Foreword I have pleasure in submitting the 2016/2017 Annual Report on TransportNI work in the Derry City and Strabane District Council Area.

The objective of this report is to

- provide an update on the work we are undertaking on major schemes which affect your council area,

- highlight works completed in the Derry City and Strabane District Council area during the year 2015-2016 and

- set out our initial proposals for schemes to be undertaken during the year 2016-2017.

I previously advised of the welcome decision to progress sections of the A5 and A6 dualling projects and an update will be given on these projects, both of which will greatly benefit the North West region.

On a general note the capital funding available for Local Transport and Safety Measures schemes is reduced this year and this severely limits the number of schemes that can be delivered across the District Council area. As the Division continues to get many requests for all types and sizes of improvement schemes, priorities still have to be set. Accident reduction, encouraging the use of transport other than the private car, and meeting established traffic and pedestrian needs, attract a high priority rating. I am pleased to report that a good programme of such schemes was delivered last year.

I am also pleased to report that a large programme of maintenance work was delivered in 2015-2016 through successful in-year monitoring bids despite a low level of funding being available at the start of the financial year. While there is a welcome increase in the initial road maintenance capital budget that has been made available, there again is a very limited resource budget available for routine maintenance activities. This will result in TransportNI only being able to provide a limited maintenance service across most functional areas.

Our Request / Enquiry forms can be used to raise local issues with TransportNI, or deal with matters that are not directly related to my report. I would also encourage Councillors to continue to contact the relevant members of my staff in relation to

operational matters and they will do their best to assist.

I hope that you find this report informative. TransportNI values constructive comment on all its activities and I, along with Section Engineer, Robert McCartney, look forward to meeting the Council.

Western Division Western Division is one of four Client Divisions within TransportNI. It spans the local Council areas of Derry City and Strabane, Mid-Ulster and Fermanagh and Omagh

In Western Division we are responsible for approximately 9712km of public road together with 2816 bridges, and 64,147 street lights, 124 controlled crossings (Pelican/Puffin/Toucan & Zebra type), 117 traffic signalised junctions. The A5 Western Transport Corridor (A5WTC) is a Executive led scheme which aims to provide 85 kilometres (55 miles) of dual carriageway from south of Londonderry at New Buildings to the border at Aughnacloy.

On 16 February 2016 the Department published for consultation the Notice of Intention to Make Vesting Orders (draft Vesting Orders) for the following phases of the scheme: • Phase 1A - New Buildings to north of Strabane; • Phase 1B - south of Omagh to Ballygawley; and • Phase 2 - north of Strabane to south of Omagh.

The Department also published the Notice of Intention to Make a Direction Order (draft Direction Order) for the length between New Buildings and Ballygawley and a new Environmental Statement (ES) covering the full extent of the scheme between New Buildings and the border at Aughnacloy. The consultation period extended to 4 April 2016.

New draft Vesting Orders and a Direction Order for the section between Ballygawley and the border at Aughnacloy (Phase 3) are not being taken forward until details of the link with the N2 at the border with the Republic of Ireland have been clearly identified. This section was however being included in the new Environmental Statement which must take account of the full extents of an overall project.

Four public exhibitions on the scheme proposals were held between 1 March 2016 and Friday 4 March 2016 at the Everglades Hotel in Londonderry (1 March), followed by the Silverbirch Hotel, Omagh (Wednesday 2 March), the Fir Trees Hotel, Strabane (Thursday 3 March) and Smyth Memorial Hall, Ballygawley on Friday 4 March 2016. There were a total of 1054 registered attendees at the exhibitions.

The Department received 972 representations on the scheme proposals during this consultation period. During the period the Department also became aware that the Non-Technical Summary (an integral part of the Environmental Statement) did not fully reflect the content of the main body of the Environmental Statement. While the content of the main body of the Environmental Statement was unchanged, to ensure anyone who may only have read the shorter Non-Technical Summary was appropriately informed, it was decided to re-consult on the Environmental Statement which included a revised Non-Technical Summary. This new consultation period commenced on 18 April and concluded on 2 June 2016.

A Public Inquiry has been programmed for autumn 2016. On this occasion the Planning Appeals Commission will administer the Public Inquiry.

The Department must then await the Inspector’s Report and consider its recommendations in detail. The Inspector’s Report is expected around May 2017.

The Budget Statement of 17 December 2015 allocated £229m between 2016/17 and 2020/21 to the A5 scheme, including a contribution from the Irish Government of £75m.

Subject to the successful completion of all the statutory procedures and a satisfactory outcome from the Inspector’s Report, it is hoped that construction can commence in late 2017 on Phase 1A (between New Buildings and north of Strabane) in line with the ‘A Fresh Start’ Agreement.

The Joint Venture Contractor for Phase 1A is BAM/Balfour Beatty & FP Mc Cann.

1.2.1 A6 Randalstown to (Managed by Northern Division)

The Regional Strategic Transport Network Transport Plan (RSTN TP) 2015 endorsed the provision of a continuous dual carriageway from the western end of the M22 at Randalstown to the Castledawson Roundabout.

Progress Report The Department published its decision in January 2013, confirming it was minded in principle to accept the Inspector’s recommendation not to proceed with the alternative junction examined at the February 2012 Inquiry, and confirmed it would submit a new Planning Application for a further alternative junction. A planning application for an alternative junction layout at Bellshill Road was submitted at the end of June 2013. Planning approval for the junction was granted on 3 December 2014. The Notice of Intention to Make a Vesting Order (NIMVO) was published the weeks commencing 9/2/15 and 16/2/15. A number of objections were received and a Public Inquiry was held in Castledawson on 29 September 2015. The Inspectors report and statement by the Department were published on 19 May 2016.

