Main results of the Council

The Council discussed the situation in Kyrgyzstan following the violent confrontation in the south and adopted conclusions underlining the need to restore public order and build democratic institutions and confirming the EU's readiness to provide urgent humanitarian aid.

The Council held an exchange of views with International Quartet Envoy Tony Blair on the situation in Gaza following the Israeli operation in international waters against the Flotilla. It adopted conclusions calling for an immediate, full and impartial inquiry, declaring that the situation in Gaza is unsustainable and calling for the policy of closure to be changed and the crossings to be opened for the flow of humanitarian aid, commercial goods and persons. It declared that the EU is ready to contribute to the implementation of a mechanism to permit the reconstruction of Gaza and the revival of its economy.

The Council discussed Iran's nuclear programme and adopted conclusions welcoming UN Security Council Resolution 1929 imposing a fourth round of sanctions. It also prepared for the discussion by Heads of State or Government at the on Thursday on measures to accompany and support the UN Resolution.

Ministers discussed the Western Balkans with ICTY prosecutor Serge Brammertz . The Council adopted conclusions welcoming the outcome of the high-level meeting on the Western Balkans in Sarajevo on 2 June 2010 and recalling the EU's commitment to the European perspective of the Western Balkan countries in line with the Thessaloniki Agenda.

In its conclusions, the Council notes that Serbia has maintained its cooperation with the Tribunal, states that ministers agreed to submit the Stabilisation and Association Agreement with Serbia to their parliaments for ratification, and welcomes Serbia's application of 22 December 2009 for membership of the European Union. It also expresses concern about the political situation in Albania , Ministers also raised the situation in the former Yugoslav Republic of Macedonia.

Ministers discussed the situation in Somalia and the issue of piracy , and were given a briefing by the outgoing Commander of the EU naval operation EU NAVFOR ATALANTA, Rear-Admiral Peter Hudson . The Council adopted conclusions prolonging Operation EUNAVFOR Atalanta for a further two years and agreeing in principle to extend the Area of Operations further to the east and south

Ministers discussed Cuba in the context of the annual evaluation of the EU's common position.

The Council adopted the EU position for the UN high-level meeting on the millennium development goals in New York in September. It also discussed gender equality and development.

MILLENNIUM DEVELOPMENT GOALS

TheCouncilheldanexchangeofviewsinpreparationfortheUnitedNationshighlevelplenary meetingtobeheldinNewYorkfrom20to22SeptembertoreviewimplementationoftheUN's millenniumdevelopmentgoals(MDGs).

ItapprovedconclusionssettingouttheEUpositionforthemeeting.

TheMDGsconstitutethefirsteversetofshareddevelopmentgoalsagreedatinternationallevel. Worldleadersagreedin2000totakedecisiveactiontocombatworldpovertyinitsdifferent dimensionsby2015,usingtimeboundandmeasurabletargets.Withonlyfiveyearsremaininguntil thedeadline,theaimoftheNewYorkmeetingwillbetoprovideacomprehensivereviewof successesandshortcomings,andtoagreeonconcreteactiontospeedupprogress.

TheEUhasdoubleditsofficialdevelopmentassistancesince2000inpromotingtheMDGs.In 2009itprovidedEUR49billion,morethanhalfthetotalofglobaldevelopmentaid.

AnEUactionplanongenderequalityandwomen'sempowermentindevelopmentisattachedtothe Councilconclusions.

GENDER EQUALITY AND DEVELOPMENT

TheCouncilheldabriefexchangeofviewsongenderequalityanddevelopmentpolicy,endorsing anEUplanofactionongenderequalityandwomen'sempowermentindevelopment.

EAST AFRICA - PIRACY

TheCounciltookstockofthesituationinEastAfrica,followingavisitbytheHighRepresentative attheendofMay,discussingbrieflyhowtoaddresstherootcausesofpiracyintheregion. Itconfirmeditssupportforacomprehensiveapproachintheregion,linkingsecuritypolicywith development,theruleoflaw,respectforhumanrights,genderrelatedaspectsandinternational humanitarianlaw.

