(CEI) performed this Phase I Environmental Site Assessment (ESA) of the Subject Property at 120 South Governors Avenue, Dover, Delaware (hereinafter, the Subject Property). The objective of this ESA was to document the presence of Recognized Environmental Conditions (RECs)1, and, as applicable, Historical Recognized Environmental Conditions (HRECs) and Controlled Recognized Environmental Conditions (CRECs) in connection with the Subject Property in accordance with our approved scope of work, and in general accordance with ASTM E-1527-13 Standard Practice for Phase I Environmental Site Assessments. CEI’s scope of work included review of historical use information, physical setting information, federal and state regulatory databases, and local government records, historical and on-site interviews, and a visual field reconnaissance of the Subject Property and adjoining properties. Further details regarding the scope, objectives, extent and limitations of our services are detailed in the text of this report. The Executive Summary is only a brief description of these ESA services, and the entire report must be read for a comprehensive and accurate understanding of findings, conclusions and recommendations. This report discusses the environmental condition of the Subject Property as of the date of CEI’s field reconnaissance. Recognized Environmental Conditions Based upon the inquiries, reviews and observations made during this ESA, as reflected in this report, the following known or suspected RECs, HRECs, or CRECs have been identified with a possible connection to the Subject Property: 1. Delaware Electric Signal (Formerly Donohos & Son Historical Paint Manufacturing), 145 South New Street: This Donohos site is located in close proximity south of the Subject Property. Records from the DNREC public databases recognize this property as a Site Investigation and Restoration Site (SIRS) and an underground storage tank site. Specifically, this site was previously used for paint manufacturing purposes and contained one underground storage tank and one aboveground storage tank. Reportedly, subsequent to paint manufacturing operations, both tanks were abandoned in place and are no longer used. A preliminary assessment (PA) was completed on the property in July 2004 by SIRS. In summary, the PA recommended no further action be taken under CERCLA concerning possible past contamination, since the site is capped with asphalt paving and the potential of migration of any contaminants is minimal. Also, the PA recommended further action should be conducted under the DNREC Tank Management Branch (TMB) to investigate the potential release from the underground storage tank located on the Donohos property. 1 Refer to Section 2.0 of this report for the ASTM definitions of RECs, HRECs, and CRECs. COD-120SGovernorsAve-ESAI-Report.wpd City of Dover Phase I Environmental Site Assessment Report March 13, 2019 120 South Governors Avenue, Dover, Delaware 19904 Page 2 of 21 A conditional No Further Action (NFA) letter dated December 10, 2007 was issued by TMB with regards to the tanks closed in place on the Donohos site. However, a shallow soil sample analyzed by the TMB had a lead concentration of 1,620 parts per million (ppm). This concentration exceeds the DNREC soil screening concentration for lead in soil (400 ppm). TMB found that the lead contamination may be unrelated to a petroleum release, since typically other gasoline chemical constituents are found in soil samples from gasoline tank releases. Therefore, TMB concluded that the lead contamination in the soil may be unrelated to a petroleum release and is more likely a result of the historic paint manufacturing at the Donohos facility. Due to the potential lead contamination at the Donohos site from paint manufacturing, TMB referred this site back to SIRB (now SIRS) for review and potential follow-up. Based upon the findings from the database search, the Donohos property located within close proximity to the Subject Property meets the ASTM E 1527-13 definition of a controlled recognized environmental condition (CREC). A CREC is a “recognized environmental condition resulting from a past release of hazardous substances or petroleum products that has been addressed to the satisfaction of the applicable regulatory authority with hazardous substances or petroleum products allowed to remain in place subject to the implementation of required controls. An interview by CEI was conducted with SIRS project officials. CEI understands that no soil samples have been collected or analyzed since the initial soil sampling by TMB and no work has been performed to determine the extent of soil contamination from paint manufacturing activities at the Donohos site. Therefore, there is a possibility that since the Subject Property is within close proximity (within approximately 50-feet) of the Donohos site, soil contamination from the Donohos site may have migrated onto the Subject Property. CEI recommends that a Phase II, Environmental Site Assessment be performed on the Subject Property to determine any impact from the Donohos site prior to performing any land disturbance (i.e., removal of asphalt paving, soil excavations, demolition, etc.) or soil intrusive work on the Subject Property. Size: ± 1.7763 acres Parcel: 2-05-07709-01-4400-00001 At the time of CEI’s field reconnaissance on March 8, 2019, the Subject Property was a square shaped parcel located in Dover, Kent County, Delaware. The property contains an occupied two- story building divided into two suites (Auto Plus and Kent County Community Action Agency, Compliance Environmental, Inc.