Construction A two phase procurement strategy has been adopted, influenced by current funding constraints, encompassing a design development phase and a construction phase. The first phase, a contract to develop the detailed design and a Target Cost (cost to carry out the works) was awarded on 1 May 2015 to a Graham/Farrans JV. Development work has commenced, including additional site investigation work to inform the design process. It is anticipated that Phase 1 will be complete in late summer 2016. With funding allocations in the Executive’s Budget Statement of December 2015 it is anticipated that Phase 2 (Construction) of the scheme will start in late summer 2016.

1.2.2 A6 Londonderry to (Managed by Northern Division)

The Regional Strategic Transport Network Transport Plan (RSTN TP) 2015 endorsed the provision of a 30 kilometre dual carriageway from Londonderry to Dungiven, including a dual carriageway bypass of Dungiven. The scheme complements the Ilex Regeneration Plan for Londonderry and the wider North West.

Progress Report The A6 Londonderry to Dungiven scheme is well advanced in terms of development. It has been through Public Inquiry (2012) and the Inspector has produced a report embracing various recommendations, some relating to complex issues. Most of these issues have been addressed by officials. Following a thorough examination of the issues raised the then Minister for Regional Development Michelle Mcllveen announced on 24 February 2016 that the scheme would proceed, subject to future funding, and the making of the Direction Order. The December 2015 Budget Statement allocated funding to the scheme for the period 2016 to 2021. Work is currently underway to determine the length of the scheme which can be constructed within the funding allocation.

1.2.3 A2 Buncrana Road

The Regional Strategic Transport Network Transport Plan (RSTN TP) 2015 endorsed improvement of the A2 Buncrana Road, Londonderry from Pennyburn Roundabout to the border with the Republic of Ireland.

Progress Report

The preferred route for the scheme, announced on 10 February 2009, will widen the existing road from Pennyburn Roundabout to Skeoge Link Roundabout to four lanes and will provide a dual carriageway from Skeoge Roundabout to the Border with the Republic of Ireland. Further work is required to complete the preliminary design and assessment of the scheme. When complete, this would provide sufficient information to ensure the land required to facilitate improvement of Buncrana Road is afforded a degree of planning protection. There are no plans at this time to proceed to publication of draft statutory orders

Construction

There was no provision in the 2011-2015 budget for construction of the scheme and spending beyond the current budget period on schemes such as the Buncrana Road improvement will dependent upon the level of funding made available through future budgetary settlements and the relative priorities afforded to schemes competing for the available funds.

EXPLANATION OF MAINTENANCE OPERATIONS

Resurfacing and Strengthening

Roads generally fail by cracking and rutting. They usually do not fail suddenly, but gradually deteriorate due to the impact of traffic, age and weathering. Wear normally appears as either excessive permanent deformation of the whole or part of the carriageway structure, or is associated with the cracking of the bituminous layers. Road pavements are normally designed for an operational life of 20 years. During this period and beyond, there is a need for the highway authority to intervene at times to either treat or replace the top course of bituminous material known as the “wearing course” or to provide additional depth to preserve the structure of the pavement and extend its life. Resurfacing is the application of a layer of this mixed material of 40mm (1.5") minimum thickness. It strengthens the road, seals it against the ingress of water, and improves skidding resistance and riding quality. The thicker the layer, the more strength imparted. Wearing course bitmac has an expected life of 7-12 years (which can be extended by subsequent surface dressing) whereas asphalt has an expected life of 15-20 years but costs more. Resurfacing of existing roads can usually be carried out on top of the existing surface (overlay) but where kerb levels or bridge heights are restricted the existing surface may need to be removed by planing.

Surface Dressing

This process involves spraying a bitumen emulsion binder onto the existing road surface, followed by a layer of stone chippings, which is then rolled. It has three main purposes:- · to improve skidding resistance of the surface · to seal the road surface against ingress of water · to prevent deterioration.

2.2 ROUTINE MAINTENANCE COMPLETED 2015-2016

Grass Cutting. The grass verges on all rural roads were cut once last year with additional cutting carried out at sightlines as required. In total we cut approximately 3920 kms of grass to ensure sightlines are preserved.

Defects

Section Office staff regularly inspect the local network for actionable defects in accordance with the Road Maintenance Guidelines. These guidelines classify the local roads according to traffic volume and establish corresponding deadlines for the repair of any defects identified. The available figures show that during this past year 3565 priority defects were recorded with 70.5% being repaired inside the specified timescales. Drainage

Public Liability Claims

In 2015-2016 we received 193 new claims for compensation. This was made up of: • 85 claims for vehicular damage, • 97 personal injury • 11 for property damage.

In the same period £179k was paid out on 70 claims, some of which covered settlements relating to previous years.

There were 113 claims rejected during this period.

2.3 WINTER SERVICE 2015-2016 The official winter maintenance period commenced on 19th October 2015 and ended on 3rd April 2016. The first application of salt took place on 20th November 2015.

During the winter of 2015/16 there were 68 occasions when salt was applied to the 596.72 km of roads on the gritting schedule using 4764 tonnes of salt, a decrease of 28.6% over the previous year when there were 100 salting actions.

The winter was milder than previous years but with many marginal nights when treatment was still required. The season had also to be extended due to low temperatures being experienced on 8 – 9th April and on 25 – 26th April 2016.

