Initially the work of 250 beds Family Wing Hospital was awarded to M/s. Staco – Shahid Builder (J.V) and the rate of contractor was approved vide CBR No. 49 dated 09-07-2018 and the contract was awarded to him. 2. Later on decision was taken at department’s level in December 2018 and to convert 250 beds to 500 beds Teaching Hospital. 3. The case was placed before the Board and the Board approved the case vide CBR No. 20 dated 25-01-2019 accordingly. 4. This office directed the contractor to submit his willingness whether he is willing to execute the work on his already approved rates or otherwise. 5. After refusal from contractor the case was discussed at departmental level on dated 22-08-2019 at HQ Rawalpindi it was decided to initiate the process for tendering of additional work. 6. Accordingly, the advertisement was forwarded to PPRA for uploading on their website and same was uploaded by PPRA vide TS Number TS400511E dated 20-09-2019. 7. In the meanwhile, the contractor M/s. Subject: REHABILITATION & IMPROVEMENT OF LAHORE DRY PORT, MOGHALPURA

To consider Divisional Office, Pakistan Railways, Lahore letter No.334/W/33/DP/MGPR/2018 dated 11-07-2019 whereby Dry port has requested for NOC regarding utilization of “C” Land for construction of road. Since a portion of existing sewerage system passes through area / land of Lahore Cantonment Board, and they intend to use the patch from Lahore Road to Dry Port for their heavy vehicles, therefore, permission may be granted to construct a road and also to lay a sewerage system at their own expense to facilitate the movement of their vehicles.

Land measuring 23.97 Acers, comprising survey No. 25/A, was classified as “C” land vested in the Board under section 108 of the Cantt Act, 1924. 2.05 Acres was excluded from this holding for the extension of Muslim Graveyard vides MOD letter No. 16/1/L/D5/C/65/4950, dated 09-02-1967. Out of remaining land i.e. 21.92 Acres, an area measuring 10 Acers was handed over to Punjab Road Transport Board (PRTB) on 04-12- 1975 under the authority of CBR No. 11, dated 18-07-1995 for construction of workshop and Vehicle Depot. Thereafter, the Board vide CBR No. 33, dated 27-01-1976 decided to lease out additional area measuring 01 Acre 02 Kanal 19 Marlas and 74 Sft in addition to 10 Acres. As such total area becomes 11 Acres 02 Kanal 19 Marla and 74 Sft. After lengthy correspondence, the Managing Director, PRTC Lahore (formerly PRTB) vide letter dated 05- 12-2001 intimated this office that operations of PRTC had been closed w.e.f. 30-06-1997. All the moveable PRTC properties lying in dry port had been disposed off and after that NLC Engineers, Lahore Road Rehabilitation Project had taken over the premises in December- 2000 vacated the site and handed over to LCB. Accordingly, Ex-post facto sanction of the President for leasing of land measuring 11 Acres and 3 Kanals comprising Survey No. 25/A- 1 to the Punjab Road Transport Board received vide Ministry of Defence letter No. 19/77/L/AD(A)/ML&C/76/2177/D-12/ML&C, dated 07-06-1981.

The road is in deplorable condition and construction of road will provide an alternative route to the CB land thereby augment the value of the land.

Plot No.4 situated at LARECHS Colony, Lahore Cantt is held by Ch. M. Aslam Pervaiz S/o Ch. Shams-Ud-Din on lease for residential purpose which will expire on 16-8-2078.The sub Lease Deed executed between the lessee and LARECHS Colony, Lahore Cantt through General Secretary LARECHS Co-Operative Housing Society Ltd.

It is pertinent to mention here that the lessee of plot No.4 situated at LARECHS Colony started excavation of basement through excavator without prior approval of building plan from LCB. LCB stopped the excavation work immediately through Agency of this office and also served notice under section 185 of the Cantt Act, 1924 vide letter No.7304/75751- Reg dated 10-04-2019 upon him.

