Remington Model 1889 Grade 1. Serial #57126. 12-gauge side-by-side shotgun with 30” barrels and external hammers. Bores are dirty and may clean up. Both barrels choked modified. Action works. Metal has turned to a brown patina and is average with a dent in the left barrel. No scrolling on receiver. Wood is good and has been refinished. Original butt plate. C&R. R 2. Climax Model Side-by-Side. Serial #1719. 12-gauge side-by-side shotgun with 30” Damascus barrels, made in Belgium. Bores are good. Action works. Metal is fair with scattered rust. Fine checkered stock and forearm are average to good with some scratches and missing finish. Forearm is missing a wedge of wood. What appears to be the original butt plate is in poor condition. C&R. R 3. Stevens Model 311A. Serial #UAA1. 12-gauge side-by-side shotgun with 28” barrels choked modified and full. Good bores and action. 2.75” chambers. Double triggers and extractor. Metal is average with scratches and scattered rust. Some case coloring remains on receiver. Wood is average with finish loss, marks and scratches. C&R. R 4. Stevens Model 620. Serial #27577. 20-gauge pump action shotgun with a 28” barrel and good bore. Action works but is stiff. This is a Browning patented shotgun made by Stevens. Choke is stamped “full” but there is an “M” stamped over the “full”. Metal is average with considerable fading and minor scattered rust spots. Wood is average and extra finish has been applied. LOP is 14”. C&R. R 5. Arisaka Model Type 99 Short Rifle Last Ditch. Serial #6413. 7.7mm bolt action rifle with a 25.25” barrel and very dirty bore. Action works. Metal is fair with heavy rust. Wood is average for age. Wooden butt plate. Adjustable rear sight. Mum has been ground off. It has the cleaning rod. C&R. R 6. Ranger Model Over/Under 103.12. Serial #575888. 16-gauge semi auto shotgun with 26” barrel and good bore. Improved choke with 2.75” chamber. Action works. Metal and wood are poor with rust, scratches and heavy finish loss. LOP is 13.75”. C&R. R 22. British Model No. 4 Mark I. Serial #17973. .303 Brit bolt action Sporterized rifle. Most of the markings have been removed from this gun by refinishing. “England” is plainly visible, along with the serial number. What appears to be “No. 4 Mk I” is barely visible on the receiver. Barrel has been cut to 21” and a globe front sight added. The rear sight is a Redfield peep sight. Action works fine. Checkered, Monte Carlo style stock with holes for swivel studs. Metal and wood are good. Action works fine but is a little stiff. Bore is dirty but should clean to good or better. C&R. R 23. Ithaca Model 37 Featherlight. Serial #680830-2. 12-gauge pump shotgun with a 28” barrel and average bore. Action works. Choked modified with a 2.75” chamber. Metal is poor with heavy scattered rust and finish loss. His entire life he has had a great interest in guns, however, it was not until 2007 when he began his immense collection. Starting out, Stark held a keen interest in seeking out European military rifles from the late 19th to mid- 20th century. He says that his inspiration for this came primarily from the Mauser line of rifles, due to its wide array of models & designs. Over the past decade, Stark says his collection began to transform as his focus shifted to categories such as guns of World War 1, United States military guns, and then to .22 Slide-Action rifles. Furthermore, Stark says he then began to collect Lugers, American Eagles, and other handguns of the 1900’s. To Stark, both design and era are two leading factors he considers when seeking out a new addition to his collection. He has no interest in plastics, as only the original steel and wood-work that made these guns so famous are what draws him in. Stark’s main interest in collecting firearms stems from his interest in the intricate mechanisms within the guns casing. Stark is a Mechanical Engineer by trade, attributing much of his enjoyment when dissembling, cleaning, and restoring guns - to study the guns functionality, as well as to maintain and preserve its original condition.

As such, FPC, along with its members and supporters, have a vested interest in the ATF’s Proposed Rule, which seeks to, inter alia, provide new definitions of “firearm frame or receiver” and “frame or receiver.” The Proposed Rule is inconsistent with the relevant statutory language, makes no principled distinction between precursor materials and manufactured frames or receivers, was adopted in a procedurally improper fashion, and is arbitrary and capricious. I. THE PROPOSED RULE EXCEEDS THE LIMITS OF AUTHORITY GRANTED TO THE ATF UNDER THE GUN CONTROL ACT As relevant to this rulemaking, the Gun Control Act, 18 U.S.C. § 921, et seq. (“GCA”), defines the term “firearm,” in part, as “(A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon; (C) any firearm muffler or firearm silencer; or (D) any destructive device.” 18 U.S.C.