2.4 STREET WORKS

TransportNI monitors the installation, maintenance and removal of utility plant within the public road network. The activities of Statutory Utilities are controlled under the Street Works (Northern Ireland) Order 1995 and a range of Codes of Practice.

There is an electronic web-based system to allow TransportNI and utilities to exchange street works information. This system, NISRANS (the Northern Ireland Street Works Registration and Notification System) is a jointly owned system involving TransportNI and most utility/communication companies which have Statutory rights to place and maintain their apparatus in or on the public road network. TransportNI can also use NISRANS to control utilities street works activities. Approximately 30% of Statutory inspections are carried out at works stage and subsequent stages prior to accepting reinstatements as final. The cost of these inspections is covered by the utilities.

All reasonable efforts to minimise disruption and delay to road users is employed through advertised road closures and co-ordination of these street works.

All openings (except for emergencies) are notified in advance on the electronic Street Works Gazetteer operated by Symology and monitored by TransportNI.

Over the past year 3267 notifications of intention to excavate in the highway were made by the various utilities in the Derry City and Strabane District Council area, of which 1099 were subject to inspection. Of those reinstatements inspected 2.82% were classified as unsatisfactory.

Vehicle restraint systems (VRS) across Western Division have been inspected and remedial work prioritised. Some of these VRS will be replaced in the coming years and particular attention will be paid to barrier on wooden posts with welded angle ends. Sites will be assessed on an individual basis and current design standards will be applied. If additional barrier is needed it will be provided and if the need for barrier can be eliminated that opportunity will be taken.

The total number of lights in the district is presently 29,985. Regular outage repair is carried following in coming reports from the general public via our on line reporting system or the central call centre. Expenditure on street lighting during 2015-2016, including extra funds received during the year, amounted to £1,543,568 for maintenance (including £1,117,897 on energy). Total capital expenditure amounted to £1,010,296 (including £337,000 DSD Funding). Particular mention should be made of the work carried out at Linsfort Drive, Ringford Road, Londonderry, Lisnaragh Road, Dunnamanagh and Fyfin Road, Victoria Bridge where an increase in funding near year end allowed commencement/completion of renewal schemes in these areas.

4.1 Planning Consultations

TransportNI is a statutory consultee to the planning process and in carrying out this role provides specialist advice to the planning authority on roads and transportation related matters associated with proposed development.

Our Development Control Section examines a planning application from a number of different aspects including access to the public road, road safety, transportation, traffic progression and car parking depending on the type of application.

In the past year Development Control Section dealt with 1102 planning consultations in the Derry City & Strabane District Council area. These range from single dwelling applications to major housing & mixed use retailing applications.

4.2 Private Streets

We have been successful in adopting 12 private streets and a total length of 2.791km has been added to the maintained network in the past year. These include:

4.2 Private Streets – Enforcement

Private Streets Section continues to invoke enforcement proceedings against developers who fail in their responsibility to provide bonds before commencement of work on site. This takes the form of a series warning letters followed if necessary by enforcement action.

TransportNI will afford a developer every opportunity to fulfil their responsibilities in completing development infrastructure works to an adoptable standard. Where it becomes evident that a developer is either incapable or unwilling to complete the work, TransportNI will consider initiating legal proceedings. This may result in the need for TransportNI to complete the works and recover the costs.

TransportNI has a finite resource at its disposal and given the variation in annual funding levels, the availability of contracting resource to deliver private street enforcement works cannot be assured. In addition, TransportNI has no control over the interests of other stakeholders, primarily Northern Ireland Water (NIW), which impact on the delivery of the completion of adoption works.

ER107/16 Suspension of Standing Orders.

A Member of the Sinn Fein grouping asked for a suspension of Standing Orders, the Chairperson agreed.

The aforementioned Member advised of the situation facing Adult Learning Disability Services in the Western Trust. She highlighted the recent press coverage and public meeting that was held in the City Hotel the previous night. She herself had attended the meeting and was shocked to hear the experiences of those affected by this underfunding had experienced. She stated that many of her own

Page 69 constituents and their families had faced struggles that were appalling. She described the level of underfunding to the value of £8m for Adult Learning Disability Services as totally shocking, with an additional £4m underfunding for Physical and Sensory Disability services as scandalous. She added that the most vulnerable in our society are once again losing out and are being treated appallingly. She informed Members of the Western Learning Disability Action Group who have launched a campaign and have asked for Councils support. Their 4 main demands are:  Immediate reinstatement of the funding  Retrospective funding allocated to cover what they have lost  An investigation as to how this was allowed to happen, and  Assurances that they are involved in all central decision making regarding funding from this point onwards.

She advised that the Deputy First Minister has stated that he will press the incoming Health Minister to rectify this situation. She added her party’s full support for this campaign and advised that she had submitted a motion for the May Council meeting calling on the Council’s support. She further asked for the committee support today for this campaign. She finished by quoting one of the speakers from the public meeting who stated that “it shouldn’t have to come to this – we have a right”.

The Chairperson in concurring with the previous speaker offered his support for the campaign and stated that it was our duty to protect those who can’t protect themselves.

A Member of the SDLP grouping also offered his party’s support for the campaign and affirmed that it was the duty of society to protect the most vulnerable and thus society cannot allow for this to happen. He stated that this Council would fail if it did not support the campaign. He stated that society is about caring about those that can’t care for themselves.

An Independent Member of Council advised that he was aware that this was an issue facing Omagh and Fermanagh also. He advised that the UUP MLA had offered his support for the campaign and he too wishes to address the issue with the new Health Minister when appointed.

