To consider the appointment of Ms. Sidra Sajjad as Assistant Librarian (BS-09) under Rule-9 against an vacant post for a period of six months w.e.f 01-04-2019 @ Rs.11770/- p.m plus other usual allowance as admissible under the Rules. Cantt Board Public Library is being run on double shift basis morning and evening and her employment is necessary for said purpose. In this regard it is intimated that Ms. Sidra Sajjad was appointed as Assistant Librarian on daily wages basis as contingent labour w.e.f 11-12-2014 @ Rs. 600/- per day and performing her duties with the entire satisfaction of her superiors. She is a qualified Librarian having master in Library Sciences. All relevant documents are placed on the table for consideration.

Central Medical Board (CMB) has relocated from Karachi to Lahore and non availability of sign board directing candidates to reach out CMB is creating problem for them. Therefore, he requested for the grant of permission to install sign board nearby Allied Bank on Bagh Ali

Road (measuring 2 ½ x 4 ½) to facilitate the candidates. If found feasible by Cantt Engineer permission (under supervision of Cantt Engineer) to install the sign board can be granted.

Muhammad Fayyaz S/o Muhammad Tufail (2). Sultan Maqsood S/o Abdul Ghafoor illegally and un- authorizedly started construction at site. Necessary notices under Section-185 vide letter No.7304/10876-Reg, dated 04-04-2018 & 256 of the Cantts Act, 1924 vide letter No.1874/13626-Reg, dated 25-06-2018 were served upon the occupants. In response to above mentioned notices, the occupant’s submitted commercial Building plan for approval of the Board. This office vide letter No.1874/DNRB-DR-13939-Reg, dated 02-07-2018 asked the occupants to apply for conversion of subject properties from old grant terms to regular lease and building plan was also returned un-actioned. It is pertinent to mention here that the above named transferees (1). Muhammad Fayyaz S/o Muhammad Tufail (2). Sultan Maqsood S/o Abdul Ghafoor illegally and un-authorizedly merged all three properties / houses into single unit and they have applied for conversion of properties on Schedule-V of the CLA Rules 1937 into regular lease in Schedule-IX-C of the CLA Rules 1937 for residential purpose under the policy in-vogue. The area measuring 3805 Sft applied for conversion is comprising of Properties No.1094,1096/A & 1093. Thereafter, the occupants filed Writ Petition No.224082/2018 titled as “Sultan Maqsood Vs LCB etc” wherein the Honourable Court vide Order dated 09-07-2018 disposed of the petition with a direction to LCB to decide the application (regarding approval of Building plan) of the petitioner within period of 07 days. In compliance of direction of Honourable High Court, this office passed specking order dated 16-07-2018 relevant part is reproduced here as under:- “You are hereby advised to “apply for conversion of subject property from old grant terms to regular lease to proceed further in subject matter” as per DGML&C Revised Policy of Conversion of properties held on old grant into regular lease under the CLA Rules, 1937 No.3/6/D-12(ML&C)/97-2007; followed by submission of building plan for consideration of the Board. You may also submit an appeal application (as you undertook in writing during the hearing) against the order passed by Cantonment Board vide No.1874/DNRB-DR-13939-Reg, dated 02-07-2018 in compliance with Schedule-V of the Cantts Act, 1924 within 30 days from the service of the order.

Upon receiving duly authorized and completed application, Cantonment Board

in compliance with Section-37(1) of Cantts Act, 1924 will review the appeal

application in its next monthly meeting, in the light of applicable rules and

regulation and decide the same in accordance with the law.”

Thereafter, the occupants filed another Writ Petition No.226819/2018 titled as “Sultan Maqsood Vs LCB etc” alleging therein that he i.e. petitioner has complied with (by submitting all required documents) the specking order of LCB dated 16-07-2018. The Honourable Court vide Order dated 24-07-2018 disposed of the petition with a direction to LCB to place the case of the petitioner in upcoming Board meeting further the Court has directed the petitioner to undertake construction at his own peril in accordance with relevant provisions of the Cantts Act, 1924, however, if he transgresses any provision of law, he will be responsible for outcome of the same. The case was placed before the Board and the Board vide CBR No.34 dated 15-08-2018 resolved as under:- “Considered. Discussed at length and the Board decided to ask the grantee to complete all legal formalities and title documents to proceed further in the matter. Board further decided to stop the all kind of construction at site till provision of legal documents and approval of Building plan by the Board. Furthermore, the honourable Court may also be apprised that the petitioner of the case is not a legal owner of the House No.1093, Svy No.88/1466 and carrying illegal construction at site (seems to be commercial at residential plot by erecting pillars) by misusing of the court orders as well as beaten the LCB staff on duty due to stoppage of illegal construction.” In continuation of above mentioned CBR, it is submitted that the in response of letter dated 3-09-2018, the grantees have submitted Declaration Certificate dated 18-09- 2018. This office issued letter dated 09-10-2018, the applicants have got published the requisite Public Notice in Daily “Mashriq”, dated 11-10-2018, but no any objection to the proposed transfer has been received within the stipulated time limit. Thereafter, this office vide letter No.1874/DNRB-DR-D-413, dated 26-11-2018 directed the grantees to submit proper Sch-V form showing complete details of properties along-with the request of merging the properties into regular lease of Sch-IX-C of the CLA Rules, 1937 for commercial purpose and Revised Building plan along-with willingness on stamp paper for compounding the offence of un-authorized construction by imposing Composition fee, but the grantee failed to comply with the direction of above mentioned