TheEUhascommittedEUR215.4millionfordevelopmentaidtoSomaliathroughtheEuropean developmentfundforthe200813period.TheEuropeanCommission'sdevelopmentaid programmeforSomalia(includingallregionsofsouthcentralSomalia,PuntlandandSomaliland) amountstoalmostEUR180millionfor87projects.Themainareasofdevelopmentcooperationare governance,securityandsupportforcivilsociety,education,theproductivesectorsandrural development.HumanitarianaidfromtheEUamountedtoEUR45.8millionin2008.

GAZA - Council conclusions

TheCounciladoptedthefollowingconclusions:

"1. TheEUdeeplyregretsthelossoflifeduringtheIsraelimilitaryoperationininternational watersagainsttheFlotillasailingtoGazaandcondemnstheuseofviolence.TheCouncil believesthatanimmediate,fullandimpartialinquiryintotheseeventsandthe circumstancessurroundingthemisessential.Tocommandtheconfidenceofthe internationalcommunitythisshouldincludecredibleinternationalparticipation.

2. ThesituationinGazaremainsunsustainable.Thecontinuedpolicyofclosureis unacceptableandpoliticallycounterproductive.TheEUcallsforanurgentand fundamentalchangeofpolicyleadingtoadurablesolutiontothesituationinGaza.Inline withUNSCResolution1860,theEUreiteratesitscallforanimmediate,sustainedand unconditionalopeningofcrossingsfortheflowofhumanitarianaid,commercialgoods andpersonstoandfromGazaincludinggoodsfromtheWestBank.TheCouncilcallsfor asolutionthataddressesIsrael'slegitimatesecurityconcernsincludingacompletestopto allviolenceandarmssmugglingintoGaza.

3. TheCouncildeploresthecontinuingactsofrocketfire.Allthoseresponsiblemusttake immediateandconcretestepstoceaseandpreventsuchviolence.TheCouncilcallson thoseholdingtheabductedIsraelisoldierGiladShalittoreleasehimwithoutdelay.Hamas mustalsounconditionallyallowICRCaccessandenditsinterferencewiththeoperations ofNGOsandUNagenciesinGaza.

4. TheEUstandsreadytocontributetotheimplementationofamechanismbasedonthe 2005AgreementonMovementandAccessthatwouldpermitthereconstructionofGaza andtherevivalofitseconomy.Tothisend,fullandregularaccessvialandcrossings,and possiblybysea,onthebasisofalistofprohibitedgoods,shouldbetheprimeaim,whileat thesametimeprovidingstrictcontroloverthedestinationofimportedmerchandise.To achieveprogressontheground,theHighRepresentativewillcontinuetoengagewiththe GovernmentofIsrael,thePalestinianAuthority,Quartetmembersandotherappropriate partiesasamatterofurgencyandpresentEUoptionswithaviewtothenextForeign AffairsCouncil.

5. TheCouncilrecallsitsconclusionsofDecember2009.TheEUstressestheparamount importancethattheproximitytalkscontinuewithaviewtotheresumptionofdirect negotiationswhichshouldleadtoasettlementnegotiatedbetweenthepartieswithin24 months.AlleffortstoachievePalestinianreconciliationbehindPresidentMahmoudAbbas mustbeaccelerated.TheCouncilacknowledgesEgyptianeffortsinthisrespect."

WESTERN BALKANS - Council conclusions

TheCounciladoptedthefollowingconclusions:

"THE SARAJEVO MEETING

TheCouncilwelcomestheoutcomeoftheHighLevelMeetingontheWesternBalkans,organised bytheCouncilPresidencyandchairedbytheForeignMinisterofSpain,MrMoratinos,whichtook placeon2June2010inSarajevotomarkthe10 th anniversaryoftheZagrebsummitandappreciates theparticipationofallpartners.TheCouncillooksforwardtoappropriatefollowuptothemeeting.

Recallingitsconclusionsof7/8December2009,theCouncilreaffirmstheEU'sunequivocal commitmenttotheEuropeanperspectiveoftheWesternBalkancountriesinlinewiththe ThessalonikiAgendaandinaccordancewiththerenewedconsensusonenlargementandlooks forwardtomovingtothenextstagesoftheprocess.TheCouncilreiteratesthateachcountry's progresstowardstheEuropeanUniondependsonitsindividualeffortstocomplywiththe CopenhagencriteriaandtheconditionalityoftheStabilisationandAssociationProcess.

