    Volume 93 Number 881 March 2011 The Layha for the Mujahideen:an analysis of the code of conduct for the Taliban fighters under Islamic law Muhammad Munir* Dr.Muhammad Munir is Associate Professor and Chairman,Department of Law, Faculty of Shari‘a and Law, International Islamic University, Islamabad. Abstract The following article focuses on the Islamic Emirate of Afghanistan Rules for the Mujahideen** to determine their conformity with the Islamic jus in bello. This code of conduct, or Layha, for Taliban fighters highlights limiting suicide attacks, avoiding civilian casualties, and winning the battle for the hearts and minds of the local civilian population. However, it has altered rules or created new ones for punishing captives that have not previously been used in Islamic military and legal history. Other rules disregard the principle of distinction between combatants and civilians and even allow perfidy, which is strictly prohibited in both Islamic law and international humanitarian law. We hardly find a reference to the economic ideas of Muslim scholars who lived in the 16th or 17th century, in works dealing with the history of Islamic economic thought. The period after the 9th/15th century remained largely unexplored. Dr. Islahi has ventured to investigate the periods after the 9th/15th century. He has already completed a study on Muslim economic thinking and institutions in the 10th/16th century (2009). In the mean time, he carried out the study on Muslim economic thinking during the 11th/17th century, which is now in your hand. As the author would like to note, it is only a sketch of the economic ideas in the period under study and a research initiative. It covers the sources available in Arabic, with a focus on the heartland of Islam. There is a need to explore Muslim economic ideas in works written in Persian, Turkish and other languages, as the importance of these languages increased in later periods.

Accordingly, it is necessary to extract the reason from the texts and attach it to the developments of contemporary reality to prove the ruling, and since the subject of the use of knowledge in which the word of majesty (Allah) is used.

[email protected] Abstract This article considers the celebrated elegy by the classical 7th-century Arabic poet, Abu Dhuʾayb al-Hudhali — his ʿayniyya, which ends with ʿayn as a rhyming letter. Analyzing the poem’s structure and comparing it with that of two poems composed by Abu Dhuʾayb’s teacher, Saʿida b. Juʾayya al-Hudhali, leads to the conclusion that Saʿida’s two poems were the main sources on which the pupil drew to create his poem. The sophisticated changes that Abu Dhuʾayb introduced in structure and content, however, made his poem more memorable than those of his teacher. The article raises another question, to which there is, as yet, no definitive answer: what was the true inspiration for Abu Dhuʾayb’s poem? Was it the death of his sons, as is traditionally believed, or was it literary: to surpass his teacher in composing a more skillful poem?