Page 66 letter, rather he filed another Writ Petition No.15344 of 2019 titled as “Sultan Maqsood Vs LCB etc” wherein honourable Lahore High Court passed order on 15-03-2019 operating part of the same is reproduced here as under:- “In view of the above, office is directed to transmit a certified copy of this petition along with its annexure to Respondent No.1 (Chief Executive Officer, Lahore Cantt Board, Sarwar Road, Lahore Cantt) at the expense of the petitioner, who shall look into the matter and treat the same as representation filed on behalf of the petitioner and decide the same strictly in accordance with law, after providing an opportunity of hearing to the petitioner and the others concerned, within a period of 30-days from the date of receipt of order of this court. In order to regulate further proceedings, the petitioner shall appear in the office of the said respondent on 25-03-2019 @ 11:00 am. Learned Assistant Attorney General for Pakistan shall also convey this order to the concerned authority. With this direction, the instant constitutional petition stands disposed of.” In compliance of Judgment dated 15-03-2019, As the property in-question is held on old grant, therefore, to place the case before the Board for approval to the following measures:- i. To carry out mutation entry in respect of House No.1093 Svy No. 88/1466 and lastly in favour of the legal heirs by way of inheritance on the basis of above referred Declaration Certificate dated 18-09-2018. ii. To consider above referred letters, Bungalow No.70, Survey No.240 measuring 6.173 Acers Situated at Bagh Ali Road, Lahore Cantt vested in the Board as Class-C. Out of the above said bungalow, following chunks of land are required by the Walton Cantt Board for the purpose mentioned against each as per DGML&C directives during the visit of Lahore region on 26-11-2018. Walton Cantt Board further requested that management is required to be changed from Lahore Cantt Board to Walton Cantt Board and the case may also be initiated for obtaining sanction of the Competent Authority to change the management above said land from Lahore Cantt Board to Walton Cantt Board. It is apprised that previously in a separate case, at the time of handing over the possession of Bungalow No.3, Bagh Ali Road, Lahore Cantt, vide CBR No.10 dated 12-11- 2000 considered and resolved as under: - Considered and resolved that possession of Bungalow No.3, Bagh Ali Road, Lahore Cantt as well as the adjacent grassy ground be handed over to the Board for conversion into senior officers Guest House as desired

The Board considered the case at length and resolved to approve that possession of the above said land be handed over to the Walton Cantonment Board for upgradation / extension of the existing Rest House as directed by the worthy DGML&C @ Rs. 5,00,000/- monthly rent. Subject: COMPOSITION OF THE OFFENCE OF UN-AUTHORIZED CONSTRUCTION IN RESPECT OF HOUSE NO.271/1/PART, SVY NO.88/390/PART/1, KARACHI MOHALLAH, LAHORE CANTT (RESIDENTIAL PURPOSE)

To consider DML&C, Lahore Region, Lahore Order dated 28-03-2019 “the Board imposed composition fee amounting to Rs.1,52,850/- vide CBR No.44(3), dated 09- 07-2018 to regularize the construction. However, the incumbent has mentioned in his appeal that he is retired employee of the ML&C Deptt having no other source of income except the monthly pension being drawn regularly and living hands to mouth, thus, keeping in view the hardships of the appellant, the composition fee is hereby reduced to 5% from 10% of the total cost of construction, imposed by the respondent Board.

Description

House No. 271/1/Part, Survey No. 88/390/Part/1, measuring 1267.25 Sft, situated at Karachi Mohallah, Sadar Bazar, Lahore Cantt is held by Mr. Afzal Ahmad S/o Haji Bashir Ahmad on lease in Sch-IX-A (old) of the CLA Rules 1937 for residential purpose. Previously, building plan of the property in-question was approved by the Board vide its CBR No. 238(34), dated 05-06-2014. During the construction, the lessee carried out deviations from the approved building plan.

The lessee submitted Revised Addition / Alteration Building plan along-with willingness for regularization of un-authorized construction on payment of Composition Fee vide Notice under Section 179 of the Cantt Act, 1924 dated 22-05-2018.

The case was placed before the Board and the Board vide CBR No. 44(3), dated 09-07-2018 approved the regularization of un-authorized construction on payment of Composition Fee @10% of cost of un-authorized construction which comes to Rs. 1,52,850/-

As per decision of the Board, the lessee was directed to deposit the amount of Composition Fee i.e. Rs. 1,52,850/- within 30 days vide this office letter dated 05-09-2018, but he did not comply with. Instead of depositing above said amount, the lessee filed an appeal to DML&C, Lahore Region for waiving off Composition Fee. The DML&C, Lahore Region vide order dated 28-03-2019 reduced the composition fee from 10% to 5%. Relevant case is put up on the table for consideration. RESOLUTION

The structure drawings / design is required to be vetted from the Managing Director Engineering Services UET Pakistan Pvt Ltd. ESUPAK. The UET Lahore has already offered their rate @ 1.50/ sft for 500 beds Teaching Hospital vide their letter No. ESUP/19/0028 dated 03-04-2019 and they are also willing to vet the design of CB Medical College at their above offered rate.
