The GoI, MoEF&CC has extended the said general approval to underground laying ofCNGI PNG pipelines along the roads within existing right of way not falling in National Parks and Wildlife Sanctuaries, without felling of trees, where the maximum size of the trench is not more than 2.00 meter depth and 1.00 meter width subject to fulfilment of conditions stipulated in the resolution of GoG Dated 15th September, 2016., referred above. In view of the above, the undersigned is pleased to convey the "in principle" approval of the State Government for Diversion of 2.1284 ha. Protected Forest land for laying across & along gas pipeline 4" M.S.90 MM MDPE, 125 MM MDPE & 160 MM MDPE gas pipeline underground of City gas distribution development in Umreth and Vasad Taluka of Anand District in favour of Managing Director, Charotar Gas Sahakari Mandli Ltd., Anand. subject to the following conditions:- 1. This permission is granted only for use of the forest land for the purpose specified in the proposal. The legal status of the forest land shall remain unchanged. 2. The Net Present Value (NPV) for the area to be diverted under the proposal shall be deposited by the user agency as per the orders of the Hon'ble Supreme Court of India dated 30.10.2002, 01.08.2003, ". 28.03.2008 and 09.05.2008 in IA-566 in W.P.(Civil) No. 20211995 and as per the guidelines issued by the MoEFCC vide letters No.5-111998- Il-" FC(pt-II) dated. 18.09.2003 as well as letter No.5-2/2006-FC dated 03.10.2006 and 5-3/2007-FC dated 05.02.2009 in this regards. 3. All the funds received from the user agency under the project shall be transferred/deposited to CAMPA fund only through e.portal. 4. User Agencies shall generate challan through OSMFWC portal before making payment for Stage-II Clearance process. All the fund shall be deposited through OSMFWC portal by the User Agency. 5. The forest land shall not be used for any purpose other than that specified in the FCA proposal. 6. User agency will have to obtain permission from the Nodal Officer (FCA), for carrying out any maintenance works in future. 7. User agency will have to restore the forest land after use/ maintenance work. No tree shall be cut. 8. User agency will be liable to compensate any loss to Forests/Environment caused due to the use of the said land by the user agency. 9. Project area is not a part of Protected arealSanctuarylNational Park and the project area is 50.00 Km. away from the Jambughoda Wildife Sanctuary. 10. User agency will seek permission from the Road & Building Department/Science & Technology Dept. Sachivalaya, Gandhinagar, if required so. 11. Gas pipe line will be laid underground in the trench of maximum depth of 2.00 meters and width of 0.5 meters, in between rows of road side plantation. 12. User Agency shall submit the details regarding compliance of MoEF's guideline dated 03.08.2009 and 05.02.2013 with regard to the Scheduled Tribe & Other Forest Dwellers (Recognition of Forest Rights) Act, 2006. FRA shall be uploaded on e.portal (https://parivesh.nic.in.). 13. Additional Conditions as per the Government ofGujarat's Resolution no. FCA-I013111-101111SF-241F,Dt.12.06.2015 shall be complied with. 14. Any other condition, which the State Government or Nodal Officer (FCA) may stipulate from time to time. 15. The Compliance report shall be uploaded on e.portal (https://parivesh.nic.in/). After receipt of the compliance report on the fulfilment of condition no. (2), (3), (4), (5), (12), (13) & (15) mentioned above from you, order of formal approval will be issued by this Department. ~J ( S. M.
