AN ORDINANCE AMENDING THE LOGAN MUNICIPAL SECTION 12.24.040 LOGAN CITY SKATE PARK, TOBACCO AND SMOKE FREE ZONE, LOGAN, UTAH

BE IT ORDAINED BY MUNICIPAL COUNCIL OF CITY OF LOGAN, STATE OF UTAH AS FOLLOWS:

SECTION 12.24.040 SUBSET A: Shall now read as, "In any skate park facility owned or operated by the city of Logan, the use of of any type, similar devices, and motorized vehicles are prohibited."

SECTION 12.24.040 SUBSET B: Shall now read as, "Any person riding a , using , in-line skates, or human-powered kick scooters with no wider than twelve {12l in in a facility owned or by city of shall, without city supervision, skate at their own risk. The use of equipment including helmets, kneepads, elbow pads, wrist guards is strongly recommended."

SECTION 12.24.040 SUBSET C: Shall now read as, "Any person riding a skateboard, roller in-line skates, or a kick as in B, in the facility shall extreme caution, respecting the use the facility by other and complying with other city ordinances pertaining to public morals, and welfare."

THIS ORDINANCE AMENDMENT SHALL BECOME EFFECTIVE UPON PUBLICATION.

DATE : June 1, 2017 FROM: Russ Akina, Director SUBEJCT: Request to Amend Ordinance 12.24.040 Logan City Skate Park, Tobacco and Smoke Free Zone

History In 2001, the City of Logan constructed a 17,000 square foot concrete skate park facility for use by the general public. The skate park was designed specifically for , roller skates, and in-line skate use only. An ordinance was created for the facility to regulate use and protect the integrity and functionality of the skate park, protect the City from risk exposure, and provide safety protocols as recommended by liability professionals and the skate park industry. The current ordinance (12.24.040) prohibits the use bicycles, scooters, similar devices, and motorized vehicles in the skate park.

Public Inquiry The Parks and Recreation Department has received inquiries from the general public requesting that scooters be permitted at the Logan Skate Park. After additional research and consultation with the skate park architect firm hired by the City in 2000 to design the facility, City staff learned that the use of human-powered kick scooters similar in size to that of a skateboard is now an acceptable use by the skate park industry and supported by the architect firm hired at the time by the City (see attachment titled as Exhibit A). While staffs research discovered that there are many variations of human powered kick scooters, it is the Department's recommendation that kick scooters be restricted to those with a diameter no greater than twelve (12) inches.

Proposed The Parks and Recreation Department is seeking approval to amend City Ordinance 12.24.040 Subset A, B, and C to include the permitted use of human-powered kick scooters with wheels no wider than twelve (12) inches in diameter in the Logan Skate Park facility.

Hope all is well. I'm up on a previous email the Logan Skate Park. Recently, we have been inundated with scooter enthusiasts wanting to use the Skate Park. Currently, scooters are prohibited.

Question: If the City of Logan amended its ordinance to permit scooters, would that negate Design's standing with skate park?

We are okay with scooters riding within the Logan Skate Park as we've seen the popularity grow the past few years and they don't cause anymore damage to a skate park than your average skateboard. Your story sounds very familiar as the City of Chandler, AZ had to build a separate bike park to help accommodate the needs within their community after their first skate park was built. We designed their original skate park and then a couple of years later we designed their bmx park that doesn't allow skateboards:

As you can see in the project images that there is now a 4" metal plate behind any fall coping and existing exposed concrete edges.
