The work involves routine operational works for water supply system including bore wells operation, STP operation and operation Of R.O Plant.

The extent and nature of work has been given in Schedule of Rates (SOR) to be read in conjunction with SCC, Scope of work and SOR.

Based on the past experience of GAIL, the operation of water supply pump, operation of STP pumps, providing water supply services to GAIL Vihar and operation of bore wells requires round the clock deployment of pump operators and helpers i.e. one number operator and one number helper in each shift for three shift per day. One operator for RO plant in general shift & one sweeper in general shift shall be the requirement of minimum / necessary man power for successful execution of the work. However the idea of man power given above is just tentative hence the contractor shall always ensure the smooth and uninterrupted services by deploying sufficient man power because the above mentioned man power is just indicative. Smooth operation of water supply pumps, RO Plant, STP operation cum sweeping work shall be the sole responsibility of the contractor. In order to execute above work according to SoR and scope of work, minimum 8 (Eight) PaP (Project affected people) apart from other required man power shall be deployed by the contractor. Engaging minimum 08 PAP is an essential condition of the contract which should be followed in line with past trend.

The minimum wages of all the workers shall be disbursed as per Category/Area “C” of the notification issued by the office of the Dy. Chief Labour Commissioner, Kanpur, from time to time. Base of rates taken from the circular number: K-27(MW-RATES) 2017-B.IV dated 07/11/2017 issued by office of the deputy chief labour commissioner (Central), Shram Bhawan, ATI Campus, Udyog Nagar Kanpur. - 208022

The bidder has to quote the rate of item no. 1 of SOR in such a way so that payment of minimum wages (may be revised as per govt. notifications time to time during the contract), provident fund, Exgratia, Safety kit, premium of insurance policy, escalation of minimum wages (if any in future) and Contractor profit etc. is ensured easily for the engaged manpower. Remaining components of payment of workers according to labour law, will be dealt as per the provision given in the tender document elsewhere. In case the quoted rate of the bidder for item i.e. no. 1 is separately found to be less than the worked out for each shift on the basis of the applicable minimum wages as on the date of the technical bid opening including contribution of PF and Exgratia by the employer (including administrative charges) on prevailing rates, then the offer of the bidder shall be liable for rejection at the sole discretion of GAIL. Bidders are therefore, advised to quote the rates after going through all the prevalent provisions in this regard.

In addition to above the scope of work for other services shall be as per the SOR.

S P E C I A L C O N D I T I O N S OF C O N T R A C T

1.0 LOCATION AND SITE CONDITIONS:

2.1 GAIL Vihar Township is situated at a distance of 3 kms from Phaphund Railway Station, U.P. (India) on Howrah - Delhi main line.

The work is required to be done inside GAIL Vihar Township. Depending upon exigencies of work and as per instruction EIC, the work may require to be executed out Side Township. The bidder is advised to see the site conditions and nature of job before quoting his rates. It shall be taken that bidder has been the site conditions and no claim on this account shall be entertained at a later date. Job shall be done in strict compliance with tender specifications.

3.0 CONSTRUCTION WATER AND POWER: WATER AND ELECTRICITY SHALL BE PROVIDED BY GAIL FREE OF COST. THE SAME SHALL BE PROVIDED AT ONE LOCATION FROM THE NEAREST AVAILABLE SOURCE IN THE VICINITY OF THE SITE OF WORK. THE CONTRACTOR SHALL MAKE HIS OWN ARRANGEMENT FOR CONNECTION & FURTHER DISTRIBUTION ETC. AT HIS OWN COST.

4.0 TIME SCHEDULE: Total period of contract for this work will be for 24 months. The contract period for the work shall be reckoned from the date as mentioned in letter of award. The contract may be extended for further period of maximum 06 (Six) Months beyond 24 months on mutual acceptance basis.

GAIL reserves the right to terminate the contract without assigning any reason during the currency of the contract period by giving 30 days notice to the contractor.