A Member of the DUP grouping also concurred with the remarks of Members in the Chamber. He stated that he too 100% supported this

Page 70 campaign and advised that the MLA for the DUP had also confirmed his support.

A non-committee Independent Member of Council, advised that he had been in attendance at the public meeting the previous night. He outlined the personally testimonies that were made and he could only describe the experience of the most vulnerable in our society as horrendous. He stated that once again those that can’t defend themselves are being made to suffer. He further added that there was cross community and cross political support for this campaign, and one which he backed himself.

The Committee

Recommended that Council supports the Western Learning Disability Action Group campaign.

Election Posters

The Chairperson advised Members that information had been received from an Independent Member of Council to advise that when removing election posters some cable ties had been left on lamp posts and this was causing a Health and Safety concern. He asked that all parties relay this information to their teams and ensure that the posters are taken down correctly.

Outgoing Chair of the Environment and Regeneration Committee

As outgoing Chairperson of the Environment and Regeneration Committee the Chairperson took the opportunity to thank Members for their commitment and consideration during his time as Chairperson. He stated that he had held the role for just over 15 months. This was his first position as Chairperson of a committee and he felt that it had provided him with a great learning curve. He thanked Members for the

Page 71 respect that they had shown him in his role. He also offered his thanks to the Director of Environment and Regeneration, the Heads of Service and their retrospective teams for the hard work and commitment that they have shown over the period. He also took the opportunity to thank the PA to the Director of Environment and Regeneration who assisted him greatly and ensured that everything ran smoothly.

A Member of the Sinn Fein grouping thanked the Chairperson for his work over the past 15 months. He stated that he found the Chairperson to always be fair and fulfilled the role efficiently. He too offered his thanks to the Director and all her staff.

An Independent Member of Council also thanked the Chairperson for how he had conducted himself in the Chamber, he stated that he was a credit to himself and his party.

A Member of the SDLP grouping took the opportunity to thank the Chairperson for a job well done.

A Member of the DUP grouping offered his party’s thanks to the Chairperson for a good job.

A non-committee Independent Member of Council also recorded his thanks to the Chairperson and stated that as a non-committee Member, he had always found him to be accommodating and fair.

An Independent Member of Council, referred to the above item and stated his disappointment at the stance of the Department of Regional Development in relation the above. He said that the current structure was not suitable for young children and should not be accepted by this Council.

A Member of the SDLP grouping concurred with the remarks of the previous speaker and asked that a letter be sent reinstating Councils concerns to the new Minister of DRD when appointed.

ER112/16 Annual Service Plan – Environment and Regeneration Directorate

The Director of Environment and Regeneration presented the above report, which had been previously circulated to Members. The report sought Members approval to adopt a Service Plan for 2016/17 for the Environment and Regeneration Directorate and to consider the achievements from 2015/16.

The Chairperson thanked officers for all their work and welcomed the fact that 28 capital projects with a construction value of more than £23.5m have been completed. He stated that it was unbelievable the work that the Directorate had completed.

In response to a Member of the DUP grouping, the Director of Environment and Regeneration advised Members that when the Planning function transferred to Council there was in excess of 500 legacy applications and that this year more than 1100 applications have been received. She stated that staff have determined a majority of legacy applications with less than 150outstanding alongside processing new ones. She advised that it is important that processes are developed that will allow more timely processing of applications, in particular the use of pre-application discussions with developers. She assured Members that all steps were being taken to process applications as quickly as possible.

In response to a Member of the SDLP grouping, the Director of Environment and Regeneration advised Members that street cleansing for the City and District is at a high standard, however Council continues to take a proactive role in initiating more improvements to provide an even higher standard. She stated that Council are working with the Community to encourage responsible behaviour and look at

Page 73 more proactive ways to engage the community in taking pride in their area. She advised that Council looks at best practice from other Councils as a learning tool.

A Member of the Sinn Fein grouping welcomed the Service Plan and the ambitious plans for the future. He commended Officers for the work that has been done and stated that the achievements speak for themselves. In referring to the volume of dog waste collected he stated that such figures demonstrated that the Councils message of dog owners taking responsibility for their dog waste is being listened to. He sought clarification as to when Council plans to roll out the distribution of the brown food caddy bins to domestic households. The Head of Environment confirmed that the distribution process for the brown caddy bins will be phased out with a completion date of the 31 March 2017 for all domestic households in City and District.

In response to the same Member the Head of Capital Development and Building Control advised that any elements of the Capital Plan that have secured funding will be worked on. The Director of Environment and Regeneration added that the Capital Projects are monitored on a regular basis and that Council will progress any projects that have secured funding, as soon as possible.

An Independent Member of Council congratulated staff on the extensive work completed and the proposed work plan for the future. He queried how many of the back log planning applications were still awaiting completion. He also sought clarification on where the responsibility falls for the LDP Planning Committee. The Director of Environment and Regeneration advised that out of more than 500 back log applications the current total sits at less than 150 applications awaiting determination and it is anticipated that this figure will be halved by the summer. She assured Members that all necessary steps were been taking by staff to progress applications as quickly as possible. She further advised that the LDP Planning Committee sits within the Environment and Regeneration Directorate and thus she is responsible for this committee and the completion of its work plan. She informed Members that the LDP Planning Committee is a separate meeting to the Planning Committee and the progress of this is closely monitored by officers and by the Senior Management team.

