DANGEROUSLY FREE: OUTLAWS AND NATION-MAKING IN LITERATURE OF THE INDIAN TERRITORY by Jenna Hunnef A thesis submitted in conformity with the requirements for the degree of Doctor of Philosophy Graduate Department of English University of Toronto © Copyright by Jenna Hunnef 2016 Dangerously Free: Outlaws and Nation-Making in Literature of the Indian Territory Jenna Hunnef Doctor of Philosophy Department of English University of Toronto 2016 Abstract In this dissertation, I examine how literary representations of outlaws and outlawry have contributed to the shaping of national identity in the United States. I analyze a series of texts set in the former Indian Territory (now part of the state of Oklahoma) for traces of what I call “outlaw rhetorics,” that is, the political expression in literature of marginalized realities and competing visions of nationhood. Outlaw rhetorics elicit new ways to think the nation differently—to imagine the nation otherwise; as such, I demonstrate that outlaw narratives are as capable of challenging the nation’s claims to territorial or imaginative title as they are of asserting them. Borrowing from Abenaki scholar Lisa Brooks’s definition of “nation” as “the multifaceted, lived experience of families who gather in particular places,” this dissertation draws an analogous relationship between outlaws and domestic spaces wherein they are both considered simultaneously exempt from and constitutive of civic life. In the same way that the outlaw’s alternately celebrated and marginal status endows him or her with the power to support and eschew the stories a nation tells about itself, so the liminality and centrality of domestic life have proven effective as a means of consolidating and dissenting from the status quo of the nation-state. -

‘A Man of Courage and Activity’: Thomas Tew and Pirate Settlements of the Indo - Atlantic Trade World, 1645 -1730 1 Kevin McDonald Department of History University of California, Santa Cruz “The sea is everything it is said to be: it provides unity, transport , the means of exchange and intercourse, if man is prepared to make an effort and pay a price.” – Fernand Braudel In the summer of 1694, Thomas Tew, an infamous Anglo -American pirate, was observed riding comfortably in the open coach of New York’s only six -horse carriage with Benjamin Fletcher, the colonel -governor of the colony. 2 Throughout the far -flung English empire, especially during the seventeenth century, associations between colonial administrators and pirates were de rig ueur, and in this regard , New York was similar to many of her sister colonies. In the developing Atlantic world, pirates were often commissioned as privateers and functioned both as a first line of defense against seaborne attack from imperial foes and as essential economic contributors in the oft -depressed colonies. In the latter half of the seventeenth century, moreover, colonial pirates and privateers became important transcultural brokers in the Indian Ocean region, spanning the globe to form an Indo-Atlantic trade network be tween North America and Madagascar. Let Privateers Marque Terrorism: A Proposal for a Reawakening ROBERT P. DEWrrE* INTRODUCTION In the aftermath of the terrorist attacks of September 11, the United States has repeatedly emphasized the asymmetry between traditional war and the War on TerrorlI-an unorthodox conflict centered on a term which has been continuously reworked and reinvented into its current conception as the "new terrorism." In this rendition of terrorism, fantasy-based ideological agendas are severed from state sponsorship and supplemented with violence calculated to maximize casualties.' The administration of President George W. Bush reinforced and legitimized this characterization with sweeping demonstrations of policy revolution, comprehensive analysis of intelligence community failures,3 and the enactment of broad legislation tailored both to rectify intelligence failures and provide the national security and law enforcement apparatus with the tools necessary to effectively prosecute the "new" war.4 The United States also radically altered its traditional reactive stance on armed conflict by taking preemptive action against Iraq-an enemy it considered a gathering threat 5 due to both state support of terrorism and malignant belligerency. -

Navigating the Atlantic World: Piracy, Illicit Trade, and the Construction of Commercial Networks, 1650-1791 Dissertation Presented in Partial Fulfillment of the Requirements for the Degree of Doctor of Philosophy in the Graduate School of The Ohio State University by Jamie LeAnne Goodall, M.A. Graduate Program in History The Ohio State University 2016 Dissertation Committee: Margaret Newell, Advisor John Brooke David Staley Copyright by Jamie LeAnne Goodall 2016 Abstract This dissertation seeks to move pirates and their economic relationships from the social and legal margins of the Atlantic world to the center of it and integrate them into the broader history of early modern colonization and commerce. In doing so, I examine piracy and illicit activities such as smuggling and shipwrecking through a new lens. They act as a form of economic engagement that could not only be used by empires and colonies as tools of competitive international trade, but also as activities that served to fuel the developing Caribbean-Atlantic economy, in many ways allowing the plantation economy of several Caribbean-Atlantic islands to flourish. Ultimately, in places like Jamaica and Barbados, the success of the plantation economy would eventually displace the opportunistic market of piracy and related activities. Plantations rarely eradicated these economies of opportunity, though, as these islands still served as important commercial hubs: ports loaded, unloaded, and repaired ships, taverns attracted a variety of visitors, and shipwrecking became a regulated form of employment. In places like Tortuga and the Bahamas where agricultural production was not as successful, illicit activities managed to maintain a foothold much longer. -