5.0 DEFECT LIABILITY PERIOD: The tenderer shall guarantee all the work executed by him for a period of 03 months from the date of completion of work(s)/Part(s). If during this period any defect occur, the same shall be made good by the contractor at his own cost. Failure to comply with this requirement may result in the forfeiture of security deposit. However, in case of critical items, if the guarantee period is beyond defect liability

6.0 AUTHORISED REPRESENTATIVE OF THE CONTRACTOR: Authorized representative of the contractor shall be stationed at Dibiyapur and meet E-I-C twice in a week or more as per the requirement and shall always be available on mobile phone. If the authorized representative does not attend office as per above conditions and meet E-I-C then Rs. 500/- per incident will be deducted from the bill of the contractor,

7.0 TERMS OF PAYMENT:

(A) PAYMENT OF RUNNING BILLS: (i) 100% payment shall be released on completion of item / work as certified in the R.A bills. (ii) Payment will be released by HoD Finance GAIL Dibiyapur after due certification by the E-I-C. (iii) Bill shall be submitted at Central Dak System of GAIL Dibiyapur. (iv) Payment shall be done through e-payment only hence bidders are required to provide their bank detail for mapping of their bank account into GAIL’s system for payment.

(B) PAYMENT OF FINAL BILL: (i) Contractor must submit his final bill within sixty days of completion of the work and payment of the final bill shall be made to the contractor within 120 days of the submission of the bill and after completion of all obligations under the contract.

(ii) No Demand Certificate: The contractor shall submit No Demand Certificate (NDC) for the net payment as finalized in the final bill before release of payment. The final bill shall be paid only on submission of NDC, otherwise final bill will be paid only after one year of submission of the same, as per GAIL’s records and no claim of contractor shall be entertained thereafter.

The bills shall be submitted in a printed form in quadruplicate along with soft copy of bill. Security deposit and other taxes as applicable shall be deducted from the bills. Payment of running bills shall be made to the contractor within 15 days of the submission of the bill to Engineer-In Charge.

(i) Penalty For Non-Submission of bill in time:

The RA bills shall be submitted within 15 days from completed calendar month (but not more than maximum one month period). Penalty shall be imposed @ Rs. 5000/- per month on late Submission of bills beyond one month period except final bill.

(ii) All Labour payments shall be made only through e-payment to Bank Account of the workers directly. Documentary proof of the same is to be attached with monthly running bill. In case of non-submission of proof of e-payment of the workers, an amount of Rs.1000/- per month shall be deducted from subsequent month bills.

(iii) Penalty For Non-Payment Of Minimum Wages:

GAIL (India) Limited (A Government of India Undertaking- A Maharatna Company) Delay in payment of wages by the stipulated time period, i.e. latest by 7th day of subsequent month. If 7th day of a particular month is closed/holiday, then the wages shall be disbursed by the next working day. In case payment is made beyond above mentioned time period then Rs. 20/- per day per head shall be paid to the workers by the contractor along with the payment of monthly wages. In addition to above Rs. 1000/- per day shall also be deducted from the bill of the contractor. Delay will be counted up to the date of payment of wages. No other charges shall be payable on penalty amount.

(iv) Penalty For Not Providing Insurance Policy: Penalty of Rs.200/-only per day after 15 days from the date of issue of P.O. shall be imposed on monthly running bills in case of non-submission of valid workmen compensation insurance policy.

(v) Penalty For Non Payment of Ex-gratia : Penalty of Rs.1000/-only per person per month shall be imposed on running bill, if contractor fails to distribute ex-gratia to contract employee before 07(seven) days of Deepawali. The penalty shall be calculated from the due date of payment of ex-gratia (before 7 days of Deepawali) up to the date of payment of ex-gratia.

(vi) Penalty For Not Distributing Death Gratuity: If the contractor fails to disburse the Death Gratuity to the nominee of the deceased contract employee within one month from the date of death of contract employee, then an amount equal to the amount of Death Gratuity shall be deducted from the Running bill or from PBG / Security Deposit and will be paid to the nominee of the deceased contract employee.

(vii) Penalty For Noncompliance / non-submission of PF: If the contractor fails to submit the PF of engaged workers /non-compliance or violations of PF rules/ false representation of facts to avoid the payment of provident fund amount to the engaged manpower, an amount of Rs 70,000/-only as a penalty shall be deducted immediately from the deposited amount / PBG / SD amount and no bill shall be processed till finalization of case from statutory authority.

(viii) Penalty For not deploying Bio Metric attendance machine 2 numbers:

If the contractor fails to arrange Bio Metric attendance machine within one month of award of contract then Rs. 15,000/- per month shall be deducted from their running / final bill.