In response to the same Member, the Director of Environment and Regeneration agreed that the street cleansing element for rural areas is a key area for Council to work on. She stated that ongoing work is

Page 74 being carried out to encourage residents and visitors to enhance their surrounding areas. She noted the Members comments and acknowledged that this a work area which requires innovative solutions to tackle the problem.

A non-committee Independent Member of Council also highlighted areas in urban areas that have become hotspots for fly tipping. He asked that Council as part of this work plan, look at ways to resolve this issue. The Head of Environment advised that Council continuously review these areas and have established a unit which takes a multi- disciplinary approach looking at fly tipping, grass and street cleansing. He stated that Council is working with all stakeholders to develop a model that can address these problems.

The Committee

Recommended that Council adopts the Service Plan for 2016/17.

ER113/16 Friends of Derry Walls – Funding Request

The Director of Environment and Regeneration presented the above report, a copy of which had previously been circulated to Members. She advised that the report had been also presented to the Business and Culture Committee the previous day. The report advised Members of a request for funding from the Friends of Derry Walls. The report also sought authority to support identified elements of the Friends of Derry Walls 2016/17 Annual Activity Plan.

A Member of the DUP grouping highlighted the work that this volunteer organisation carries out. He stated that this group plays an important part in the Historical assets of this City. He said that all steps should be taken to assist this group in their attempts to secure funding.

A Member of the SLDP grouping stated his disappointment that Council was not in a position to provide the £21,500 funding required. He stated that should this have been presented earlier, then provision could have made for this though the rates but unfortunately that process has already concluded. He too offered his support for the group and the work that they do for the City Walls. He stated that the Walls are an historical asset for the City and the passion that this group has for them is evident. He called for any support that Council can offer to achieve the best outcome should be provided.

Page 75 An Independent Member of Council welcomed the offer of assistance in kind that was being proposed and he highlighted the Stables in Sion Mills project that also could avail of similar assistance from Council.

The Director of Environment & Regeneration advised that Council was unable to provide funding as there currently was no mainstream budget or competitive process available to which the group could apply. She further advised that going forward Council has agreed to move away from funding groups directly but to support strategic outcomes based on our Community Plan. She reiterated that Officers were committed to working with this group and other groups in the area to protect and encourage sustainable use of our heritage assets.

The Committee

Recommended that Council considers the contents of the report and that Officers write to the Friends of Derry Walls advising that Council supports their objectives and the Officers will work with them in order to assist in the delivery of their delivery plan. Council cannot directly provide the £21.5k of funding requested. Officers work with the Friends of Derry Walls to achieve a successful outcome of the grant application submitted to the Irish Walled Town Network towards the delivery of the Derry Walls Day 2016.

ER114/16 Friends of the Walls – Project Partnership Proposal

The Regeneration Manager presented the above report, a copy of which had previously been circulated to Members. The report sought Members approval to assist in the development of project proposals put forward by the Friends of the Derry Walls in respect of the proposed restoration of the plinth located at Royal Bastion on the City Walls.

A Member of the DUP grouping welcomed the report and the work of the Friends of Derry Walls, he stated his support for the proposal and that any assistance Council can provided should be given.

Recommended that Council approves the development of partnership arrangements with the Friends of Derry Walls and Siege Hero’s Museum in respect of the plinth restoration project in terms of providing in-kind project management services.

ER115/16 District War Memorials – Proposed Restoration Projects

The Regeneration Manager presented the above report, a copy of which had previously been circulated to Members. The report provided Members with an update on progress in respect of the scoping work undertaken by Officers in relation to the development of proposed restoration projects of war memorials at The Diamond, Derry; Castlederg and Strabane. The report also sought approval to commit Council funding towards each of these projects.

An Independent Member of Council sought clarification in relation to the monument in Castlederg. He advised of the site meeting he had attended at the start of the year with a Council Official were the required work was discussed. He further added that at the last meeting of this committee it was indicated that this project was to begin in the near future. He stated that he was frustrated at the conflicting information being provided today and could not understand what the delay was in the project and why it was taking so long to get started.

The Director of Environment & Regeneration apologised if it appeared that there was conflicting information in relation to the Castlederg Memorial. She assured Members that this work had begun and would progress and be completed as a matter of urgency.

Page 77 A Member of the Sinn Fein grouping stated that he found the costs involved in the restoration work for the monument in The Diamond to be staggering and asked that the matter be referred to the Council’s Capital group for prioritisation.

A non-committee Independent Member of Council raised his concerns at the rate payers being expected to foot the bill for the restoration of this monument. He questioned whether the siting of this monument in the City centre was appropriate. He stated that this monument stood for the past and that Council should be looking to using this money for something positive for the future. He said that Councillor’s owed it to the rate payer to use any money in a sensible way.

A Member of the DUP grouping in response to the previous speaker stressed that this work needed to be completed as the monument was in need of immediate restoration works. He stated that the monument was a dedication to all the men and women who gave themselves for the war and the 100 anniversary should be an occasion to remember those that fought for us.

The Committee

Recommended that Council commits to providing direct assistance toward the Diamond and Strabane war memorials.

ER116/16 Application Processes Under Building Regulations (NI)

ER117/16 Brikklin Waste Contract Update

The Head of Environment presented the above report, a copy of which had previously been circulated to Members. The report updated Members on matters relating to contractual/financial position following the placing of Brickklin Waste Limited into administration on the 30 July 2015.

