1.0 BACKGROUND OF THE PROJECT

The Asian Development Bank together with the Australia Government (Aus AID) and the OPEC funds for International Development (OPEC) will contribute to the development of the Government of Lao PDR through the Northern GMS road network improvement project. The GMS Corridors are seen as initializing projects for economic cooperation in the sub region and serves the sub-regional development along the important axes. The improvement of the project corridor National Road-4 will facilitate development between the neighbouring countries. In particular the transport infrastructure will complement the Governments programs to promote agricultural and industrial production in the corridor of influence area by redressing the transport deficiencies and providing more reliable and less costly transport services. Under the proposed Northern GMS Transport Network Project some 370 km of the National Road- 4 is to be rehabilitated and improved in the province of and Sayaboury including a bridge crossing of the Mekong at Thadeua. In addition some 100 km of rural access roads will be improved under the community infrastructure component of the project.

2.0 OBJECTIVES OF THE EMP MONITORING

The rehabilitation of the National Road-4 would give rise a number of positive impacts, and give better connectivity to the rural areas with the adjacent towns. The adverse impacts during the construction stage can be mitigated by implementing the monitoring and the suitable mitigation measures at proper place and time. The EMP has been developed for mitigating the negative impacts through the activities below. x Reviewing the IEE Report prepared in 2007; x Site investigating to identifying additional negative impacts to be considered in the EMP; x Clarifying the institutional aspect that necessary for the implementation of EMP, including that for establishment of Environment Social Responsible Staff (ESRS). The Environmental Management Plan (EMP), deals strictly with those actions needed to monitor and mitigate potential negative environmental impacts of the project The EMP has the following components: 9 Environmental Control and Mitigation Measures. 9 Monitor the implementation Program 9 Reporting to the Designated Institutions. 9 Training and Capacity Buildings 9 Construction Supervision of Environment Procedures 9 Environmental monitoring Checklist

3.0 SCOPE AND REPORTING PERIOD

Reporting Period: 6 months from June till December 2011

Scope: Environmental control by monitoring of the civil work activities and the contractor’s action for the mitigation measures to be required.

4.0 METHODOLOGY

To ensure that all environmental requirements are being complied, the following activates are taken for the project implementation and monitoring arrangements:

(i) Weekly/daily environmental monitoring by the environmental officer of the contractor and consultant supervision staff will be done based on the Checklist attached, and the issues should be identified for the contractor’s action, (ii) Monthly environmental monitoring by the environmental officer of the contractor and RE of the consultant will be done based on the Control Sheet attached, and the RE of consultant will monitor the contractor’s activity if the rectification has been done or not in the deadline. (iii) If the contractor has not taken an action properly and the incident has caused serious damages to the environment, a penalty will be levied to the contractor in accordance with PS 22 of the Particular Specification of the Contract.

5.0 PROJECT STATUS

During this period from June till December 2011, the civil contractors have carried out the following activities on the project site, and will continue the same activities for subsequent period also.

6.0 COMPLIANCE WITH EMP

a. Environmental Performance Most of the environmental issues identified in the November 2011 ADB Review Mission have been rectified but there are some more further action by Contractors needed as recorded in Appendix 1, by photograph documents.

The other and/or new issues of non-compliance had been observed as of the early of November 2011 and further action and monitoring for improving the civil work to ensure all environmental requirements are conducted in December 2011. The Appendix 2 provides, a table for all civil work sections summarizing compliance with all environmental mitigation measures specified in the Civil Work Contract and EMP including details regarding the level of compliance (i.e., complied, not complied, partially complied, not applicable) with the provisions of implementation of specific mitigation measures.

b. Environmental Effects Monitoring (Air quality and noise, surface water quality etc.) Widespread environmental negative effects on air quality and noise, surface water quality have not been identified in the construction site and the neighbourhood. Therefore sampling and laboratory test have not been performed during the period. Local community along the construction road are continued to be exposed to excessive dust due to lack of dust control measures as show in photos (Appendix 3). The contractor was strongly required to provide it immediately and regularly water spraying on the construction.

