Agenda Item No.1. Confirmation of minutes of the 162nd meeting of Executive Committee held on 31.1.2011.

It was noted that 162 nd meeting of Executive Committee was held on 31.1.2011. The minutes of the same were circulated to all members of Executive Committee vide letter No. 5-1/2011-EC (162 nd ) dated 10.2.2011 with the request to suggest addition/deletion if any within 15 days.

No comments in respect of the correctness of the minutes were received, therefore, Executive Committee confirmed the minutes.

Agenda Item No.2. Policy decision in respect of the Ayurveda, Unani and Siddha Colleges for the year 2011-12.

It was noted that Government of India was asked to inform the policy for adoption for the year 2011-12 in respect of Ayurveda, Unani and Siddha colleges. The consequent upon a representation of All India Federation of Ayurveda Colleges submitted to HFM and Secretary, AYUSH in respect of the lack of Post-graduate

1163ec teaching staff in almost all specialities as well as of some subjects i.e. Panchkarma, Swasthvritta, Prasuti & Striroga, Kaumarbhrittya and Agadtantra etc. Moreover, there is also a shortage of higher faculty (professor + Reader). In this regard two meetings with HFM and Secretary, AYUSH were convened. As per discussion, the following policy was informed by the CCIM to Government of India.

(iv) In respect of the Colleges established under section 13 A from 2004-05 to 2008-09 be assessed on the basis of 100% teaching staff. In respect of the Colleges established in 2009- 10 be assessed upto 2 nd professional and established in 2010- 11 be assessed upto 1 st Professional.

Excess number of teacher (over and above from the requirement of CCIM) in any Department will not be taken into consideration of as whole in percentage of teaching staff.

2. Post-graduate Course

i. One Professor/Reader and one Lecturer in concerned subject in addition to requirement of UG teacher-student ratio for deciding PG intake capacity in case of Professor be 1:3 in case of Reader 1:2 and in case of Lecturer 1:1. ii. Where there is no UG, only running PG course 1 Professor, 1 Reader and 1 Lecturer will be required. 2. Number of beds of 1. In response of the same, Government of India has informed following policy for adoption for the year 2011-12 Applicable to 13 A & 13 C Colleges of Ayurveda, Unani and Siddha colleges.

1. FOR UNDER GRADUATE COURSE.

B. All Unani colleges are required to be recommended on the basis of provisions as exist in the notified PG regulations for Unani entitled ‘ The Indian Medicine Central Council (Postgraduate Unani Education) Regulations, 2007’. It is reiterated that all the provisions (measurable and non measurable) as contained in the Indian Medicine Central Council (Postgraduate Unani Education) Regulations, 2007 shall be examined by CCIM before sending their recommendation. 2. Number of beds of 1. For Post-graduate Course in Ayurveda and Siddha- teaching hospital for post Minimum 150 beds are required including 50 beds for 10 graduate ASU colleges PG seats in clinical subjects with UG intake capacity of 50 students. However, no. of beds in hospital for PG seats in clinical subjects will be maintained in 1:5 student- bed ratio in addition to beds required for UG seats. 2. For PG courses in Unani- Minimum 75 beds are required including 25 beds for 5 PG seats in clinical subjects with UG intake capacity of 50 students. However, total no. of beds in hospital for PG seats in clinical subjects will be maintained in 1:5 student- bed ratio in addition to beds required for UG seats. 3. Agenda Item No.3. Consideration of Visitation Report of Ayurved colleges.

It was noted that 250 Ayurved Colleges were visited by the visitors of CCIM appointed as per decision of the Executive Committee in its meeting held on 31.1.2011 under Agenda Item No.03 to assess the available facilities of teaching and practical training for conducting UG and PG course as the case may be and to verify the compliance of the shortcomings informed by the Government of India.

After receipt of the visitation reports, President, CCIM had constituted a Screening Committee of following members to screen the visitation report. the meeting of the Screening Committee was held on 12-13&14.5.2011.

