2 PLANNINGHISTORY

2.1 Itis understoodthat chalkextractionfromthe site dates backmorethan 150years. The originalplanningpermissionfor chalk extractionwas an InterimDevelopmentOrder consent granted in 1941. This was subsequentlyregisteredunder the Planningand CompensationAct1991andgiventhe referenceTA92/0070.

2.2 In 1993an appilcationwas made to SurreyCountyCouncil(Surrey)by Tilconfor the determinationof modern planning conditionsas required under the Planningand CompensationAct 1991. There were no planningconditionsattached to the original permissionwhichcontrolledthedevelopmentat the site.

2.3 Newplanningconditionswereissued bySurreyon 11June 1997(referenceTA93/0765) and were accompaniedby approvedplans showingthe then extentof extraction,the operationalphases and the restorationcontours.The conditionsallowforextractionand infillingto be carriedout until2042.

2.4 The 1997 planningconditionsplace no restrictionsin terms of the rate at whichthe

remainingchalkreserves,whichextendto approximatelyover 1 milliontonnes, maybe exported. Similarly,there is no restrictionon the rate of infillthat may be imported (althoughthe existingEnvironmentAgencypermitspecifiesup to 200,000tonnes per annum). Based on the existingchalkreservesand availablevoidspace, approximately 800,000cubicmetresofinfillwouldbe requiredto achievetheapprovedrestorationinthe eventallchalkreservesare extracted.

2.5 As a resultof the flexiblenatureof the extantplanningpermissionintermsof extraction and importation,there is no restrictionon the numberof vehiclemovementsassociated

withoperationsat OxtedQuarry.Themovementofvehiclesis limitedto between07:00—

2.7 Chalkis primarilysoldforspreadingon agriculturallandand as a generalfill.Historically there was extensivechalkprocessingcarriedout on site to producehydratedlimeand powders. In morerecentyears annualsales of chalkhave been almost40,000tonnes and inertinfillhas been almost100,000tonnes per year untilthe recentincreaseinthe EnvironmentalPermit,whichallowsupto 200,000tonnesperyearto be infilled.

5.1 In order to reviewthe safety performanceof the localroad network,collisiondata was obtainedfromSurreyCountyCouncil,whichextendedalongthe A25betweenthe East HillRoad and BarrowGreen Road junctions;alongthe lengthof BarrowGreen Road, ChurchLaneand East HillRoad;along ChalkpitLaneto the junctionwithThe Ridge; alongthe fulllengthofThe Ridgeand alongNodhdownRoadto itsjunctionwithChurch Road.

5.12 Paragraph 10.5.9 of MfS2 advises: “The Y distance should be based on the recommendedSSD values. However,based on the researchreferredto above, unless there is localevidenceto the contra,y,a reductionin visibilitybelowrecommendedlevels willnotnecessarilylead toa significantproblem.”

5.13 Thisis reiteratedin an articlecontainedinthe November2010editionof Transportation Professional,the magazineof the CharteredInstitutionof Highwaysand Transportation. 5.15 The safetyrecordon the routesconsideredis likelyto be a resultof the predominantly localnatureofdriversusingthe minorroadnetwork,whichdoes notrepresentan obvious through-routeto longer distance through-traffic. Localdriverswillbe aware of the constraints and potentialhazards along the route. Conversely,due to its varying geometry,driversunfamiliarwiththe routescouldbe expectedto exercisea significant degreeofcautionwhentravellingalongthe localroads.

7 HIGHWAYIMPACT

7.1 The reviewundertakenrevealsthat the road networkdoes have certainconstraintsin terms of its width,alignmentand visibilityin some locations. Notwithstandingthese apparentconstraints,the collisiondata providedbySurreyCountyCouncilindicatesthat the recenthistoricactivitiessince2007havenotledtoa significanthighwaysafetyissue.

7.2 The local roads in the area have generallylowvolumesof traffic,whichundoubtedly assists in maintaininga goodsafetyrecordbynaturallylimitingthe likelihoodof vehicles meetingonthe narrowersectionsofthe route.

