1. Analysis of soil samples showed elevated levels of lead in the made ground on the site and both chrysotile and amosite fibres were detected. The details include an asbestos survey and the covering of areas of made ground with 600mm clean topsoil. The topsoil used be certified as suitable for residential gardens and should be sampled and the results submitted as part of the validation report to be submitted following the remediation work being carried out. 3 Prior to commencement of external walling, samples of all external walling and roofing materials shall be submitted for the written approval of the local planning authority. Thereafter development shall be carried out as approved.

A. IMPLEMENTATION OF GROUND GAS REMEDIATION SCHEME Prior to commencement of development a ground gas remediation scheme shall be submitted to and approved in writing by the local planning authority. Thereafter the approved remediation scheme must be carried out in accordance with its terms. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

B. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority.

6 Prior to the development hereby permitted being first brought into use a validation test of the sound attenuation works shall be carried out in accordance with the requirements of BS4242:2014 and the results submitted for the written approval of the local planning authority. The validation test shall be carried out by a competent person in accordance with an approved method statement and the results shall demonstrate that the noise levels stated in the Noise Impact Assessment reference ADT 2152/ENIA compiled by Acoustic Design Technology and dated 23 January 2015 have been met.

If these levels have not been achieved, irrespective of the sound attenuation work already carried out, a further scheme will be required incorporating the recommendations of an acoustic consultant to achieve the specified noise levels. This scheme shall be submitted to and approved in writing by the Local Planning Authority, installed before use of the development begins and thereafter retained.

7 No part of the development shall be brought into use until the vehicle access, parking, manoeuvring and turning areas (shown on drawing number 014125_P102 D Proposed Site Plan) are available for use, unless otherwise approved in writing by the Local Planning Authority. Once created these areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

8 There shall be no access or egress by any vehicles between the highway and the application site until details of the precautions to be taken to prevent the deposit of mud, grit and dirt on public highways by vehicles travelling to and from the site have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. These facilities shall include the provision of wheel washing facilities where considered necessary by the Local Planning Authority in consultation with the Highway Authority. These precautions shall be made available before any excavation or depositing of material in connection with the construction commences on the site and be kept available and in full working order and used until such time as the Local Planning Authority in consultation with the Highway Authority agrees in writing to their withdrawal.

9 Unless approved otherwise in writing by the Local Planning Authority there shall be no establishment of a site compound, site clearance, demolition, excavation or depositing of material in connection with the construction on the site until proposals have been submitted to and approved in writing by the Local Planning Authority for the provision of: (i) on-site parking capable of accommodating all staff and sub-contractors vehicles clear of the public highway

(ii) on-site materials storage area capable of accommodating all materials required for the operation of the site.

The approved areas shall be kept available for their intended use at all times that construction works are in operation. No vehicles associated with on-site construction works shall be parked on the public highway or outside the application site.

10 Prior to the development being brought into use the draft Harrogate College Travel Plan dated January 2015 shall be finalised and shall be submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The final travel plan shall include:

The Travel Plan shall be implemented and the development shall thereafter be carried out and operated in accordance with the Travel Plan.

1. SITE CHARACTERISATION An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature of contamination;

(ii) an assessment of the potential risks to: * human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, * adjoining land, * groundwaters and surface waters * ecological systems * archaeological sites and ancient monuments;

(iii) an appraisal of remedial options, and proposal of the preferred option(s).

This must be conducted in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'.

2. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

3. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works.

Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

4. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirement of section 1, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of section 2, which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with section 3.

10 No development shall take place until the applicant has provided for the approval in writing of the Local Planning Authority a Design Stage Code for Sustainable Homes Certificate for each new build dwelling type comprised in the development to be carried out by a BREEAM or STROMA licensed accredited Code assessor that achieves Code level 4 or higher. The Code Level to be achieved will be a minimum of: * Code Level 4 for dwellings to be completed between 2011 and 2015, and * Code Level 6 for dwellings to be completed after 2015 Development shall be carried out in accordance with the approved details.

11 A Post Construction Stage Certificate for each dwelling/dwelling type assessed shall be provided to the Local Planning Authority in writing, confirming that the required Code level has been met, prior to the first occupation of the first dwelling comprised in the development.
