First question. Regulation of sharing economy platforms involving illegal commercial activities 1. MR YIU SI-WING (in Cantonese): The concept of sharing economy is to create economic value by sharing or leasing idle resources owned by individuals. In recent years, sharing economy platforms have been in the ascendant around the world, and the resources shared include residential units or rooms, vehicles, parking spaces, etc. The leasing of such resources is generally subject to LEGISLATIVE COUNCIL ― 7 June 2017 9091 regulation of local legislation, including the requirement that the operators concerned must obtain relevant licences. For instance, a person who operates in Hong Kong premises for short-term leases to provide sleeping accommodation with a tenancy term of less than 28 days shall obtain a licence under the Hotel and Guesthouse Accommodation Ordinance, and such premises are also subject to strict regulation in the areas of fire safety installations, building structure, etc. Some members of the hotel industry have relayed that some people operate, through sharing economy platforms, unlicensed guesthouses which have posed unfair competition to them, and visitors staying in unlicensed guesthouses are not afforded protection. Regarding the regulation of sharing economy platforms involving illegal commercial activities, will the Government inform this Council: (1) whether the authorities have a grasp of the sharing economy platforms involving illegal commercial activities that are currently in operation in Hong Kong; if so, of the commercial activities involved, and the law enforcement efforts made by the authorities against such illegal commercial activities; if not, the reasons for that; (2) whether the authorities have studied the experience of overseas countries or regions in regulating sharing economy platforms, including the legislation enacted for this purpose; if so, of the details; if not, the reasons for that; and (3) whether the authorities will adopt measures to regulate sharing economy platforms involving illegal commercial activities so as to protect the rights and interests of lawful operators and the interests of consumers; if so, of the details; if not, the reasons for that? SECRETARY FOR INNOVATION AND TECHNOLOGY (in Cantonese): President, sharing economy is an emerging economic activity which refers to different people sharing idle resources or services through the exchange of information. The operation mode of sharing economy is to build a trusted platform to effectively connect those who provide and demand for the resources or services, thereby lowering the cost of transaction. Some advocates consider that sharing economy facilitates sharing among people and can reduce waste of resources. As communication technology, the Internet and mobile devices become increasingly common, and social media, cloud computing, big data, 9092 LEGISLATIVE COUNCIL ― 7 June 2017 network payment and rating system become more mature, the development of sharing economy has accelerated. Technological development also helps lower the threshold and provides more business opportunities and room for development for innovators and small and medium enterprises. On the other hand, sharing economy disrupts the traditional business model, in particular bringing the greatest impact to sectors such as intermediaries, agents and manufacturers. Sharing economy also challenges the regulatory framework and business model of certain industries. At present, certain businesses can only be operated by designated professionals, such as hire cars, guesthouses, banks, leasing, etc., which are governed by regulatory authorities and relevant legislation. Sharing economy can trigger various problems, including quality assurance, consumer protection, difficulties in regulation, etc., and the operation of certain businesses may even violate the existing regulations. The Government is committed to promoting innovation and technology ("I&T") to drive the transformation and diversified development of the economy, as well as improve the people's quality of life. However, we must emphasize that the rule of law is the core value of Hong Kong. The development of any industry, including the I&T industry, must be done in a lawful manner. Anyone operating illegal businesses in the name of "sharing economy" is unacceptable. The laws of Hong Kong have been thoroughly studied and extensively discussed by the society, and are ultimately enacted by the Legislative Council.