(ix) Penalty For not distributing kits and liveries:

If the contractor fails to distribute kits and liveries for more than 60 days from the scheduled date of start of the contract and more than 60 days after completion of one year then a penalty of Rs. 200/- per month per employee shall be deducted from the running bill of the contractor.

(X) PENALTY AGAINST VIOLATION OF SAFETY, HEALTH AND ENVIRONMENT RELATED NORMS:

GAIL (India) Limited (A Government of India Undertaking- A Maharatna Company) Annual health checkup for the deployed labourers is mandatory and its report to be submitted to Engineer-In-Charge (EIC). Against Violation of applicable Safety, Health and Environment related norms, a penalty of Rs. 5,000.00 per occasion shall be imposed to the contractor.

C.(X).1 Violation as above resulting in:

C.(X).2 Any physical injury, a penalty of 0.5% of the contract value (maximum of Rs. 50,000.00) per injury in addition to Rs. 5,000.00 as stated above.

C.(X).3 Fatal accident, a penalty of 1% of the contract value (Maximum of Rs.1, 00,000.00) per fatality in addition to Rs. 5,000.00 as stated Above.”

In addition to above, the attached Annexures (A&B) are also to be enclosed along with the tender documents.

(XI) PENALTY FOR NON PERFORMANCE:-

If the contractor fail to maintain the system and which results into breakdown of more than a day or 24 hrs , the penalty @ 1500.00 per day shall be levied in additions to other clauses of contract .

8.0 PAYMENT OF WAGES AND OTHER COMPONENTS:

Contractor is to pay its workmen the wages which should not be less than minimum wages as notified from time to time by Government of India or Government of Uttar Pradesh whichever is higher through e-banking, evidence of which is to be submitted with monthly running bill.

9.0 EXTRA ITEM /SUBSTITUED ITEMS: The rates for extra items/substituted items of work, ordered to be operated / executed shall be derived as under:

a) If the item of work is similar to the item for which, the bidder has quoted rates in SOR, the quoted rate shall be applicable.

b) If the rate for the item does not appear in the SOR, the rate shall be derived from similar items of work indicated in SOR

c) The rates for those items of work which cannot be derived from quoted rates in the SOR shall be derived from the prevailing market rates of material and labour plus 10% towards contractor’s overheads and profits. The opinion of the Engineer in charge as to the current market rates for materials and the quantum of labour and material involved per unit shall be final and binding on the contractor. For this purpose and for the purpose of sub-clause (c) above, the coefficient of labour, material and wastage shall be adopted from the CPWD analysis of rates/standard schedule of rates as decided by the Engineer –in charge. The contractor shall submit vouchers /quotations in proof of rates paid /likely to be paid for material and labour.

GAIL (India) Limited (A Government of India Undertaking- A Maharatna Company) Above provisions for derivation of rates of extra items/substituted items shall supersede the provisions indicated in GCC.

10.0 PF/EPF 1. Contractor should also produce necessary EPF/ESIC code before commencement of work. 2. Contractor should also produce necessary EPF/ESIC code before commencement of work or workmen who are not covered under ESI Act, the contractor should appropriate workmen compensation insurance policy and submit a copy of the same to GAIL (India) Limited. All concerned officials in GAIL are requested to ensure effective compliance before commencement of work. 11.0 Ex-Gratia payment: Exgratia payment shall be paid as per provision given in the tender document.

12.0 Providing Safety Gears to Contract Employees: Safety gears shall be paid as per provision given in the tender document. Necessary dress two set of cotton uniforms- two shirts & two trousers for man worker with one pair of shoes, two pair of socks, one cap & one number full sleeves sweater per year shall essentially be provided by the contractor to the workers engaged in the work on annual basis.

13.0 MEASUREMENT OF WORK FOR PAYMENT for SOR Item Number:01

Monthly payment of Item No.1 shall be made on the basis of SOR

(Quoted prices are inclusive of contractor profit and hence no separate payment shall be made against contractor profit).

