I am writing with reference to the above application and our recent telephone conversations • regarding the application.

As we discussed on the phone, following your previous discussions with other officers, I can advice that the design and size of extension in principle, is now considered to be acceptable. However, no evidence of why the bUilding is required has been provided with this application or indeed the previous application.

It is understand that the building is intended to be an agriCUltural workers dwelling for Mr Edges son who works on the farm, but is also a drystone wall contractor. As a result this application cannot be dealt with without any evidence to prove this is the case. It is therefore requested that the current application is withdrawn and then resubmitted with an agricultural appraisal that proves that the dwelling is required. It is probably also prudent to provide additional evidence of your client's circumstances i.e. in relation to how long he has lived at the property, his particular family circumstances and any other relevant information you may think is necessary.

I note that the Highway Authority has commented on a previous application for this site (application code: NP/DDD/1005/1031) to which no highway objections were raised subject to two parking spaces and sufficient turning space being provided within the site curtilage.

This application is very similar to the previous submission and the application details state that two parking space will be provided. However, whilst the application drawings indicate the location of the two spaces, they appear to be very restricted with no space for vehicles to turn within the site. On this basis, the proposed parking spaces should be revised and a suitable turning area • provided clear of the parking spaces. Subject to the application details being amended and if your Authority is minded to approve the application, the conditions and notes recommended in my letter dated 14 November 2005 (see attached copy for your information) should be appended to any consent.

I refer to the above application which was received by this Authority on 31 October 2005 for highway comments.

The site in question is fronted by an un-classified road which is very lightly trafficked. Although visibility splays from the proposed access would be below recommended standards for a de-restricted road, the nature of the road considerably reduces vehicle speeds (to approximately 10mph). Also, the proposed extensions to the existing building do not increase the total number of bedrooms and therefore is not seen as intensification in vehicular usage to or from the site.

However, the car standing area shown on the application drawing is only approximately 3m in width. As the cottage will contain two bedrooms, the Highway Author.;~y recommends the provision of two car parking spaces within the site curtilage, each measuring 204m x 4.8m and provided clear of a standard turning area.

If the applicant is willing to amend the proposals in line with my comments above, then the Highway Authority has no objections in principle to the above application, subject to the following conditions being appended to any consent recommended in the best interests of highway safety:-

1 Before any other operations are commenced, a new vehicular access shall be formed to the adjacent unclassified road in accordance with the applications drawings, to include visibility splays of 2m x maximum achievable, laid out and constructed all to the satisfaction of the Local Planning Authority, the area in advance of these sightlines being maintained in perpetuity clear of all obstructions greater than 1m in height (600mm in the case of vegetation) relative to the adjoining nearside carriageway channel level. 3 In association with Condition 1 above, the proposed access shall be constructed of a solid bound material (Le, not loose chippings) for the first 5m behind the highway boundary, all to the satisfaction of the Local Planning Authority, In addition, there shall be no gates within 5m of the highway boundary and any such gates shall open inwards only,

4 The premises, the sUbject of the application, shall not be occupied until space has been provided within the site curtilage for the parking and manoeuvring of vehicles, in accordance with my comments above, laid out and constructed with a solid bound material all to the satisfaction of the Local Planning Authority and maintained thereafter free from any impediment to its designated use,

Dear Sirs • Oldfield Cottage, Ballidon This cottage was occupied until the middle of the 20'h Century as a srnall cottage. It would appear to date from the early 19th century as a house consisting of two bedrooms linked and a kitchen and a parlour.

There was a privy on the side of the north gable indicated on the ordnance map and now demolished.

It is proposed to rebuild it with an extension as a social housing unit. It will have three bedrooms and will not exceed 87 sq m in floor area excluding the first floor loft space which is too low for residential use,

The building will be able to retain much of its character including window openings, doors, external limestone rubble walls with sandstone lintols, jambs and quoins. Internally the fireplaces, ceiling beams and joists will be retained, The roof will be stripped and rebuilt to replace the purlins, rafters and plates, • The condition of the building: There is some deflection and slight bulging of the limestone walling where the outer face is breaking away from the inner leaf. This can be grouted satisfactorily. All the external walls will be pointed in lime putty, well raked out and filled. The joints are to be wiped flush leaving the edge of the stones clear of the mortar.

The roof has to be completely rebuilt using the existing tiles. The purlins will be 250 x 75 and the rafters 100 x 50, all tanalised softwood. The plates are 75 x 100 strapped to the wall, the ceiling joists 150 x 50 on the upper floor will be collared below the purlins.

