REDUCTION IN FORCE

The Board reserves the right to reduce positions and to suspend the contracts of non-represented classified staff members as warranted. Reasons for such suspension may include, but are not limited to, the following:

A. declining enrollment of students in the District, a particular program, a particular building or a particular grade level;

B. the return of support staff from Board approved leaves of absence;

C. a change in the financial condition of the District;

D. other financial reasons that the Board, in its sole discretion, finds warrants a reduction in force;

E. loss of funding for a particular program, project or grant;

F. changes in the curriculum or academic program of the District based on financial reasons and/or declining enrollment;

G. the reorganization of the academic structure of the District based on financial reasons and/or declining enrollment;

H. territorial changes affecting the District; or

I. actions necessitated or mandated by applicable law or regulation.

Reductions shall be made through attrition to the extent possible. In lieu of suspending an entire contract, the Board may suspend the contract of a staff member in part and provide a level of compensation commensurate with the percentage of work performed. In making such reduction, the Board will suspend contracts in accordance with the recommendation of the Superintendent, who shall, within each job classification affected, give preference first to employees on continuing contract and then to employees on the basis of seniority. The alphabetical list below shall be considered job classifications for the purpose of this reduction in force policy. Consideration for these reductions are made on an individual basis not in this order.

Continuing contract employees whose contracts are suspended shall have a right to restoration of employment in order of seniority of service within the District if and when a non-teaching position for which the employee is qualified becomes vacant or is created. Such continuing contract employees whose contract has been suspended will not forfeit such right to restoration by reason of having declined recall to a position with fewer hours. Recall rights are as delineated in the LSSA Master Agreement for bargaining unit members or the Ohio Revised Code, but only to the extent that such terms do not conflict with the requirements of OCR 3319.172 as described above.

GRADUATION REQUIREMENTS

In order to acknowledge each student's successful completion of the instructional program, appropriate to the achievement of District goals and objectives as well as personal proficiency, the Board of Education awards a diploma to eligible students at a graduation ceremony.

The Board shall award a regular high school diploma to every student enrolled in this District who meets the requirements of graduation established by this Board or who properly completes the goals and objectives specified in his/her individualized education program (IEP) including either the exemption from or the requirement to complete the tests required by the State Board of Education in order to graduate. Each student must demonstrate, unless exempted, at least a proficient level of skill on the tests required by the State Board of Education to graduate.

The requirements for graduation from high school include earning twenty (20) units of high school credit as follows:

English Language Arts 4 Health .5 Physical Education .5 Mathematics 4 (3 for 2013 graduates) students that entered ninth grade before the 2010-2011 school year) Science 3 Social Studies 3 Fine Arts, including music 1 Electives 4 (5 for 2013 graduates) students that entered ninth grade before the 2010-2011 school year) (including at least 1 whole unit, or 2 half units, in business/technology, fine arts, and/or foreign language)

Students who have participated in interscholastic athletics, marching band, or cheerleading for at least two (2) full seasons as defined in the student handbook, while enrolled in grades 9 through 12, and as documented by the guidance counselor may be excused from the high school physical education requirement.

Credit may be earned by:

A. completing coursework;

B. testing out of or demonstrating mastery of course content; or

C. pursuing one or more educational options in accordance with the District's Credit Flexibility Program.

Credit may be earned at an accredited postsecondary institution.

Students below the ninth grade will be permitted to take advanced work for credit. This work shall count toward the graduation requirements if it was both:

A. taught by a person who possesses a license/certificate issued under State law that is valid for teaching high school;

B. designated by the Board as meeting the high school curriculum requirements.

An honors diploma shall be awarded to any student who meets the established requirements for graduation or the requirements of his/her IEP; attains the applicable scores on the tests required by the State Board of Education to graduate; and meets any additional criteria the State Board may establish.

Commencement exercises will include only those students who have successfully completed requirements for graduation as certified by the high school principal or those students who have been deemed eligible to participate in such exercises in accordance with the terms of their IEP. No student who has completed the requirements for graduation shall be denied a diploma as a disciplinary measure. A student may be denied participation in the ceremony of graduation when personal conduct so warrants.

