this paper argues that there are enough commonalities between the two continental systems for the comparison of their differences to be analytically and intellectually fruitful. It goes on to propose many areas which Euroscholars might consider for future comparative study and offers as an example a case study by Jean Cushen of the differential impacts of the EU and NAFTA on Ireland’s and Canada’s labour markets. It would be difficult for me to list all the colleagues – scholars and students – who have helped me develop these ideas over the past few years.

  • Charlottetown Accord
    Charlottetown Accord This article was written by a law student for the general public. Following the failure of the Meech Lake Accord in 1990, a series of deliberations took place on the future of Confederation both within and outside of Quebec. In fact, there were four bodies empanelled to engage in these discussions – a parliamentary and an extra-parliamentary body within Quebec and a parliamentary and an extra-parliamentary body nationally. Specifically, within Quebec, there were the Allaire Committee (see Allaire Report) and the Belanger- Campeau Committee; and nationally, there were the Beaudoin- Edwards Committee and the Spicer Commission. These studies led to various reports including the federal documentShaping Canada’s Future Together. Subsequently, the federal government convened a series of five national conferences to discuss various aspects of this document. This, in turn, led to a federal report entitled A Renewed Canada. All of the foregoing culminated in negotiations among the federal government, the provincial governments (including Quebec in the latter stages of negotiations), the territorial governments and representatives from the Assembly of First Nations, the Native Council of Canada, the Inuit Tapirisat of Canada and the Métis National Council. These negotiations resulted in what is now referred to as the ‘Charlottetown Accord’. The Accord dealt with a number of constitutional issues. For example, regarding the division of legislative powers (see division of powers), it provided for exclusive provincial jurisdiction over forestry, mining and some other areas. It also required the federal government to conduct negotiations with the provinces in order to “harmonize” policy in such areas as telecommunications, labour development and training, regional development and immigration.

    Disaster Education Building Research Institute (BRI) National Graduate Institute for Policy Studies (GRIPS) 2007 Disaster Education Building Research Institute (BRI) National Graduate Institute for Policy Studies (GRIPS) 2007 Foreword Education and public awareness are the cornerstone of approaches aimed at reducing vulnerabilities to natural hazards. The Hyogo Framework for Action 2005-2015: Building the Resilience of Nations and Communities to Disasters, adopted at the World Conference on Disaster Reduction, highlights knowledge and education as one of the five main priorities of action. Attention should be accorded, and support given to efforts targeting schoolchildren and youth with the aim of making people more aware of the threat of hazards and of the need and possibility to become better prepared before disasters strike. As we progress into the implementation of both the Hyogo Framework and the United Nations Decade of Education for Sustainable Development (DESD, 2005-2014), the pride of place that the international community, national academic institutions and educational establishments concerned with disaster risk reduction are giving to education is based on evidence that education contributes towards the knowledge and skills essential for disaster preparedness. The project which was carried out on Disaster Education by the Building Research Institute (BRI) and the National Graduate Institute for Policy Studies (GRIPS) in Japan is a timely and pioneering initiative. It proved to be a valuable effort to take stock of the status of education and disaster risk reduction worldwide and to review information collected, thus laying the foundations for refining future orientations in the integration of disaster preparedness into educational programmes. As the lead agency for the DESD and a primary partner of the United Nations Secretariat of the International Strategy for Disaster Reduction in the 2006-2007 World Campaign "Disaster risk reduction begins at school”, UNESCO welcomes the initiative of BRI and GRIPS.

This thesis aims to look at the reasons for the Quebec separatist movement occurring in the past as well as its steady level of support. Ultimately, there is a split within the recent literature in Quebec, regarding those who believe that independence is off the political agenda and those who think it is back on the agenda. This thesis looks at public opinion polls, and electoral returns, to find that the independence movement is ultimately off the political agenda as of the April 2014 election, but continues to be supported in Quebec public opinion. I will first be analyzing the history of Quebec as well as the theories other social scientists have put forward regarding separatist and nationalist movements in general. Next I will be analyzing the history of Quebec in order to understand why the Quebec separatist movement came about. I will then look at election data from 1995-2012 in order to identify the level of electoral support for separatism as indicated by the vote for the Parti Quebecois (PQ).

Introduction As a teacher, in my instructions to students as they prepare their term papers, I often remind them that they should never abdicate their judgment to the authority of one single source. In the worst of circum- stances, it is much better to articulate one’s own ideas and convictions than to surrender to one single book or article. In the same spirit, I would urge readers not to rely solely on my pronouncements about the meaning of federalism in Québec. In truth, the title of this essay should include a question mark, and its content will illustrate, I hope, the richness and diversity of current Québec thinking on the subject. There are many ways as well to approach the topic at hand. The path I shall choose will reflect my academic identity: I am a political theorist and an intellectual historian, keenly interested about the relationship between philosophy and constitutional law in Canada, hidden in a political science department. As a reader of Gadamer and a former student of Charles Taylor, I shall start with some interpretive or herme- neutical precautions. Beyond the undeniable relevance of current re- flections about the theory of federalism in its most general aspects, the real question of this essay deals with the contemporary meaning of Canadian federalism in Québec.

