MISSISSIPPI LEGISLATURE REGULAR SESSION 2019 By: Senator(s) Jackson (32nd) To: Appropriations SENATE BILL NO. 2218 1 AN ACT TO AMEND SECTION 12 OF SENATE BILL NO. 2002, CHAPTER 2 3, LAWS OF THE FIRST EXTRAORDINARY SESSION OF 2018, TO REQUIRE THE 3 STATE TREASURER TO TRANSFER A CERTAIN AMOUNT OF FUNDS FROM THE 4 BUDGET CONTINGENCY FUND TO THE 2018 TRANSPORTATION AND 5 INFRASTRUCTURE IMPROVEMENTS FUND FOR CERTAIN NOXUBEE COUNTY 6 CAPITAL IMPROVEMENT PROJECTS; TO AMEND SECTION 27-104-301, 7 MISSISSIPPI CODE OF 1972, TO SPECIFY THE CAPITAL IMPROVEMENT 8 PROJECTS IN NOXUBEE COUNTY FOR WHICH MONEY MAY BE DISBURSED; AND 9 FOR RELATED PURPOSES. 10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 11 SECTION 1. Section 12 of Senate Bill No. 2002, Chapter 3, 12 Laws of the First Extraordinary Session of 2018, is hereby amended 13 as follows: 14 Section 12. (1) The State Treasurer shall transfer funds 15 from the Budget Contingency Fund to the following special funds in 16 the following amounts: 17 (a) * * * Sixty-nine Million Four Hundred Six Thousand 18 Six Hundred Ninety-six Dollars ($69,406,696.00) to the 2018 19 Transportation and Infrastructure Improvements Fund created in 20 House Bill No. 1, First Extraordinary Session of 2018; S. No. 2218 *SS26/R433* ~ OFFICIAL ~ G1/2 19/SS26/R433 PAGE 1 (tb\rc) 21 (b) One Million Dollars ($1,000,000.00) to the 22 Mississippi Highway-Railroad Grade Crossing Safety Account created 23 in Section 57-43-15; and 24 (c) Seven Million Five Hundred Thousand Dollars 25 ($7,500,000.00) to the Mississippi Railroad Improvements Fund 26 created in Section 57-46-1. 27 (2) The State Treasurer shall transfer seventy-five percent 28 (75%) of the amount remaining in the Budget Contingency Fund after 29 the transfers required in subsection (1) of this section into the 30 Gulf Coast Restoration Fund created in Section 57-119-1. 31 SECTION 2. Section 27-104-301, Mississippi Code of 1972, is 32 amended as follows: 33 27-104-301. (1) A special fund, to be designated the "2018 34 Transportation and Infrastructure Improvements Fund," is created 35 within the State Treasury, which shall consist of funds made 36 available by the Legislature in any manner and funds from any 37 other source designated for deposit into such fund. The fund 38 shall be maintained by the State Treasurer as a separate and 39 special fund, separate and apart from the General Fund of the 40 state. Unexpended amounts remaining in the fund at the end of a 41 fiscal year shall not lapse into the State General Fund, and any 42 interest earned or investment earnings on amounts in the fund 43 shall be deposited into such fund. No. 2218 *SS26/R433* ~ OFFICIAL ~ 19/SS26/R433 PAGE 2 (tb\rc) 44 (2) Monies deposited into the fund shall be disbursed, in 45 the discretion of the Department of Finance and Administration, as 46 follows: 47 (a) To pay the costs incurred by the Mississippi 48 Transportation Commission and the Mississippi Department of 49 Transportation to widen Mississippi Highway 16 to three (3) lanes 50 as follows: 51 (i) From near the Neely Town Road at the DeKalb 52 City Limits to the point at which Old Philadelphia Road ties into 53 Mississippi Highway 16; and 54 (ii) Between the two (2) points at which 55 Mississippi Highway 39 ties into Mississippi 56 Highway 16.......................................... $2,000,000.00. 57 (b) To assist in paying the costs associated with 58 preconstruction, design, engineering, land acquisition, 59 right-of-way acquisition, construction and development of the 60 Reunion Parkway project from Bozeman Road to Parkway East in 61 Madison County, Mississippi......................... $8,000,000.00. 62 (c) To assist the East Metropolitan Corridor 63 Commission, which is a commission operating as a local public 64 agency representing the Jackson Municipal Airport Authority, the 65 City of Brandon, Mississippi, the City of Flowood, Mississippi, 66 and the City of Pearl, Mississippi, in paying the costs associated 67 with land acquisition and implementation of the East Metro 68 Corridor project in Rankin County, Mississippi, from its current S. B. No. 2218 *SS26/R433* ~ OFFICIAL ~ 19/SS26/R433 PAGE 3 (tb\rc) 69 terminus at the southeast corner of, and within, the 70 Jackson-Medgar Wiley Evers International Airport, traversing 71 easterly and southerly and terminating at Interstate 20 at 72 Crossgates Boulevard in Brandon, Mississippi........ $8,000,000.00. 73 (d) To assist DeSoto County, Mississippi, in paying the 74 costs of rebuilding Holly Springs Road in DeSoto County and 75 drainage improvements to the road................... $3,000,000.00. 76 (e) To assist Carroll County, Mississippi, in paying 77 the costs of repair, renovation or replacement of a closed bridge 78 on County Road 157 in Carroll County................ $ 500,000.00. 