The Board also shall grant a diploma of adult education to all District residents over the age of twenty-one (21) who meet the requirements established by the State Board of Education.

LOCAL PURCHASING

The Board of Education recognizes its position as a major purchaser in this community, and while it is the intention of the Board to purchase materials and supplies of quality at the lowest possible cost through widespread competition, if all other considerations are equal, the Board prefers to purchase within the District from established local merchants.

The Board authorizes the Superintendent______to award purchases placed in accordance with law, this policy, and all policies of the Board otherwise applicable to local merchants whenunder these considerations and provided that all statues pertaining to public purchasing are duly observed:

( )A. their quotation is competitive,

( )B. freight charges costs andare a factors,

( )C. maintenance service needs may be required, and

( )D. promptness of delivery is a consideration

provided that all statutes pertaining to public purchasing are duly observed.

Purchasing personnel shall not show any favoritism to any vendor. Each order shall be placed in accordance with policies of this Board on the basis of quality, price, and past service delivery (if applicable), and if such factor and that all other considerations are equal. The Board believes in patronizing local businesses; consequently, in the purchasing procedure, when proposals are equal, the contract or purchase order should be awarded to the firm whose location is within the boundaries of the District.

Vendors are invited to regularly visit Lakota’s website for a current list of the District’s requests for bids or quotations and to sign up for the business e-mail distribution list.

TECHNOLOGY AND SOCIAL MEDIAPRIVACY

The Board of Education recognizes its staff members' right to privacy in their personal lives. This policy serves to inform staff members of the Board's position with respect to staff-member privacy in the educational and workplace setting and to protect the Board's interests.

All computers, telephone systems, electronic mail systems, and voice mail systems are the Board's property and are intended to be used for business purposes. The Board retains the right to access and review all electronic and voice mail, computer files, data bases, and any other electronic transmissions contained in or used in conjunction with the Board's computer system, telephone system, electronic mail system, and voice mail system. Staff members shall be notified that they have no expectation that any information contained on such systems is confidential or private.

The District’s network, email, applications and Internet system (including any software and files downloaded via the Internet onto the District’s network), cellular telephone services, and other information and communication technologies are the property of the District. Computer files, email messages, browsing histories, text messages, and other information created, downloaded, uploaded or accessed on the District’s Internet systems or other District- owned networks or systems are not the private property of any employee. Employees should not have any expectations of privacy. In addition to being subject to this Policy, Employees are subject to the District’s Policies when utilizing the District’s computer networks, files, electronic mail system and Internet system.

The Board may Rreview any of such information may be done by the Board with or without the staff member's knowledge. The use of passwords does not guarantee confidentiality, and the Board retains the right to access information in spite of a password. All passwords or security codes must be registered with the Board. A staff member's refusal to permit such access may be grounds for discipline up to and including discharge. Review of computer files, electronic mail, and voice mail will only be done in the ordinary course of business and will be motivated by a legitimate business reason.

Computers, electronic mail, and voice mail are to be used only for business and educational purposes.

Personal messages via Board-owned technology should be limited in accordance with the Superintendent'sadministrative guidelines. Staff members are encouraged to keep their personal records and personal business at home. Because the Board's

The Board is interested in its resources being properly used. Review of computer files, electronic mail, and voice mail will only be done in the ordinary course of business and will be motivated by a legitimate business reason. If a staff member's personal information is discovered, the contents of such discovery will not be reviewed by the Board, except to the extent necessary to determine if the files/e-mail/voice mail constitute a public record or if the Board's interests have been compromised. Any information discovered will be limited to those who have a specific need to know that information.

The administrators and supervisory staff members authorized by the Superintendent have the authority to search and access information electronically.

All computers and any information or software contained therein are property of the Board. Staff members shall not copy, delete, or remove any information or data contained on the Board's computers/servers without the express permission of the Superintendent or designee, or communicate any such information to unauthorized individuals. In addition, staff members may not copy software on any Board computer and may not bring software from outside sources for use on Board equipment without the prior approval of the technology administratorSuperintendent. Such pre-approval will include a review of any copyright infringements or virus problems associated with such outside software.