Before starting the consideration of the visitation report following decisions were taken:-

i) If required number of teaching staff in accordance to the intake capacity are not available, the decision may be taken by reducing the intake capacity in UG and PG Course as the case may be in accordance to the availability of number of teaching staff. ii) Ayurveda, Unani and Siddha Colleges established under Section 13 A from 2004-05 to 2008-09 be assessed upto 3 rd Professional and colleges established in 2009-10 be assessed upto second professional and colleges established in 2010-11 be assessed for first professional course in respect of requirement of teaching staff.

In view of the above decisions, the visitation reports alongwith the assessment sheet and recommendation of the Screening Committee as well as documents submitted by the college were considered by the Executive Committee and decided as under:-

Agenda Item No.4 Consideration of Visitation Report of Unani colleges.

It was noted that 41 Unani Colleges were visited by the visitors of CCIM appointed as per decision of the Executive Committee in its meeting held on 31.1.2011 under Agenda Item No.03 to assess the available facilities of teaching and practical training for conducting UG/PG course as the case may be and to verify the compliance of the shortcomings informed by the Government of India.

After receipt of the visitation reports, President, CCIM had constituted a Screening Committee of following members to screen the visitation report of Unani colleges. the meeting of the Screening Committee was held on 14-15.5.2011.

At the time of consideration of the visitation report, Executive Committee observed that bed occupancy has been calculated by Screening Committee(Unani) by restricting the bed strength upto 50 by maintaining the student bed ratio as 1:1 in order of letter issued by Government of India dated 18.3.2011 (referred under Agenda Item No.2) instead of actual bed strength informed by the college and duly verified by the visitors.

Moreover, it was also observed that Screening Committee (Unani) has taken into consideration the essentiality of 7 departments in each Unani college instead of 10 departments. Executive Committee was of the opinion that observance of 10 departments in each college should be followed as per letter issued by the Government of India i.e. No.R.11011/08/2009-EP dated 22.12.2009 as well as decision of the Central Council of Indian Medicine under Minimum Standards and Requirements of Unani College & Hospital. Vice-President (Unani) and Dr. Rashidullah Khan, Member, EC objected the same and later on walked out in protest.

After departing of Vice-President (Unani) and Dr. Rashidullah Khan, Member, EC, Executive Committee decided that minimum bed strength of the hospital should be observed 50. The college having less than 50 beds should not be recommended for granting permission for the year 2011-12 as per letter of Government of India dated 18.3.2011 (referred under Agenda Item No.2). Moreover, The bed occupancy should be calculated on the basis of actual bed strength informed by the college in its visitation proforma and duly verified by the visitors. It was also decided that observance of 10 departments in each college should be followed as per letter issued by the Government of India i.e. No.R.11011/08/2009-EP dated 22.12.2009 as well as decision of the Central Council of Indian Medicine under Minimum Standards and Requirements of Unani College & Hospital.

It was noted that Mr. KN Subudhi was engaged to look after the legal work of the Council. Initially he was engaged for three months, thereafter for six months which was expired on 31.3.2011. The President, CCIM after satisfying with the services of Mr. KN Subudhi agreed to extend the tenure of Mr. KN Subudhi as Legal Consultant for next 11 months i.e. upto 28 th February, 2012.

Executive Committee ratified the same.

Agenda Item No.10 List of Visitors

It was noted that as per decision of the Executive Committee in its meeting held on 30 th January, 2011 under Agenda Item No.3. The members of Executive Committee of respective systems under the Chairmanship of Vice-Presidents (Ayurveda, Unani & Siddha) prepared the list of the visitors. After the approval of the President, CCIM, all colleges have been visited. On denial of the teachers, the alternate arrangement was made by the office with the directions of the President, CCIM time to time.

