MISSISSIPPI LEGISLATURE REGULAR SESSION 2019 By: Representative Smith To: Appropriations COMMITTEE SUBSTITUTE FOR HOUSE BILL NO. 1173 1 AN ACT TO AMEND SECTION 27-104-301, MISSISSIPPI CODE OF 1972, 2 TO CLARIFY CERTAIN PROVISIONS RELATING TO DISBURSEMENTS FROM THE 3 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND FOR 4 PROJECTS IN ATTALA COUNTY, MISSISSIPPI; TO CLARIFY THE DESCRIPTION 5 OF THE AUTHORIZED REPAIR AND RENOVATION OF THE HISTORIC RODNEY 6 PRESBYTERIAN CHURCH PROJECT TO BE FUNDED FROM DISBURSEMENTS FROM 7 THE 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND; TO 8 CLARIFY CERTAIN PROVISIONS RELATING TO DISBURSEMENTS FROM THE 2018 9 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND FOR 10 IMPROVEMENTS TO THE EXISTING RAIL LINE AND RELATED FACILITIES 11 RUNNING FROM THE CITY OF AMORY, MISSISSIPPI, TO THE CITY OF 12 FULTON, MISSISSIPPI; TO REVISE THE BRIDGE PROJECT IN HANCOCK 13 COUNTY, MISSISSIPPI, FOR WHICH FUNDS ARE TO BE DISBURSED FROM THE 14 2018 TRANSPORTATION AND INFRASTRUCTURE IMPROVEMENTS FUND; AND FOR 15 RELATED PURPOSES. 16 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 17 SECTION 1. Section 27-104-301, Mississippi Code of 1972, is 18 amended as follows: 19 27-104-301. (1) A special fund, to be designated the "2018 20 Transportation and Infrastructure Improvements Fund," is created 21 within the State Treasury, which shall consist of funds made 22 available by the Legislature in any manner and funds from any 23 other source designated for deposit into such fund. The fund 24 shall be maintained by the State Treasurer as a separate and H. B. Unexpended amounts remaining in the fund at the end of a 27 fiscal year shall not lapse into the State General Fund, and any 28 interest earned or investment earnings on amounts in the fund 29 shall be deposited into such fund. 30 (2) Monies deposited into the fund shall be disbursed, in 31 the discretion of the Department of Finance and Administration, as 32 follows: 33 (a) To pay the costs incurred by the Mississippi 34 Transportation Commission and the Mississippi Department of 35 Transportation to widen Mississippi Highway 16 to three (3) lanes 36 as follows: 37 (i) From near the Neely Town Road at the DeKalb 38 City Limits to the point at which Old Philadelphia Road ties into 39 Mississippi Highway 16; and 40 (ii) Between the two (2) points at which 41 Mississippi Highway 39 ties into Mississippi 42 Highway 16.......................................... $2,000,000.00. 43 (b) To assist in paying the costs associated with 44 preconstruction, design, engineering, land acquisition, 45 right-of-way acquisition, construction and development of the 46 Reunion Parkway project from Bozeman Road to Parkway East in 47 Madison County, Mississippi......................... $8,000,000.00. 48 (c) To assist the East Metropolitan Corridor 49 Commission, which is a commission operating as a local public H. No. 1173 *HR26/R1645CS.1* ~ OFFICIAL ~ 19/HR26/R1645CS.1 PAGE 2 (RF\KW) 50 agency representing the Jackson Municipal Airport Authority, the 51 City of Brandon, Mississippi, the City of Flowood, Mississippi, 52 and the City of Pearl, Mississippi, in paying the costs associated 53 with land acquisition and implementation of the East Metro 54 Corridor project in Rankin County, Mississippi, from its current 55 terminus at the southeast corner of, and within, the 56 Jackson-Medgar Wiley Evers International Airport, traversing 57 easterly and southerly and terminating at Interstate 20 at 58 Crossgates Boulevard in Brandon, Mississippi........ $8,000,000.00. 59 (d) To assist DeSoto County, Mississippi, in paying the 60 costs of rebuilding Holly Springs Road in DeSoto County and 61 drainage improvements to the road................... $3,000,000.00. 62 (e) To assist Carroll County, Mississippi, in paying 63 the costs of repair, renovation or replacement of a closed bridge 64 on County Road * * * 57 in Carroll County........... $ 500,000.00. 65 (f) To assist Lamar County, Mississippi, in paying the 66 costs associated with necessary infrastructure improvements in 67 Beat 5 of Lamar County and/or construction of recreational 68 facilities in Beat 5................................ $ 500,000.00. 69 (g) To assist Lamar County, Mississippi, in paying the 70 costs of improvements to the intersection of Scruggs Road and 71 Mississippi Highway 589, including, but not limited to, the 72 relocation of portions of the road, the purchase of property 73 related to the relocation, signage, paving, other costs related to H. No. 1173 *HR26/R1645CS.1* ~ OFFICIAL ~ 19/HR26/R1645CS.1 PAGE 3 (RF\KW) 74 improving the safety of the intersection and other road safety 75 projects in Supervisors District 5 of 76 Lamar County........................................ $1,500,000.00. 77 (h) To assist Bolivar County, Mississippi, in paying 78 the costs associated with preplanning and construction of a 79 Mississippi River landing dock facility and related 80 facilities in Bolivar County........................ $1,000,000.00. 81 (i) To assist Rankin County, Mississippi, in paying the 82 costs related to the extension of Gunter Road in 83 Rankin County....................................... $2,800,000.00. 84 (j) To assist the Pearl River Valley Water Supply 85 District in paying the costs associated with the repair, 86 rehabilitation, reconstruction or replacement of seawalls at the 87 Ross Barnett Reservoir as required by the settlement agreement in 88 the case of Bobby L. Baker, Jr., et al. v. Pearl River Valley 89 Water Supply District, in the Circuit Court of Rankin County, 90 Mississippi, Civil Action No. 212-133E.............. $4,000,000.00. 91 (k) To assist the City of Hattiesburg, Mississippi, in 92 paying the costs associated with resurfacing and other 93 improvements to Hardy Street in the City of Hattiesburg from its 94 intersection with U.S. Highway 49 East to its intersection with 95 West Pine Street in the City of Hattiesburg......... $ 400,000.00. 96 (l) To assist the City of Hattiesburg, Mississippi, in 97 paying the costs associated with resurfacing and other 98 improvements to 38th Avenue in the City of H. B. No. 1173 *HR26/R1645CS.1* ~ OFFICIAL ~ 19/HR26/R1645CS.1 PAGE 4 (RF\KW) 99 Hattiesburg......................................... $ 100,000.00. 100 (m) To assist Hinds County, Mississippi, in paying the 101 costs of construction and development of the Byram-Clinton Parkway 102 project in Hinds County............................. $2,000,000.00. 103 (n) To assist the City of Senatobia, Mississippi, in 104 paying the costs associated with the following purposes, in the 105 following order: 106 (i) Construction and development of roundabout 107 projects and other improvements at the intersection of Main Street 108 and Scott Street and adjoining or related intersections in the 109 City of Senatobia; 110 (ii) Improvements at the intersection of Front 111 Street and Main Street in the City of Senatobia; and 112 (iii) Improvements at the intersection of Heard 113 Street and Main Street in the City of Senatobia..... $2,300,000.00. 114 Any such funds that are in excess of that needed to complete 115 the projects described in this paragraph shall be used to assist 116 the City of Senatobia in paying the costs associated with making 117 historically relevant infrastructure improvements in the city's 118 downtown historic district. In addition, the scope of work for 119 any projects described in this paragraph that are located in the 120 city's downtown historic district must be in keeping with the 121 character of the district. 122 (o) To assist in paying the costs associated with: H. No. 1173 *HR26/R1645CS.1* ~ OFFICIAL ~ 19/HR26/R1645CS.1 PAGE 5 (RF\KW) 123 (i) Constructing, developing, extending and 124 implementing wastewater infrastructure and related facilities, 125 systems and infrastructure within and/or near Gateway Industrial 126 Park in Pike County, Mississippi; and 127 (ii) Constructing access roads and related 128 infrastructure within and/or near Gateway Industrial Park in 129 Pike County......................................... $3,000,000.00. 130 (p) To assist the City of Petal, Mississippi, in paying 131 the costs associated with (i) the repair, rehabilitation, 132 resurfacing, construction and reconstruction of Leeville Road/Main 133 Street located in Forrest County, Mississippi, in the City of 134 Petal from its intersection with the Evelyn Gandy Parkway 135 southerly to the boundary of the corporate limits of the City of 136 Petal; and (ii) the repair, rehabilitation, resurfacing, 137 construction and reconstruction of Smithville Road located in 138 Forrest County, Mississippi, in the City of Petal... $ 750,000.00. 139 (q) To assist the Town of West, Mississippi, in paying 140 the costs associated with repairs, resurfacing and making other 141 improvements to streets in the Town of West......... $ 500,000.00. 142 (r) To assist Oktibbeha County, Mississippi, in paying 143 the costs associated with the resurfacing and repaving of Longview 144 Road in Oktibbeha County............................ $ 750,000.00. 145 (s) To assist in paying the costs associated with the 146 completion of the four-lane of Mississippi Highway 19 South at the 147 south Philadelphia City boundary intersection at Holland Avenue H.