Advisory Opinions and the Problem of Legal Authority Christian R. Burset* The prohibition against advisory opinions is fundamental to our understanding of federal judicial power, but we have misunderstood its origins. Discussions of the doctrine begin not with a constitutional text or even a court case, but a letter in which the Jay Court rejected President Washington’s request for legal advice. Courts and scholars have offered a variety of explanations for the Jay Court’s behavior. But they all depict the earliest Justices as responding to uniquely American concerns about advisory opinions. This Article offers a different explanation. Drawing on previously untapped archival sources, it shows that judges throughout the anglophone world—not only in the United States but also in England and British India— became opposed to advisory opinions in the second half of the eighteenth century. The death of advisory opinions was a global phenomenon, rooted in a period of anxiety about common-law authority. -

Frederick Douglass This paper explores the voyage of the slave ship Creole, which left Virginia in 1841 with a cargo of 135 persons bound for New Orleans. Although the importation of slaves from Africa into the United States was banned from 1808, the expansion of slavery into the American Southwest took the form of forced migration within the United States, or at least beneath the United States’s flag. -

4 Nordhoff and Hall’s Mutiny on the Bounty: A Piece of Colonial Historical Fiction Sylvie Largeaud-Ortega University of French Polynesia Introduction Various Bounty narratives emerged as early as 1790. Today, prominent among them are one 20th-century novel and three Hollywood movies. The novel,Mutiny on the Bounty (1932), was written by Charles Nordhoff and James Norman Hall, two American writers who had ‘crossed the beach’1 and settled in Tahiti. Mutiny on the Bounty2 is the first volume of their Bounty Trilogy (1936) – which also includes Men against the Sea (1934), the narrative of Bligh’s open-boat voyage, and Pitcairn’s Island (1934), the tale of the mutineers’ final Pacific settlement. The novel was first serialised in the Saturday Evening Post before going on to sell 25 million copies3 and being translated into 35 languages. Captain William Kidd
Captain William Kidd Name: William Kidd. Born: Dundee, 1654. Occupation: Sea captain. Defending English and American trade routes First ship: Antigua. He emigrated to New York in the 1680’s. Married: Sarah Bradley Cox Oort, a wealthy widow. On 6 September 1696, Kidd and 150 crew members went to capture a pirate called Robert Culliford in the Indian Ocean. aboard the Adventure Galley. His crew took over his ship on the way. This is called mutiny. Kidd was forced to become a pirate himself. In 1698, Kidd and his crew attacked and took a ship: the cargo was silk, muslin, calico, sugar, opium, iron and salt peter and a worth rumoured to be £70,000 . The Quedah Merchant, renamed the Adventure Prize, was kept by Kidd, as he was forced to abandon and sink his now leaking ship. Being a pirate was now against the law in England and America but Kidd did not know this on his return to America in 1699. He buried the treasure on his way to Boston in Gardiner Island and Block Island. The New England governor, Lord Richard Bellomont, had him arrested on 7 July 1699 in Boston. He was sent to England in February 1700. The trial started on 8 May and was completed the next day – the verdict was that Kidd was guilty of the murder of one of his crew and guilty of multiple acts of piracy. Captain William Kidd was hanged on 23 May 1701. His corpse was left to rot at the Thames River as an example to other would-be pirates. -

And, during the following two to three weeks, all of the various high offices in the government and the royal household were filled. Most of the politically powerful posts went either to tories or to moderates. The tory Earl of Danby was made Lord President of the Council and another tory, the Earl of Nottingham was made Secretary of State for the Southern Department. The office of Lord Privy Seal was given to the Atrimming@ Marquess of Halifax, whom dedicated whigs had still not forgiven for his part in bringing about the disastrous defeat of the exclusion bill in the Lords= house eight years earlier. Charles Talbot, Earl of Shrewsbury, who was named Principal Secretary of State, can really only be described as tilting towards the whigs at this time. But, at the Admiralty and the Treasury, both of which were put into commission, in each case a whig stalwart was named as the first commissioner--Lord Mordaunt and Arthur Herbert respectivelyBand also in each case a number of other leading whigs were named to the commission as well.i Whig lawyers, on the whole, did rather better than their lay fellow-partisans. Devonshire lawyer and Inner Temple Bencher Henry Pollexfen was immediately appointed Attorney- General, and his cousin, Middle Templar George Treby, Solicitor General. -
