Ct. No. C9890809) v. JOHN PAUL FLOREZ, Defendant and Appellant. Defendant John Paul Florez is currently serving a “Three Strikes” sentence. Following the passage of Proposition 36, the Three Strikes Reform Act, he filed a petition for resentencing under Penal Code section 1170.126.1 Although he was eligible to be resentenced based on his current and past offenses, the trial court exercised its discretion to find that resentencing him “would pose an unreasonable risk of danger to public safety” (§ 1170.126, subd. (f)) and denied his petition. Defendant appealed. For the reasons set forth below we find no merit in any of defendant’s arguments on appeal and affirm the order denying his petition. FACTUAL AND PROCEDURAL BACKGROUND In 1998, police officers saw defendant urinating behind a convenience store in San Jose. Officers believed defendant dropped something on the ground. Shortly thereafter, officers discovered a small bag containing 0.19 grams of cocaine near where defendant 1 Unspecified statutory references are to the Penal Code. had been standing. Officers also determined that defendant was under the influence of opiates and cocaine. In 1999, defendant pleaded guilty to a felony for possession of a cocaine base and a misdemeanor for being under the influence. He also admitted he had been convicted of four prior strike convictions within the meaning of the former Three Strikes Law and that he had served three prior prison terms. -

This article is brought to you by the William & Mary Law School Scholarship Repository. https://scholarship.law.wm.edu/facpubs CONSTITUTIONAL A VOIDANCE AND THE ROBERTS COURT Neal Devins • This essay will extend Phil Frickey's argument about the Warren Court's constitutional avoidance to the Roberts Court. My concern is whether the conditions which supported constitutional avoidance by the Warren Court support constitutional avoidance by today's Court. For reasons I will soon detail, the Roberts Court faces a far different Congress than the Warren Court and, as such, need not make extensive use of constitutional avoidance. In Getting from Joe to Gene (McCarthy), Phil Frickey argues that the Warren Court avoided serious conflict with Congress in the late 1950s by exercising subconstitutional avoidance. 1 In other words, the Court sought to avoid congressional backlash by refraining from declaring statutes unconstitutional. Instead, the Court sought to invalidate statutes or congressional actions based on technicalities. If Congress disagreed with the results reached by the Court, lawmakers could have taken legislative action to remedy the problem. This practice allowed the Court to maintain an opening through which it could backtrack and decide similar cases differently without reversing a constitutional decision. In understanding the relevance of Frickey's argument to today's Court, it is useful to compare Court-Congress relations during the Warren Court of the late 1950s to those during the final years of the Rehnquist Court. -

1 Summary of papers written by Judicial Officers on the subje ct: ªLAW OF PRECEDENTº Introduction :- A precedent is a statement of law found in the decision of a superior Court, which decision has to be followed by that court and by the courts inferior to it. Precedent is a previous decision upon which the judges have to follow the past decisions carefully in the cases before them as a guide for all present or future decisions. In other words, `Judicial Precedent' means a judgment of a Court of law cited as an authority for deciding a similar set of facts, a case which serves as authority for the legal principle embodied in its decision. A judicial precedent is a decision of the Court used as a source for future decision making. Meaning :- A precedent is a statement of law found in decision of a Superior Court. Though law making is the work of the legislature, Judges make law through the precedent. 2 Inferior courts must follow such laws. Decisions based on a question of law are precedents. Decisions based on question of facts are not precedents. Judges must follow the binding decisions of Superior or the same court. Following previous binding decisions brings uniformity in decision making, not following would result in confusion. It is well settled that Article 141 of the Constitution empowers the Supreme Court to declare the law and not to enact the law, which essentially is the function of the legislature. To declare the law means to interpret the law. This interpretation of law is binding on all the Courts in India. -
A Guide to Critical Legal Studies
BOOK REVIEW A GUIDE TO CRITICAL LEGAL STUDIES. By Mark Kelman.* Harvard University Press, Cambridge, Massachusetts and London, England, 1987. Pp. 360. $30.00. Reviewed by David L. Gregoryt I A Guide to CriticalLegal Studies,1 written by Professor Mark Kel- man of Stanford Law School, definitely has merit but will nonetheless disappoint many. For those unfamiliar with the academic legal literature of the Critical Legal Studies (CLS) movement, the book fails as an an- nounced guide. At the same time, for those who are more informed, the book does not say enough that is new. The book is grossly mistitled; no attempt is made to initiate the novice gradually into the complexities of critical legal theory. Professor Kelman, a very sophisticated and erudite scholar,2 makes the mistake of presuming that his audience will already be familiar with the major tenets of critical legal theory. The previously uninformed but intellectually curious prospective reader will find the book an intimidating baptism by fire, more closely akin to total immer- sion than to serving as any sort of road map or guide. These readers are better advised to explore critical legal studies literature through prior law review articles; Professor Kelman's extensive footnotes 3 handily refer the * Professor of Law, Stanford University. C.M.A. MCCAULIFF* The Bill of Rights provides broadly conceived guarantees which invite specific judicial interpretation to clarify the purpose, scope and meaning of particular constitutional safeguards. Two time- honored but apparently divergent approaches to the jurisprudence of constitutional interpretation have been employed in recent first amendment cases: first, history has received prominent attention from former Chief Justice Burger in open-trial, family and reli- gion cases; second, natural law has been invoked by Justice Bren- nan in the course of responding to the Chief Justice's historical interpretation. History, although indirectly stating constitutional values, provides the closest expression of the Chief Justice's own jurisprudence and political philosophy. -

Even in remedies, where the line persists, the conventional scholarly wisdom favors erasing it. Yet something surprisinghas happened. In a series of cases over the last decade and a half, the U.S. Supreme Court has acted directly contrary to this conventional wisdom. These cases range across many areas of substantive law-from commercial contracts and employee benefits to habeas and immigration, from patents and copyright to environmental law and national security. Throughout these disparate areas, the Court has consistently reinforced the line between legal and equitable remedies, and it has treated equitable remedies as having distinctive powers and limitations. This Article describes and begins to evaluate the Court's new equity cases. -

It came into force on 29 July 1957, upon the fulfilment of the relevant provisions of paragraph E of Article XXI. The Statute has been amended three times, by application of the procedure laid down in paragraphs A and C of Article XVIII. On 3 I January 1963 some amendments to the first sentence of the then paragraph A.3 of Article VI came into force; the Statute as thus amended was further amended on 1 June 1973 by the coming into force of a number of amendments to paragraphs A to D of the same Article (involving a renumbering of sub-paragraphs in paragraph A); and on 28 December 1989 an amendment in the introductory part of paragraph A. I came into force. All these amendments have been incorporated in the text of the Statute reproduced in this booklet, which consequently supersedes all earlier editions. This Article critiques two representative theories (or families of theories), originalism and nontextualism, and offers a principled alternative, which we call “controlled activism.”