Page 78 A non-committee Independent Member of Council raised his concern at the lack of information being provided to Councillors. He alleged that Officers had tried to sweep this report under the carpet. He stated that Councillors were being provided with minimal information and that he had requested details on how the decision was made to withhold payment from the company by email on 28th April and had not received a response. He highlighted the direct loss of jobs as a result of Council withholding £750,000.00 without justification and the lack of Council support for those affected. He stressed that he had not been consulted or involved in any decision making that resulted in the company going out of business.

He stated that an officer who was now present in the Chamber had used his influence at a meeting to persuade other Councils to withhold money from the Company and that the officer had also overridden the advice of Councils solicitor at this meeting.

He further alleged that Officers had withheld more payment than necessary from Brickkiln which had directly led to closure of the business. He also alleged that no member of Council had supported the 50 workers who had lost their jobs.

He added that this was similar to the shambolic process relating to stewarding and security and wanted to know what checks had been carried out on the waste processes within Council

The Chairperson in response to the previous speaker, advised that the report presented to Members today had been provided as a result of the request for additional information and that all items for information in the Committee are taken for information unless a Member had queries so there was no attempt by Officers to sweep the report under the carpet. The Head of Environment has presented the details of this report and taken Members through the content. He also stated that he personally went on Radio Foyle to offer his support in the aftermath of the job losses.

The Director of Environment & Regeneration advised that waste services have undergone numerous audits by the Assurance department. She suggested that this issue is raised with the Chief Executive and the Lead Assurance Officer to consider a response to the issues highlighted by the Independent member.

Page 79 Another non-committee Independent Member of Council requested that his matter is referred to the Assurance, Audit and Risk Committee for consideration.

The Head of Environment assured Members that all processes have been completed in conjunction with proper procurement procedures and in partnership with the regulator NIEA, the audit team, the Council Solicitor and the administrators. He also stated that this Council has not withheld payments, payments have been suspended awaiting further information and to date that is still the situation, Council awaits the information, and if and when provided payment can be progressed.

ER118/16 DOE Consultation on Proposals for a Historic Environment Fund

ER119/16 Transport NI Lands Grass Cutting Information and Update

The Head of Environment presented the above report, a copy of which had previously been circulated to Members. The report informed Members of definitions in terms of road categorizations with regard to arterial and other road classifications.

An Independent Member of Council thanked officers for the report and stated that it was clear now the criteria and rationale which was being used. He highlighted an area near the hamlet of Garvetagh and the surrounding areas that needed attended to.

In response to a Member of the SDLP grouping, the Grounds Maintenance and Cemeteries Officer advised that Council have identified a few issues around health & safety, particularly on the dual carriage ways. He advised that they are working with Transport NI to put measures in place to allow the workers to carry out the cutting in a safe manner.

The Head of Environment advised that it was the responsibility of Council to carry out grass cutting on the main approach roads, however it is also a responsibility of Council to do so in a safe manner. He stated that the issue of speed at some roundabouts was a concern for Council. He advised that Council will put in place a health and safety plan and this will allow for the commencement of this work. It is hoped that the area around the crescent Link will be cut around the 1st June 2016.

Page 80 A Member of the Sinn Fein grouping took the opportunity to thank the Grounds Maintenance and Cemeteries Officer and his team. He stated that the flower displays around the city and district are lovely to see and a credit to this Council. He raised concerns with the roads in the City and stated that it is a disgrace the way in which Transport NI have let the roads get in to such a dilapidated state. He said in particular the Strand Road area needed to be addressed.

Friends of the Derry Walls - Author: Regeneration Manager Project Partnership Proposal - Cannon Restoration Project

1 Purpose of Report/Recommendations 1.1 To seek Members approval to assist in the development of a project proposal put forward by the Friends of the Derry Walls (FODW) in respect of the conservation of the cannons on the City Walls.

2 Background 2.1 Members will recall items presented at E&R Committee in May 2016 in relation to developing a partnership approach with the Friends of the Derry Walls on the Plinth Restoration Project. Officers are in receipt of a separate request from FODW seeking Council assistance as a partner in the development of another conservation- led project relating to the restoration of the cannons located on the City Walls. The FODW identified this projects as part of their 2016/17 annual activity plan. The conservation of the cannon guns is identified as a key action within the City Walls Management Group's draft Strategic Plan. The City Walls Management Group is led by the Department for Communities Historic Environment Division.

3 Key Issues 3.1 In terms of the cannons, FODW are looking to develop a partnership approach with Council (as owners of the Cannons) to identify external funding sources to undertake an artefact condition survey and any subsequent restoration programme that is identified. FODW are seeking an in principal agreement from Council to submit funding applications, for the conservation, interpretation and maintenance of the City's historic cannons. FODW also indicate that this would allow for the development of a volunteer and education programme also. 3.2 FODW have been liaising with the Heritage Lottery Fund in respect of this project and submitted an application in April 2016 for funding support to the value of £100k for the various components. FODW indicate that formal support from Council as owner of the cannons is an important part of the determination of their funding application. No decision has been made in respect of the funding application made by FODW. Page 89 4 Financial, Equality, Legal, HR and Other Implications 4.1 In terms of the cannons, Officers would acknowledge the need for a current artefact condition survey to be undertaken of the collection on the Walls and as well as the carriages. The survey would then inform the potential works in terms of scale, scope and cost. The cannons are owned by Council and accordingly, Officers are supportive of any proposals that seek to promote their conservation, condition and presentation. 4.2 There are no direct financial implications to Council with the funding being sourced directly by FODW to external grant sources. Should Members be in agreement, then it would be beneficial to form a partnership arrangement with FODW in identifying external sources of grant aid to undertake a survey and any associated works. Such a partnership approach would be formalised by means of a time-bound Memorandum of Understanding between Council and FODW any other relevant partners setting out the definitions, terms and conditions of the project.