7.0 ENVIRONMENTAL PERMITS / CLEARANCES

a. Government Environmental Approval The environmental certification on the IEE for the Project issued by WREA is only valid for two years from the date of issue in August 2007. MPWT was requested by ADB Mission in November 2011 to provide a copy of the renewal or extension certification from the Ministry of Natural Resources and Environment (MONRE), former WREA. The renewal of the Environmental Certificate for the Project from MONRE was issued on 4 January 2012 (Appendix 4).

b. Failure to Comply with the Environmental Permit In accordance with the civil work contract, failure on behalf of the contractor to reasonably comply with these measures may result in the levying of penalties by the Engineer of US$ 5,000 per occurrence. These amounts will be deducted from payment certificates. Deductions will be increased to US$ 10,000 per occurrence if the Contractor fails to comply after the first 3 occurrences. During this reporting period and also the previous period, such failures have not been identified.  8.0 COMPLAINT

The grievance monitoring is done by the SV consultant regularly as below:

(i) Both the monitoring and resettlement specialists visit the construction site regularly for monitoring the construction works. Also, the specialists regularly collect the grievance note from the grievance posts which are set up at the villages. (18 grievance posts have been set up in villages along the R4, 3-5 posts in each section of civil works.)

(ii) The monitoring specialists will notify the supervision staff (RE) immediately let the contractor take necessary measures to mitigate affects if there are negative impacts caused by the projects. 9.0 ENVIRONMENTAL TRAINING AND ORIENTATION

The Technical and Environmental Division (TED) has been assigned by the Road Department of the Ministry of Public Works and Transport (MPWT) to undertake environmental and social monitoring of impact of road construction and improvement in the ecologically sensitive and settlement areas. The objectives of this monitoring team are to ensure that the supervision consultants undertake close and regular monitoring of the contractors’ implementation of environmental mitigation measures and to guarantee that all necessary mitigations and environmental safeguards have been carried out in order to prevent or minimize adverse environmental impacts generating from the projects. • To assess the compliance of construction works to the Construction Environmental Management Plan (CEMP) • To view progress of environmental works being conducted and remained works that need to be done for the five contracts • To assess what environmental concerns that need to be addressed and • To find appropriate ways for the contractors comply with the CEMPs before issuing Taking- Over certificates to the contractors.

Target The MPWT team visited the entire project locations of the five contracts R4-1, R4-2, R4-3, R4-4 and R4-5 to review the ongoing works and construction activities carried out by the contractors. On each site visit the IEE and CEMP were used as baselines to assess whether the contractors have complied with the said documents.

Team member for the Program/Activity The Environmental and Social Monitoring of MPWT Team comprises the staffs of Technical and Environmental Division under DOR, the Environmental and Social Division of Public Works and Transport Institute, the representative of the representative from Public Work and Transport of Sayaboury province, the representative from Department of Natural Resources and Environment (DONRE) of Sayaboury province and the representative from Public Works and Transport of Luang Prabang and Sayaboury and District of 7 Districts along ADB11 road project. The second Environmental and Social Monitoring of MPWT Team carried out the activity between 14 and 19 December 2011 (Appendix 5)

Activity Schedule The TED plans to conduct the program for both environmental and social division monitoring 4 times during the Project implementation, that is in the middle of December 2010, May 2011, November 2011 and October 2012. The first and second activity by the Environmental and Social Monitoring Team of TED were conducted in December 2010 and December 2011. 

10.0 ISSUES FOR FURTHER ACTION

The corrective actions and action plans are specified in Appendix 2. The table provides details of; (i) Environmental impacts that have not been addressed or sufficiently addressed, (ii) specific actions to be undertaken to resolve identified issues, (iii) responsible persons ( contractor ) who will carry out such actions, (iv) target date to carry out and complete required actions.

11.0 CONCLUSION

While most of the environmental issues identified in the November 2011 ADB review mission, have been rectified, new issues of non-compliance had been arisen since then. It is therefore further action and monitoring for improving the civil work to ensure all environmental requirements are needed. The regular environmental monitoring on the corrective action and plans based on the control sheet Appendix 2 would be very effective and useful.

To be directly responsibility for implementation of Initial Environmental Examination Report, Resettlement Plan and including the Environmental Management Action Plan for mitigation measurement that contain in this updated detail Environmental Management Action Plan in September 2011. In case there are some new issues happen in the project which are not assess in the IEE and RP, the project owner should do supplementary assessment for Environmental and Social Management Plan including those mitigation measurement and also to ensure adequate budget in order to implementation. b. To restore whole affected areas of the project after completed project. c. The project owner should establish quarterly, semiannual and annual report on environmental and social management plan implementation. Both reports should submit to MONRE, DNRE of Luang Prabang and Sayaboury Province. 3. To hand over to Department of Natural Resources and Environment (DNRE) of Luang Prabang and Sayaboury Province to collaborate with related District’s Offices to monitor the environment and social protection and mitigation measurement which may happen in the future and regular report to MONRE. The Northern GMS Transport Network Improvement Project involves the improvement of Route No.4 in northern of Laos. The project road is totally 370 km long, linked from branch of Road No.13 North in Xieng Nguen District, Luang Prabang Province to Lao – Thai Border at Baan NaKha of Kenthao District, Xayabury Province. The project construction are comprise a Mekong bridge at Thadeu, which funded by the government of Republic of Korea and the upgrading of existing pavement with provision of shoulders as well as drainage systems which funded by ADB, AusAid and OPEC. In addition, the environmental and social safeguards program in during project implementation is necessary, which it can mitigate/minimize any environmental and social impacts which may happened during construction time.