Agenda Item No. 11. Amendment in IMCC (PG Ayurveda Education) Regulations, 2005 - reg. , It was noted that Government of India vide letter No R. 11011/5/2010-EP dated 18.3.2011 in response of the CCIM’s letter No. 26-74/2010-Common Matters dated 10.03.2011 has conveyed the approval of competent authority on proposed Amendment in IMCC (PG Ayurveda Education) Regulations, 2005 as follows:-

Agenda item No.12 To enhance the power of Secretary, CCIM.

It was noted that President, CCIM again desiring to authorize the Registrar to sanction expenditure of miscellaneous and contingent nature upto an amount of Rs.25,000/- instead of Rs.2,000/- on the following grounds.

However, in this connection provision in General Regulation reads under:-

“81. The Registrar shall have power to sanction expenditure of miscellaneous and contingent nature upto an amount not exceeding Rs.2000/- in each case and expenditure in excess of this amount shall require the sanction of the President. 82. A permanent advance of Rs.2000/- shall be made to the Registrar.”

Grounds:

1. To obtain the sanction of the President, CCIM on the contingent expenditure more than Rs.2000/- in respect of essential as well as regular expenses like post, telegram, telephone, speed-post, internet etc. takes time because

President is residing out of Delhi. To ensure the timely payment of these bills, either the file has to be sent to the residence of the President, CCIM i.e. Jaipur through messenger or President, CCIM may have to come to the office frequently. It also involve the regular expenditure, therefore, to avoid such type of recurrence expenditure as well as penalty on account of delay payment, it will be in the interest of the Office to enhance the sanction of Registrar from Rs.2000/- to 25000/- for smooth functioning of the Office of CCIM. 2. As sanction of Rs. 2,000/- for the Registrar was sanction by Government of India in 1996. Now due to escalation Rs. 2,000/- has become equivalent to approximate Rs. 25,000/-.

Executive Committee agreed the same and decided to send the proposal to Government of India for sanction.

Agenda Item No.13 Reporting of Action taken by Government of India – regarding.

i) To regularize the admission of Rishikul Ayurved Medical College, Hardwar.

Government of India vide letter No.R.17011/193/2009-EP dated 10.2.2011 has regularized the admission of Rishikul Ayurved Medical College, Haridwar admitted for the session 2008-09.

ii) Withdrawal of letter to transfer the students from Shekhawati Ayurved Medical College, Pilani.

In pursuance of decision of Hon’ble High Court of Rajasthan, Jaipur/Jodhpur Government of India vide letter No.R.12011/0802008-EP dated 14.2.2011 has withdrew the letter regarding transfer of the admitted students to other permitted colleges of the State of Shekhawati Ayurved Medical College, Pilani.

iii) Gujarati Ayurved College, Gwalior

Government of India vide letter No.R.12011/47/2006-EP dated 6.4.2011 in pursuance of the Order of Hon’ble High of Madhya Pradesh Bench at Gwalior has withdrew the para 01 of their previous letter dated 5.1.2011 in respect of transfer of students.

iv) Admissions made by Bapuji Ayurved Medical College, Shimoga for the year 2008-09.

Government of India, Department of AYUSH, New Delhi informed vide letter No.R.17011/50/2009-EP dated 14.7.2010 has regularized the admission made by

Bapuji Ayurved Medical College, Shimoga for the session 2008-09 vide letter No. R.17011/50/2009-EP dated 4.2.2011.

v) Reject the scheme of Amjadia Educational and Welfare Trust, Ahmednagar Bara Chikia East Champaran.

Government of India, Department of AYUSH vide letter No. R.12012/01/2010-EP dated 4.2.2010 has rejected the scheme of Amjadia Educational and Welfare Trust, Ahmednagar Bara Chikia East Champaran to start new Unani college vide letter No.R.12011/01/2010-EP dated 4.2.2011.

vi) Reject the scheme of Warsi Welfare and Education ORB’s Ashmhl, Sambhal Moradabad.

Government of India, Department of AYUSH vide letter No. R.12012/03/2010-EP dated 3.2.2011 has rejected the scheme of Warsi Welfare and Education ORB’s Ashmhl, Sambhal, Moradabad to start new Ayurved college.

vii) Reject the scheme of Prabhav Hem Kamdhanu Giri Vihar Trust’s Ayurved College, Vaghadhera.