7.3 The peak hour flows on ChalkpitLane when the site was not operationalof 212 movementsinSeptember2016maybe comparedwiththe capacityofa singletrackroad with passing places. A study undertaken by the Transportand Roads Research Laboratory(TRRL)nowTRLconsideredthe capacityof singletrackroadscarryingtraffic flowsof between50and 300movementsper hour.

7.4 The findingsof the studyadvise: “Resultsfromthe TRRLstudies indicatethat simplyin terms of their capacity for canying moving trafficsingle lane cardageways, correctly designed, are unlikelyto incursignificantincreases in delaycomparedwithtrafficin free flowconditions,at flowlevelsofup to 300 vph(totaltwo-way)’

7.5 Inthiscase, muchofChalkpitLaneis wideenoughfortwocars to pass each other,which increasescapacityand reducesdelay. Therelativelylownumberof HGVmovementsper day (up to 57 loads/114movementson average)equates to just 10-11movementsper

8.18 Whenconsideringthefactthatthereis an extantpermissionto2042and a clearhistoryof HGVuse, the prevailingvibrationclimateshould includethe quarrytrafficwithinthe baseline. Whencomparedagainstthis scenario,the proposeddevelopmentrepresents nochangetothe prevailingconditions.

CommunityEffects/Severance

8.19 Effectson the communitycan ariseas a resultof a revisedinfrastructurelayout,changes in trafficflowor both. In thiscase there are no proposedchanges to the layoutof the roadnetworkassociatedwiththe development,or indeedthe prevailingtrafficflowswhen comparedwiththe extant planningpermission. However,forcomparisonpurposesan assessment has been undertakenbetweenscenarioswherethere is no developmentat OxtedQuarryand withoperationsat the recentlevelsof activityto assess the impactof the variationintrafficflow.

8.20 Part 8 of DMRBVolume11 advises assessments on the effectson communitiesbe assessed on routeswheretrafficflowswouldincreaseordecreaseby30%.

8.21 DMRB11definesa reductionof circa30%in builtup areas as offeringslightrelieffrom

8.30 Havingconsideredthe foregoing,itis apparentthatthe proposeddevelopmentwouldnot have a significantdetrimentalimpacton the localroadnetworkintermsof environmental matters.

9 CUMULATIVEIMPACT

9.1 SurreyCountyCouncil’sScopingOpinionrequiredthecumulativeimpactofOxtedQuarry to be consideredinthe contextof programmed/commilleddevelopmentsinthe area. To confirmwhatdevelopmentsshouldbe included,the HighwayAuthoritywas consultedon 2 May2012. Theresponse,receivedon 3d May2012identifiedOxtedSand Pit,which was alsoidentifiedinthe ScopingOpinion,and Palmer’sWoodOilfield.

OxtedSand Pit

9.2 The inclusionof Oxted Sand Pit derivedfromcommentsmade withinthe Inspector’s Reporton the Examinationintothe SurreyMineralsPlanPrimaryAggregatesDPDofMay 2011,whichspecificallyhighlightedthe potentialcumulativeimpactand stated:“Aproject transportassessment at applicationstage wouldbe requiredto take account of the total volume of trafficmovements connected with the preferred area and the restoration operationson the existingsandpitas wellas othertrafficonBarrowGreen Road.”

9.3 In March2017, SurreyCountyCouncilPlanning& RegulatoryCommitteeresolvedto grant planningpermission(subjectto a S106Agreement)forthe applicationMINERALS TA11/1075,whichprovidesfor the infillingof the site withinert waste for restoration purposessubjectto 39 planningconditions.Asconfirmedinthe TransportStatementof July 2011, which accompanies and forms part of the EnvironmentalStatement accompanyingthe planningapplication,“Thesite has an extantpermissionpermitting110 movementsper dat. Thislimithas been acceptedbySurreyCountyCouncilandcarried throughto thesuggestedplanningconditions,witha reductionto60 perdayon Saturdays (at NO.10of the 22 March 2017 Planning & RegulatoryCommitteeReport). Thetotaltrafficgeneration of the site is currentlynot significantand it willnot be increasedby the extensionof the productionperiod”.