2. Background

In order to minimize the environmental and social impacts during construction time, the environmental and social programs for Road No.4 improvement project is the one component which essential and required to operate during project implemented. During 14-19 December 2011, the Technical and Environmental Division (TED) staffs under Department of Roads (DoR) and a staff from Environmental and Social Division (ESD) under the Public Works and Transport Institute (PTI) were visited the site to monitor the impact of environmental and social from road No. 4 construction project. In addition, the team* from MPWT had been discussed with the project managers, project consultants, and resident engineers.

3. Issues

3.1 Section 1: Xieng Nguen – Tha Deau (61.75 km)

According to noted from ADB mission during November, (i) at main camp Km 57+600 the project had cleaned and dredged out cements’ useless (see figure 1). In addition, (ii) the mainly rocks stockpile at Km 58+500 which ADB commented as the rocks stockpile has massively grown, the project explained as the rocks in stockpile will be use in civil work as being as sub-base and base- course for road construction. During MPWT team visited, the team had noted that (iii) the most of labors in fieldwork are wearing inappropriate personal protective equipment during working times such as hard hats, masks, safety shoes, noise protection, etc (see figure 2).

During MPWT visited, the team noted that at the construction camp Km 66+600, several environmental issues like (i) birds husbandry, (ii) oil leakage and spill in camp, (iii) improper garbage collecting, (iv) and improper warning signs (see figure 3). The team had advised contractor as these issues should be hurry solves and improve the environmental condition in this camp. Furthermore, at sub camp at Km 99+900, the teams also observed and found that the (v) wastewater in pond was being directly polluted to watercourse (see figure 4), the MPWT team recommended to setting up the pond as dredge out mud, then lay sand, charcoal and gravel as foundation which it can be wastewater treatment plant. In addition, during MPWT team visited at (vi) crushing plant Km 113+000, the team found that the contractor were lack of dust suppression measurement during rock crushing (see figure 5). Finally, improper oil tank storage also had observed by MPWT team (see figure 6).

3.3 Section 3: Nam Pui Bridge – Pak Lay Bridge (100 km)

According to ADB mission on November noted that Km 153+650 had (i) spoils dumped along steep slopes in the mountainous area (see figure 7), the contractor explained and finding more solution to solve this problems as planting trees or shrubs and readjust new stream alignment. However, at the crushing plant Km 192+500, there is critical environmental issue like (ii) lack of dust mitigation measure (see figure 8). The contractor should have measurement to control dust like provide water sprinkle during working time.

During field observation and interview, there are some environmental critical points such as (i) at Km 243+850, local resident at Baan Xayamoungkoun, Paklay District, would like project construction improve their land property as fill up more soil (see Figure 9). (ii) Km 246+700, improper disposal concrete tanks dumping at local land, the project should breaking down into small pieces (see Figure 10). (iii) No pipe conversion at junction Km 248+750, which connected between rural access and main road (see Figure 11). (iv) At crushing plant (Km 270+800), several environmental crises like improper lubricant oil leak and spill around plant (see Figure 12), moreover burning tires to warm bitumen is the most critical issue which prohibit, the contractor should stop this activity immediately (see Figure 13). (v) At the construction camp Km 271+500 located nearby local village, the land owners complained about the agreement of the land hiring that contractor not yet paid. In addition, this case should be investigation by soccial specialist. At last, (v) the sub camp at Km 284+000, the concrete pavement surrounding oil tank has been provided but the concrete dike is not yet constructed (see Figure 14).

3.5 Section 5: Houy Pet – Nakha (80.73 km)

In the same way with ADB reported, the MPWT team was agreed as the contractor of this section is well organized and maintenance in environmental and social issues. During MPWT team visited, the contractor is doing well especially on environmental issue like dust mitigation measure. At the

On the other hand, the MPWT team concerned about the land improvement for public utility at Km 351+100, which the level of land improvement merged to the main road (see figure 16). It was agree that the consultant will require the contractor to provide pipe convert at the entrance of land improvement as well as provide side-drain beside the land.
