The Relators allege that the Defendant pharmacies submitted false or fraudulent claims to obtain federal funds from Government Healthcare Programs (GHP) to which they were not entitled. The Relators claim this occurred through the electronic submission of inflated usual and customary charges to GHPs because Defendants failed to report their cash price matches as their usual and customary price. I. INTRODUCTION Federal and State GHPs include Medicare, Medicaid, TRICARE and the Federal Employees Health Benefits Program. The federal government provides beneficiaries of GHPs with prescription drug-benefits through relationships with private subcontractors known as pharmacy benefit managers. GHPs would offer pharmaceutical benefits, reimbursing those providers who dispense covered drugs to program beneficiaries.

In addition to our retail outlets we operate a distribution center and water bottling plant in Abingdon, Virginia. In total, we employ over 13,000 associates. Today, we have 14 retail supermarkets in Kentucky where we employ approximately 1500 associates.