9.12 Paragraph 137 continues:“HGVsaccessing OxtedChalkpittravel up BarrowGreen Road and althoughnot altHGVsleavingthe chalkpituse the same route,a worstcase scenario accountcan be taken of all ChalkpitHGVsexitingvia BarrowGreen Road. Whilstthe ConeyHillcompoundis accessed fromBarrowGreenRoad,a memberofstaff in a LGVvisitsthe compoundonce a day and the remainderof the timethe access is gatedandlocked”

9.13 Itis apparentfromthe precedingparagraph,that inassessingthe impactofthe proposed developmentat PalmersWoodCilfield,the Councilhas assessed the cumulativeimpact on the assumptionthat all of the traffictravellingto/fromOxtedQuarry(the Chalkpit), does so viaBarrowGreenRoad,past the access to the ConeyHillCompound.As has been describedpreviously,OxtedQuarryoperatesa one-waysystembyagreementwith Surrey CountyCouncil,whicheffectivelyhalves the volumeof Oxted Quarrytraffic travellingalongthe westemsectionof BarrowGreenRoadand reducesthe potentialfor HGVstravellinginoppositedirectionsto meetalongtheroute.

9.14 Atparagraph138ofthe reportto Committee,thecumulativeimpactofwithOxtedSandpit is considered:“Anothermineralworkingin the vicinityis OxtedSandpitwhichhas been workedfor sand but has yet to be filled, Currentlythe site is closed but a planning applicationhas recentlybeen madetoextendthetimeforinfillingandrestorationofOxted Sandpit. Whilstthe applicationwas deemedinvalidand was returnedto the applicant,it is understoodthatitis the applicant’sintentionto resubmitin thenear future. 11 RESIDENTS’CONCERNS

11.1 Thereis a historyofconcernsbeingexpressedbyresidentsregarding(heuse ofChalkpit Lane by HGVtraffictravellingto/fromOxted Quarry. An OfficerReport to Local Committee(Tandridge)dated 7 May2008was submittedby 5CC, whichreferredto a petitionof425signatures.

11.2 Havingconsideredvariousoptionsand consultedwiththe Policeregardingexistinguse and potenhalalternatives,thereportconcludedat paragraph10.1:

“Whilstit is recognised that the problems of HGVtrafficare unacceptableto local residents,the CountyCouncil,DistrictCounciland SurreyPoliceare unableto remove theproblem.Ameliorationmeasures are possiblebutwillnotreducethenumberofHGVs usinglheroads. 12.34 Despitethe insignificantimpactassociatedwiththe proposedoperationsat OxtedQuarry when assessed against the extant situation,possiblemitigationmeasures have been identifiedto safeguardthe favourablerecordintermsof highwayimpactdemonstratedin recentyears.

12.35 Potentialadditionalplanningconditionsto formalisethe existingvoluntarySiteRulesare suggested, whichare consideredto contributetowardsthe favourablehighwaysafety recordand minimisingthe potentialadverseimpactsassociatedwithongoingoperations at OxtedQuarry.

12.36 Itis alsoproposedto regularisethe relocationoftheweighbridgewithinthe siteto reduce the potentialforqueuingtooccuronChalkpitLaneviathe ROMPprocess.

12.37 Havingconsideredthe foregoing,it is concludedthat subject to the retentionof the existingplanningconditionsand the managementprotocolsadopted by the operator, there is no reason to concludethe continuationof the operationsat the site wouldhave an unacceptableimpacton the local highwaynetworkthat wouldjustifywithholding planningpermission.

12.38 Inthe event5CC considersit is essentialthat a dailylimitis imposedon the numberof HGVmovementsassociatedwithinfillactivities,the reviewundertakendemonstratesthe peak figureof 362 movementsper day wouldbe acceptable based upon national guidance. Notwithstandingthis,the operatorhas confirmedthat an annualaverageof 100HGVmovementsperday (50in/SOout)witha cap limitof200 HGVmovements(100 in/lOUout)perdaycouldbe accommodatedoperationally.