Government of India, Department of AYUSH informed vide letter No. R.12011/15/2010-EP dated 4.2.2011 has rejected the scheme of Prabhav Hem Kamdhanu Giri Vihar Trust’s Ayurved College, Vaghadhera.

viii) Application of Shubhdeep Ayurved Medical College, Indore.

Government of India, Department of AYUSH, New Delhi vide R.14011/26/2010-EP dated 1.2.2011 has returned the application of Shubhdeep Ayurved Medical College, Indore for starting PG course in (i) Kayachikitsa (ii) Samhita & Siddhant (iii) Rasashastra (iv) Rachna Sharir with 05 seats in each subject.

ix) Vagdevi Ayurved Medical College Bollikunta WARANGAL

Government of India vide letter No.R.12011/23/2005-EP dated 1.2.2011 has not permitted for the year 2010-11.

x) To regularize the admission of Ayurved & Unani Tibbia College, Delhi

Government of India vide letter No.R.17011/17/2009-EP dated 9.3.2011 has regularized the admission of 40 students made by Ayurveda & Unani Tibbia College, Delhi in BUMS Course for the session 2008-09

Government of India, Department of AYUSH vide letter No. R.13011/13/2010-EP dated 29.4.2011 did not agree to issue the LOI for proposed courses.

In pursuance of decision of Hon’ble High Court of Maharashtra, Bench at Nagpur under Writ Petition No.4918/2010 Government of India vide letter No.R.12011/10/2007-EP dated 09.5.2011 has withdrew the letter regarding transfer of the admitted students to other permitted colleges of the State.

Government of India vide letter No.R.14011/28/2009-EP dated 12.5.2011 has granted the permission to Muniyal Institute of Ayurveda Medical Sciences, Manipal for conducting PG Course as under:-

Agenda Item No.14 Remuneration to the visitors to visit Ayurveda, Unani & Siddha Colleges.

It was noted that as per decision of the Executive Committee in its meeting held on 31.1.2011 the visitation of Ayurveda, Unani and Siddha Colleges is being conducted by the teachers of Government Ayurved, Unani and Siddha Colleges considering as Expert (fulfilling the criteria of qualification and experience as per concerned Regulations). The teachers of Government Ayurveda, Unani and Siddha colleges while visiting the office to submit the visitation report have quarry in respect of remuneration to be paid to the visitors for visitation.

In this regard it was noted that as Executive Committee in its meeting held on 17- 18 th May, 2010 decided to pay the remuneration of Rs.2000/- to the members for the visitation purpose and it was decided to obtain the sanction of Government of India as required under Section 12 (d) of IMCC Act, 1970. The Government of India has been requested to convey the sanction vide letter No.8-4/2007-Act dated 16.6.2010 and subsequent reminder of even number dated 18.1.2011.

It was further noted that Government of India while granting the sanction vide letter No.V.12015/1/2008-Ay.Desk dated 19.7.2010 of remuneration to the members of the CCIM or outside experts @ Rs.1,500/- for full day and Rs. 750/- for half day alongwith the room rent (i.e.Rs.1500/- per day) and taxi charges limiting the amount (actual with ceiling of Rs.600/- per day). The CCIM is also paying the remuneration as per above rate to the teachers of Ayurveda, Unani & Siddha Colleges while being invited as Expert in CCIM.

In view of the above, President, CCIM decided that visitors be treated as outside expert, therefore, it was decided to pay Rs.1500/- per day for two days (not for journey period) as visitation of Ayurveda, Unani & Siddha colleges have been proposed for two days to the visitors (teachers/Expert) who visited (Ayurveda, Unani & Siddha colleges) for the year 2011-12.