TheCouncilwelcomesthecommitmentoftheWesternBalkanstointensifythepaceofreformin keyareas.Itstressestheimportanceofaddressingthechallengesahead,inparticularrelatedtothe ruleoflaw,includingthefightagainstcorruptionandorganisedcrime.

TheCouncilwelcomesthecommitmentoftheWesternBalkanstofurtherstrengthenregional cooperationonthebasisoftheprinciplesofinclusivenessandregionalownership.Itwelcomes recentcommendableinitiativesregardingreconciliationandencouragesfurthereffortstothiseffect. TheCouncilrecallstheimportanceofregionalcooperationandgoodneighbourlyrelationsand encouragesallpartiesconcernedtoaddressoutstandingissueswithneighbouringcountries.

RecallingitspreviousconclusionsaccordingtowhichtheEUstronglysupportsthegoalofthe abolishmentofthevisaregimeforallthecountriesoftheWesternBalkans,aswellasthejoint statementoftheEuropeanParliamentandtheCouncilof30November2009,theCouncilwelcomes theprogressachievedbyAlbaniaandBosniaandHerzegovinainreachingthecriteriaofvisa liberalisation,asstressedintheCommissionproposalof27May2010foraEuropeanParliament andCouncildecisiontoamendRegulation539/2001,asitappliestoMemberStates.TheCouncil andtheEuropeanParliamentwilltakeadecisionassoonastheCommissionassessesthatallthe outstandingbenchmarksaremetandinthelightofsuchassessment.

SERBIA

FollowingthelatestreportoftheProsecutoroftheICTY,theCouncilnotesthatSerbiahas maintaineditscooperationwiththeTribunalwithaviewtodeliveringfurtherpositiveresults.

TheCouncilencouragesSerbiatofollowtherecommendationsoftheProsecutor.

RecallingtheCouncilconclusionsof29April2008and7/8December2009,Ministersagreedto submittheStabilisationandAssociationAgreementtotheirparliamentsforratification.

TheCouncilunderlinesthatfullcooperationwiththeICTYremainsanessentialelementofthe StabilisationandAssociationAgreement.

TheCounciltooknotethatSerbiaappliedformembershipoftheEuropeanUnionon22December 2009andwelcomedSerbia'scommitmenttoEUintegration.TheCouncildecidedtoreturntothe membershipapplication.

ALBANIA

TheCouncilcontinuestobeconcernedaboutthepoliticalsituationinAlbaniafollowingthegeneral electionson28June2009.Itwelcomesthereturnoftheoppositiontotheparliamentinconnection withthefacilitationinitiativebyMEPsDaulandSchulz,onbehalfoftheirpoliticalgroups,which wassupportedbytheHighRepresentativeandbyCommissionerFüle.Itishightimetofinda solutiontothecurrentcrisisonabasiswhichwillstandthetestoftime.

TheCouncilregrets,however,thatthefacilitationinitiativehasnotyetfoundsufficientsupportto enabletheAlbanianGovernmentandtheoppositiontoovercometheirdifferences.TheCouncil reiteratesthatitistheresponsibilityoftheGovernmentofAlbaniatogetherwiththeoppositionto promptlyfind,inatransparentmannerandinfullrespectoftheAlbanianconstitution,solutionsand waysforwardwhichwillberequiredforthecountryonitsEUpath.

TheCouncilencouragesAlbaniatoactivelycontinuewiththenecessaryreformsforthesmoothand timelyimplementationoftheStabilisationandAssociationAgreement,takingintoaccountthe EuropeanPartnershippriorities,anditreiteratesitssupportfortheEuropeanperspectiveforthe country.

TheCouncilrecallsthatAlbania'sapplicationforEUmembership,submittedinApril2009,willbe assessedaccordingtotheprinciplessetoutintheEUTreatyandthecriteriadefinedbythe CopenhagenEuropeanCouncilin1993,aswellastheDecember2006EuropeanCouncil conclusionsontherenewedconsensusforenlargement.TheCouncilagreestoreturntothematter whentheCommissionhaspresenteditsopinion."

