Jeffery, Division Chief DATE: July 10, 2018 SUBJECT: 2017 Hazard Mitigation Plan Update Adoption Background: The Federal Emergency Management Agency (FEMA) requires that all jurisdictions develop and maintain a current Hazard Mitigation Plan (HMP) in order to be eligible for hazard mitigation projects and reimbursements from presidentially declared disasters. This plan identifies hazards and the potential risks the County has for each. It also identifies repetitive problem areas and recommends mitigation projects to alleviate future damage. Discussion: The HMP Update process was comprised of the following four main phases: Phase 1 — Organize Steering Committee and Process; Phase 2 — Assess Hazards, Risks, Vulnerability, and Mitigation Capability; Phase 3 — Develop a Mitigation Plan; and Phase 4 — Implement the Plan. Each phase was performed to obtain maximum participation from steering committee members, municipalities, and residents. Once the first three phases were completed, the contractor, Visions LLC, produced a DRAFT plan for the steering committee's review and approval. Once that was approved the plan was submitted to both the Maryland Emergency Management Agency (MEMA) and FEMA for review and approval. FEMA approved pending adoption on December 18, 2017, and forwarded that approval in January 2018. In order to gain final approval and implement the updated plan the County, as well as the Municipalities of North Beach and Chesapeake Beach, must adopt the plan through resolution. The North Beach Mayor and Town Council adopted by resolution on July 12, 2018, and Chesapeake Beach Mayor and Town Council adopted by resolution on July 19, 2018. Fiscal Impact: The County received a Hazard Mitigation Plan Grant for contractor expenses and the local match was budgeted in the Emergency Management budget. Conclusion/Recommendation: The Updated HMP is presented to the Board of County Commissioners for approval, along with the attached Resolution. Staff recommends the Board approve and sign the Resolution. Once recorded, we will forward to MEMA,. FEMA for final approval and implementation. Coordination f Legal Sufficiency: County Attorney Resolution No. RE: Adoption of the Calvert County, Maryland 2017 Hazard Mitigation Plan Update Page 1 of 3 FOR THE PURPOSE OF ADOPTING THE CALVERT COUNTY, MARYLAND 2017 HAZARD MITIGATION PLAN UPDATE WHEREAS, Calvert County is vulnerable to natural hazards such as costal erosion, flooding, extreme weather conditions, and wildfires that can result in property loss, loss of life, economic hardship and threats to public health and safety; WHEREAS, Calvert County has been faced with threats to life and safety and property damage from other natural and man-made hazards, including high winds, shoreline erosion and hazardous materials incidents; WHEREAS, the Disaster Mitigation Act of 2000 requires local and state governments to prepare and adopt hazard mitigation plans as a condition of receiving Pre-Disaster Mitigation Grant assistance and Hazard Mitigation Grant Program assistance after November 1, 2004; WHEREAS, the Calvert County Department of Public Safety, Emergency Management Division, received grant funds to update the County's Hazard Mitigation Plan in compliance with current disaster mitigation regulations; WHEREAS, the Countywide Hazard Mitigation Planning Team which, includes representatives from the Towns of North Beach and Chesapeake Beach, along with citizen representatives, has prepared and recommended the Calvert County, Maryland 2017 Hazard Mitigation Plan Update that reviews Calvert County's options to protect people and reduce damage from flooding and other hazards including shoreline erosion, high winds and hazardous materials incidents WHEREAS, the recommended Calvert County, Maryland 2017 Hazard Mitigation Plan Update identifies cost-effective actions Calvert County can take to eliminate or reduce the long term risk to life and property affected by the natural hazards that face the County; and WHEREAS, the recommended Calvert County, Maryland 2017 Hazard Mitigation Plan Update was the subject of public information meetings and public participation held in Calvert County, Maryland on October 19, 2016, November 14, 2016, November 28, 2016, January 9, 2017, and April 13, 2017; WHEREAS, the recommended Calvert County, Maryland 2017 Hazard Mitigation Plan Update has been widely circulated for review by federal, State and regional agencies and has been supported by those reviewers; and WHEREAS, the Board of County Commissioners for Calvert County, Maryland believes it is important for the county to be prepared for and mitigate against hazards by adopting and implementing the Calvert County, Maryland 2017 Hazard Mitigation Plan Update. NOW THEREFORE BE IT RESOLVED, by the Board of County Commissioners for Calvert County, Maryland that the Calvert County, Maryland All Hazard Mitigation Plan Update, maintained within the permanent records of the Calvert County Department of Public Safety is hereby adopted and supersedes Resolution 47-12; BE IT FURTHER RESOLVED, that the existing Hazard Mitigation Planning Team, whose members are listed in Chapter 1 of the 2004 Hazard Mitigation Plan Update adopted by Resolution Resolution No. RE: Adoption of the Calvert County, Maryland 2017 Hazard Mitigation Plan Update Page 2 of 3 09-05, shall remain in place with new members to be appointed as necessary and to replace members as appropriate; BE IT FURTHER RESOLVED, that the Hazard Mitigation Planning Team (the "Planning Team") shall include members from the following community agencies: Community Officials Calvert County Inspections & Permits Calvert County Public Safety Calvert County Historic Preservation Calvert County Department of Planning and Zoning Town of North Beach Planning Town of Chesapeake Beach Planning Tri-County Council of Governments Utility Representatives Calvert Cliffs Nuclear Power Plant (CCNPP) Cove Point LNG (Dominion) SMECO Business/Resident Representatives Property Owners and residents Home Builders and Contractors Business Owners Insurance Company Representatives; BE IT FURTHER RESOLVED, that new Planning Team members shall be appointed by the Board of County Commissioners of Calvert County; BE IT FURTHERED RESOLVED, that the Board of County Commissioners of Calvert County will appoint the chair to the Planning Team; BE IT FURTHER RESOLVED, that the Planning Team shall meet as often as necessary to prepare or review mitigation activities and progress toward implementing the Calvert County, Maryland 2017 Hazard Mitigation Plan Update, but not less than once a year; BE IT FURTHER RESOLVED, that, by April 30 each year, the Planning Team shall prepare an annual evaluation report to the Board of County Commissioners of Calvert County on the Calvert County, Maryland 2017 Hazard Mitigation Plan Update; BE IT FURTHER RESOLVED, that the annual evaluation report shall include: (1) a review of the Calvert County, Maryland 2017 Hazard Mitigation Plan Update; (2) a review of any floods, other major natural events, or hazardous materials incidents that occurred during the previous calendar year; (3) a review of the action items in the Calvert County, Maryland 2017 Hazard Mitigation Plan Update, including how much was accomplished during the previous year; (4) a discussion of why any action items were not completed or why implementation is behind schedule, and recommendations for new projects or revised action items. Such recommendations shall be subject to approval by the Board of County Commissioners of Calvert County as amendments to the adopted Plan; and BE IT FURTHER RESOLVED, that this Resolution shall take effect upon recordation and publication of a fair summary.