79 (f) To assist Lamar County, Mississippi, in paying the 80 costs associated with necessary infrastructure improvements in 81 Beat 5 of Lamar County and/or construction of recreational 82 facilities in Beat 5................................ $ 500,000.00. 83 (g) To assist Lamar County, Mississippi, in paying the 84 costs of improvements to the intersection of Scruggs Road and 85 Mississippi Highway 589, including, but not limited to, the 86 relocation of portions of the road, the purchase of property 87 related to the relocation, signage, paving, other costs related to 88 improving the safety of the intersection and other road safety 89 projects in Supervisors District 5 of 90 Lamar County........................................ $1,500,000.00. 91 (h) To assist Bolivar County, Mississippi, in paying 92 the costs associated with preplanning and construction of a 93 Mississippi River landing dock facility and related S. No. 2218 *SS26/R433* ~ OFFICIAL ~ 19/SS26/R433 PAGE 4 (tb\rc) 94 facilities in Bolivar County........................ $1,000,000.00. 95 (i) To assist Rankin County, Mississippi, in paying the 96 costs related to the extension of Gunter Road in 97 Rankin County....................................... $2,800,000.00. 98 (j) To assist the Pearl River Valley Water Supply 99 District in paying the costs associated with the repair, 100 rehabilitation, reconstruction or replacement of seawalls at the 101 Ross Barnett Reservoir as required by the settlement agreement in 102 the case of Bobby L. Baker, Jr., et al. v. Pearl River Valley 103 Water Supply District, in the Circuit Court of Rankin County, 104 Mississippi, Civil Action No. 212-133E.............. $4,000,000.00. 105 (k) To assist the City of Hattiesburg, Mississippi, in 106 paying the costs associated with resurfacing and other 107 improvements to Hardy Street in the City of Hattiesburg from its 108 intersection with U.S. Highway 49 East to its intersection with 109 West Pine Street in the City of Hattiesburg......... $ 400,000.00. 110 (l) To assist the City of Hattiesburg, Mississippi, in 111 paying the costs associated with resurfacing and other 112 improvements to 38th Avenue in the City of 113 Hattiesburg......................................... $ 100,000.00. 114 (m) To assist Hinds County, Mississippi, in paying the 115 costs of construction and development of the Byram-Clinton Parkway 116 project in Hinds County............................. $2,000,000.00. No. 2218 *SS26/R433* ~ OFFICIAL ~ 19/SS26/R433 PAGE 5 (tb\rc) 117 (n) To assist the City of Senatobia, Mississippi, in 118 paying the costs associated with the following purposes, in the 119 following order: 120 (i) Construction and development of roundabout 121 projects and other improvements at the intersection of Main Street 122 and Scott Street and adjoining or related intersections in the 123 City of Senatobia; 124 (ii) Improvements at the intersection of Front 125 Street and Main Street in the City of Senatobia; and 126 (iii) Improvements at the intersection of Heard 127 Street and Main Street in the City of Senatobia..... $2,300,000.00. 128 Any such funds that are in excess of that needed to complete 129 the projects described in this paragraph shall be used to assist 130 the City of Senatobia in paying the costs associated with making 131 historically relevant infrastructure improvements in the city's 132 downtown historic district. In addition, the scope of work for 133 any projects described in this paragraph that are located in the 134 city's downtown historic district must be in keeping with the 135 character of the district. 136 (o) To assist in paying the costs associated with: 137 (i) Constructing, developing, extending and 138 implementing wastewater infrastructure and related facilities, 139 systems and infrastructure within and/or near Gateway Industrial 140 Park in Pike County, Mississippi; and S. No. 2218 *SS26/R433* ~ OFFICIAL ~ 19/SS26/R433 PAGE 6 (tb\rc) 141 (ii) Constructing access roads and related 142 infrastructure within and/or near Gateway Industrial Park in 143 Pike County......................................... $3,000,000.00. 144 (p) To assist the City of Petal, Mississippi, in paying 145 the costs associated with (i) the repair, rehabilitation, 146 resurfacing, construction and reconstruction of Leeville Road/Main 147 Street located in Forrest County, Mississippi, in the City of 148 Petal from its intersection with the Evelyn Gandy Parkway 149 southerly to the boundary of the corporate limits of the City of 150 Petal; and (ii) the repair, rehabilitation, resurfacing, 151 construction and reconstruction of Smithville Road located in 152 Forrest County, Mississippi, in the City of Petal... $ 750,000.00. 153 (q) To assist the Town of West, Mississippi, in paying 154 the costs associated with repairs, resurfacing and making other 155 improvements to streets in the Town of West........