Floor joist replacements will be 150 x 65 as necessary.

The fireplaces and internal walls are to be reconstructed in situ and new lined chimneys installed with 300 diameter flue liners to ensure a good flow from the fireplace or kitchen stove.

Arch M.A. R.I.B.A. Associate The foundations have to be underpinned for all the walls and where there is only earth on the outside of the rear (east) wall and the north gable, the earth is to be carefully removed in metre lengths and new rubble limestone constructed in lifts of not more than 1.000m.

The paving internally is to be taken up and removed and a new slab and DPM laid on insulation.

Internally the walls are to be rendered with Limelite or similar plaster. Note as the walls are limestone rubble, introducing a DPM would not work and seka or similar base coat may be used as damp proofing to the walls.

All services are renewed. • This is a description of the work and not a specification and covers the proposed renovation for information only. Galvanised steel windows will replace existing, single glazed with secondary glazing. The gutters and downpipes will be cast iron on rise and fall brackets.

I!J 2311 Page 1 !l I MrS& MEdge Oldfield Cottage I I 1 INTRODUCTION I 1.1 Site description I The site, Oldfield Farm Cottage, is located in Ballidon to the north of Ashbourne in Derbyshire, at as grid reference SK 205 547. The cottage is believed to date from the 17th Century and I has been derelict for over fifty years. The cottage is situated within a farm and is close to a farm house and associated stone barns. I

1.2 Proposed works There are proposals to renovate the derelict cottage into residential accommodation. I• 1.3 Aims of study I Baker Shepherd Gillespie was commissioned to carry out a daytime bat survey to assess the building for potential to support bats and to make searches for any evidence of a bat roost. • 2 METHODOLOGY • 2.1 Desk study Derbyshire Wildlife Trust were contacted to provide bat records for a 1 km radius around as ••I grid reference SK 205 547. 1 2.2 Field survey Senior Ecologist Philippa Harvey, who holds an English Nature scientific survey bat licence (Licence Number: 20060404), and Senior Ecologist Katy Stiles, who holds an English Nature • scientific survey and bat roost visitor licence (Licence Number: 20050206) carried out a daytime internal and external bat survey on 21 51 February 2006. A powerful torch and • binoculars were used to make internal and external inspections of the bUilding to assess the potential for the building to support bats and to make searches for evidence of the presence of • bats. This would include bat droppings, feeding remains, characteristic staining on timbers, live bats and dead bats. The weather during the survey was cold and dry with a light breeze. • 3 RESULTS • • 3.1 Desk study Derbyshire Wildlife Trust prOVided the following bat record (species unknown): • • SK 203 544 Ballidon Church 17/08/1998 •• 3.2 Field survey •

3.2.1 Bats • I Oldfield Farm Cottage is a stone built two-storey cottage with a pitched clay tile roof. It is thought that the cottage was built in the 171h Century and has been derelict for over fifty years. I The cottage has a rubble filled cavity wall. I External The front elevation of the Gottageis partially Govered in ivy and a gap was noted in the Gorner I of the window frame that is considered likely to extend back into the cavity wall. I On the rear elevation of the cottage numerous gaps were recorded in the stone work. A gap was noted in the corner of a window lintel (see Photo 3) but this was covered in cobwebs I indicating that there had been no recent movement of animals. I I 2311 Page 2 I I MrS & M Edge I Oldfield Cottage I Gaps were located in the southern gable end wall that appears to lead into the cavity wall. I Gaps were also present on the northern gable end wall, but these have been exposed more recently when an old toilet building was removed. I The pitched roof has numerous missing and lifted tiles and gaps were noted under the ridge I tiles.

The numerous gaps in the stonework and the gaps noted under tiles, in particular the ridge tiles are considered to nave .- potential to support roosting bats. • Internal The ground floor is divided into two rooms. A fireplace and chimney are present within the • dividing wall and on the northern gable end wall. The chimney within the dividing wall is covered in soot and cobwebs and is considered to be of limited potential to support roosting • bats. The chimney on the northern gable end appears to be tightly sealed and no suitable roosting features were noted. Gaps were noted on the southern gable end internally, where • there is missing plasterwork that has exposed the stonework. Some deep cracks are present into the rubble filled cavity which could potentially support roosting bats. No evidence of bats • was associated with these gaps. • The first floor is used for storage and is cluttered. Torching is present under the tiles and some ivy is growing internally. Some large timbers are present supporting the roof but no suitable bat roosting features were noted. Gaps were noted near to the chimney on this floor with potential •• to support roosting bats. No evidence of bats was recorded internally. • Gaps that have been recorded in the walls that lead into the cavity are considered to have • potential to support roosting bats. • 3.2.2 Nesting birds Two old swallow nests were recorded internally in the southern part of the cottage. • • • • • • • 2311 Page 4 • • I I MrS&MEdge Oldfield Cottage • 4 ASSESSMENT •I 4.1 Constraints on study information I February is not an optimum time of year to carry out bat surveys because bats are generally in hibernation at this time of year and external evidence of their presence is often not present due to weathering. Assessments can still be made at this time of year of buildings for their potential • to support roosting bats. I 4.2 Potential impacts