5 Recommendations 5.1 Based on the above, Members authority is sought to develop a formal partnership agreement via a time-bound Memorandum of Understanding with FODW authorising them to progress a cannon restoration project as outlined in their funding proposal to HLF (dated April 2016).

1 Purpose of Report/Recommendations 1.1 To advise Members of correspondence received from MLA Ross Hussey with regard to access to Greenlaw Road, Ballymagorry.

2 Background 2.1 Correspondence has been received from MLA Hussey enclosing a copy petition sent to Transport NI (Appendix 1) with regard to maintaining access to Greenlaw Road at Ballymagorry in consideration of A5 development works. 2.2 Residents of the Ballymagorry area access the former Canal site using both the Greenlaw and Park Roads. The construction of the A5 is scheduled to transect these roads limiting access to the Canal. 2.3 Residents are keen that the new arrangements allow for vehicle access and have petitioned TNI in this regard.

3 Key Issues 3.1 MLA Hussey has forwarded a copy of the petition to Council seeking Members endorsement with regard to the resident’s stance on this issue.

Extension of Lease at Killen Head of Environment Recycling Centre Author:

1 Purpose of Report/Recommendations 1.1 To seek Members approval with regard to the extension of a lease in respect of Killeen Recycling Centre, Castlederg.

2 Background 2.1 Members will be aware that Council operates a number of recycling centres across the district enabling the public to dispose of a wide range of recyclable materials including for example large bulky domestic items including white goods and furniture. 2.2 At present the facility serving the wider Castlederg area is located at Killeen and is leased from a Mr Galbraith. 2.3 Members will recall previous items detailing arrangements at this location and that the facility is limited in capacity and not consistent with current best practice models and that Council is currently investigating alternatives locations within the Castelderg area with a view to developing a new site.

3 Key Issues 3.1 The current lease on the site has expired and officers consider it prudent that an extension to the current lease be put in place. 3.2 Officers consider that a rolling year to year lease be put in place with a 6 month termination clause requirement. 3.3 Mr Galbraith has been consulted and is amenable to this. 3.4 Council’s legal services section will draft the lease in consultation with Mr Galbraith’s legal advisor(s).

4 Financial, Equality, Legal, HR and Other Implications 4.1 Provision has been made within existing budgets for this.

5 Recommendations 5.1 That Council enter a rolling year to year lease with Mr Galbraith for the lease of Killeen Recycling Centre.

1 Purpose of Report/Recommendations 1.1 To advise Members of applications processed under Building Regulations (NI) between 1 April 2016 and 30 April 2016 Appendices 1 and 2. 1.2 Applications:

During the period, 1 April 2016 and 30 April 2016 183 applications have been received for assessment involving 202 separate addresses.

2 Key Issues 2.1 Certifications:

83 Building Notice Applications were approved. 69 Notice applications were approved for the Affordable Warmth Scheme. 66 Full Plan applications were issued with Approval Certificate, covering 69 sites. 16 Regularisation applications were issued with Regularisation Certificates.

2.2 Inspections:

656 Inspections were carried out in this period including 161 commencement inspections and 228 completion inspections, 208 of which were deemed satisfactorily complete.

2.3 Property Certs:

159 Property Certificates were received in the report period, 91.2% of which were processed within 10 working days and the overall average response rate was 5.8 working days.

2.4 Income Generated

The total income generated by the Building Control Section for the month of April 2016 was £45,536.00 Page 123 2.5 In the month of April 2016 the Building Control Section received applications with a construction value of £ 17,875085.00

1 Purpose of Report/Recommendations 1.1 To provide Members with an update on the new recycling facility at Pennyburn.

2 Background 2.1 As Members are aware, a new state of the art recycling facility has been developed at Pennyburn with a 1.5 million pound investment by Council including £250,000 from Rethink Waste. 2.2 The new site at Pennyburn is part of a long term plan by Council to enhance and improve recycling facilities across the district thereby contributing to Council achieving full compliance with all relevant waste targets.

3 Key Issues 3.1 The site reopened to the public on the 23rd May 2016 after a period of closure to allow for the development works to take place. The site will be officially opened by the Mayor on the 31st May 2016 at 3pm. 3.2 In bringing forward the development officers were also keen to consider wider service improvements and in particular improving opening hours for users. In consideration of this an amended shift pattern was discussed and agreed with staff and the relevant trade unions. 3.3 As and from the date of opening the site will operate from 8am to 8pm Monday to Friday, 8am to 5pm on a Saturday and 1pm to 5pm on a Sunday all year round. 3.4 The site has been designed to increase the recycling capacity fourfold therefore four site attendants will be required to supervise the site at all times. It is proposed to appoint a team leader for each shift. Due to the size of the facility, each attendant has been issued with a walkie talkie to allow them to communicate freely with one another and be on hand to assist members of the public. 3.5 In addition the site has been designed to be user friendly and to allow the members of the public to easily identify where they can recycle their waste. The site attendants are also to advise and assist the public where necessary. The site has also been set out to maximise recycling with mixed waste disposal being the final option before exiting the site. Page 177 3.6 The site also includes an area for Councils mechanical sweepers to discharge bringing both a improvement in travel time in terms of existing discharge facilities and reducing costs through additional travel, fuel etc..