    Prepared Statement of Xiaorong Li, Independent Scholar Congressional-Executive Commission on China Roundtable on "Current Conditions for Human Rights Defenders and Lawyers in China, and Implications for U.S. Policy" June 23, 2011 The serious backsliding of the Chinese government’s human rights records had started before the 2008 Summer Olympics, highlighted with the jailing of activists Hu Jia, Huang Qi, and many others, the torture and disappearance of lawyer Gao Zhisheng, the imprisonment of Nobel Peace Prize laureate Liu Xiaobo and house arrest of his wife, both incommunicado, and the house arrest of Chen Guangcheng after his release. Yesterday’s release of the artist Ai Weiwei on bail awaiting for trial was in the same fashion as his arrest: with disregard of the Chinese law. All these took place in the larger context of severe restrictions on freedom of expression and association, repression against religious and ethnic minorities, and significant roll-back on rule of law reform. Since February, several hundreds of people have been harassed or persecuted in one of the harshest crackdowns in recent years when the Chinese government tried to stamp out any sparks for protests in the Tunisia-style “Jasmine Revolution” after online calls first appeared. According to information documented by the group Chinese Human Rights Defenders, the Chinese government has criminally detained a total of 49 individuals, outside the Tibet and Xinjiang regions. As of today, nine of them have been formally arrested, three sent to Re-education through Labor (RTL) camps, 32 have been released but most of them not free: out of which 22 have been released on bail to await trial, while four remain in criminal detention.

INTRODUCTION During late spring and early summer, namely, from mid-April to early June of 1989, a tiny handful of people exploited student unrest to launch a planned, organized and premeditated political turmoil, which later developed into a counterrevolutionary rebel- lion in Beijing, the capital. Their purpose was to overthrow the leadership of the Chinese Communist Party and subvert the so- cialist People's Republic of China.... In order to achieve thorough victory, we should mobilize the people completely, strengthen the people's democratic dictator- ship and spare no effort to ferret out the counterrevolutionary rioters. We should uncover instigators and rebellious conspira- tors, punish the organizers and schemers of the unrest and the counterrevolutionary rebellion ...and focus the crackdown on a handful of principal culprits and diehards who refuse to repent.' In late 1990, the Chinese government brought formal charges against several dozen of the most prominent leaders of the May- June 1989 Tiananmen Square pro-democracy movement. They are among several dozen political detainees who are expected to be tried soon in Beijing for their role in the 1989 pro-democracy movement. They may face heavy prison sentences after unfair trials behind closed doors. The relatives of some of the prisoners were officially notified of the charges and expect them to go on trial soon. One of the detainees' wife, who made an unprecedented public appeal for her husband's release a few months ago, has expressed her helplessness in these terms: "I feel tiny and weak, as insignificant as a droplet of water in the sea. When I call on behalf of my husband, I hear not a sound in response." Amnesty International believes the prisoners are arbitrarily detained for the peaceful exercise of fundamental human rights and that they are unlikely to receive fair and open trials, in accordance with international standards. The organisation has called on the government to make public the identities of all people now facing trial in relation to the protests, full details of the charges against them, and the dates and places of the hearings. It has also urged the government to ensure that the trials are open to the public and conducted in accordance with international standards for fair trial, and to allow international observers to the trials.

YU ZHENBIN Yu Zhenbin, a prisoner of conscience, and civil servant from the Qinghai Provincial Archives Bureau was sentenced to 12 years’ imprisonment in January 1991. Yu Zhenbin was apprehended on 27 June 1989 in Xining, the capital of Qinghai province, and charged with "organizing a counter-revolutionary group". He was accused of setting up the Democratic Opposition Parties’ Alliance in Xining. The authorities alleged at the time that this organization was "counter-revolutionary" and aimed at overthrowing the ruling Chinese Communist Party (CCP). Yu Zhenbin was also accused of having made three public speeches in Xining criticizing CCP policies and state leaders and distributing leaflets calling for a revised Constitution, a new central government and an end to one-party rule. Yu Zhenbin, aged 35, is being held at the Haomen Farm, Detachment No. 3, in Beizhou, Qinghai Province. Very little information is known about Yu Zhenbin, probably partly because relatively little information leaked out of Qinghai during the time of the 1989 pro-democracy protests as compared with other parts of China. He is due for release in June 2001.