Executive Committee ratified the same. Agenda Item No.15 Ratification of the Action taken by the President, CCIM

1. DY Patil Ayurved Medical College, Navi Mumbai

It was noted that as per decision of the Executive Committee in its meeting held on 24.11.2010 the recommendations for issuing the letter of Intent in following subject for starting PG Course were sent to the Government of India. The Government of India has issued the Letter of Intent vide letter No.R.14011/32/2010-EP dated 21 st January, 2011 as under:-

It was also asked to the college to submit the compliance of shortcomings mentioned in under reference letter. The CCIM was asked to verify the compliance and furnish the recommendation to Government of India for issuing the Letter of Permission. As college was proposed for visitation, therefore, it was considered that recommendation for issuing the LOP may be made to the Government of India on the basis of latest visitation report.

There was two or three calls from the Department of AYUSH asking to furnish the recommendations on the pending proposals under Section 13 A lying with the CCIM.

After assessment of the visitation report, it was recommended to the Government of India for issuing LOP as per LOI issued by the Government of India.

Executive committee ratified the same.

2. MAM Ayurved College, Hadapsar

It was noted that as per decision of the Executive Committee in its meeting held on 24.11.2010 the recommendations for increasing intake capacity in following subjects from 03 to 06 were sent to the Government of India as per previous visitation report there were only 200 beds. The Government of India gave an opportunity of hearing to the college. The college at the time of hearing submitted a CD of hospital in favour of verification of the 250 beds in the hospital. After examination of the CD it was observed that there were 250 beds. However, as visitation for the year 2011-12 was already been conducted, therefore, it was decided that as per latest visitation report the bed strength may be taken into

36 163ec consideration. On the basis of the latest visitation report, it was observed that college is possessing 225 beded hospital. Moreover, Government of India had also pointed out that State Government and concerned University has been issued NOC and consent respectively for 02 seats in Rasashastra.

There was two or three calls from the Department of AYUSH asking to furnish the recommendations on the pending proposals under Section 13 A lying with the CCIM.

In view of the above, as per instructions of President, CCIM it has been informed that CCIM has made the following recommendations on the basis of availability of teaching staff in the department.

LOP may be recommended as follows to increase PG in

Kriya Sharir 3-6 Rachna Sharir 3-6 Rasashastra 3-6 Stri & Prasuti 3-6 Kayachikitsa 3-6 Shalya 3-6

Executive committee ratified the same.

3. Shri Bhanwar Lal Dugar Ayurved College, Sardarshar, Rajasthan

It was noted that college was visited on 18-19.3.2010 for the year 2010-11. After assessment of the teaching and practical training and observing the bed occupancy 34.13% against the 40%, the college was not recommended to Government of India for granting the permission for the session 2010-11. However, after hearing Government of India visited the college to verify the facts submitted by the college at the time of hearing. However, after assessment of bed occupancy from March, 2010 to 29 th September, 2010 observed the bed occupancy more than 40%. Therefore, Government of India granted the permission for the session 2010-11. Considering the lack of bed occupancy on the basis of date from 1.1.2009 to 31.12.2009, the proposal of the college was not considered by CCIM for increasing intake capacity from 40 to 50. But Government of India asked the comments of the CCIM by stating that standards for 40 and 50 seats are same while Government of India has permitted the college for the session 2010-11 considering the bed occupancy more than 40% after the visitation.

There was two or three calls from the Department of AYUSH asking to furnish the recommendations on the pending proposals under Section 13 A lying with the CCIM.

However, President, CCIM as per latest assessment agreed to send the recommendation to Government of India for increasing intake capacity from 40 to 50.

Executive committee ratified the same.

Addl. Agenda item No.1. Enhancement of consolidated salary of Ayurveda, Unani & Siddha Experts

It was noted that a representation of Ayurveda, Unani and Siddha Experts working in the Council to enhance their consolidated salary by Rs.10,000/- per month has been received by stating that they are working all types of technical work including assessment of visitation report, duplicity of teachers, fake experience and other technical work of respective systems.