IRAN - Council conclusions

TheCounciladoptedthefollowingconclusions:

"TheCouncilwelcomestheadoptionoftheUnitedNationsSecurityCouncilResolution1929.This ResolutionunderlinesthedeepconcernswithintheinternationalcommunityaboutIran'snuclear programme.Theofferofnegotiationsremainsonthetable.TheCouncilreiteratesitssupportfora negotiatedsolutionandfortheeffortsoftheEUHighRepresentativeCatherineAshtontomeet withIraniancounterpartstodiscusstheirnuclearprogrammeandotherissuesofmutualconcern.

CHILD LABOUR - Council conclusions

TheCounciladoptedthefollowingconclusions:

"1. June12istheinternationaldayagainstchildlabour.Onthisdaytheinternational community,basedonastrongbeliefthatthevulnerabledeserveprotectionandthatthe youngdeserveafuture,commemorateoursharedgoalofachildlabourfreeworld.While duringtheperiod20002004theworldwitnessedadecreaseinchildlabour,sincethen, thispositivetrendhassloweddown.

2. TheCouncilexpressesitsdeepconcernaboutthefactthatover200millionchildrenare stillengagedinchildlabour,morethanahalfofwhichareinhazardouswork.TheCouncil reaffirmsitscommitmenttoprotectandpromotetherightsofthechild,includingtheright ofchildrentoenjoyeducationandtolivealifefreefromchildlabour.

3. TheCouncilstronglywelcomesthedocument‘CombatingChildLabour’preparedbythe Commission,followingtheCouncil’sdiscussioninMay2008.TheCouncilsupportsthe conclusioninthestudybytheCommissionthatthereisroomforsteppingupEUefforts towardseliminatingchildlabour,basedonacomprehensivepolicyapproach.TheCouncil agreeswiththeCommissionthattheEU’sandMemberStates’instruments–notablya policydialogue,combinedwithdevelopmentcooperationandtradeincentivescanbeused moreeffectivelytocontributetotheinternationallyagreedgoalofeliminatingtheworst formsofchildlabourby2016andeventuallyendingallformsofchildlabourifappliedin amutuallysupportivemannerandasapartofabroaderpolicyframeworkthatfocuseson developmentandpovertyeradication.

4; TheCouncilisfullyawareoftheroleandresponsibilitiesoftheEUinthestrifetowards endingchildlabour,andagreestotakeanumberofmeasurestofurtherincreaseits contributiontoreachingthisgoal.Particulareffortsarecalledfortocounterallformsof discriminationthatcontributestochildlabour,andtoaddresshazardousworkbychildren inregions,sectorsandoccupationswherechildlabourismostprevalent.TheCouncil considersthefollowingmeasuresasafirststepfollowingthereportbytheCommission andwillreverttotheissue.

5. Dialogueandmultilateralaffairs–Thepromotionoftherightsofthechildconstitutean integralpartoftheEU’shumanrightspolicy.TheEUGuidelinesforthePromotionand ProtectionoftheRightsoftheChildstresstheneedtomainstreamtheserightsinEU policyandaction.TheCouncilemphasizesthattheeliminationofchildlabourisalegal obligationbasedininternationaltreatiesandconventions,inparticulartheConventionon theRightsoftheChildandILOConventions138and182.ItinvitestheHR,the CommissionandEUMemberStatestoactivelyencourageeffectiveimplementationof theseobligationsinEUdialogueswiththirdcountries.

TheCouncilrecallsthatworstformsofchildlabourconstituteviolenceagainstchildren.It affectsveryyoungchildren,andentailsseriousphysicalandemotionalharm.TheCouncil welcomestheappointmentbytheUNSGofMartaSantosPaisasSpecialRepresentative onViolenceagainstChildrenandiscommittedtoworkwithher,inparticularonfollowup totheUNSG’sreportonchildlabourpresentedatthelastsessionoftheUNGAaswellas theresolutionadoptedbytheGeneralAssembly.Thecouncilstressestheneedforusing effectivelythemultilateralsystemandexistingpartnershipswhilerecognizingtheleadrole oftheILOincombatingchildlabour.

