Thank you for letting me review these inspection reports. Although there are things in the reports that make me suspicious and procedures that seem less rigorous than what we would want , I don't see any hard evidence that venting of Freon or other CFCs is taking place. In the absence of an observation of a violation of that, I do not think a referral to EPA is warranted.

However, their record keeping seems sloppy, and they sho uld be told what is required. If they don't improve after you notify them of the requirements, maybe a referral would be warrant ed a t that point .

I have enclosed a copy of the EPA regulations that apply to junk yards (and other CFC disposal sites) . The relevant sections are §182.156(f) and (h) on pp. 26715 and 26716. ("MVAC" in t hese regulations means "motor vehicle air conditioner." )

Specifically, the regs require that whenever a junk yard receives a car, they must evacuate the (if there is any), or get a signed statement from the seller of the car that there isn't any. It doesn't seem that they are requiring these signed statements, nor are they keeping meticulous records.