Executive Committee agreed to enhance consolidated salary from Rs.30,000/- to Rs.40,000/- engaged for first six month and Rs.35,000/- to Rs.45,000/- who have completed six months in the Council. Further, it was decided that Experts should be appointed at least on consolidated salary of Rs.35,000/- initially in the Council.

Addl. Agenda item No.2. Changes of the clarification in respect of nomenclature of the subject of Ayurveda.

It was noted that due to changes of the nomenclature of PG Degree/subject time to time reads as under holder of PG degree are facing the difficulty to get the service.

Addl. Agenda item No.3. Letter received from Dr. D Ramanathan, Member, EC.

Dr. D Ramanathan, Member, EC at the time of discussion submitted a letter reads as under the following contents

“The Government order (issued on 21.2.2011) permits the Parambarya Vaidyas (Traditional Practitioners) of Malabar region in Kerala to practice Ayurveda. They do not have any qualifications, so this is illegal and against the IMCC Act, 1970. Hence, CCIM had approached the Kerala High Court through a Contempt Petition. After notice, the case is now posted for final hearing on 08.6.2011.

Since the matter is very serious and has potential to affect the standing of the CCIM in the eyes of common people, and also since this can have disastrous consequences for public health in Kerala, it is necessary that CCIM takes this issue very seriously and defend the case vigorously.

Therefore, it was proposed that CCIM may engage a Senior Advocate to defend the interests of CCIM in the Kerala High Court on 08.6.2011. the fees etc. of the Senior Advocate is likely to be about Rs.60,000/- for the hearing which may kindly be sanctioned.”

Executive Committee agreed to appoint the Senior Advocate to defend the case in the High Court of Kerala.

Addl. Agenda item No.4. Visitation report of Dhanwantri Ayurved College at Koydam, Distt. Kheda, Gujarat - regarding

It was noted that Dhanwantri Ayurved College at Koydam, Distt. Kheda, Gujarat has been visited on 3 rd & 4 th May, 2011 in compliance of order dated 28.10.2010 of Hon’ble High Court of Gujrat at Ahmedabad under Writ Petition No.14227/2010 to assess the available facilities of teaching and practical training as well as compliance of shortcomings informed by Government of India while not granting the permission and withdrawing the LOI issued earlier.

Executive Committee after going through the Visitation Report, it was decided not to recommend to Government of India for issuing LOP.

As all Visitation reports of Ayurveda and Unani could not be considered, therefore, it was decided to adjourned the meeting for 26 th May, 2011.

Dr. Jayaprakash Narayan, Vice-President (Ayurved) could not attend the meeting.

At the outset of the meeting, Vice-President (Unani) raised the issue regarding not to follow the letter of Government of India dated 18.3.2011 by Executive Committee in word and spirit while considering the visitation report of Unani colleges and taking the decision.

Further, he stated that the assessment made by Executive Committee in respect of bed occupancy on the basis of existing number of beds is not in accordance to the instructions of Government of India issued vide letter dated 18.3.2011. Hence, Unani Members Prof. Syed Khaleefathullah, Vice-President (Unani), Dr. Khalid Siddiqui, Dr. Rashidullah Khan submitted their note of dissent on the procedure of the assessment in respect of bed strength and calculation of bed occupancy on existing bed strength. They stressed for their previous stand taken in the previous meeting i.e. 16-17.5.2011.

Further Prof. Syed Khaleefathullah, Vice-President (Unani) placed a letter No.Z.28015/15/2011-EP-IM-2 dated 19.5.2011 of Department of AYUSH, New Delhi. The content of letter reads as under:-

“it may be noted that the Department’s letter dated 22.12.2009 was to communicate decisions taken by the Central Government to incorporate in the draft Regulations of the Central Council of Indian medicine on Minimum Standard Requirements for Ayurveda, Siddha and Unani colleges and attached hospitals, whereas, the Department’s letter dated 18.3.2011 is for Minimum Standards Norms for conditional permission to ASU colleges for the academic session 2011-12. Hence, there is no question of mention of continuation of previous letter dated 22.12.2009 in the recent communication dated 18.3.2011.”

