I. EXECUTIVE SUMMARY

1. This Safeguards Monitoring Report of Road Sector Governance and Maintenance Project (RSGMP) covered the period from July to December 2020. 2. Civil Works. Note: The road length of CW-2 and CW-3 was changed in Dec. 2018 and Mar. 2019 respectively because the certain length of the road is no longer required due to the other projects. 3. Current Progress of Civil Works. Current progress of civil works of each package achieved at the end of December 2020 is 81.6 % (CW-1), 84.1 % (CW-2), 91.4% (CW-3), 83.6 % (CW-4), 90.7 % (CW-5), and 76.7 % (CW-6) respectively. The total progress of the civil works achieved as of the end of December 2020 is 83.4 % versus the plan including the current VOs which is 92.8 %. It means that the current progress of total civil works is slightly behind the schedule after VOs has been made. The details are shown in the paragraph 27. 4. Government Restriction Put in Place to Curb the COVID-19 Outbreak (July-December 2020). On 29 December 2020, the government announced that the country remains at risk of a second wave of COVID-19 and charter flights with countries that are experiencing an out break of COVID-19 are to remain suspended. The total numbers of cases recorded as of the end of December 2020 remain at 41 including 40 people who have been discharged from hospital. The details are shown in the paragraph 30. 5. Contractor’s Action / Measures Taken for Preventing Covid-19: The workplace of the contractors has been conducting strict disease prevention health measures advised by the National Taskforce. All the contractors submitted a health and safety (H&S) plan on 15 May 2020 referring to an updated environmental management plan to ensure the health and safety of workers during the civil works, and the contractors conducted daily monitoring and record the results. As of the end of December 2020, there was no case of COVID-19 who is identified among the Project civil work contractors, and Project provinces (Salavan, Xekong and Attapeu) (refer to https://www.covid19.gov.la/index.php). The details are shown in the paragraph 39 and Appendix II. 6. Involuntary Resettlement Performance Monitoring. The project is category C for involuntary resettlement (IR) as the project will not entail any land acquisition or restriction of access to land resulting in physical or economic displacement of people. Contract variations initiated in  

