Cahaba Beach Dog Park LLC General Client Agreement

General Client Agreement 1. Owner agrees to pay the rate for the daycare, boarding, bathing, and grooming in effect on each date the pet is checked in to Cahaba Beach Dog Park, LLC. 2. Owner further agrees to pay all charges for special services requested, all veterinary costs if needed, for the pet during the time said pet is in the care of Cahaba Beach Dog Park, LLC. 3. Owner assumes any and all liability and expenses for injuries that Owners pet may inflict upon any human or other pet while at Cahaba Beach Dog Park, LLC. 4. Owner further agrees that the pet shall not leave Cahaba Beach Dog Park, LLC until all charges are paid. 5. By signing this contract and leaving said pet with Cahaba Beach Dog Park, LLC, the Owner certifies to the accuracy of all information given about said pet. 6. Owners understands that if pet is not picked up on date specified in a separate agreement and no notice given to the Cahaba Beach Dog Park, LLC after 3 days Cahaba Beach Dog Park, LLC will proceed with the procedures for handling abandoned animals as per guidelines provided by Alabama State Law and Owners shall be liable for any and all costs of the same. 7. Owner specifically represents to Cahaba Beach Dog Park, LLC that pet has not been exposed to rabies, parvo, distemper or bordetella within a thirty day period prior to check out for boarding, daycare, grooming or bathing or playing in the off-leash dog park. 8. All charges incurred by owner shall be payable upon pick up of pet. Cahaba Beach Dog Park, LLC shall use any and all legal remedies to collect any and all unpaid charges(including the expenses of collecting the same which may include legal fees and expenses) resulting from boarding, daycare, grooming, bathing or other service provided by Cahaba Beach Dog Park, LLC at the Owner’s expense. 9. If the pet becomes ill or if the state of the pet’s health otherwise requires professional attention, Cahaba Beach Dog Park, LLC in its sole discretion may engage the services of a veterinarian or administer medicine or give other requisite attention to the pet and the expenses thereof shall be paid by the Owner. Owner gives consent to Cahaba Beach Dog Park, LLC to act on Owner’s behalf in obtaining emergency or any veterinary care at Owner’s expense if deemed necessary by Cahaba Beach Dog Park, LLC or any of its employees. Owner indemnifies and holds Cahaba Beach Dog Park, LLC harmless for said expenses. 10. This contract contains the entire agreement between the parties. All terms and conditions of this contract shall be binding on the heirs, administrators, personal representatives and assigns of the Owner and Cahaba Beach Dog Park, LLC. 11. Owner understands that there are risks and benefits associated with group socialization of dogs. Owner agrees that while the socialization and play is closely and carefully monitored by Cahaba Beach Dog Park, LLC staff to prevent injury, it is still possible that during the course of normal play the dog may receive minor nicks and scratches from roughhousing with other dogs. Any injuries to the dog will be pointed out by staff upon pick up. 12. Owner is aware that by leaving pet at Cahaba Beach Dog Park, LLC, or any other pet facility, said pet is at a higher risk of contracting kennel cough or other viruses. Although all of the pets are required to be vaccinated, no vaccine is 100% guaranteed. There are some strains of kennel cough not covered by the bordetella vaccine. Owner understands he / she will be responsible for any and all medical bills incurred to pet’s illnesses. 13. Notwithstanding anything here in to the contrary, Owners hereby acknowledge that he/she is voluntarily participating in the activities and services offered by Cahaba Beach Dog Park, LLC, who will exercise all necessary and proper care and precautions to keep Owners and dogs safe such activities and services, and to prevent injury to any person, property, other dog or person. However, because dogs are unpredictable animals with their own will and drives, Cahaba Beach Dog Park, LLC cannot protect against every potential injury, risk or accident. This Release and Waiver are intended to shift the risk of participating in the activities and services offered by Cahaba Beach Dog Park, LLC to the Owners/Guardians of the dog . Do not sign it unless you are willing to accept assumption of the risk of participation in such activities and services, and the risk of bodily injury, death or property damage while on the property of Cahaba Dog Park, LLC or elsewhere. Owners agree that in consideration for being permitted to participate in the activities and services offered by Cahaba Beach Dog Park, LLC and/or to use any of the Cahaba Beach Dog Park, LLC facilities in connection with such activities and/or services, the Owners, for himself/herself, and his/her heirs, next of kin, executors, and personal representatives assumes the risk(s) associated with participating such an activity and services and waives, releases, discharges and covenants not to sue Cahaba Beach Dog Park, LLC, its directors, officers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns, (hereinafter collectively the “Releases”) from any and all liability to the Owners for any loss, harm, damage, claim, injury or accident to the person or property of the Undersigned, whether caused by any ordinary negligent act or omission of the Releases while the Undersigned or his/her dog is engaged in or participating in said activities or services or using any of Cahaba Beach Dog Park, LLC facilities in connection therewith. The Owners expressly agree that the foregoing release and waiver, and assumption of risk are intended to be as expansive, broad and inclusive as permitted by Alabama law. Nothing herein is intended to release Releases from any harm, injury, claim or damage caused by intentional torts or wanton or reckless misconduct. Further, Owners agree to hold harmless Releases, from any and all claims of injury, loss, cost, expenses, or damage caused by the actions of Owners’ dog(s) during the course of participating in the activities or services offered by Releases , or while under the care, custody or control of Releases. 14. In case any provision in this Agreement shall be held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions hereof will not in any way be affected or impaired thereby. 15. In addition to this agreement, Owners agree to complete and be bound by the terms and conditions of the provisions set forth in the Daycare Rules, Policies and Regulations, The Off-Leash Park Rules, Policies and Regulations, The Dog Behavior and Training Intake Form, The Daycare/Off-Leash Intake Form, the Client Information Form, the Boarding Check-in Form and any other forms required by Cahaba Beach Dog Park, LLC.