    Copyright 2013, The Concord Review, Inc., all rights reserved THE ROOTS OF FRENCH CANADIAN NATIONALISM AND THE QUEBEC SEPARATIST MOVEMENT Iris Robbins-Larrivee Abstract Since Canada’s colonial era, relations between its Fran- cophones and its Anglophones have often been fraught with high tension. This tension has for the most part arisen from French discontent with what some deem a history of religious, social, and economic subjugation by the English Canadian majority. At the time of Confederation (1867), the French and the English were of almost-equal population; however, due to English dominance within the political and economic spheres, many settlers were as- similated into the English culture. Over time, the Francophones became isolated in the province of Quebec, creating a densely French mass in the midst of a burgeoning English society—this led to a Francophone passion for a distinct identity and unrelent- ing resistance to English assimilation. The path to separatism was a direct and intuitive one; it allowed French Canadians to assert their cultural identities and divergences from the ways of the Eng- lish majority. A deeper split between French and English values was visible before the country’s industrialization: agriculture, Ca- Iris Robbins-Larrivee is a Senior at the King George Secondary School in Vancouver, British Columbia, where she wrote this as an independent study for Mr. Bruce Russell in the 2012/2013 academic year. 2 Iris Robbins-Larrivee tholicism, and larger families were marked differences in French communities, which emphasized tradition and antimaterialism. Behiels Department of History University of Ottawa Abstract.-Canada‘s 1992 Charlottetown Constitutional Accord represented a dramatic attempt to transform the Canadian federation which is based on formal symmetry, albeit with a limited recognition of some asymmetry, into an asymmetrical federal constitution recognizing Canada‘s three nations, French, British, and Aboriginal. Canadians were called up to embrace multinational federalism, one comprising both stateless and state-based nations exercising self-governance in a multilayered, highly asymmetrical federal system. This paper explores why a majority of Canadians, for a wide variety of very complex reasons, opted in the first-ever constitutional referendum in October 1992 to retain their existing federal system. This paper argues that the rejection of a formalized asymmetrical federation based on the theory of multinational federalism, while contributing to the severe political crisis that fueled the 1995 referendum on Quebec secession, marked the moment when Canadians finally became a fully sovereign people.     THE POLITICS OF ROMANCE IN "THE HISTORY OF EMILY MONTAGUE" Robert Merrett ΤLHE MOST INTERESTING, because most problematic, claim that Mary Jane EdwardIHEs makes in her fine edition of The History of Emily Montague is that Frances Brooke expresses in her novel an "essentially positive view of the potential of the new British colony."1 This claim is problematic for many contextual and textual reasons. In the first place, although on March 22, 1769 Brooke dedicated her book to Guy Garleton, the recently appointed governor of Canada, and spoke glowingly of the country's prospects under his governance, her optimism is rendered questionable by her personal experience of the new province and by the frustration of her political wish to affirm the Conquest of Quebec. While the dedication praises Carleton's "enlightened attention" for bring- ing about a "spirit of loyalty and attachment to our excellent Sovereign" and a "chearful obedience" to British law (1), the text of her epistolary novel, in the course of plotting a retreat from Canada to England, necessarily embodies a much less positive attitude than announced by the dedication. When Mr. Brooke returned to his wife and England in the autumn of 1768, he did so because his petition for a land grant had met with no more success than their joint campaign to establish the Anglican Church in Quebec.2 Like many of their middle-class contemporaries, the Brookes opposed historical, social and politi- cal forces that they understood only partly and could resist hardly at all. Courchene ** I: INTRODUCTION AND OVERVIEW1 The federal spending power (FSP) has returned to centre stage in public policy debates, in large part due to Stephen Harper’s call for “open federalism” replete with a commitment to respect the constitutional division of powers on the one hand and the subsequent Parliamentary proclamation that “the Québécois form a nation within a united Canada” on the other. Watts (1999,1) defines the spending power as “the power of Parliament to make payments to people, institutions or provincial governments for purposes on which Parliament does not necessarily have the power to legislate, for example, in areas of exclusive provincial jurisdiction.” However, for the purposes of this paper the exercise of the federal spending power will be viewed more broadly and will encompass areas like federal regulation that can also affect the division of powers. In any event, the key issue here is that for Prime Minister Harper’s commitment to respect the constitutional division of powers to be credible it follows that the exercise of the federal spending power in selected areas must somehow be circumscribed.