• 4.2.1 Bats • Bats and their roosts are protected under the Wildlife and Countryside Act 1981 (as amended by the CRoW Act 2000), and by the Conservation Regulations 1994. In summary, these make • it an offence to damage or destroy any bat roost, intentionally or recklessly obstruct a bat roost, I deliberately, intentionally or recklessly disturb a bat or intentionally kill, injure or take any bat. In PPS9 in paragraph 16, the government indicates that local authorities should take steps to I. further the conservation of species of principal importance for the conservation of biodiversity -. in and should ensure that that these species are protected from adverse effects of development, where appropriate, by using planning conditions or obligations. II The list of species (Countryside and Rights of Way Act 2000 Section 74) subject to this duty ~ includes the common pipistrelle Pipisfrellus pipisfrellus bat. Paragraph 116 of Government Circular 06/2005 which accompanies PPS9 also advises that • planning authorities should give due weight to the presence of a European Protected Species, I such as bats, on a development site to meet their statutory requirements in exercising its functions in relation to the Habitats Directive. I No evidence of the presence of bats has been recorded internally or externally. The cottage I does support features with potential to support roosting bats, such as the gaps in the stonework and gaps under roof and ridge tiles. The presence of bats cannot be discounted at I the current time because of the timing of the survey. On the current survey information it has to be concluded that the proposed renovation works to the cottage have the potential, if a bat roost is present, to damage and destroy a bat roost and potentially kill and injure any bats that Ie may be present.

• 4.2.2 Nesting birds • Nesting birds are protected under the Wildlife and Countryside Act 1981, which makes it an I offence to intentionally kill, injure or take any wild bird or take, damage or destroy its nest whilst in use or being built, or take or destroy its eggs. • Two old swallow nests were recorded in the cottage. The proposed works to renovate the cottage have potential, if carried out during the bird nesting season (generally March to late • August, but this can vary), to damage and destroy active bird nests. • • • I

~ 2311 Page 5 • • MrS& MEdge Oldfield Cottage • 5 RECOMMENDATIONS • 5.1 Bats • Prior to the start of works it is recommended that a further daytime and evening bat survey is I carried out at a more appropriate time of year, ideally no earlier than late April/May, to try to determine more conclusively the presence or absence of roosting bats. I

If a bat roost is discovered then prior to the start of works a licence from DEFRA will need to I be secured to derogate from the legal protection afforded to bats. It should be noted that these licences can take between 6 and 8 weeks to secure and as part of these licences mitigation I measures need to be implemented to ensure continued roosting opportunities on site for bats. This could include the retention of gaps in the external stonework, the erection of bat boxes I and/or the incorporation of "bat tubes" into the walls. I As a good practice measure even if a bat roost is not identified it is recommended that gaps are retained in the external stonework for future use by bats. Ii

5.2 Nesting birds I It is recommended that if at all possible works are carried out outside the bird nesting season .ll (generally March-late August) to avoid an impact on nesting birds. If this is not possible then it is recommended that as soon as possible, following a brief check of the cottage for signs of active nests, that the door is kept shut and the open windows are boarded to prevent birds • from -being ableTo acces-s the "5liflaiiig. "HowElveia-nc)fizontai "ga-p -m-essuring "no 1ess 1han -30 I mm should be made across the top of the board to enable any bats that may be using the cottage to still exit and enter the barn prior to a further bat survey being undertaken. • As a good practice measure it is recommended that opportunities for nesting birds are I considered into the renovation of the cottage. This could include retaining gaps in the external stonework. • 6 SUMMARY I A daytime bat survey has been undertaken at Oldfield Cottage at Sallidon. No evidence of the presence of bats has been recorded but the cottage has potential to support roosting bats. Further survey work at a more appropriate time of year is recommended. Recommendations • are also made in relation to nesting birds. .. •I Observations relating to signs of protected species are valid at the time of survey.