Social media may have a significant impact on organizational and professional reputations. Because social media blurs the lines between personal voice and institutional voice, the District has created the following policy to clarify how best to enhance and protect personal and professional reputations when participating in social media for those who choose to use it.

The District prohibits participation in social media for an employee’s personal use during the work day. Social media may be used to advance the educational mission of the District or otherwise for job-related purposes, but only with District administration’s knowledge and consent. All information posted by a District employee on behalf of the District must comply with the District Policies, and must be approved by the Public Information Officer. Employees are personally liable for anything they post to social media sites.

For the purpose of this policy “social media” includes, but is not limited to: • Social networking Sites (Facebook, Myspace, Foursquare, Linkedin) • Micro-blogging Sites (Twitter) • Blogs (including District and personal blogs, as well as comments) • Video and Photo Sharing Websites (Flickr, YouTube) • Forums and Discussion Boards (Google Groups, Yahoo! Groups) • Online Encyclopedia (Wikipedia, Sidewiki)

Employees have the right to participate in social media using personal equipment on their own time. To the extent permitted by law, the District prohibits all conduct, including online activity, that may negatively impact the District’s reputation, the reputation of its employees, or its educational interests, or that may negatively impact its students or the community at large. Such activity, even if engaged in on an employee’s own time, may result in discipline up to and including termination of employment.

In an interest to improve the support of afterhours facility and technology operations, the Lakota School Support Association (LSSA) and the Lakota Board of Education (the Board) agree to enter into this agreement.

In order to be considered for the reimbursement, the LSSA staff member must meet the following criteria and their department head must recommend that offering a stipend in lieu of a district issued device is in the best interest for district operations.

A. Their jobs require them to be accessible outside of scheduled or regular work hours or to be contacted and respond in the event of an emergency;

B. Their jobs consistently require timely and business-critical two (2) way communication for which there is no reasonable alternative technology;

C. Their jobs require them to monitor and react to issues in regards to facility or technology systems after hours

LSSA staff members who are recommended by their department head for a reimbursement and therefore, provide a personal communication device as a condition of their employment shall receive a monthly PCD allowance ("allowance"), at the amount approved annually by the Board to reimburse them for the costs associated with maintaining and using the PCD for business purposes.

Amount of the Allowance

The allowance shall consist of a monthly allowance of at the specific dollar amount set by the Board for mobile telephone service and wireless internet/data connection. For the 2013-14 school year, the amount will be $40 per month ($20 per paycheck).

The allowance is not intended to reimburse the employee’s dollar-for-dollar costs for the mobile telephone service, and shall not exceed the expenses the employee actually incurs in maintaining his/her her personally-owned PCD.

The allowance shall not serve as a substitute for a portion of the staff member’s regular wages, and does not constitute an increase to base pay and will not be included in the calculation of percentage increases to base pay due to annual raises, job upgrades or benefits based on a percentage of salary, etc. The Board will pay only the Board-approved allowance even if actual monthly costs exceed the allowance.

If an employee is absent for more than thirty (30) consecutive days on either paid or unpaid leave of absence, the allowance will be temporarily discontinued (i.e. it will be prorated during the period of absence) unless the employee can demonstrate s/he needs the PCD for essential business communications during the period of absence, and/or the Superintendent approves the continuation of the allowance.

To be eligible to receive the allowance, the employee must maintain the type of mobile telephone coverage and wireless internet/data plan that is reasonably related to his/her job responsibilities.

In order to continue to receive the allowance, employees are expected to answer all business-related calls on his/her mobile phone and promptly respond to any messages. The employee will also follow all board policies in regards to the use of wireless communication devices while on duty.

Allowance is Not Considered Taxable Income

Provided the employee maintains and uses his/her personally-owned cell phone for business purposes as described herein, the allowance should not be considered additional income to the employee (i.e., the allowance will be treated as a non-payroll reimbursement of a business expense – similar to mileage reimbursements – and no payroll taxes will be withheld from the employee’s paycheck for the amount of the allowance and the amount of the allowance will not be reported as wages on the employee’s year-end W-2 statement). Additionally, staff members who receive an allowance are not required to submit a log documenting their business-related use of the mobile phone; non-exempt employees, however, must comply with the timekeeping requirements set forth above. For determination of individual taxability, employees should check with their personal tax advisor.

