The appellant Thiru N.Suresh is present . The Public Authority is represented by Thiru S.Arulmani, District Registrar, South Madras Registration District, Office of the District Registrar and Thiru B.Manimozhian , Assistant, Chennai South Joint -I Sub- Registrar’s Office, Saidapet, Chennai -15. 2. A perusal of the petition dated 30.10.2013 filed under Section 6(1) of the R.T.I. Act, 2005, reveals that the appellant has sought for certain information in ten items with regard to a registered society viz. Silver Streak Apartments Welfare Association, bearing Registration No.516/2012 The Public Information Officer by his letter dated 28.11.2013 has furnished information for all the ten items.
3. Not being satisfied with the reply, the appellant has preferred a First Appeal on 07.12.2013 under Section 19(1) of the RTI Act before the First Appellate Authority. The First Appellate Authority has not furnished any information within the statutory period. Aggrieved by this, the appellant has preferred a Second Appeal dated 25.01.2014 under Section 19(3) of the RTI Act before this Commission stating that the information is incomplete and the said appeal has been taken up for enquiry today (16.02.2015).
4. The queries relate to membership in Silver Streak Apartments Welfare Association – a registered society. It has mutually been agreed to confine in the enquiry to items (a), (c), (g) and (i). As regards items (c), (g) and (i), the District Registrar, South Chennai Registration District undertakes to furnish the copies of the provisions of the Rule or Act, as the case may be, which the District Registrar shall comply in two weeks from the date of receipt of this order. As regards item (a), the query is whether the membership in a registered society is compulsory or optional. The PIO would appear to have answered in the affirmative. The Petitioner would appear to have sent an application to the Commercial Taxes and Registration Department, Secretariat, Chennai-9 for which he has been furnished a reply to the effect that membership in any registered society is not compulsory as per the Tamil Nadu Societies Registration Act, 1975. Thus, there is conflict of information furnished by the Public Information Officer on the one hand and the Government on the other. It is now for the Public Information Officer to resolve this conflict by obtaining appropriate clarification from the Government and furnish the relevant information over again to the petitioner which he shall do in two weeks from the date of receipt of this order. 5. Nothing more that remains to be considered in this appeal and accordingly this appeal is closed.