Daycare Rules, Policies and Regulations 1. All dogs are required to wear an appropriate “play” collar. It needs to be made of cotton / nylon. No pinch collars or choke chains allowed in playgroups. Identification tag is recommended. 2. Owners are not allowed to bring personal belongings. 3. If we notice a dog is infested with fleas or ticks we will immediately administer Capstar for fleas or give a cleansing bath. Additional fee will apply. 4. Cahaba Beach Dog Park provides food for all overnight guests. If your dog requires a special diet please bring your own food supply. 5. In order to maintain the safest playgroups possible, we have to enforce certain playroom etiquette. Therefore occasionally your pet may be removed from the group for timeout. 6. If a dog shows aggression (growling, snapping) towards a handler, they will be immediately moved to their suite. They will have alone play time until check out or until owners have had a private training session and they are approved to attend daycare by our trainer/behavior consultant. 7. All dogs must be kept current on vaccinations in order to play. No exceptions made. 8. Owners are aware that there are certain risks with allowing your dog to play with other dogs. When dogs play together the following are possible: bites, punctures, scratches, broken bones, bruises, transmission of disease, and others. All owners are responsible for their own pet. 9. In order to remain a doggie daycare member, all daycare dogs MUST attend daycare once every 6 months or complete another Temperament Test.

I, the below signed client have read and agree to the Daycare rules, policies and regulations above (Please initial) Date Off-Leash Park Rules, Policies and Regulations 1. All dogs must be temperament tested prior to visiting Cahaba Beach Dog Park Off-Leash Park 2. Puppies under 3 months (12 weeks) of age are prohibited. 3. All dogs must be healthy, have current rabies, bordetella and DHPP vaccinations on file at CBDP, along with owner identification tags. Puppies must have 3 sets of boosters and bordetella. 4. Dogs who have exhibited diarrhea or a cough within 48 hours are prohibited 5. Guests and dog owners assume all risk when using Cahaba Beach Dog Park. 6. Aggressive dogs are strictly forbidden. Any dog showing aggression towards humans or other dogs must be immediately leashed and removed. 7. Dog owners must have a leash available on their person at all times. 8. Dogs barking excessively must be removed from CBDP Off-Leash Park. 9. Owners must stop their dogs from digging and immediately fill any holes. 10. Limit of four (4) dogs per adult. 11. Dog handlers must be 16 years of age or older. Children under the age of 16 must be accompanied by an adult. Member will be held responsible for children’s conduct 12. Dogs must be leashed at all times outside of the fenced CBDP Off-Leash Park area. 13. For safety reasons, pronged (pinch), spiked, studded and choke chain collars are prohibited and must be removed before entering CBDP Off-Leash Park. Remove harness and gentle leaders. 14. Owners must remove dog waste. Cleanup stations are provided for your convenience. 15. Squeak toys, tug of war toys, dog bones, chew treats, etc. are not allowed. 16. Glass containers are prohibited. 17. Smoking on Cahaba Beach Dog Park property is prohibited 18. Member must always be present in the same space as their dog(s). Member must have visual contact and voice control of their dog. 19. Member is responsible for any injury caused by their dog. 20. Cahaba Beach Dog Park reserves the right to cancel membership due to complaints about a member’s dog’s behavior. 21. No inhumane treatment of a dog is allowed. (i.e. kicking, hitting, poking with objects, etc.) 22. No dogs or children are to be left unattended in park or vehicles. 23. Members must wear shoes in the park at all times. 24. Only members’ dogs are allowed in the park. 25. If a dog becomes agitated, aggressive, or misbehaves with another dog or human, it is the member’s responsibility to move to another area or leave the park. 26. No in-season female dogs are allowed. Female swipes will be carried out and any female dog to be found in-season will be expelled from the park. 27. No food of any kind is allowed in the off leash areas of the park. 28. During inclement weather, special events or routine maintenance CBDP Off-Leash Park may be closed. Please call, check our facebook page or check our website if you have any questions. 29.
