NATIONAL GUARD EMPOWERMENT ACT On April 26, 2006, the National Defense Enhancement and National Guard Empowerment Act of 2006 was introduced in both the U.S. Senate and the House of Representatives. This legislation proposes significant changes to the role of the chief of the National Guard Bu- reau and other Guard relationships. It is completely logical that the policies and procedures that have guided the effective use of the National Guard be considered for revision in light of the sweeping changes to the mis- sions and employment of our armed forces. NGAUS will monitor this legislation in the weeks ahead. You are encouraged to share your thoughts on this bold initiative. • Arizona Law Protecting National Guard Members on State Active Duty
AZ-2015-NG (updated April 2018) Arizona Law Protecting National Guard Members On State Active Duty By Kyle E. Helmick1 Arizona has enacted a good provision protecting the civilian job rights of National Guard members on state active duty. Here is the entire text of the pertinent section: A. An employer shall not refuse to permit members of the National Guard or the United States armed forces reserves to take leaves of absence from employment for the purpose of complying with competent orders of the state or United States for active duty, or to attend camps, maneuvers, formations or armory drills. The leaves of absence shall not affect vacation rights that employees otherwise have, except that an employer need not consider the period of absence as a period of work in determining eligibility for vacation and the amount of vacation pay to which the employee is entitled. B. A member of the national guard or the United States armed forces reserves shall not lose seniority or precedence while absent under competent military orders. On return to employment the employee shall be returned to the employee's previous position, or to a higher position commensurate with the employee's ability and experience as seniority or precedence would ordinarily entitle the employee. C. An officer or employee of this state, or any department or political subdivision of this state, who is a member of the national guard or the United States armed forces reserves shall be entitled to leave of absence pursuant to § 38-610 from the individual's duties without loss of time or efficiency rating on all days during which the individual is engaged in field training as provided by this chapter, and for a period during leave of absence not to exceed thirty days in any two consecutive years the individual is entitled to pay.

The sight of a parade, the sound of marching music, the color of a crowd, creates a festive holiday spiriL Though it is a holiday, let us not forget the time these citizen soldiers have devoted to the Guard. Let us not forget the employers of these Guardsmen; in some cases, allowing Guardsmen to participate in Annual Field Training has created a hardship for the employer. Our heartiest: thanks go to these employers for their whole-hearted co-operation. The first citizen soldier concept in Arizona came about in February 1865; over a hundred years ago. Since that time, our Guard has enjoyed a tradition that leaves very little room for addition; and a tradition that, as years go by, ls difficult to uphold. • Department of Emergency and Military Affairs Program Summary
Federal Funds Department of Emergency and Military Affairs Program Summary Program Overview As the state agency responsible for the Arizona National Guard and coordinating the state emergency response, the Department of Emergency and Military Affairs (DEMA) receives and expends a significant amount of Federal Funds. These grants cover costs associated with salary, facility maintenance, planning, preparedness, and mitigation. Background DEMA receives Federal Funds to help offset the costs of the Arizona National Guard and to prepare for emergencies. The Arizona National Guard, which is divided into an Army and Air Force branch, is a reserve fighting force that can be called to active duty by either the President or the Governor. When not called to active duty, the Arizona National Guard is controlled by the Governor through the Adjutant General, a gubernatorial appointee. Though largely controlled by the state, the Arizona National Guard is predominately federally funded with only 2.9% of total FY 2018 expenditures derived from the state's appropriated National Guard Matching Funds line item. As of September 2018, there were approximately 7,700 members of the Arizona National Guard with 5,200 of them belonging to the Army and 2,500 to the Air Force. DEMA also oversees the State Emergency Response and Recovery Plan which provides a framework for state, local, and federal governmental entities to coordinate efforts to prepare for and handle emergencies or disasters. As a result, a large portion of federal monies for emergency mitigation and preparedness flow through or to DEMA. Program Funding The federal money that DEMA receives can be divided into 2 categories: Military and Emergency funding.