2019 and 2020, namely NR18B under CW-5, LR6901 under CW-2, LR7615, did not trigger the involuntary resettlement safeguard. The categorization thus remains C for IR. 7. Indigenous People (IP) /Ethnic Groups Performance Monitoring (July-December 2020). During this reporting period (July-December 2020), PMC surveyed the number of workers who worked for civil works and CBM. The data of the workers for civil works were provided by the contractors of 6 packages. The data of the workers for CBM works were provided by OPWT. Based on the survey data during this period ethnic groups of workers employed for both civil works and CBM are Lao Loum and Lao Theung which are major Lao ethnic group. The details are shown in the paragraph 45 and Appendix III. The civil works need a technical skill and the workers are recruited from the first major ethnic group, Lao Loum who have much skill. CBM works are not required high technical skill and could be required from local community where the Lao Thueng live. 8. Employment Generation Monitoring Results - Civil Works (July-December 2020). Majority of the civil works are non-local workers because the civil works need a technical skill and the workers who have such skill could not be recruited from the local community. Female workers could work on simple job. The details are shown in the paragraph 50 and Appendix III. 9. Employment Generation Monitoring Results (Community Based Maintenance: CBM) (July-December 2020). All workers for CBM are local people and the details are shown in the paragraph 52 and Appendix III. Majority of the CBM workers are male because the CBM activity need long distance walking under the hard climate conditions and the female does not want to join in this activity (get from the interview community workers). As the results, the number (%) of female workers is lower than male workers. 10. Socio-Economic Survey of CBM conducted by Maintenance Capacity Development Specialist and Social Development Specialist (December 2020). 11. The socio-economic survey of CBM was conducted by Maintenance Capacity Development Specialist and Social Development Specialist in December 2020. The details are shown in the paragraph 54 and Appendix IV. 12. HIV/AIDS and Human Trafficking Awareness Campaign Program Activity (July- December 2020). During July-December 2020, the contractors of 6 packages conducted HIV/AIDS and Human Trafficking Awareness Campaign Program Activities as shown in Table 2. 13. Social and Environmental Safeguards Activities (July-December 2020) - Environmental Safeguard Workshop & Awareness Campaign. There was no activity during this reporting period (July - December 2020). - Environmental Compliance Certificate (ECC). During July - December 2020, the quarry production activity at (Km 37) LR9001 was approved by DONRE Attapeu on 9 July 2020. - Updated Environmental Management Plan (EMP)/ Contractor’s Environmental Management Plan (CEMP). There was no activity during this reporting period (July - December 2020). - Environmental Monitoring and Training Activities by DONRE. The environmental monitoring and the job training through the actual monitoring that was conducted by Department of Natural Resources and Environment (DONRE), for the relevant local authority such as DPWT, Contractors and Project Management Consultant as shown in Table 3. - Social and Environmental Safeguards Monitoring Results by National Safeguards Specialist of PMC (September 2020). National Safeguards Specialist of PMC conducted the field monitoring during 8-13 September 2020 by observing the sites of the restoration works of CW1, CW3, CW4 and CW5, and Variation Order for CW2, CW4, CW5 and CW6 with interview to the local people along these working sites. 14. Summary of Compliance with EMP Requirement. The contractor performed the works almost satisfactory to minimize the negative environmental/social impacts, so there were no significant issues and no further action was required during this reporting period (July-December 2020) for CW1-NR20, CW2-LR6901, CW3-NR16, CW4-LR7615, CW5-NR 18B and CW6-LR9001. 15. Traffic Accident Record on the Project Road (2018-2020). The traffic accident data during 2018-2020 was collected from the provincial traffic police for the Project National Road (NR20, NR16, and NR 18B) which includes case of accident, people injured, and vehicle damaged. The details are shown in the paragraph 67 and Appendix VII. Traffic accident has not occurred by the Project including civil works since the Project started till end of December 2020. 16. Grievances Redress Mechanism. During this period (July-December 2020), there is no grievance, but requests to the Project are provided by villages’ community through DPWT/OPWT as in the paragraph 69 and Appendix VIII. 17. Key Activities Planned in the Next Reporting Period: i) Social Safeguards - Continue to monitor and evaluate the contractor’s performance on HIV/AIDS and Human Trafficking Awareness Campaigns Program for all 6 packages. - Continue to monitor effectiveness of IEC materials. In this reporting period, IEC materials for HIV/AIDS prevention program, such as posters, leaflet, and brochures were provided at the HIV/AIDS prevention program. - Continue to monitor the gievances redress. ii) Environmental Safeguards - Continue Environmental Monitoring and Training for the Project roads by DONRE Xekong, Attapeu in every 3 months. DONRE Salavan and DOAF Attapeu have completed the environmental monitoring and training program because the rehabilitation works have been completed. - The monitoring of CEMP will be conducted by Environmental Safeguard Specialist (PMC) for all 6 packages in July 2021. iii) Health and Safety Plan for Preventing COVID-19 The contractor shall continue to conduct strict disease prevention health measures advised by the National Taskforce as below: - Gathering / meeting is to be organized within limited numbers of participants and participants must stay at least one-meter apart from each other; - Facilities for hand washing such as soap and water, or hand gel must be provided; - Undergo temperature screening; - Wear face masks if workers are close. - In addition to the above measures, the followings are advised by ADB;

 

- Record keeping of locations workers had visited/lived in immediately before and during construction; - Conduct information and education campaign; - Procedures to be adopted in the event any workers are suspected to have contracted COVID- 19.

  

II. PROJECT OVERVIEW AND GENERAL SAFEGUARD ARRENGEMENTS

A. Project Outline 18. The Government of Lao PDR has requested the Asian Development Bank (ADB) for support in implementing the “Road Sector Governance and Maintenance Project”. This Project supports the Government’s transport sector priorities of increasing the capability of the Departments of Public Works and Transport (DPWTs) to manage road assets that have been transferred to provincial control, as well as providing capacity building within the central level of the Ministry of Public Works and Transport (MPWT). 19. One of the project components is to rehabilitate and maintain the selected national and local roads: 73.5 Km of roads in , 71.7 Km of roads in Xekong Province and 165.9 Km of roads in , as indicated below. This will contribute to improve living standards and socioeconomic development for the local communities. 20. The project also seeks to ensure sustainable road maintenance for the project and to maximize the social benefits of road improvements through a community-based road asset management component. The aim of this component is to build communities’ capacity to (i) set up and manage their own Maintenance Committees, and (ii) improve their skills in routine road maintenance and management. The training and maintenance tools that are provided to the communities are part of the community development support to contribute to generate local employment in the project area.