Employee’s Responsibilities

Since the mobile phone is the employee’s personal property, the mobile phone may be used for personal calls, except during work time, and be combined or enhanced with other personal plans (i.e., the employee may also at his/her own expense, add extra services or equipment features, as desired). The employee is responsible for paying all monthly service charges in full and on time. The Board does not accept any liability for claims, charges, or disputes between the service provider and the staff member. Because the employee is personally responsible for the mobile phone, any replacement for loss or damage will be at the expense of the employee. Such replacement or repair must be completed promptly and the employee’s department head must be notified if the employee will not be available by his/her mobile phone for a period of time.

Employees should contact the vendor/carrier through which they purchased their mobile phone and their mobile telephone service (including wireless internet/data service, if applicable) for technical support, if needed.

Employees shall be made aware that the reimbursement of costs for their individual mobile phone can subject their mobile phones, and the records of said phones, to the Ohio Public Records laws. Employees will comply and work with the District if employees’ mobile phone records are requested pursuant to the Ohio Public Records laws.

Employees are subject to all applicable Board policies and guidelines their mobile phones. See Policy 7530.02 – Staff Use of Personal Communication Devices.

Changing or Ending Mobile Telephone Service Contract Early If prior to the end of a mobile telephone and/or wireless internet/data service contract, a personal decision by the employee results in the need to end or change the contract, the employee will bear the costs of any fees associated with the change or cancellation.

If prior to the end of a mobile telephone and/or wireless internet/data service contract, the employee’s misconduct, or misuse of the mobile phone, results in the end to end or change the contract, the employee will bear the costs of any fees associated with the change or cancellation.

If prior to the end of the mobile telephone and/or wireless internet/data service contract, the Board determines to reduce or cancel (unrelated to employee misconduct) the employee’s monthly allowance, the Board will bear the cost of any fees associated with the change or cancellation so long as the fees associated with the change or cancellation are due to the fact that the employee would not have had the mobile telephone and/or wireless internet/data service contract but for the receipt of the monthly allowance. For example, if the employee is reassigned and/or his/her duties are changed, and the mobile phone is no longer needed for business purposes, if the employee does not want to retain the current contract level/amount, changes or cancellation fees for a lesser contract level/amount will be reimbursed by the Board. The Board will not reimburse changes or cancellation fees for a change in carrier/provider.

If the employee is non-renewed or voluntarily resigns while the service contract is still in effect, the Board will not be responsible for any fees associated with the employee’s decision to subsequently change or cancel the contract.

Upon termination, nonrenewal or resignation, the Board will immediately discontinue the monthly allowance.

Potential Disciplinary Action/Termination of the Mobile Phone Allowance

Violation of this policy may constitute just cause for disciplinary action up to and including termination. Use of mobile phone in any manner contrary to local, State or Federal laws will constitute misuse, and will result in immediate termination of the allowance.

This memorandum shall expire on June 30, 2014.

Appendix E Agreement with The Procter and Gamble Company

Student Field Experience Program Agreement Between Lakota Local School District And The Procter & Gamble Company

This Student Field Experience Program Agreement (“Agreement”) is entered into by and between the Lakota Local School District Board of Education (“Lakota”) and The Procter & Gamble Company (“Company”)

WHEREAS, Lakota provides a training and education program option for its high school students (“Field Experience Program”) and, as part of the Field Experience Program, desires for students to receive on-site education and training from Company at its facility located at 8256 Union Centre Blvd., West Chester, Ohio 45069;

WHEREAS, Company is willing to provide on-site learning experiences for students who participate in this Field Experience Program, subject to the terms and conditions set forth herein;

NOW THEREFORE, in consideration of the mutual covenants and promises contained herein, Lakota and Company hereby agree as follows:

General Criteria:

1. The Field Experience program is for the benefit of Lakota’s students. The program combines academic instruction with work experience.

2. Students are not entitled to, nor shall they receive, wages or any other payment, and shall not receive any compensation from the Company for the time spent in the Field Experience Program.