In response of the above, the owner of Plot No.4, submitted building plan which was returned un-actioned with observations that building plan be routed through LARECHS instead of directly submitting to Cantt Board and that front of house to be shown toward eastern side as per terms & conditions of lease deed. He was also directed to obtain NOC of neighbors (lessees) for construction of basement. The lessee of adjoining plot No.5, LARECHS Colony, Lahore Cantt Mr. Shahzad Ahmad has submitted several applications against construction of basement by the lessee of plot No.4 LARECHS Colony, Lahore Cantt stating therein that the excavation for basement is causing danger to his multistory 60’- 0” high building. He has also stated that the excavated portion may be filled and approval of basement may not be granted to the lessee of plot No.4.

As the neighbor (lessee of Plot No.5) refused to grant NOC hence lessee of plotNo.4 has submitted building plan through LRECHS Society after rectification of observations except NOC of neighbors. He has however, submitted Indemnity Bond on Non- Judicial Stamp Paper for making good any loss / damage if caused by construction of basement. The site visited by the SD/Man of this office and reported that only excavation of basement exists at site.

It is also pertinent to mention here that the LERECHS Cooperative Housing Society Ltd, has endorsed a copy of letter dated 03-09-2012 stating therein that basement shall not be allowed without “ No objection certificates” / Consent of owners / lessees of adjoining properties.

Description Plot No. 207, Survey No. 94/6/207 measuring 800 Sq. yds situated at Sarwar Colony, Sarwar Road, Lahore Cantt is held by Maj General Muhammad Azeem Asif, HI (M) S/o Muhammad Ahsan on lease in Schedule-IX-B of the CLA Rules 1937 for residential purpose. MEO, Lahore Circle forwarded Schedule V application dated 19-06-2019 submitted by above said lessee for grant of extension of an area measuring 80 Sq.yds classified as Class “C” land situated on western side of Plot No. 207.

The site was checked by SDM of this office and reported that the land measuring 80 Sq.yds is classified as class “C” land situated at western side of the property. The land has already been occupied by the lessee at site.

It is apprised that in a case of similar nature in respect of House No. 27, Sarwar Colony, the Board vide CBR No. 44, dated 05-04-2011:

“Considered and regretted. The MEO Lahore be informed to ask the applicant to pay the cost of land to Cantt Board at prevalent market rate and if he is not willing then he should vacate the Cantonment Board land”.

The decision of the Board was conveyed to MEO and DML&C Lahore vide letters dated 03-05-2011 and dated 11-05-2011 respectively. In response to above, ML&C Deptt vide letter, dated 28-05-2011 intimated that “since the management of land of Army Housing Scheme Sarwar Colony is entrusted to Cantt Board for the purpose of Road, Green Belt / Park etc free of cost, hence demand of Cantt Board to deposit market rate to Cantt Board is not correct as well as against the instructions contained in Ministry of Defence corrigendum No. 30/12/HD/Pt-1/51/D-30/07, dated 22-09-2007. The Deptt further advised to issue NOC for grant of said piece of land as an extension to the lessee of Plot No. 27, enabling MEO Lahore to process the case as per Government letter / corrigendum No. 30/12/HD/Pt-1/51/D-30/07, dated 22-09-2007. In compliance of Deptt instructions, the Board vide CBR No. 14, dated 06-07- 2011 resolved to issue NOC from municipal/congestion point of view regarding grant of area measuring 165 Sq.yds as extension to House No. 27 comprising Survey No. 94 (west ext)/27, measuring 800 Sq. Yds situated at Sarwar Colony, Sarwar Road, Lahore Cantt without demanding market value against the applied reclassified Class “C” land in the light of Government of Pakistan, Ministry of Defence corrigendum No. 30/12/HD/Pt-1/51/D-30/07, dated 22-09-2007 and ML&C Deptt letter No. 51/2014/Lands/ML&C/2007,dated 28-05-2011.

Audit Authorities, however raised objection against Non recovery of Premium by LCB. The objection has been converted in DP and Audit Authorities have advised that Premium may be made good or Ministry to be approached for a uniform policy based on status in-vogue. The case was submitted to HQ ML&C Rawalpindi through letter dated 03- 01-2014. However, the same has not been decided by the Ministry as yet DP No.74/14-15.