 

B. Project Implementation Arrangement 21. MPWT is the executing agency (EA) and DOR is the implementing agency (IA) for the Project. DPWT-Attapeu, DPWT-Salavan, and DPWT-Xekong are the implementing units (PIUs). DOR have the overall coordination responsibility and work closely with DPWTs to implement the Project. Following MPWT Departments/ Institutes etc. provide support to the project when needed in their respective areas:

- Public Works and Transport Institute (PWTI) on the social and environmental monitoring; - Department of Transport (DOT) on the axle load and road safety; - Department of Finance (DOF) on the financial management; - Public Works and Transport Training Center (PWTTC) on the capacity building; - Department of Planning and Cooperation (DPC) on the Road Maintenance Funds; and - Department of Legislative Affairs of the MPWT on the documents registration / revised standard. 22. National Steering Committee (NSC) has been established to oversee project implementation and provide policy guidance at the national level. The steering committee is chairing by a vice minister of MPWT and the committee were comprised of vice governors from the provinces of Salavan, Xekong and Attapeu, officials from MPWT, Ministry of Finance (MOF), Ministry of Natural Resources and Environment (MONRE), Ministry of Planning and Investment (MPI) and provincial Departments of Public Works and Transport (DPWTs).

C. Safeguard Implementation Arrangements 23. The Semi-Annual Social and Environmental Safeguards Monitoring Report is developed by PMC during Rehabilitation and Maintenance. 24. Social Safeguards: The Social Safeguards PMC team is responsible for all social safeguards implementation activities. The PIU is a main coordination to communicate with district authorities for social safeguards activities during the Project period. The District Committees are set up for support and joint the social safeguards in conducting Orientation and Community Awareness Campaign program in the target village along the project roads in Salavan, Xekong and Attapeu provinces. The social Safeguards monitoring during the rehabilitation and maintenance work is conducted by PMC team, DPWT, OPWT and District Committees. 25. Environment: The environmental mitigation measures have identified in the part of initial environmental examination (IEE) at the ADB-PPTA-8492 in 2015 and it is incorporate to the environmental management plans (EMP) for the Project have been prepared by PMC. Main objectives of the environmental mitigation measures decides to ensure that the Project does not cause any negative impact to existing Social and environmental in the Project area. 26. Responsibilities: for the implementation of the EMP during detail design, rehabilitation and maintenance period is the Implementing Agency (IA), with overall guidance from the PIU by supporting of PMC team. DONRE of three provinces (Salavan, Xekong, and Attapeu) are responsible for the environmental monitoring. DOAF Attapeu is responsible to conduct the environmental monitoring of the works for NR18B in DongAmphan NBCA to minimize the environmental impacts guiding the contractors during the rehabilitation works; to ensure all works and impacts in NBCA are restricted to the ROW as per the provided detail design drawings; no disposal and clean-up of all construction material, and NBCA management team of DOAF to confirm adequate clean-up prior to site handover. 28. Current progress of civil works of each package achieved at the end of December 2020 is 81.6 % (CW-1), 84.1 % (CW-2), 91.4% (CW-3), 83.6 % (CW-4), 90.7 % (CW-5), and 76.7 % (CW-6) respectively. The total progress of the civil works achieved as of the end of December 2020 is 83.4 % versus the plan including the current VOs which is 92.8 %. It means that the current progress of total civil works is slightly behind the schedule after VOs has been made. 29. Current Works at the end of December 2020 of each Package of road are shown below: CW-1 (NR20, 56 km): i) Continue the PBM Works (patching pothole MAC 112 at Km 15+900, 30+450, 42+300, 44+200, and 51+100, and crack sealing MAC 116 at Km 7+250, 23+450, 43+150 and 44+200, after handing-over the rehabilitation works on 22 November 2019; ii) All works of the restoration works (additional works) have been completed in June 2020; iii) COVID-19 : Some of the contractor’s workers who stay out of the working area (province) left the work site for family care after the Prime Minister’s Order on prevention activity to the COVID-19 pandemic issued on 29 March 2020, which would be adverse effects to the work performance. Total workman force in April was about 30 % of the normal month.