14.0 The attendance/payment sheet showing attendance of workers, minimum wages, PF details as per the format attached as Annexure ‘I’ shall be submitted along with the running bill as a proof for claiming payment against SOR Item No.1, The minimum wages to be considered for payment shall be as per category “C” under Area “C” (for employment in maintenance activities) as per the notification issued from time to time by the Office of the Dy. Chief Labour Commissioner (Central), Kanpur / GAIL Dibiyapur and circulated .

The Minimum wages as per circular K-27(MW-RATES/2017-B.IV dated-07.11.2017 of ALC is as under.

Rs.359/-00 per man day (unskilled), Rs.420/-00 per man day (Semiskilled), Rs.506/-00 per man day (skilled), Effective from 01.10.2017 is considered for calculation of minimum wages rate for item no.-1,

Where both Central and State Government has fixed the minimum rates of Wages, the rates of wages whichever is higher will be applicable.”

Monthly targets of scope of work, which has to be completed by the contractor, shall be indicated by EIC. Attendance of workers shall be taken up through Biometric Attendance System from the very 2nd month of award of the contractor. Hence the contractor shall arrange Biometric Attendance System within first month i.e. within 30 days of award of contract failing which due penalty shall be imposed as per the relevant clause of tender document mentioned elsewhere.

16.0 GST shall be paid as per guideline.

17.0 SPECIFICATIONS: The specification for the entire work shall be in accordance with latest CPWD specifications and latest IS codes. Whenever these codes are silent, the same shall be governed by sound engineering practice and the decision of the Engineer-In-Charge in matter of interpretation shall be final and binding on the contractor. GCC/CPWD Specifications are kept in Civil Department at Compressor station Dibiyapur and tenderer must inspect and read carefully before submitting their quotation. It is fully read and understood by the tenderer irrespective of the fact whether they have done so or not and no claim on this account shall be entertained at a later date. It is deemed understood that the tenderer have thoroughly read the GCC before filling in the rates.

18.0 ORDER OF PRECEDENCE: In case of ambiguity in Schedule of Rates (SOR), Special condition of contract, general conditions, specifications, drawings the following order of precedence will prevail: (a) Telex/Telegram/Fax of intent, detailed letter of intent along with statement of agreed variations and its enclosures and any corrigendum/addendum. (b) Schedule of Rates (SOR) (c) Special /Additional conditions of contract. (d) Specifications/Special notes regarding specifications / drawings in conjunction with each other. (e) General conditions of contract.

19.0 VARIATION IN QUANTITIES OF ITEMS DURING EXECUTION: During execution of item/work variation in individual quantities may be up to any limit (plus and minus) as per the site requirement. The contractor shall be bound to execute them at the rates quoted by him. GAIL also reserves the right to split the item/work in full or in part during its execution (depending upon exigencies of work) without assigning any reason thereof. The decision of Engineer-In-Charge/any authorized person by GAIL shall be final and binding on the contractor in this regard.

20.0 SAMPLES FOR APPROVAL: The contractor shall furnish to the Engineer-In-Charge for approval samples of all material to be used in the item/work. Such samples shall be submitted before item/work is commenced in advance. It is the responsibility of the contractor to arrange for tests as required by Engineer-In-Charge at his own cost. GAIL (India) Limited (A Government of India Undertaking- A Maharatna Company) installation. Contract shall procure materials as indicated in list of approved makes (if given) / or materials with ISI certification may also be used after approval of EIC/any authorized person by GAIL.

21.0 COMPLETION CERTFICATE: Within one month of the completion of work(s)/Part(s) in all respect, the contractor shall be furnished with a certificate by the Engineer-In-Charge of such completion, but no certificate shall be given nor shall the work be deemed to have been executed until all surplus materials and rubbish is cleared off the site completely nor until the work shall have been measured by the Engineer-In- Charge whose measurement shall be binding and conclusive. The works will not be considered as complete and taken over by the owner, until all the temporary works, labour and store and colonies etc. constructed are removed and the work site cleared to the satisfaction of the Engineer-In-Charge. If the contractor fails to comply with the requirements of this clause on or before the date fixed for the completion of the works, the Engineer-In-Charge may at the expenses of the contractor remove such, surplus materials and rubbish and disposal off the same as he thinks fit and clean off such dirt as aforesaid, and the contractor shall forthwith pay the amount of all expenses incurred and shall have no claim in respect of any such surplus materials as aforesaid except for any such actually realized by the sale thereof.
