Canadian Sanctions and Canadian charities operating in Zimbabwe: Be Very Careful! By Mark Blumberg (January 7, 2009) Canadian charities operating in Zimbabwe need to be extremely careful. It is not the place for a new and inexperienced charity to begin foreign operations. In fact, only Canadian charities with substantial experience in difficult international operations should even consider operating in Zimbabwe. It is one of the most difficult countries to carry out charitable operations by virtue of the very difficult political, security, human rights and economic situation and the resultant Canadian and international sanctions. This article will set out some information on the Zimbabwe Sanctions including the full text of the Act and Regulations governing the sanctions. It is not a bad idea when dealing with difficult legal issues to consult knowledgeable legal advisors. Summary On September 4, 2008, the Special Economic Measures (Zimbabwe) Regulations (SOR/2008-248) (the “Regulations”) came into force pursuant to subsections 4(1) to (3) of the Special Economic Measures Act. The Canadian sanctions against Zimbabwe are targeted sanctions dealing with weapons, technical support for weapons, assets of designated persons, and Zimbabwean aircraft landing in Canada. There is no humanitarian exception to these targeted sanctions. There are tremendous practical difficulties working in Zimbabwe and if a Canadian charity decides to continue operating in Zimbabwe it is important that the Canadian charity and its intermediaries (eg. Agents, contractor, partners) avoid providing any benefits, “directly or indirectly”, to a “designated person”. Canadian charities need to undertake rigorous due diligence and risk management to ensure that a “designated person” does not financially benefit from the program. -

The theme of succession, both of the State Presidency and the leadership of ZANU PF, increasingly bedevils all matters relating to the political stability of Zimbabwe and any form of transition to democracy. The constitutional issues related to the death (or infirmity) of the President have been dealt with in several reports by the Research and Advocacy Unit (RAU). If ZANU PF is to select the nominee to replace Robert Mugabe, as the state constitution presently requires, several problems need to be considered. The ZANU PF nominee ought to be selected in terms of the ZANU PF constitution. -

The Zimbabwe Human Rights NGO Forum (also known as the “Human Rights Forum”) has been in existence since January 1998. Uriri , for the respondent (plaintiff) Exception MATHONSI J: The defendants (who are the excipients in this matter) have excepted to the plaintiff’s (who is respondent) declaration and I have, to decide whether that exception has merit or not. The plaintiff is a government Minister, being the Minister of Defence, and a senior member of a political party known as the Zimbabwe African National Union Patriotic Front (Zanu PF) which is one of the ruling parties in the current government of national unity. The defendants are the owner of a publication which is said to enjoy wide circulation in Zimbabwe, namely the Zimbabwe Independent, and its editor. In the Zimbabwe Independent edition of 11 May 2012, an article was published in the front page under the title “Mnangagwa Ready to Rule”. The article reads in pertinent part thus: “Defence Minister Emmerson Mnangagwa (pictured) has for the first time openly declared his interest in taking over from President Robert Mugabe as the leader of Zanu PF and the country, in remarks showing the succession battle in the party is intensifying. Mnangagwa told the Zimbabwe Independent last Friday at Heroes Acre during the burial of Zanu PF politburo member Edson Ncube he was ready to govern if given an opportunity. This virtually confirmed he is positioning himself to succeed Mugabe, remarks which could anger senior Zanu PF officials and fuel factionalism and internal power struggles ahead of the next elections. -
Intelligence and the Politics of Zimbabwe's Presidential Succession
INTELLIGENCE AND THE POLITICS OF ZIMBABWE’S PRESIDENTIAL SUCCESSION BLESSING-MILES TENDI* ABSTRACT Since the late 1990s, Zimbabwean politics has been shaped by the political succession war raging within the ruling ZANU PF party. The internal fight to succeed President Robert Mugabe pitted a faction controlled by retired General Solomon Mujuru, who was fronting his wife Joice Mujuru, against another faction led by Emmerson Mnangagwa, a government minister. The competition between these factions reached a crucial stage in 2014, when Mugabe dismissed Joice Mujuru as vice president and purged her key allies in ZANU PF and the government. This article examines the role of state intelligence in this struggle, arguing that the Military Intelligence (MI) leadership, which supported Mnangagwa in the succession war, surveilled Joice Mujuru and constructed a controversial gendered case to destroy her bid to succeed Mugabe. In contrast, some elements in the principal civilian intelligence institution, the Central Intelligence Organization, surveilled the Mnangagwa faction in order to support Joice Mujuru’s power bid. Mugabe was persuaded by MI to purge Joice Mujuru because she posed a threat to his hold on power. This course of action was also given some impetus by Mugabe’s longstanding grievance against her faction. The article widens scholarship on the security sector’s political interventions in Zimbabwean politics, whilst emphasizing how the gendered dimensions of surveillance can reinforce patriarchal national politics. President Robert Mugabe has led the ruling Zimbabwe African National Union Patriotic Front (ZANU PF) party and Zimbabwe since 1977 and 1980, respectively. Mugabe, a nonagenarian, is Africa’s oldest serving president. -

Executive Summary This report is the last of a three part series of thematic reports analysing the performance of the Seventh Parliament in the last year of its tenure. While the previous two reports assessed the aspects of the Seventh Parliament to do with attendance and gender; this last offering looks specifically at the achievements of Parliament , with particular regard to issues such as Bills passed, debates undertaken and legislative performance in general. The report notes, among other things, that: • The levels of participation and debate among Parliamentarians were generally low, with some members spending the entire year without contributing anything to pertinent discussions; • Although most ministers impressively managed to participate in either House of Assembly or Senate sessions, at least two-thirds of the ZANU PF ministers never participated in either the House of Assembly or Senate sessions, a worrying trend considering that they have held ministerial positions for longer; • Question and Answer sessions – an important process in Parliament- were characterised by poor attendance by Ministers.