Vice-President (Unani) also pointed out that assessment of teaching staff in respect of Ayurveda & Siddha colleges has been made on the basis of the intake capacity

50, 60, 80 and 100 as per Minimum Standards & Requirements of Ayurveda & Siddha Colleges & Hospital laid down by CCIM instead of 50, 75 and 100 as was stipulated by Government of India as per draft CCIM norms, therefore, the same may be adopted in the Ayurveda & Siddha also.

Executive Committee noted the same.

Further it was brought to the notice of the Executive Committee that due to over sight of bed occupancy of Government Siddha Medical College, Pallayamkottai was recommended to Government of India for granting permission for the session 2011- 12, therefore, Executive Committee reviewed the recommendations and decided to recommend to Government of India for not granting the permission for the said college for the session 2011-12.

Meanwhile, it was observed that AMO/MO have been deputed by State Government in Ayurveda Colleges to fulfill the required number of teaching staff against Lecturer. Executive Committee decided that AMO/MO possessing the PG qualification in concerned subject attaining the age of 40 years at the time of deputation against the post of Lecturer be treated as eligible teacher in respect of Ayurved colleges

For Unani Colleges deputed after 12.5.2010 against the post of Lecturer provided that possessing PG AMO/MO in concerned subject and attaining the age of 40 years at the time of deputation be taken into consideration as eligible teacher. The similar consideration shall be applicable for Medical Officer/AMO deputed prior to 12.5.2010 against the post of Lecturer possessing UG qualification and at the time of deputation attaining the age upto 40 years may be taken into consideration as eligible teacher for the assessment of teaching staff.

It was also decided that all cases considered in previous meeting and to be considered today should be reviewed and latest assessment should be sent to Government of India accordingly.

In view of the decision taken earlier as well as decision taken in respect of MO/AMO, the visitation reports of remaining colleges of Unani alongwith the assessment sheet and recommendation of the Screening Committee held on 24-25.5.2011 as well as documents submitted by the college were considered by the Executive decided as under:-

Addl. Agenda item No.6. Representation of Consultant, RTI and Legal Consultant.

It was noted that a representation has been submitted by Shri Ram Swaroop Singh, Consultant, RTI and Shri A Subudhi, Legal Consultant to enhance the 33% of consolidated salary i.e. approximate 6,600/- per month proportionately as consolidated salary of retired Assistants engaged in the Council has been increased from Rs.15,000/- to Rs.20,000/- after completion of six months.

In this regard, it was noted that both Consultants were engaged on the consolidated salary of R s.20,000/- per month and have successfully completed six months in the CCIM.

Executive Committee agreed to enhanced 25% the consolidated salary i.e. Rs.20,000/- to 25,000/-.

Addl. Agenda item No. 7 Representation of Sri Kalidas Ayurved Medical College, Badami

It was noted that Sri Kalidas Ayurved College, Badami was proposed for visitation report for furnishing the recommendation to the Govt. of India for the year 2011-12. In response of the same the college vide letter No. SKAMCB/1537/2011 dated 23.03.2011 informed that under Secretary Govt. of India Ministry of Health and Family Welfare of Dept. of AYUSH has pleased to order that the required teaching staff and is 35 and above including the Professor and Reader. But the present teaching staff is only 24 and appointment is to be made for the rest of the teaching staff and the staff for the other two Departments including Rachana Sharir, and Kaumarbhritya.

We have sought an opportunity and time for obeying the said order referred above.

The college and the management are taking steps to follow-up and for appointment of the teaching staff for the said Departments and other subjects.

It was requested to grant time for follow-up and for visitation of the college by the visitors CCIM.

In view of the above, college has not been visited so far.

Executive Committee noted the same and decided to recommend for not granting the permission for the session 2011-12 be forwarded to Government of India. It was also decided that State Government, Department and University should be approached to know the status of the college in respect of admission etc.