3. Students will be provided training by the Company, and may receive academic credit from Lakota which can be applied toward fulfilling students’ high school credit requirements.

4. Lakota’s students do not displace Company employees, but work under their close observation and supervision.

5. Students participating in the Field Experience program shall not be deemed or considered employees of Company or its affiliates for any purpose. Nothing in this Agreement is intended or shall be deemed to create any relationship between the parties other than that of education affiliation.

6. Company understands that it does not derive any immediate advantage from the activities of the students, and on occasion its operations may actually be impeded.

7. Lakota’s students are not guaranteed employment during or at the conclusion of the Field Experience Program period, and may not receive any preference or advantage in future hiring based on their participation in the Field Experience Program.

8. Students shall be responsible for their own expenses associated with their participation in the Field Experience program, including transportation to and from the Company.

9. The Company will provide instruction and experiences at the Field Experience Program site that will provide participating students with skills and attitudes necessary for life-long learning, competitive employment opportunities and continuous improvement.

Lakota Agrees to:

1. Select mature students with a demonstrated interest in pursuing a career in engineering and other related fields, who are eligible for the Field Experience Program.

2. Provide at least 30 days’ written notice to Company of Field Experience Program assignments.

3. Require all students and teachers, coordinators, advisors or other representatives of Lakota to comply with the policies, procedures and regulations of Company.

4. Require all students and teachers, coordinators, advisors or other representatives of Lakota to acknowledge and accept the following responsibilities:

a. keep confidential all Company information as required;

b. follow the assigned Company personnel’s schedule while at the Company, as applicable or as directed;

c. provide their own transportation to and from Company and, as necessary, to and from any reasonable special assignment made by a Company supervisor;

d. provide their own health insurance for the full term of student’s Field Experience Program;

e. complete forms that may be requested by Company;

f. follow administrative policies of Company;

g. dress appropriately as determined by Company personnel for the Field Experience Program, including adhering to applicable Company dress codes;

h. conduct themselves in a professional manner as outlined by Company policies, procedures and standards, as well as any code of ethics applicable to the Field Experience Program;

i. such other requirements reasonably requested by Company, consistent with the purposes and objectives of the Field Experience Program.

5. Appoint a Field Experience Program Coordinator(s), who shall serve as the liaison between Lakota, the students, and Company.

6. Administer the Field Experience program and provide the students and Company with all necessary forms;

7. Provide related student instruction in concert with the instruction and training provided to the students by the Company;

8. Maintain all necessary records to administer the Field Experience program;

9. Withdraw a student from the Field Experience Program when, in the judgment of Lakota and/or in collaboration with Company officials, the Field Experience Program no longer meets the needs of the student, and/or when student’s conduct warrants a withdrawal from the Field Experience Program;

10. Prior to students commencing the Field Experience Program under this Agreement, develop in collaboration with the Company a syllabus and objectives of the Field Experience Program’s curriculum; recognize that changes to such syllabus or objectives may need to be made throughout the term of this Agreement.

11. Make periodic contacts with Company’s Field Experience Education Coordinator to discuss the students’ progress and learning;

12. Evaluate the students and assign them grades (Pass/Fail);

13. At the conclusion of the Field Experience Program, provide written information and/or feedback to Company regarding its supervisors’ performance in the Field Experience Program.

Company Agrees to:

1. Accept students selected by Lakota for field experiences in the Field Experience program, subject to the Company’s continued reservation of its right to reject any student selected by Lakota, and subject to the further conditions set forth herein;

2. Provide field experiences consistent with the syllabus and objectives of the Field Experience program, and to provide supervision appropriate to the academic and experience level of the students participating in the Field Experience program;

3. Provide physical facilities for the Field Experience Program;

4. Assign a Field Experience Education Coordinator who shall serve as Company’s primary contact with both Company supervisors who will participate in the Field Experience program and with Lakota. Company’s Field Experience Education Coordinator, to the

extent possible, will attend meetings provided for Company supervisors of the Field Experience program;

5. Require its Field Experience Education Coordinator to plan and develop the Field Experience program’s curriculum and rotations with the stated goals and objectives developed in collaboration with Lakota;

