5 February 2020 PRESS SUMMARY R (on the application of Samuel Smith Old Brewery (Tadcaster) and others) (Respondents) v North Yorkshire County Council (Appellant) [2020] UKSC 3 On appeal from [2018] EWCA Civ 489 JUSTICES: Lady Hale, Lord Carnwath, Lord Hodge, Lord Kitchin, Lord Sales BACKGROUND TO THE APPEAL This issue in this appeal is whether the Appellant, as local planning authority, properly understood the meaning of the word “openness” in the national planning policies applying to mineral working in the Green Belt, as expressed in the National Planning Policy Framework (NPPF). Paragraph 90 of the NPPF (in its original 2012 form) provides: “Certain other forms of development are not inappropriate in the Green Belt provided that they preserve the openness of the Green Belt and do not conflict with the purposes of including land in the Green Belt. These are: - mineral extraction;” The application in issue in this case was for the extension of the operational face of Jackdaw Crag Quarry. This is a magnesian limestone quarry 1.5 kilometres to the south-west of Tadcaster, North Yorkshire, owned and operated by the Third Respondent, Darrington Quarries. The Appellant’s Planning and Regulatory Functions Committee on 9 February 2016 accepted their officer’s recommendation that planning permission be granted. The officer’s report detailed a wide range of planning considerations. Under the heading “Landscape impact” the report summarised the views of the Appellant’s Principal Landscape Architect, who did not object in principle to the proposal, but drew attention to the potential landscape impacts and the consequent need to ensure that mitigation measures were maximised. -

The Society publishes a Newsletter and a quarterly journal Brewery History, which first appeared in 1972. It has also published a national directory and a series of county-wide surveys of historic breweries; the Society’s archive is held by Birmingham Central Library. The ongoing threat to the historic fabric of the English brewing industry was discussed at the conference From Grain to Glass, organised jointly by English Heritage (EH), the BHS and the Association for Industrial Archaeology (AIA), which took place at Swindon on 13 June 2003; the joint BHS and Victorian Society study day From Hop to Hostelry: the brewing and licensed trades 1837 -1914 (Young’s Ram Brewery, Wandsworth, 25 February 2006); and during the AIA Ironbridge Working Weekend (Coalbrookdale, 29 April 2006). -

What’s your style? Amber: Amber to coppery-brown in color and usually clear. Medium to high hop and malt flavors. The malts may be sweet, often with a caramel flavor. Malts and hops usually well balanced. Somewhat similar to American pale ales with more body, caramel richness, and a balance more towards malt than hops Bière de Garde: Golden to light brown in color. Toasted malt aroma, slight malt sweetness in flavor, and medium hop bitterness. Hop aromas and flavors should be low to medium. Fruity esters can be light to medium in intensity Brown: Moderate to high malt character with flavors that can include caramel, chocolate, toffee, nuts, and biscuit. Malts tend to have moderate sweetness. Hop flavor can be very low to moderate and On Tap bitterness may be present. Dubbel: Dark amber-brown beers with a lot of rich, roasted malt flavors. Ratings via RateBeer and BeerAdvocate They can be somewhat spicy and with fruity characteristics (scored out of 100) Gose: Pronounced “GOH-zuh”, is an unfiltered wheat beer. Dominant Ballast Point Sculpin - (7%) San Diego, CA flavors include a tartness, an herbal characteristic, and a strong saltiness Sculpin IPA is bright with aromas of apricot, peach, mango and lemon. Its Hefeweizen: Unfiltered German wheat beer that is pale straw to dark lighter body also brings out the crispness of the gold in color. They have banana and clove esters that come from special hops. ***** RateBeer 100, BeerAdvocate 97 yeast. They can optionally have a vanilla and/or bubblegum flavor, and IPA - (5oz - $2.5, 12oz - $5.5) are accompanied by a bready wheat taste. -

Brown ale oftenis the first beerattempted by novicehomebrewers. It is, however,a beerstyle whose definition is often disputed by beer authoritiesand commercialbrewers. Homebrewing emphasizes hops and "lots of everything",whereas "craft brewers considertheir brown alesas a naturalantidote to a highlyhopped flagship pale ale." Is brown ale definedby its color, or by a flavor commonto all beersunder the rubric of its name? Jim Parker,formerly of the AmericanHomebrew Association, and Ray Daniels,a beer author andeducator, adroitly addressthis duality in their book Brown AIe. Andthey do offe1an answer. They begin, sleuthingits historicalbegirnings, drawing thought provokingconclusions. Some of these may influence our understandingof not only brown ale,but of porter, stout, mild, AND paleale. The authorssuggest that pre-1700beers may not havebeen as dark, murky, or smokyas other writershave claimed. Brewers, beforethe 1700's,often relied on raw grainsin place of maltedbarley, because of their easieravailability and cheaperprice. Malstersthemselves preferred straw to wood when kilning the barley malt, becauseof lower cost, but also becauseof better results.Both of thesepractices would haveproduced beer, as an old sourcestates, "yellow as the gold noble." Danielsand Parker quoteanother passage, this from 1542:"It [beer] must be fresheand cleare,it must not be ropy nor smoky."And eventhough Englishbrewers were slow to embracethe use of hops,their judicious infusion of spices,produced ales, which were not nearlyas sweetas has been claimed. -
