1 Critical Pedagogy, Cultural Studies, and Radical Democracy at the Turn
Critical Pedagogy, Cultural Studies, and Radical Democracy at the Turn of the Millennium: Reflections on the Work of Henry Giroux By Douglas Kellner (http://www.gseis.ucla.edu/faculty/kellner/) After publishing a series of books that many recognize as major works on contemporary education and critical pedagogy, Henry Giroux turned to cultural studies in the late 1980s to enrich education with expanded conceptions of pedagogy and literacy.1 This cultural turn is animated by the hope to reconstruct schooling with critical perspectives that can help us to better understand and transform contemporary culture and society in the contemporary era. Giroux provides cultural studies with a critical pedagogy missing in many versions and a sustained attempt to link critical pedagogy and cultural studies with developing a more democratic culture and citizenry. The result is an intersection of critical pedagogy and cultural studies that enhances both enterprises, providing a much-needed cultural and transformative political dimension to critical pedagogy and a pedagogical dimension to cultural studies. Crucially, Giroux has linked his attempts to transform pedagogy and education with the project of promoting radical democracy. Giroux's earlier work during the 1970s and 1980s focused on educational reform, pedagogy, and the transformation of education to promote radical democracy. In Border Crossings (1992), Giroux notes "a shift in both my politics and my theoretical work" (1). The shift included incorporation of new theoretical discourses of poststructuralism and postmodernism, cultural studies, and the politics of identity and difference embodied in the new discourses of class, gender, race, and sexuality that proliferated in the post- 1960s epoch. -

Apologetics and defeatism are equally unacceptable. Additionally, with regard to education in particular, marxists have constantly emphasised its imbrication in society and history. So assessments of marxism's contributions to education, made particularly at a time when its standing is parlous or at best problematic, need a clear understanding of the shifting demography of revolutionary aspiration. Marx is bedecked with garlands of roses, while behind him, pensively peering over his shoulder, stands a small boy sucking his fingers. Below is a card on which is written, 'Du hattest ja so recht' - 'You were so right'. A touching vignette? A surprising tribute? A sly nostalgia? On May 7 1973, Time magazine published a feature article on the remarkable renaissance of Karl Marx. -

'Cancel culture' doesn't stifle debate, but it does challenge the old order Billy Bragg Speech is only free when everyone has a voice – that’s why young people are angry Outside Broadcasting House in London, the BBC has erected a statue to one of its former employees, George Orwell. The author leans forward, hand on hip, as if to make a telling point. Carved into the wall beside him is a quote from the preface of Animal Farm: “If liberty means anything at all, it means the right to tell people what they do not want to hear.” It’s a snappy slogan that fits neatly into a tweet, but whenever I walk past this effigy of the English writer that I most admire, it makes me cringe. Surely the author of Nineteen Eighty-Four would understand that people don’t want to hear that 2+2=5? For Orwell’s quote is not a defence of liberty; it’s a demand for licence, and has become a foundational slogan for those who wilfully misconstrue one for the other. Over the past decade, the right to make inflammatory statements has become a hot button issue for the reactionary right, who have constructed tropes such as political correctness and virtue signalling to enable them to police the limits of social change while portraying themselves as victims of an organised assault on liberty itself. The latest creation in their war against accountability is “cancel culture”, an ill-defined notion that takes in corporate moves to recognise structural racism, the toppling of statues, social media bullying, public shaming and other diverse attempts to challenge the status quo. -

Rhode* This article explores the leadership challenges that arose in the wake of the 2020 COVID-19 pandemic and the widespread protests following the killing of an unarmed Black man, George Floyd. Lawyers have been key players in both crises, as politicians, general counsel, and leaders of protest movements, law firms, bar associations, and law enforcement agencies. Their successes and failures hold broader lessons for the profession generally. Even before the tumultuous spring of 2020, two-thirds of the public thought that the nation had a leadership crisis. The performance of leaders in the pandemic and the unrest following Floyd’s death suggests why. The article proceeds in three parts. Part I explores leadership challenges during the COVID-19 pandemic and the missteps that put millions of lives and livelihoods as risk. It begins by noting the increasing frequency and intensity of disasters, and the way that leadership failures in one arena—health, environmental, political, or socioeconomic—can have cascading effects in others. Discussion then summarizes key leadership attributes in preventing, addressing, and drawing policy lessons from major crises. Particular attention centers on the changes in legal workplaces that the lockdown spurred, and which ones should be retained going forward. Analysis also centers on gendered differences in the way that leaders addressed the pandemic and what those differences suggest about effective leadership generally. Part II examines leadership challenges in the wake of Floyd’s death for lawyers in social movements, political positions, private organizations, and bar associations. -

The Rules of #MeToo Jessica A. Clarke† ABSTRACT Two revelations are central to the meaning of the #MeToo movement. First, sexual harassment and assault are ubiquitous. And second, traditional legal procedures have failed to redress these problems. In the absence of effective formal legal pro- cedures, a set of ad hoc processes have emerged for managing claims of sexual har- assment and assault against persons in high-level positions in business, media, and government. This Article sketches out the features of this informal process, in which journalists expose misconduct and employers, voters, audiences, consumers, or professional organizations are called upon to remove the accused from a position of power. Although this process exists largely in the shadow of the law, it has at- tracted criticisms in a legal register. President Trump tapped into a vein of popular backlash against the #MeToo movement in arguing that it is “a very scary time for young men in America” because “somebody could accuse you of something and you’re automatically guilty.” Yet this is not an apt characterization of #MeToo’s paradigm cases. -
