WHITE JADE RING AND QUEEN MOTHER OF THE WEST As for the foundation and succession myths of early Chinese dynasties, Allan holds that “Ancient Chinese literature contains few myths in the traditional sense of stories of the supernatural but much history” (Allan, 1981: ix) and “history, as it appears in the major texts from the classical period of early China (fifth-first centuries B.C.),has come to function like myth” (Allan, 1981: 10). While “the problem of myth for Western philosophers is a problem of interpreting the meaning of myths and the phenomenon of myth-making” as Allan remarks, “the problem of myth for the sinologist is one of finding any myths to interpret and of explaining why there are so few.” (Allen, 1991: 19) To decode why white jade enjoys a prominent position in the Chinese culture, the underlying conceptual structure and unique culture genes should be investigated.

My first language was Yiddish, and my second was French, learned as I played with the French Canadian kids on the block. My third and fourth languages were English and Hebrew, studied simultaneously in the Jewish Peretz Day School, in which half the day’s work was in Yiddish and Hebrew and the other half in English and French. Non-Jews were referred to as gentiles, and I did not know any until high school. I never saw a black person until my first trip to New York City when I was 14. My milieu was entirely Jewish, hailing from deeply Jewish parents – father Ezra Yelin, atheist Talmudic scholar; his father, a rabbi and “Rosh Yeshiva” (head of the Yeshiva) in Bialystock, Poland. My paternal great-grandfather, Rabbi Aryeh Layb Yelin, wrote one of the commentaries on the Talmud, “Yafeh Aynayim” in the Bavli Talmud. My mother, renowned Canadian writer/poet, chronicled Jewish life in Montreal, founded the first Jewish kindergarten at the Jewish Peretz School, and later was a founding member of the first Reconstructionist synagogue, Dorshei Emet, in Montreal. I went to Jewish schools, and spent all my summers from 4 to 17 at Jewish summer camps conducted in Hebrew.

Prof. Riccardo Fracasso Laureando Valentina Moriggia Matricola 851693 Anno Accademico 2015 / 2016 前言 河西走廊是中国内地通往西域的要道,甘肃省西北部狭长堆积平原,位于祁连山以东,合黎 山以西,乌鞘岭以北,甘肃新疆边界以南,长约一千公里,宽数公里至近两百公里,为南北 走向的长条堆积平原,自古以来就是富足之地,兵家极其重视的地方,因位于兰州黄河以西, 为两山夹峙,故名。又称雍凉之地,古凉州雍州的属地 在河西走廊横亘着一座比较长的山脉—祁连山脉,在祁连山脉南麓是河湟谷地北麓是 河西走廊。河西走廊地区的低海拔地带在地理上属于绿洲, 在历史上就曾经存在着相对发 达的农业生产。在海拔比较高的祁连山一带,因为不适宜农业生产具有相对发达的畜牧业, 形成了祁连山游牧带。河西走廊的地理环境是影响文化类型的一个重要因素,走廊两边的山 地形成了山区草原牧场,在山下的戈壁地带又是戈壁牧场,而在戈壁中的绿洲上则出现了进 行水利灌溉的农业区。这样,河西走廊地区的文化边界与族群关系具有一种“过渡地带”的 性质及在这里存在着游牧文化和农耕文化分界线但是很难说是有着清晰的界限,因为游牧和 农耕的族群之间关系呈现出一定的周期性。 河西走廊地处举世闻名的丝绸之路咽喉要道,自古以来就是东西方文化的联结纽带和 汇聚区。作为一条地理走廊,河西走廊是内亚地区的一个通道,在这条走廊上,几千年来东 西方人员交通往来,留下了很丰厚的文化积淀,其中的文学遗产形成了一座庞大的文学宝库。 这里有中原及内地士人往来河西创作的作品,也有河西本土作家作品。河西走廊文学包括多 种多样的文学体制:上古昆仑神话、汉魏河西文学到明清河西文学、唐代边疆诗、五凉文学 及敦煌文学中的河西文学、河西俗文学、河西少数民族文学、河西走廊的西游记文化等。河 西文学中有诗词赋散文等雅文学,也有变文宝卷贤孝等俗文学。这些体制都在重绘中国文学 路线图方面具有重要地位,应该给予重新认识和评价。 诞生于这一地理空间中的河西文学,就是这两种文化的结晶,不但蕴藏着丰富的地理 文化特征,而且也已经形成了自己相对完备的言说方式、叙述样态、抒情表征和风格特点, 有了自己的作家群落和读者群体。在这里人员构成十分复杂,有世代居住在这里的原著居民, 有当年流徙到这里的贬官罪臣以及他们的后代,有流落到这里的知青、右派、支边的人们以 及他们的后代,所以,不同历史、文化背景的人们相聚在这片自然条件相对较差、资源匮乏、 环境恶劣的土地上,代代繁衍生息,演绎了无数生离死别、爱恨情仇、感天佩地、平庸凡俗 的人生故事,形成了具有独特内涵的民生文化。另外,河西走廊还是各种宗教文化流徙翻转 的集散地,不同时期、不同教义的宗教派别在这里相互激荡、交融,形成了形态、内涵各不 相同的宗教文化。 1 任何国家与民族的文学,甚至任何作家与作品,都存在一个地理基础与空间前提的问 题,因为任何作家与作品都不可能在真空中产生出来,任何文学类型也不可能在真空中发展 起来,任何作家与作品及其文学类型绝对不可能离开特定的时间和空间而存在。因此,任何

The myths of the Yellow Emperor’s eating the white jade cream and the Queen Mother of the West living in Kunlun Jade Mountain, as recorded in Classic of Mountains and Seas, are mythological imaginations of the historical reality that the jades were spread from the West to the East and recreated by people living in the early state of the Central Plains. All such motifs, no matter the white jade cream that produced black jades, the Yellow Emperor’s planting the jade flowers, the Kunlun Jade Mountains (the Mountain of Jades) where the Queen Mother of the West lives or the Jade Lake, clearly show Chinese indigenous worship for the white jades. Scholars like Su Xuelin and Ling Chunsheng think that Queen Mother of the West is the goddess of the moon that originated from the old West Asian civilization. However, such idea is full of contradictions and flaws after the discovery of Chinese unique worship for white jades and the holy mountain of Kunlun.

Ho † Abstract: Most scholarship on Chinese legal philosophy has neglected the study of Confucian jurisprudence in practice. As a result of this incomplete portrayal, scholars predominantly view the premodern Chinese Confucian legal tradition as lacking a rule of law system, which has led to blaming Confucianism for much of China’s modern and historical rule of law problems. This article seeks to complicate this view by examining Confucian jurisprudence in practice: specifically, the development of pre-Tang dynasty panwen (written legal judgments). Through analysis of specific panwen from various Chinese primary sources—many of which have never been translated into English—this article will show that even in Chinese antiquity the legal system was not solely marked by codification or the lack of the rule of law, but was far more complex and diverse than most scholars have portrayed.