7. DevelopmentCooperationDevelopmentcooperationbytheEUdonorsrepresentsan importantcontributionintheeffortstocombatchildlabour.TheCouncilnotesthatthe eradicationofchildlabourrequiresaholisticapproach,includingthroughprevention,and isnotonlyamatterofimprovinghumanrights,italsoyieldshighsocialandeconomic returnsandcontributestoeradicatingpovertyandpromotinghumandevelopment.The CouncilinvitestheCommission,andMemberStates,toencouragepartnercountriesto adoptandimplementNationalActionPlansagainstChildLabour,Timebound Programmestoendtheworstformsofchildlabouratthelatestby2016,includechild labourintheILODecentWorkCountryPrograms,andinregionalstrategiestotackle transborderformsofchildlabour.

8. TheCouncilinvitestheCommissionandtheMemberStatestoworkwithpartnercountries toensurethatchildren’srights,includingthefightagainstchildlabourwhereitoccurs,is mainstreamedinpovertyreductionstrategiesandaddressedinallrelevantsectors.The Councilwelcomestheinclusionofaspecificcallforproposalsonchildlabourwithinthe ThematicprogrammeInvestinginPeople.

9. TheCouncilreaffirmsitsDecember2009conclusionsonHumanRightsandDemocracyin ThirdCountries,inwhichitexpresseditsfullsupportfortheworkoftheUNSpecial RepresentativeonBusinessandHumanRights.Bytakingthenecessarystepstoimplement theproposedUNFrameworkonBusinessandHumanRights,theEuropeanUnionwould alsomakeasignificantcontributiontocombatingchildlabour.TheCouncilalsoaffirmsits supportfortheILOTripartiteDeclaration,theUNGlobalCompactandtheOECD GuidelinesforMultinationalEnterprises.TheCouncilwouldwelcomeafuture CommissionCommunicationonCSRwhichaddressestheissueofbusinessandhuman rightsintheglobalcontextandgivesdueconsiderationtotheissueofchildlabour.Inthis context,theCouncilinvitestheCommissiontoorganiseamultistakeholderconference withrepresentativesofthebusinesscommunity,civilsociety,internationalorganisations, EUInstitutions,andMemberStates,todiscussprogressmadeandwhatfurtherstepsmay betaken.

9a. TheCouncilwouldwelcomefutureCommissionguidelinesonsociallyresponsible procurement,andencouragesprocuringauthoritiestouseexistingpossibilitiestotakeinter aliasocialconsiderationsintoaccountatthedifferentstagesoftheprocurementprocess, wheneverpossibleanddeemedtoberelevanttotheindividualprocurement.

10. Tradeincentives–TheCouncilunderlinestheimportanceoftheGSP+topromote sustainabledevelopmentandgoodgovernanceincludingtheeffectiveimplementationof theILOconventions138and182.Tothatend,theCouncilinvitestheCommissionto improvetheGSPschemeinthecontextoftheupcomingreviewoftheGSPregulation.

PIRACY OFF THE COAST OF SOMALIA - Council conclusions

"TheCouncilnoteswithconcernthecontinuingimpactofpiracyoffthecoastofSomaliaon internationalmaritimesecurityandontheeconomicactivitiesandsecurityofcountriesinthe region.TheCouncilreiteratesitsdeterminationtostrengthentheEU’soverallengagementto enhanceregionalcapacitytofightpiracy.

Kyrgistan - Council conclusions

TheCounciladoptedthefollowingconclusions:

"TheCouncilexpressesitsseriousconcernovertheviolentconfrontationinthesouthof Kyrgyzstan,whichhasalreadyleadtoasignificantnumberofcasualties.Itexpressesitssincere condolencestothefamiliesofthevictims.

TheCouncilunderlinestheneedtorestorepublicorderandrespectfortheruleoflaw,insiststhat allviolenceandprovocationsshouldceaseimmediatelyandcallsonallsidestoshowrestraint. Dialoguemustberestoredasamatterofpriority.