6. Require its Field Experience Education Coordinator to meet with Lakota’s Field Experience Program Coordinator(s) at reasonable periodic intervals subject to the Field Experience Education Coordinator’s availability to discuss the students’ progress in the Field Experience program;

7. Promptly notify Lakota when a student is not performing satisfactorily, or when student’s behavior is disruptive or detrimental to the Field Experience program, and, if deemed necessary, facilitate the removal of a student from the Field Experience program;

8. Allow representatives from Lakota to visit Company before, during or reasonably after the Field Experience period, subject to applicable Company or departmental access restrictions;

9. Provide the students with training that is mutually agreeable to Lakota and Company, including providing instruction for tasks and duties to be performed;

10. Provide an adequate number of appropriately-trained supervisors to supervise and oversee the students as they work and/or receive instruction and training as part of the Field Experience program.

11. Comply with all applicable state and federal employment regulations for cooperative education/student learner/field experience programs;

12. Provide students with an equal opportunity to participate in the Field Experience program, including refraining from discrimination on the basis of race, color, religion, ethnic or national origin, gender, sexual orientation, or non-disqualifying handicap;

13. Provide suggestions to Lakota’s Field Experience Program Coordinator(s) for curriculum revisions to improve the Field Experience program;

14. Maintain the confidentiality of personally-identifiable information for students participating in the Field Experience program to the extent required by state or federal law.

Term & Termination:

1. The term of this Agreement shall be three months commencing on February 1, 2014 and terminating on April 30, 2014.

2. The Agreement shall automatically renew for terms of three months running from February 1 until April 30 of each year for two years unless or until either party to this Agreement

notifies the other in writing of its intention not to renew the Agreement at least thirty (30) days prior to the expiration of the then-current term.

3. Either party may terminate the Agreement with or without cause with at least sixty (60) days’ written notice.

Legal Compliance:

1. Generally. If any activities contemplated in this Agreement are deemed by either Company or by Lakota to be in violation of any lawfully adopted laws, rules, regulations or policies of the State of Ohio or a Federal government agency (collectively "Laws"), (i) this Agreement shall, as negotiated in good faith and agreed upon by the parties hereto, be amended so as to comply with the Laws, or (ii) if no such amendment is agreed upon within 60 days or compliance with the Laws is not practicable, either party may terminate this Agreement upon thirty (30) days’ written notice to the other. Nothing herein shall require either party to undertake any activity not consistent with applicable law.

Indemnification:

1. To the extent permitted by law, and to the extent that insurance coverage is available for this purpose, Lakota hereby agrees to indemnify, defend and hold Company harmless from any and all liability and claims for injury, death or loss to person or property brought by a participating student, his parents or legal guardian(s), and/or any other third party which arises from the gross negligence, or intentional, willful or reckless conduct of Lakota, its employees, or Board of Education members.

2. Company hereby agrees to indemnify, defend and hold Lakota harmless from any and all liability and claims for injury, death or loss to any person or property brought by a participating student and/or his/her parents or legal guardian(s) arising from the gross negligence, or intentional, willful or reckless conduct of Company’s employees or agents.

Miscellaneous Provisions:

1. This Agreement may be amended at any time by written instrument executed by both parties.

2. This Agreement may not be assigned by either party.

3. This Agreement shall survive for the purposes of enforcing any remaining duties and obligations of the respective parties subsequent to termination of this Agreement.

4. If any term(s) of this Agreement is/are deemed unenforceable, such term(s) shall not affect the enforceability of the other terms of this Agreement that can be given effect without the unenforceable provision(s).

5. Notices required or permitted under this Agreement shall be in writing and shall either be personally delivered or sent by certified mail, return receipt requested, addressed to:

6. Neither party shall use the other party’s name or mark or refer to the other party directly or indirectly in any media release, public announcement, public disclosure or marketing materials relating to this Agreement without the prior consent of the other party prior to each such use or release.

7. This Agreement contains the entire understanding of the parties as to the matters contained herein, and supersedes any and all prior written or oral statements, understandings or agreements.

8. Counterparts. This Agreement may be executed in one or more counterparts, all of which together shall constitute only one Agreement.

9. This Agreement shall be governed by and construed according to the laws of the State of Ohio.