Addl.Agenda Item. No. 8 Verification reports

It was noted that as per decision of Executive Committee held on 16-17.05.2011, the following colleges were proposed for visitation to clarify during the contradiction of total number of patient admitted and total number of bed days occupied submitted reporting period as mentioned in the visitation report conducted by the visitors recently. 3. Dhanwantary Ayurved College, Udgir After going through the records, following observations have been made by visitors. 1. There is no similarity maintained in the data submitted by the college at the time of recent visitation and presented during the re- visitation conducted on 24.5.2011 was maintained. 2. OPD register was maintained day to day basis not year-wise(by mentioning the Central Register number year-wise). CR number was not maintained. 3. The Principal re-confirmed number of admitted patient submitted at the time of previous visitation i.e. 21948. 4. The Principal re-confirmed the total number of bed days occupied at the time of previous visitation i.e. 16355.

In view of the above, the data submitted and presented by the college at the time of previous visitation and on 24.5.2011 (re-visit) seems to be at variance.

Executive Committee observed that data is not clear therefore, it was decided that college should be called to appear in the office with original records of OPD and IPD for verification.

Agenda Item. No. 9 Visitation of Shri Bhanwarlal Nahata Ayurved College, Mandsaur

It was noted that Shri Bhanwarlal Nehata Ayurved College, Mandsaur was proposed for visitation report for furnishing the recommendation to the Govt. of India for the year 2011-12. In response of the same visitors have reported for non-cooperation of the Society with the views of the Chairman of the Society reads as under:-

1. CCIM conducted 5 visits so far and given away late permission for admitting the first year students to BAMS course. 2. The State Government did not permit to carry out admissions, and hence no students were admitted into the course. CCIM has not pointed out any shortcoming and granted permission to admit the batch. 3. Basing on this point, Chairman refused to co-operate with us for conduction of visitation procedures. As they did not allow and blindly rejected to initiate the enquiry. We have requested to submit the same in writing (ref. No-2). In spite of our repeated requests; the college authorities prevented us from conducting inspection of college as well as hospital building and other infrastructure facilities. They finally dropped us at the airport with a delay and we missed our return journey which was advanced to 28 th march instead of 30 th March. So we were forced to stay at hotel on 28 th and commenced our return journey on 29 th March.

Visitors have forwarded the representation of the college on the same issue. The content of the letter are as under:

“The inspection team consisting of Dr. Sarama Karra Nishteswar and Dr. Dei Laxmipriya have arrived our college – “Mandsaur Institute of Ayurveda Education and research, Mandsaur” today. We have not been informed of their visit by CCIM. We came to know only when the inspectors informed us of their visit to Mandsaur. We immediately enquired from you and informed that no students were admitted this year. It was confirmed verbally on phone that it might have been issued by mistake and necessary action would be taken. But still inspection Team has been sent to Mandsaur.

It may please be acknowledged that the letter of approval was received by us after the due date for admission. And since then there has been several communications made to CCIM and AYUSH to extend the time limit to admit students. Hon’ble High Court, Indore Branch (MP) has also instructed to CCIM/AYUSH to consider our appeal to extend the date of admission. The action on all those communications is still awaited.

The said inspection is to be carried out in the existing colleges for second year. Since we were not permitted to admit students inspection was not required for us. The relevant records were already submitted to CCIM and AYUSh based on which the approval was granted. It is thus requested that since we are not going into second year, due to delay in letter of Approval and there is no short comings cited to be complied with the current inspection should not be carried out.

It is further requested that we may be granted permission to admit students even at this stage. And the inspection of the college may be carried out after 2011-12 when the first year students advance into the second year.”

In this regard, it is also submitted that college has also filed a Court Case to treat the permission granted for the year 2010-11 to 2011-12 as admission could not taken place in previous year on account of delay of granting permission by Government of India.

Executive Committee noted the same and decided that recommendations for not granting permission for the session 2011- 12 be forwarded to the Government of India.
