MISSISSIPPI LEGISLATURE REGULAR SESSION 2019 By: Representative Smith To: Appropriations HOUSE BILL NO. 1173 1 AN ACT TO AMEND SECTION 27-104-301, MISSISSIPPI CODE OF 1972, 2 TO CLARIFY THE DESCRIPTION OF THE AUTHORIZED REPAIR AND RENOVATION 3 OF THE HISTORIC RODNEY PRESBYTERIAN CHURCH PROJECT TO BE FUNDED 4 FROM DISBURSEMENTS FROM THE 2018 TRANSPORTATION AND INFRASTRUCTURE 5 IMPROVEMENTS FUND; TO CLARIFY CERTAIN PROVISIONS RELATING TO 6 DISBURSEMENTS FROM THE 2018 TRANSPORTATION AND INFRASTRUCTURE 7 IMPROVEMENTS FUND FOR IMPROVEMENTS TO THE EXISTING RAIL LINE AND 8 RELATED FACILITIES RUNNING FROM THE CITY OF AMORY, MISSISSIPPI, TO 9 THE CITY OF FULTON, MISSISSIPPI; TO REVISE THE BRIDGE PROJECT IN 10 HANCOCK COUNTY, MISSISSIPPI, FOR WHICH FUNDS ARE TO BE DISBURSED 11 FROM THE 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND; 12 AND FOR RELATED PURPOSES. 13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 14 SECTION 1. Section 27-104-301, Mississippi Code of 1972, is 15 amended as follows: 16 27-104-301. (1) A special fund, to be designated the "2018 17 Transportation and Infrastructure Improvements Fund," is created 18 within the State Treasury, which shall consist of funds made 19 available by the Legislature in any manner and funds from any 20 other source designated for deposit into such fund. The fund 21 shall be maintained by the State Treasurer as a separate and 22 special fund, separate and apart from the General Fund of the 23 state. Unexpended amounts remaining in the fund at the end of a H. B. No. 1173 *HR26/R1645* ~ OFFICIAL ~ G2/3 19/HR26/R1645 PAGE 1 (BS\KW) 24 fiscal year shall not lapse into the State General Fund, and any 25 interest earned or investment earnings on amounts in the fund 26 shall be deposited into such fund. 27 (2) Monies deposited into the fund shall be disbursed, in 28 the discretion of the Department of Finance and Administration, as 29 follows: 30 (a) To pay the costs incurred by the Mississippi 31 Transportation Commission and the Mississippi Department of 32 Transportation to widen Mississippi Highway 16 to three (3) lanes 33 as follows: 34 (i) From near the Neely Town Road at the DeKalb 35 City Limits to the point at which Old Philadelphia Road ties into 36 Mississippi Highway 16; and 37 (ii) Between the two (2) points at which 38 Mississippi Highway 39 ties into Mississippi 39 Highway 16.......................................... $2,000,000.00. 40 (b) To assist in paying the costs associated with 41 preconstruction, design, engineering, land acquisition, 42 right-of-way acquisition, construction and development of the 43 Reunion Parkway project from Bozeman Road to Parkway East in 44 Madison County, Mississippi......................... $8,000,000.00. 45 (c) To assist the East Metropolitan Corridor 46 Commission, which is a commission operating as a local public 47 agency representing the Jackson Municipal Airport Authority, the 48 City of Brandon, Mississippi, the City of Flowood, Mississippi, H. No. 1173 *HR26/R1645* ~ OFFICIAL ~ 19/HR26/R1645 PAGE 2 (BS\KW) 49 and the City of Pearl, Mississippi, in paying the costs associated 50 with land acquisition and implementation of the East Metro 51 Corridor project in Rankin County, Mississippi, from its current 52 terminus at the southeast corner of, and within, the 53 Jackson-Medgar Wiley Evers International Airport, traversing 54 easterly and southerly and terminating at Interstate 20 at 55 Crossgates Boulevard in Brandon, Mississippi........ $8,000,000.00. 56 (d) To assist DeSoto County, Mississippi, in paying the 57 costs of rebuilding Holly Springs Road in DeSoto County and 58 drainage improvements to the road................... $3,000,000.00. 59 (e) To assist Carroll County, Mississippi, in paying 60 the costs of repair, renovation or replacement of a closed bridge 61 on County Road 157 in Carroll County................ $ 500,000.00. 62 (f) To assist Lamar County, Mississippi, in paying the 63 costs associated with necessary infrastructure improvements in 64 Beat 5 of Lamar County and/or construction of recreational 65 facilities in Beat 5................................ $ 500,000.00. 66 (g) To assist Lamar County, Mississippi, in paying the 67 costs of improvements to the intersection of Scruggs Road and 68 Mississippi Highway 589, including, but not limited to, the 69 relocation of portions of the road, the purchase of property 70 related to the relocation, signage, paving, other costs related to 71 improving the safety of the intersection and other road safety 72 projects in Supervisors District 5 of 73 Lamar County........................................ $1,500,000.00. No. 1173 *HR26/R1645* ~ OFFICIAL ~ 19/HR26/R1645 PAGE 3 (BS\KW) 74 (h) To assist Bolivar County, Mississippi, in paying 75 the costs associated with preplanning and construction of a 76 Mississippi River landing dock facility and related 77 facilities in Bolivar County........................ $1,000,000.00. 78 (i) To assist Rankin County, Mississippi, in paying the 79 costs related to the extension of Gunter Road in 80 Rankin County....................................... $2,800,000.00. 81 (j) To assist the Pearl River Valley Water Supply 82 District in paying the costs associated with the repair, 83 rehabilitation, reconstruction or replacement of seawalls at the 84 Ross Barnett Reservoir as required by the settlement agreement in 85 the case of Bobby L. Baker, Jr., et al. v. Pearl River Valley 86 Water Supply District, in the Circuit Court of Rankin County, 87 Mississippi, Civil Action No. 212-133E.............. $4,000,000.00. 88 (k) To assist the City of Hattiesburg, Mississippi, in 89 paying the costs associated with resurfacing and other 90 improvements to Hardy Street in the City of Hattiesburg from its 91 intersection with U.S. Highway 49 East to its intersection with 92 West Pine Street in the City of Hattiesburg......... $ 400,000.00. 93 (l) To assist the City of Hattiesburg, Mississippi, in 94 paying the costs associated with resurfacing and other 95 improvements to 38th Avenue in the City of 96 Hattiesburg......................................... $ 100,000.00. 97 (m) To assist Hinds County, Mississippi, in paying the 98 costs of construction and development of the Byram-Clinton Parkway H. B. No. 1173 *HR26/R1645* ~ OFFICIAL ~ 19/HR26/R1645 PAGE 4 (BS\KW) 99 project in Hinds County............................. $2,000,000.00. 100 (n) To assist the City of Senatobia, Mississippi, in 101 paying the costs associated with the following purposes, in the 102 following order: 103 (i) Construction and development of roundabout 104 projects and other improvements at the intersection of Main Street 105 and Scott Street and adjoining or related intersections in the 106 City of Senatobia; 107 (ii) Improvements at the intersection of Front 108 Street and Main Street in the City of Senatobia; and 109 (iii) Improvements at the intersection of Heard 110 Street and Main Street in the City of Senatobia..... $2,300,000.00. 111 Any such funds that are in excess of that needed to complete 112 the projects described in this paragraph shall be used to assist 113 the City of Senatobia in paying the costs associated with making 114 historically relevant infrastructure improvements in the city's 115 downtown historic district. In addition, the scope of work for 116 any projects described in this paragraph that are located in the 117 city's downtown historic district must be in keeping with the 118 character of the district. 119 (o) To assist in paying the costs associated with: 120 (i) Constructing, developing, extending and 121 implementing wastewater infrastructure and related facilities, 122 systems and infrastructure within and/or near Gateway Industrial 123 Park in Pike County, Mississippi; and H. No. 1173 *HR26/R1645* ~ OFFICIAL ~ 19/HR26/R1645 PAGE 5 (BS\KW) 124 (ii) Constructing access roads and related 125 infrastructure within and/or near Gateway Industrial Park in 126 Pike County......................................... $3,000,000.00. 127 (p) To assist the City of Petal, Mississippi, in paying 128 the costs associated with (i) the repair, rehabilitation, 129 resurfacing, construction and reconstruction of Leeville Road/Main 130 Street located in Forrest County, Mississippi, in the City of 131 Petal from its intersection with the Evelyn Gandy Parkway 132 southerly to the boundary of the corporate limits of the City of 133 Petal; and (ii) the repair, rehabilitation, resurfacing, 134 construction and reconstruction of Smithville Road located in 135 Forrest County, Mississippi, in the City of Petal... $ 750,000.00. 136 (q) To assist the Town of West, Mississippi, in paying 137 the costs associated with repairs, resurfacing and making other 138 improvements to streets in the Town of West......... $ 500,000.00. 139 (r) To assist Oktibbeha County, Mississippi, in paying 140 the costs associated with the resurfacing and repaving of Longview 141 Road in Oktibbeha County............................ $ 750,000.00. 142 (s) To assist in paying the costs associated with the 143 completion of the four-lane of Mississippi Highway 19 South at the 144 south Philadelphia City boundary intersection at Holland Avenue 145 and extending south along Mississippi Highway 19 South to the 146 intersection of BIA Road 241 (also known as Tucker Road), 147 including, but not be limited to, all necessary acquisition, 148 preconstruction and construction activities......... $2,000,000.00.