4 Financial, Equality, Legal, HR and Other Implications 4.1 The scheme has been funded from Councils Capital development programme and has been completed within agreed timeframes. 4.2 The team leaders as proposed at 3.4 above will be recruited from within the existing Pennyburn cohort of employees and whilst there will be a commensurate uplift in salary this will be funded from within existing departmental budgets and efficiencies.

1 Purpose of Report/Recommendations 1.1 The purpose of the report is to inform the members on the outcome of the recent Maritime Museum Public Consultation Event undertaken as part of the planning process for the project.

2 Background

2.1 Council, in partnership with the Heritage Lottery Fund and other potential funders intend to create a new Maritime Museum and Archive Centre at the former military base at Ebrington.

3 Key Issues 3.1 The Public Consultation Event took place at St Columb’s Park House on Wednesday 11th May 2016 from 9:00am to 8:00pm. Adverts were placed in the Derry Journal and Londonderry Sentinel and letters were dropped to residents along Browning Drive informing them of the event. The HLF sponsored Council Project Coordinator also publicised the event on Radio Foyle. 3.2 Discussions with attendees and comments provided at the public consultation event were very positive, the architectural plans did not raise any issues and all attendees were in support of the development of the Maritime Museum and Archive at the Ebrington site, including all those from Browning Drive who attended the event. 3.3 Officers have also offered the chairperson of the Browning Drive Residents Group to host a separate consultation should their members wish to avail of this. To date this offer has not been taken up by the group. 3.4 Public Consultation Report including actual comments received is attached to this report at Appendix 1. 3.5 It is envisaged that the reserved matters application for this project will be submitted in June 2016, subject to timely and supportive comments being received back from the various statutory consultees to the current live PAD process.

Page 181 INTRODUCTION

Derry City and Strabane District Council are proposing to construct a Maritime Museum and Archive facility to be located at the Ebrington site in Derry, based in buildings 45/46 and 49.

The proposed project is made up of three broad elements: museum galleries tracing the maritime history of Derry/Londonderry and the North West and giving an introduction to the history of Ebrington; a new city archive facility with genealogy service; and multi- purpose educational facilities.

The nearest residential area is private housing on Browning Drive and the Browning Drive Residents Association have been contacted regarding the project.

The planning application will be submitted as Reserved Matters to the wider Outline Planning Permission for the redevelopment of the Ebrington Site.

The following consultation events have taken place prior to the planning submission:

 November 2014 - Stakeholder consultation for the Maritime Museum and Archive Centre Interpretation plan – 13 consultees

 June 2014 - Legenderry Maritime Festival, Community Engagement and Visitor Survey. Overall the survey results indicated a high level of local interest and a strong desire to see the new maritime museum and archive developed at Ebrington. Informally many people were especially keen to see the site at Ebrington developed and saw the new museum and archive as integral to that.

 December 2014 to September 2015 - Maritime Museum Heritage Road Show – community engagement initiative was undertaken by DCSDC in the form of a Maritime Heritage Road Show. The road show was hugely successful and as a result the Museum Service has reached out to new and existing members of the community, raised awareness of the plans for the Maritime Museum project and numerous new contacts and relationships have been created which will be explored further in the future. Over thirty groups consulted over nine month period.

 Throughout 2015 - Audience Development Report ad Action Plan – this included consultation with a wide variety of user and interest groups.

 May 2015 - U-Boat Anniversary Event, May 2015. The success of this event and level of public enthusiasm received encouraged the council to develop this event in greater partnership with local agencies such as Visit Derry and City Centre Initiative as well as Tourism NI and Tourism Ireland and in due course link to further development with the new Maritime Museum and Archive.

The public consultation event for Maritime Museum and Archive Proposals was advertised in the Derry Journal and Londonderry Sentinel two weeks prior to the event.

Notice of the public consultation was hand delivered to 23 properties on Browning Drive. A copy of the newspaper notice and letter to residents is appended to this report. The HLF sponsored Council Project Coordinator also publicised the event on Radio Foyle.

The proposals were displayed in the Main Hall in St Columb’s Park House, Waterside on Wednesday 11th May from 9am to 8pm.

The display was manned by Council Capital Development staff and the HLF sponsored Council Project Coordinator and feedback sheets were available for attendees to make comments.

Approximately 20 people attended the event and the feedback was very positive and in support of the development of the new Maritime Museum and Archive at Ebrington.

Royal naval The maritime museum project will enhance Ebrington and Association as our particular interest is world war two and how the city Waterside coped with the influx of ships and servicemen and women, we hope the gallery’s will reflect the full story of sacrifice as well as social interaction

Browning Drive Great to see the project finally getting the red light, the story of the hymn “Amazing Grace” should be included as it’s a good maritime story and would interest the casual visitor. The city and the area have a great maritime story to tell, hope there is enough space for it all.

Royal Naval I agree with the Ebrington Development a Maritime Association Museum very much needed. To highlight the city and port of Londonderry, before, during and after the commitment during the war

Royal Naval Ebrington needs a “draw” to encourage the general public, Association visitors and tourists to come and view. This would lead to them using other facilities at Ebrington. All Government departments need to get on board to ensure the future of Ebrington as a vibrant and informative site that will be utilized by public and the schools.

The museum is an essential tool in educating our younger

Page 185 people of their heritage, growth of the city and its massive input and importance during WWII and after to show how other nations were involved.

By Email Great to hear something that I have always thought was needed in this city start to get some momentum.

I hope that all aspects of the rich maritime history are covered in the proposals, from early settlement days to the siege of Derry to the mass exodus of people during the famine to rich 20th century history, but especially I think a section should be dedicated to the hard working dockers of this city.
