St. Elmo Nauman, Jr. 3 CHAPTER ONE Thaddeus Bachman’s antique shop was the crown jewel of Worth Street, a renovated and gentrified slice of the Village dedicated to separating the upscale from their money. Bachman’s famed brownstone rubbed elbows with Lubitsch Rare And Hard To Find Books on the west and The Estelle Gallery, featuring Outstanding Western And Wildlife Art on the east. Bachman’s four-story brownstone had been built in 1898 by a shipping heir, and had been equipped with a ballroom on the top floor. Bachman renovated the joint stem to stern, turning the first floor into his main showroom. Four broad steps led to his generous red granite stoop, a double wrought-iron gate protecting his Italian hand-carved oak doors from the depredations of the hoi polloi. At ten a.m. on a Tuesday morning, those gates should have been open, allowing ingress to Bachman’s loyal customers, who included several members of the House of Saud as well as a Baldwin or two. In particular, they should have been opened to admit Robert Hotchkiss, Esq., an investment banker facing a messy divorce. -

THE McFARLANE DEFENDANTS’ BRIEF IN OPPOSITION TO PLAINTIFF’S MOTION FOR ORDER DECLARING GAIMAN’S INTEREST IN CERTAIN COMIC BOOK CHARACTERS Defendants Todd McFarlane and Todd McFarlane Productions, Inc. (together, the “McFarlane Defendants”) submit this brief in opposition to plaintiff Gaiman’s motion for an order declaring that he has a copyright interest in the following three comic book characters: Dark Ages Spawn, Tiffany and Domina (the “Pending Accounting Motion”). INTRODUCTION As more fully discussed below, there are three distinct and fully sufficient grounds on which to deny the Pending Accounting Motion: 1. Mr. Gaiman is improperly attempting, through a post-judgment accounting procedure, to expand the judgment in this action to grant him an ownership interest in three additional copyrights despite having never asserted any such claim in the lawsuit. In particular, the three characters at issue in his motion were never raised in any fashion whatsoever—or even mentioned—in his pleadings or at trial in this case. Now, after judgment, Mr. Gaiman seeks improperly to supplement the record with hand-selected images that are misleading in their appearance. Due process requires that any adjudication of these new claims concerning additional characters be one in which the evidence can be tested, authenticated and explained to a trier of fact. A quasi-administrative, post-judgment accounting procedure is not the proper time or place, and this Court should reject Mr. Gaiman’s effort to obtain by way of motion what he has never sought by way of trial. -

In my MA thesis, I examine closely the allusive qualities of the white knowledge present in Pratchett’s Tiffany Aching series: The Wee Free Men (2003), A Hat Full of Sky (2004), Wintersmith (2006), I Shall Wear Midnight (2010) and The Shepherd’s Crown (2015). -

Ver. 1.4 by CoreAnon Welcome, to the Universe of Spawn. A dark, violent world where Heaven and Hell battle endlessly for human souls and Armageddon is only a moment away. Though a long-standing truce has forbid the full might of Heaven and Hell warring on the face of the Earth, elite agents of both powers roam the surface of the planet, furthering the agendas of their respective masters. You will begin your 10 years here about a week after Al Simmons has awakened in a trash-filled alley, or the latter half of 1992 according to the comic’s timeline. You, too, will awaken in New York City – also in a trash-filled alley, though not the same one. Everyone’s gotta start somewhere… However, you’re special, Jumper. You’ve got a certain air about you. You’re a protagonist, aren’t you? A main character. The type that gets drawn into things, a single person that’s at the center of shifts of power, the catalyst of cataclysms if you wanted to get poetic about it. Don’t be surprised: I can spot your kind a mile away. But that leaves me in a bit of a bind, you know? If you’re going to be a major player, but without a team to play on… you see where I’m going with this? While it’s great you’re so independent, it would really throw things out of whack if you just did whatever you wanted without picking a side. So… which will it be? Heaven… or Hell? Some people talk about their dissertation or book as a labour of love. The one remaining matter for the court’s determination is plaintiff Neil Gaiman’s motion to compel defendants to turn over all documents in their possession relating to income attributable to three characters known as Domina, Tiffany and Dark Ages Spawn, featured in a series of comics written and published by defendants Todd McFarlane, McFarlane Productions and TMP International, Inc. The issue in dispute is whether the three characters are derivative of two characters known as Angela and Medieval Spawn that are subject to the parties’ joint copyright interest. The parties agree that they are co-owners of Angela and Medieval Spawn. Defendants 1 Case: 3:02-cv-00048-bbc Document #: 323 Filed: 07/30/2010 Page 2 of 14 do not contest plaintiff’s right to an accounting and division of profits for the posters, trading cards, clothing, statuettes, animated series on HBO, video games, etc. that feature those characters. The dispute is limited to information about the profits earned from Dark Ages Spawn, Tiffany and Domina, which defendant has refused to provide to plaintiff. Defendants contend that these characters are not subject to plaintiff’s copyright because they were based solely on plaintiff’s ideas and not on any physical expression of those ideas. -

Biographical Dictionary of Kansas Artists (active before 1945) Compiled by Susan V. Craig, Art & Architecture Librarian Univ. of Kansas August 2006 1 This book began with a 1981 reference question about John Noble, a name I did not recognize despite having studied art history and worked as an art librarian for more than 10 years. Learning that John Noble was a Kansas artist, I went looking for the best available book on Kansas art only to learn the resources were few. As a new faculty member at the Univ. of Kansas, I needed to establish a research project so I decided to prepare a dictionary of Kansas artists thus fulfilling both the research requirement and educating myself about the history of the visual arts in my native state; I just didn't intend the project to take 25 years or realize that I would have more than 1750 entries in the dictionary. I began by defining the scope of the work: • "Kansas artist" was loosely defined as artists who were both born in the state as well as artists who were born elsewhere but were artistically active in Kansas. Under this latter definition, I included artists who produced significant artworks such as the murals installed in Kansas post offices. Occasionally, artists who lived or worked primarily in Kansas City, MO may be included. I did not deliberately include all Kansas City artists but neither did I exclude them if the name came from a Kansas source such as the Kansas State Gazetteer. • Another choice I made was to look for artists who were artistically active before 1945.