TheCouncilinsistsontheneedtopursuethepoliticalprocesstobuilddemocraticinstitutionsin Kyrgyzstan,notablythroughthereferendumonanewconstitutionandearlyelectionsasannounced bytheprovisionalgovernment.Thisprocessrepresentsthebestchancetoensurepeace,institutional stability,opendialogue,ruleoflawanddemocracyforthepeopleofKyrgyzstan.

EU/ Uzbekistan - Memorandum of understanding on energy

TheCouncilendorsedthetextofamemorandumofunderstandingoncooperationwithUzbekistan inthefieldofenergy.

TheMemorandumfollowsupthestrategyforanewpartnershipbetweentheEUandthecountries ofCentralAsia,adoptedbytheEuropeanCouncilinJune2007,whichhighlightedthecommon interestindiversifyingexportroutes,demandandsupplystructuresandenergysources,and supportingthedevelopmentofmarketeconomystructuresintheCentralAsia.

Relations with Central Asia

TheCouncilapprovedajointreportbytheCouncilandtheCommissionontheimplementationof theEUstrategyforCentralAsia.

Thereportstatesthatimplementationofthestrategyhasenabledimportantadvancesoverthepast threeyearsineducation,asregardseconomicdevelopment,tradeandinvestment,energyand transport,environmentalpolicies,andcommonthreatsandchallenges.Importantinitiativeshave alsobeenputinplacetopromotehumanrights,ruleoflaw,goodgovernanceanddemocratisation.

Iraq - Integrated Rule of Law mission

TheCounciladoptedadecisionextendingby24monthstheEU'sintegratedruleoflawmissionin Iraq(EUJUSTLEXIraq),from1July2010to30June2012.

Duringthisadditionalperiod,EUJUSTLEXwillprogressivelyshiftitsactivitiesandrelevant structurestoIraq,focusingonspecialisedtraining,whilemaintainingoutoffcountryactivities.

ThedecisionprovidesforanadditionalfinancialreferenceamountofEUR17.5million.

TakingintoaccountfurtherdevelopmentsinthesecurityconditionsinIraqandtheoutcomeofthe mission'sactivitiesinIraq,theCouncilwillexaminetheresultsofthenewmandateanddecideon thefutureofthemissionafter30June2012.

Partnership and cooperation agreement with Uzbekistan

TheCouncilauthorizedtheCommissiontoopennegotiationsonanagreementamendingtheEU's partnershipandcooperationagreementwithUzbekistan.

TheCounciladoptedthefollowingconclusions:

"1. TheCouncilrecallsitsConclusionsof8December2009welcomingtheexpressed commitmentofArmenia,AzerbaijanandGeorgiatoenhancetheirrespectiverelationswith theEUwithintheframeworkprovidedbytheEasternPartnership,asaspecificEastern dimensionoftheEuropeanNeighbourhoodPolicy.

TheEUiscommittedtoassistthepartnercountriesinthisregard.

3. TheCouncilnotesthattherecentdecisionontheestablishmentofthenewsubcommittees underthePartnershipandCooperationAgreementscurrentlyinforcewiththecountriesof theSouthCaucasuswillconsiderablybroadenthesectoraldialogueandcontributeto advancingtheimplementationoftheENPActionPlans.

4. TheCouncilrecognisesthehighimportanceattachedtomobilityofcitizensbythecountries oftheSouthCaucasus.Bearinginmindtheimportanceofasecureenvironment,andin accordancewiththeStockholmProgrammeandtheJointDeclarationofthePragueEastern PartnershipSummit,theEUstandsreadytopromotemobilityofcitizensoftheSouth CaucasuscountriesandotherEasternPartnershipcountriesthroughvisafacilitationand readmissionagreements,andoncethesearesuccessfullyconcludedandimplemented,move towardsacontrolledprocesstakinggradualstepstowardsvisaliberalisationasalongterm goal,onacasebycasebasis,aswellasdescribetheconditionsforwellmanagedand securemobility.Inthiscontext,theCouncilhasinvitedtheCommissiontodevelopbefore theendof2010aplanonhowtotakecooperationforwardinthisarea.
